Frometa Mario Trujillo Timothy Horn Hector Sosa Vacant Mayor Mayor Pro Tem Council Member Council Member Council Member, District 3 ALSO PRESENT:Roger Bradley, City Manager Vaniah De Rojas, Assistant City Manager John Funk, City Attorney James McQueen, Human Resources Director PUBLIC COMMENT ON CLOSED SESSION AGENDA ITEMS Mayor Frorneta asked City Clerk Duane if any written public comments were received regarding Closed Session Items. City Clerk DuaNe confirmed no written public comments were received. Mayor Frometa asked if there was anyone present who would like to comment on Closed Session Items. Juan Martinez, resident, commented regarding Item No. 1 and City Council Members. Lee Squire, resident, commented regarding existing litigation Having no one else, Mayor Frometa closed public comment. RECESSED TO CLOSED SESSION Mayor Frometa announced the City Council is recessing to Closed Session at 5:40 p.m. to discuss matters under the authority of the following sections of the Government Code: 1. Government Code Section 54956.9(d)(1) – Conference with Legal Counsel – Existing Litigation: Fernando Garcia v. City of Downey, Los Angeles Superior Court Case No. BC713683. 2. Government Code Section 54956.95 – Liability Claim – Worker’s Compensation Claim – Claimant: Gerald Massie – Claim No.: 20-148502; Worker’s Compensation Appeals Board No.: ADJ 13577129 – Agency claimed against: City of Downey. 3. Government Code Section 54957(b) – PUBLIC EMPLOYEE APPOINTMENT – Title: City Treasurer RECONVENED REGULAR CITY COUNCIL MEETING – CLOSED SESSION Mayor Frometa reconvened the Regular City Council Meeting – Closed Session at 6:31 p.m. City Attorney Funk reported the Closed Session report as follows: in regards Item No. 3, the City Council considered the appointment of a City Treasurer and took action to proceed with the appointment City Council Minutes Regular Meeting – October 24, 2023 1 by a vote of 4-0. He stated the appointment would return to the City Council in open session. There was no reportable action taken for Item Nos. 1 and 2. CITY COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; CONFERENCE/MEETING REPORTS Council Member Horn reported attending Downey’s 150th Anniversary Celebration event, the Downey Historical Society tour, the Columbia Memorial Space Center Aerospace Legacy Speakers event, the tour of Casa De Parley Johnson, the multi-Chamber of Commerce mixer, and the Downey State of the City event. He inquired regarding allowing residents to volunteer to advise the City Council or City Manager in their area of expertise. Mayor Pro Tem Trujillo requested to discuss waiving permit fees and Art in Public Places fees for the Downey YMCA. Mayor Frometa provided concurrence for this request. He requested staff provide an update regarding construction of a dog park in the south side of the City and regarding a community garden Council Member Sosa welcomed the audience to the City Council Meeting. He reported attending the Father-Con event, the Downey Police Department Pink Patch fundraiser event, the Warren v. Downey football game at SoFI Stadium, Downey’s 1 50th Anniversary Celebration event, the State of the City event, the Best Buy reopening event, and the SEAACA board meeting. He requested staff expand the Pets for Vets program to include law enforcement personnel. Mayor Pro Tem Trujillo provided concurrence for this request Mayor Frometa thanked staff for their work on the City’s 150th Anniversary Celebration event and thanked the Downey Chamber of Commerce for hosting the State of the City event. She acknowledged Michael Calvert in the audience. She acknowledged the work of the Police and Fire Departments. She City Council Minutes Regular Meeting – October 24, 2023 2 commented regarding community attendance at the Havana Nights event, the filling of key positions in the City, and thanked City Manager Bradley and staff for their hard work. She commended the Police Department for communicating with the public and commented regarding the coordination between the Police Department, Code Enforcement Division, and other agencies. She reported attending a Neighborhood Watch meeting, the Father-Con event, the Warren v. Downey football game at SoFI Stadium, and the Best Buy reopening event. She requested staff address increased transient activity near the Downey View Apartments. She commented regarding researching the installation of video cameras and removable bollards in the downtown area. She requested speed monitoring on arterial streets. She invited the public to attend the Dia De Los Muertos Art Festival, the Pumpkin Patch event, and Council Member Sosa’s Town Hall Meeting. She acknowledged Veterans and Carrie Uva in the audience CITY MANAGER/STAFF MEMBER COMMENTS City Manager Bradley confirmed staff would provide updates regarding the dog park, community garden, and the Pets for Vets program and address homeless issues at the Downey View Apartments, and speed enforcement on arterial streets PRESENTATIONS 1.Mayor Frometa presented the Mayor’s Legacy Award to Beth Gendreau, Downey Food Helps. 2. Mayor Frometa presented the Mayor’s Legacy Award to Greg Welch, Downey Police Department Chaplain. PUBLIC HEARINGS: None PUBLIC COMMENT ON AGENDA, CONSENT CALENDAR AND NON-AGENDA ITEMS Mayor Frometa asked City Clerk DuaNe if any written public comments were received regarding Agenda, Consent Calendar and Non-Agenda items. City Clerk Duane confirmed no written public comments were received. Mayor Frometa asked if there was anyone present who would like to comment regarding Agenda, Consent Calendar and Non-Agenda items. BC, resident, commented regarding the public comment speaking time, additional Police Officers, City Council candidates, and the COVI D-19 shutdown and mask mandates. Margie Tabrizi commented regarding her claim against the City pertaining to damage of plumbing lines at Wood Creek Apartments City Manager Bradley stated the claim is being processed. Adam Gutierrez, resident, requested the installation of speed bumps near Price Elementary School and the installation of street lights on Gainford St. Gabriel Enamorado, resident, commented regarding Item No. 8, the Discover Downey Campaign and increasing the budget for the Campaign. Alexandra Beemer, resident, commented regarding the homeless population near Rick’s Motel, the abortion clinic on Firestone Blvd., the need for a crossing guard at Rio San Gabriel Elementary School, and bringing back the D.A.R.E. program. City Council Minutes Regular Meeting – October 24, 2023 3 Mayor Frometa commented regarding the City’s relationship with the Downey Unified School District and the City-School Task Force Claudia Dzul, Veterans Stand Together, commented regarding services offered by Veterans Stand Together and in favor of Item No. 6, and waiving fees associated with the event Nick Velez, Bastards Canteen, commented regarding Bastards Canteen and in favor of Item No. 6, and waiving fees associated with the event. Lee Squire, resident, commented regarding Veterans and support for the Jewish population in Downey Alan Halstensgaard, resident, commented regarding abortion Ramon Casas Jr. , resident, commented regarding his campaign for City Council. John Lacey, resident, recited “God Bless America” Rodolfo Cortes Barragan, non-resident, commented regarding City Council candidates and Council Members Armando Herman, non-resident, commented regarding free speech. RECESS/RECONVENE Mayor Frometa recessed the City Council meeting at 7:49 p.m. Mayor Frometa reconvened the City Council meeting at 7:53 p.m. with all Council Members present John Wilhyde, resident, thanked the Downey Fire Department for saving his life and commented regarding the hire of a new Police Chief and quality of life in Downey. Juan Martinez, resident, commented regarding Item No. 9, the Downey Council Meeting rules of decorum, the authority of the City Attorney, the removal of a previous speaker from the Council Chambers, and Palestine. It was moved by Mayor Frometa, seconded by Mayor Pro Tem Trujillo, and carried 4-0, to close public comment. CONSENT CALENDAR Council Member Horn requested the correction of a typographical error on the Regular Meeting – Open Session Minutes of August 22, 2023. Council Member Sosa abstained from Item No. 1, Regular Meeting – Open Session Minutes of August 22, 2023 as he did not attend the meeting, and pulled Item No. 6 from the Consent Calendar for separate discussion. Mayor Pro Tem Trujillo abstained from Item No. 1, Regular Meeting – Closed Session Minutes of October 10, 2023 as he did not attend the meeting and Item No. 6 due to owning property in the area. It was moved by Council Member Horn, seconded by Mayor Pro Tem Trujillo, and carried 4-0, to approve the remainder of Consent Calendar. 1. APPROVED MINUTES: August 22, 2023 (Open Session): September 12, 2023; September 26, 2023 (Closed Session); and, October 10, 2023 (Closed Session): City Clerk. City Council Minutes Regular Meeting – October 24, 2023 4 2. OTHER BUSINESS 6. STREET CLOSURE APPLICATION AND FEES FOR VETERANS DAY/MARINE CORPS BIRTHDAY FUNDRAISER EVENT: Community Development THAT THE CITY COUNCIL: APPROVED THE STREET CLOSURE PERMIT AND FEES SUBMITTED BY BASTARDS CANTEEN FOR ITS EVENT Mayor Pro Tem Trujillo announced he would abstain from Item No. 6 due to owning property in the area of the event, and left the dais at 8:02 p.m. Council Member Sosa requested the City Council consider waiving fees associated with the street closure permit for the Veterans Day/Marine Corps Birthday Fundraiser event. He commented regarding attendance of the event and funding being invested in Veteran programs. Mayor Frometa inquired regarding the suggested amount waived and the remaining balance from the prior year. She concurred with Council Member Sosa regarding supporting Veterans and referred to City Council Minutes Regular Meeting – October 24, 2023 5 previous discussion regarding waiving fees for community events. Assistant City Manager De Rojas clarified the applicant paid their fees and has a remaining unpaid balance of approximately $2,400 and staff has not received direction regarding clearing the balance. Mayor Frometa inquired if the City waived any fees from the prior year's event. Assistant City Manager De Rojas responded the City did not waive any fees and the remaining balance of approximately $2,400 was a pending invoice for Police Officer security service hours Council Member Sosa inquired regarding the total fees associated with the previous year’s event Assistant City Manager De Rojas responded she did not have the figure available. Council Member Sosa reiterated his request to consider waiving fees associated with the street closure permit Council Member Horn commented in opposition to reducing any services to lower the fee amount, citing liability concerns and payments of past fees before providing additional support in the current year. Council Member Sosa clarified the waiver of fees would serve as an in-kind donation rather than a reduction of services. He commented in favor of waiving at least half of the fees, and mentioned the benefits of the event to Veterans Council Member Horn inquired if the City would be reducing the current obligation to address the past due obligation or requesting payment for the balance before approving the requested services. Council Member Sosa responded the City could request the applicant clear their balance and waive the current fees and reiterated his request to waive at least half of the fees for the event. Mayor Frometa stated the City should ensure there isn’t a carryover balance before proceeding City Manager Bradley confirmed there is a carryover balance. Mayor Frometa commented regarding the importance of any nonprofit organization clearing their balance with the City It was moved by Council Member Sosa, seconded by Mayor Frometa, and carried 3-0, with Mayor Pro Tem Trujillo abstaining, to approve the Street Closure Permit and fees submitted by Bastards Canteen for its event, with a waiver of half of the fees contingent on the payment of the balance for Downey Police Department security services Mayor Pro Tem Trujillo returned to the dais at 8:11 p.m ADMINISTRATIVE REPORTS 7. SALARY RANGE ADJUSTMENT FOR POSITION OF ECONOMIC DEVELOPMENT DIRECTOR: Human Resources. ADOPTED RESOLUTION NO. 23-8199, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING COMPENSATION FOR THE POSITION OF ECONOMIC DEVELOPMENT DIRECTOR Director of Human Resources James McQueen presented the staff report for Item No. 7. He provided background information regarding the item and legal requirements prior to adjusting the salary or benefits for Executive Management positions. He shared the new adjusted monthly salary range for the position of Economic Development Director to better align with the City’s labor market and scope of responsibilities and added there would be no other changes to pay and benefits for the position. He reported a salary savings of $42,000 per fiscal year Mayor Frometa commented in favor of the salary savings of $42,000 per fiscal year. City Council Minutes Regular Meeting – October 24, 2023 6 It was moved by Council Member Sosa, seconded by Council Member Horn, and carried 4-0, to Adopt Resolution No. 23-8199, a Resolution of the City Council of the City of Downey Establishing Compensation for the Position of Economic Development Director 8.DIRECTION TO STAFF REGARDING SPEND LOCAL CAMPAIGN: Administration. DIRECTED STAFF TO INITIATE THE SPEND LOCAL CAMPAIGN Management Analyst Ruby Picon presented the staff report for Item No. 8. She provided background information regarding the item and the goal of the campaign to promote a thriving and sustainable local economy while fostering a sense of pride and loyalty among the Downey community. She presented four sample logos for Council consideration and listed the strategies of social media marketing, advertising, and community engagement. She clarified the social media platforms would remain as “Discover Downey” and would be rebranded to promote local businesses. She stated staff would create social media posts to inform residents about the benefits of spending locally and reposting social media posts highlighting Downey businesses and noted staff would create a digital advertisement to publish in The Downey Patriot for one month, a banner for the City’s website, an advertisement for the Downey Orbit and, an advertisement for the City Hall Lobby monitor and signs at all City facilities. She stated as part of the community engagement strategy, the City would provide local businesses with Spend Local decals to display on storefronts and feature ribbon cutting ceremonies and other milestone on Discover Downey. She reported the proposed launch date of December 1 , 2023 and an estimated $1 ,000 revenue decrease for campaign implementation Mayor Frometa thanked Ms. Picon for her report and commended the focus on business growth and the spend local concept. She asked Ms. Picon to elaborate regarding the Discover Downey Campaign and commented regarding differentiating the Campaign from the City. Ms. Picon responded Discover Downey is being refocused to be more business-centered. City Manager Bradley responded the Discover Downey Campaign would not be eliminated and Spend Local could be considered a separate element of the Campaign. He commented regarding the opportunity to keep revenues local, highlight the business community, provide exposure to businesses, and drive traffic through City social media platforms and the website. Council Member Sosa inquired regarding the original intent of the Discover Downey Campaign Assistant City Manager De Rojas responded the Campaign was targeted toward events, cultural experiences, and attractions as part of the City's rebranding process in 2016. She noted changes in the management of Discover Downey and a refocusing on events in the business community and attracting individuals to the City for economic development. Council Member Sosa requested to confirm this Campaign does not detract from promoting cultural events and focuses on promoting businesses. Assistant City Manager De Rojas confirmed his statement and added the Campaign would have a separate identifying social media platform rounding out economic development. Mayor Frometa commented regarding Downey’s vibrant cultural community and the need for economic development. Mayor Pro Tem Trujillo shared the need to educate residents regarding returning sales taxes to the City and encouraging shopping, dining, and playing in the City with concrete examples. He inquired regarding the development of hashtags and suggested #KeepYourMoneyinDowney and #ReinvestinDowney. He commented regarding contacting Mr. Enamorado regarding the history of the Discover Downey Campaign and expanding Discover Downey. He suggested keeping the City’s social media platform separate from that of Discover Downey. He commented in favor of increasing the City’s investment in the Campaign. Mayor Frometa commented regarding the logo samples and concurred with Mayor Pro Tem Trujillo regarding educating residents. City Council Minutes Regular Meeting – October 24, 2023 7 Mayor Pro Tem Trujillo commented in support of creating videos regarding spending local and ensuring tax dollars return to the City Mayor Frometa commented in favor of the Spend Local Campaign and concurred with Mayor Pro Tem Trujillo regarding increasing the $1,000 investment in the Campaign. City Manager Bradley responded staff can explore expanding the program and $1,000 would be for the initial launch of the Campaign. Assistant City Manager De Rojas added staff has provided sample social media posts explaining the importance of spending local and requested direction regarding the Campaign logo Mayor Pro Tem Trujillo commented regarding alternate language such as “Shop, Dine, and Spend Local Council Member Sosa commented in support of “Spend Local” or “Shop Local” and requested to incorporate the Downey “D” in the logo. Mayor Frometa complimented the simplicity of sample no. 1 and commented in favor of selecting sample nos. 1 or 4. Mayor Pro Tem Trujillo inquired whether the Downey “D” would be recognizable or if the logo should spell out Downey and highlighted the need to partner with the Downey Chamber of Commerce and the Downtown Downey improvement Association for rollout of the Campaign. Assistant City Manager De Rojas confirmed staff has communicated with the Downey Chamber of Commerce regarding the rollout of the project Mayor Frometa stated the community is familiar with Discover Downey and the Downey “D” and commented in favor of keeping the logo simple Mayor Pro Tem Trujillo commented regarding distribution of materials under Downey platforms Council Member Sosa commented in favor of selecting sample no whether the logo would be “Spend Local'’ or “Shop Local”, 1 and requested to clarify Mayor Frometa commented in favor of the “Spend Local” language. Mayor Pro Tem Trujillo commented in favor of selecting sample no. 1 and requested the language in the post include direction to shop, dine, purchase groceries and gas, and support retail in Downey Ms. Picon confirmed staff would provide specific direction in the body of the post. Mayor Frometa reiterated the request to film reels of Council Members pumping gas, dining, and supporting small businesses to promote the Campaign It was moved by Council Member Sosa, seconded by Council Member Horn, and carried 4-0, to direct staff to initiate the Spend Local Campaign 9. ESTABLISHMENT OF A RANCHO SOUTH CAMPUS FUTURE DEVELOPMENT AD HOC COMMITTEE: Administration. DISCUSSED FORMING A TWO MEMBER AD HOC COMMiTrEE TO DISCUSS AND REVIEW DEVELOPMENT OPPORTUNITIES OF THE RANCHO SOUTH CAMPUS City Manager Bradley presented the staff report for Item No. 9. He provided background information regarding the history of the item, the Rancho South Campus property, and opportunities for development. City Council Minutes Regular Meeting – October 24, 2023 8 Mayor Frometa commented regarding the importance of studying development opportunities for the Rancho South Campus property and indicated her desire to appoint herself and an additional Council Member to serve on the ad hoc committee. Mayor Pro Tem Trujillo nominated Council Member Sosa to serve on the ad hoc committee. Council Member Sosa accepted the position as the property is located within his Council District. Mayor Frometa confirmed she and Council Member Sosa would serve on the ad hoc committee to study development opportunities of the Rancho South Campus. 10. UPDATE REGARDING CITYWIDE PAVING EFFORTS; Public Works 1) RECEIVED AND FILED THE INFORMATIONAL UPDATE REGARDING CITYWIDE PAVING EFFORTS; AND, 2) DISCUSSED AND PROVIDED ANY DESIRED FEEDBACK ON CURRENT AND FUTURE PAVING EFFORTS IN THE CITY. Director of Finance Matthew Baumgardner presented the staff report for Item No. 10. He provided background information regarding past Citywide paving efforts and future paving plans and priorities. He reported 64% of the 214-mile road network has been paved in the last 10 years with 40% of roads paved since 2018 and attributed the increase in paving efforts to City Council actions including the adoption of the pavement management analysis, development of a 10-year Residential Street Program, and issuance of a $30.5 million bond to expedite the work. He added six of the 10 years of the Residential Street Program were completed between 2022 and 2023 and staff anticipates completing work for Areas 5 and 6 in fiscal year 2023-2024 and Areas 3 and 6 in fiscal year 2024-2025. He stated designs for all four areas are expected to be completed in the current fiscal year. He informed the Council regarding the increase in paving costs over the last six to 12 months and the possibility of additional funds required for the current fiscal year. He listed Capital Improvement Program arterial paving projects on Woodruff Ave Bellflower Blvd., Imperial Hwy., Lakewood Blvd., and Downey Ave., their funding status, and the opportunity to apply for grants and other revenue. He shared plans to complete all residential paving by the end of calendar year 2024 and the potential to complete the 10-year plan in 3.5 years. He stated the City would complete a new pavement management report in the next six months and anticipated a large improvement in the pavement condition index. He reported Woodruff Ave. is funded for construction and the four additional arterial streets are funded for design and estimated a cost of $2-4 million for each project. He shared staff would return to the City Council in 2024 after receiving bids for these projects to discuss funding for the 10-year Residential Street Program, prioritization of arterial streets, and solutions for potential funding gaps. City Manager Bradley reiterated arterial streets are funded for design which would make them eligible to receive funding from entities such as the Los Angeles County Metropolitan Transportation Authority once the design is completed in 2024. He indicated the need to review funding priorities over the next few budget cycles. Mayor Frometa inquired regarding arterial streets in Area 6. Director Baumgardner responded Area 6 is bounded by Lakewood Blvd. to the west, Florence Ave. to the north, and Firestone Blvd to the south. Mayor Frometa inquired regarding the boundaries of Area 7. Director Baumgardner responded Area 7 is bounded by Paramount Blvd. to the east, Firestone Blvd. to the north, and Imperial Hwy., to the south Council Member Sosa inquired regarding the prioritization of streets. Mayor Frometa inquired regarding reordering the priority of certain streets in the Pavement Management Plan. Director Baumgardner responded the City works with a design consultant that reviews City Council Minutes Regular Meeting – October 24, 2023 9 the Pavement Management Plan and determines treatment of each street based on the report and the amount of funding available. He noted slurry seal maintenance helps the City protect its investment and extend the life of its streets Mayor Pro Tem Trujillo added the machinery handles certain areas that are geographically close and moving the machinery throughout the City increases costs. Director Baumgardner confirmed the bids received by the City are based on the project area being in a close geographic space and grouping by geographic area spends funds wisely Council Member Sosa thanked Director Baumgardner and confirmed these considerations were factored into the initial process. Director Baumgardner confirmed his statement and staffs goal to complete the remainder of the residential streets. Mayor Frometa emphasized the importance of an education campaign to inform the community what has been done and which projects are upcoming. City Manager Bradley confirmed staff would place the map on the City’s website Council Member Horn expressed concerns regarding certain residential streets in Area 9 that were not addressed between Foster Rd, and Imperial Hwy. Director Baumgardner responded gaps in certain areas may be streets that were completed before the program was started in 2018 and did not require improvement at the time. He added staff would address streets that received a slurry seal after completion of the Residential Street Program and noted slurry seals allow an additional five to seven years before repavement is required. Council Member Horn commented the streets may also be above the grade that requires improvement.
