HomeMy WebLinkAboutResolution No. 06-6957 - Policy for Ethics Training: Council, Board, Commissions & Commitee MembersRESOLUTION NO. 06-6957 ( A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING A POLICY FOR ETHICS TRAINING FOR THE CITY COUNCIL AND FOR CERTAIN MEMBERS OF CITY COUNCIL APPOINTED BOARDS. COMMISSIONS, COMMiTrEES AND DESIGNATED CITY STAFF. WHEREAS, Assembly Bill 1234 imposes new requirements for ethics training for legislative bodies and various appointed officials; and WHEREAS, the policy established herein will satisfy the requirements of Government Code sections 53235, et. seq., in the event such requirements could be constitutionally applied to Charter Cities. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: The City Council hereby finds and determines that the above recitals are true and correct and have served as the basis, in part, for the findings and actions of the City set forth below. SECTION 2: The City Council; individuals appointed to City Boards, Commissions and Committees that are required by the Political Reform Act, the Fair Political Practices Commission and the City’s Conflict of Interest Code to file Form 700; and Executive Management personnel and such other management personnel as designated by the City Manager, shall receive at least two hours of ethics training in general ethics principles and ethics laws relevant to his or her public service every two years. Such individuals whom serve on multiple legislative bodies, committees or commissions need only receive two hours of ethics training every two years to satisfy this requirement for all applicable public service positions. The City, through the City Clerk, will be required to keep ethics training records for at least five years to document and prove that these continuing education requirements have been satisfied. These documents are public records subject to disclosure. The City may develop its own ethics training course or use an outside provider. If the City develops its own ethics training, the City must consult with the Fair Political Practices Commission and the State Attorney General. Officials that begin their term or employment on or after January 1, 2007, will be required to fulfill two hours of ethics training within one year of taking office and, thereafter, two hours every two years ( SECTION 3: The City Clerk shall certify to the adoption of this Resolution.
