REGULAR MEETING
APRIL 14, 2009
The City Council of the City of Downey held a Regular Meeting at 7:34 p.m., April 14, 2009,
in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California,

COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND
CONFERENCE/MEETING REPORTS:
Council Member Gafin announced that Friday at 6:30 p.m. Soroptimist is hosting their annual
Casino Night at the Rio Hondo Event Center and Wednesday, April 22-d, Gangs Out Of Downey
luncheon will be held there as well.
Mayor Pro Tem Bayer recognized her Commissioners, Faye Campbell and Lee Ann Sears in
the audience; and announced the next Keep Downey Beautiful clean-up will be on Saturday April
18th, meeting at the Starbucks on the corner of Lakewood Boulevard and Telegraph Road at 9 a.m.
Council Member Marquez noted that he and the Mayor visited General Atomics to observe a
test track of the Maglev system that the Orangeline Authority is hoping to develop.
Mayor Guerra explained that due to the efforts of the City of Downey and specifically Deputy
City Manager Alvarez, an appeal was won for the Water Basin to pay legal fees in the amount of
$640,000; he commended City Clerk Midstokke for disputing Los Angeles County’s bill for the
November 2008 Election and saving the City $40,000; noted that there are now 35 Neighborhood

Watch groups; announced he attended a Neighborhood Watch meeting with Mayor Pro Tem Bayer
last week, attended the Downey Unified School District's Character Counts Commission meeting
with the local youth sports leagues and attended the play “Annie” at St. Mathias High School; he
requested staff to draft an Ordinance imposing additional residential restrictions on convicted sex
offenders; and noted that the U.S. Census Bureau has started canvassing the City to collect
addresses for next April’s census count, and urged that everyone needs to be counted.
PRESENTATIONS:
Mayor Guerra presented Certificates of Recognition to Rayana Gallindo and Celeste
Hernandez for their participation in the Opening Day ceremony of Downey Girls Ponytail Athletic
Association .
Mayor Guerra presented City Pins to Kathia Morales, Miss Downey; Sandy Fernandez, Miss
Teen Downey and their Courts.
Mayor Guerra presented a Proclamation declaring April 19th - 25th as National Library Week
to the Lurssen family.
Mayor Guerra presented a Proclamation declaring the month of April as DMV/Donate Life
California Month.
Mayor Guerra presented a Certificate of Recognition to the Frase family for their volunteer
assistance with the Keep Downey Beautiful cleanup program.
PUBLIC HEARINGS: None.
NON-AGENDA PUBLIC COMMENT:
Paul Winslow, resident of Downey, spoke in protest of the cancellation of the Armchair Travel
Series at the Downey Civic Theatre. City Manager Caton explained that the longtime Theatre
Manager who put on that series retired and at this time there is no one to replace him.
CONSENT ITEMS REMOVED:
5.CASH CONTRACT NO. 650 – DISCOVERY SPORTS COMPLEX – ACCEPT THE
IMPROVEMENTS AND MAINTENANCE RESPONSIBILITY AND APPROPRIATE $832,183
FROM VARIOUS FUNDS: Administration. This item was removed at the request of Mayor
Guerra and is listed under Other Business below.
CONSENT CALENDAR:
It was moved by Mayor Pro Tem Bayer, seconded by Council Member Gafin, and
unanimously carried to approve the remainder of the Consent Calendar items as recommended:
1.APPROVED CITY COUNCIL MINUTES: Adjourned Meeting March 21, 2009; Regular and
Adjourned Meetings March 24, 2009; Adjourned Meeting March 31, 2009: City Clerk.
2.APPROVED WARRANTS ISSUED: Warrant Nos. 239531 – 240075; Wire Nos. 437 – 442
and 30001880-30001888; in the total amount of $3,739,231.95: Finance.

3.AUTHORIZED STAFF TO SUBMIT, VIA THE CITY OF LOS ANGELES. A GRANT
APPLICATION FOR THE EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT:

4.AUTHORIZED STAFF TO SUBMIT A GRANT APPLICATION FOR THE COPS HIRING
RECOVERY PROGRAM: Police.
6.BLANDWOOD ROAD AND TRUE AVENUE SANITARY SEWER LIFT STATIONS
REPLACEMENT PROJECT: APPROVED AGREEMENT WITH STEVEN ANDREWS
ENGINEERING FOR PREPARATION OF PLANS. SPECIFICATIONS AND ENGINEER’S
ESTIMATE AND APPROPRIATED $88,975 FROM THE SEWER FUND: Public Works.
7.ACCEPTED INDEPENDENT CITIES RISK MANAGEMENT AUTHORITY (ICRMA) GRANT
FUNDS IN THE AMOUNT OF $6,404 FOR PURCHASE AND INSTALLATION OF BACK-
UP CAMERAS FOR FOUR FIRE DEPARTMENT APPARATUS: Fire.
8.ADOPTED RESOLUTION NO. 09-7121, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY AMENDING RESOLUTION NO. 6709, ACCEPTING A FEE AND
WAIVING SIX (6) REQUIRED PARKING SPACES FOR A NEW RESTAURANT AT 11045
DOWNEY AVENUE IN THE DOWNTOWN PARKING ASSESSMENT DISTRICT;

9.ADOPTED RESOLUTION NO. 09-7122. A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING THE SUBMITrAL OF TRANSPORTATION
IMPROVEMENT PROJECT APPLICATIONS FOR THE 2009 LOS ANGELES COUNTY
METROPOLITAN TRANSPORTATION AUTHORITY CALL FOR PROJECTS; AND
AUTHORIZE THE CITY MANAGER TO EXECUTE ALL AGREEMENTS AS NECESSARY
TO RECEIVE AND EXPEND ANY AWARDED GRANT FUNDS: Public Works.
10.ADOPTED RESOLUTION NO. 09-7123, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING THE SUBM11-rAL OF THE “WOODRUFF AVENUE AT
VIA AMORITA PEDESTRIAN TRAFFIC SIGNAL” APPLICATION FOR SAFE ROUTES TO
SCHOOL FUNDING (8TH CYCLE): Public Works.
11.ADOPTED RESOLUTION NO. 09-7124, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY ESTABLISHING A NO STOPPING ANYTIME PROHIBITION ON THE
SOUTH SIDE OF SOMERSET RANCH ROAD SOUTH, WEST OF LAURELDALE
AVENUE; Public Works.
12.ADOPTED RESOLUTION NO. 09-7125. A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING THE APPOINTMENT OF OCTAVIO SILVA TO THE
WATER BOARD FOR COUNCIL DISTRICT THREE: Administration.
13.ADOPTED RESOLUTION NO. 09-7126, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE
RECORDS OF THE FIRE DEPARTMENT: Fire.
14.INTRODUCED AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING A RESTRICTIVE USE AGREEMENT WITH FRESH & EASY
NEIGHBORHOOD MARKET, INC. FOR THE CITY-OWNED PARKING LOT AT 8356
FIRESTONE BOULEVARD: Community Development.
15.INTRODUCED AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 3130,1 OF THE DOWNEY MUNICIPAL CODE RELATING TO THE
DESIGNATION OF ONE-WAY STREETS: Public Works.

16.INTRODUCED AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 3186 OF THE DOWNEY MUNICIPAL CODE RELATING TO THE
SPEED LIMITS FOR ROSECRANS AVENUE: Public Works.
ADMINISTRATIVE REPORTS: None.

CONSENT ITEMS REMOVED:
5.CASH CONTRACT NO. 650 – DISCOVERY SPORTS COMPLEX – ACCEPTED THE
IMPROVEMENTS AND MAINTENANCE RESPONSIBILITY AND APPROPRIATED
$832,183 FROM VARIOUS FUNDS (State Recreation Grants: $96,227; Rivers and
Mountains Conservancy $25,000; Rivers and Mountains Conservancy $250,000; Park-in lieu
funds $152,485; County Parks Grant $100,000; General Fund $208,479): Administration.
Further action: The Mayor directed that staff return the next meeting with costs of completing
the park and ongoing maintenance.
Mayor Guerra questioned if this item had been submitted to the subcommittee; and what the
additional costs will be to complete the project. Staff responded that the item had not been
submitted to the subcommittee and that while they do not have an exact cost estimate for the
remaining items on the project, these are the major costs that cover all work completed to date. It
was then explained that items of this nature generally don’t go to the subcommittee as they are just
payment on the already approved contract and may include change orders that occurred during the
project
City Manager Caton noted that staff will bring back a report on the ongoing maintenance
costs of the park and any remaining costs for additional work to be done at the next Council
Meeting
It was moved by Council Member Gafin, seconded by Mayor Pro Tem Bayer and carried,
noting the abstention of Mayor Guerra, to approve Cash Contract No. 650 and appropriate funds.
City Manager Caton noted that out of the $8.9 million dollars this project cost only
approximately $280,000 came from the General Fund and the rest was obtained through grants.

ADJOURNMENT:
The meeting adjourned at 8:17 p.m. to 6:30 p.m., April 28, 2009 in memory of Sean
Feliciano, son of longtime Downey residents Bob and Joan Feliciano.
