all of which were continued from the Council Meeting of November 27, 2001, with the exception
of Item 3, Development Agreement No. 01-104.
Ms. Midstokke affirmed receipt of the Proof of Publication for Item 3, Development
Agreement No. 01-104. 1t was moved by Council Member Winningham, seconded by Council
Member McCarthy, and so ordered to receive and file.
Mr. Vose explained these matters have been before the Council several times before, with the
exception of Development Agreement No. 01-104, which was added at the November 27, 2001,
Council Meeting. He noted the Development Agreement was approved by the Planning Commission
in December and is now being brought before the Council. Staff is recommending the Council adopt
the Resolution certifying the Environmental Impact Report, adopt the Resolution granting the appeal
and approving the General Plan Amendment, introduce the Ordinance approving the Development
Agreement, introduce the Ordinance granting the appeal to the Zone Change, continue Conditional
Use Permit No. 00-08 and Zone Variance No. 01-65 to the Council Meeting of January 22, 2002, and
approve withdrawal of Zone Change No. 01-64 to rezone the property to open space. He explained
the added Development Agreement ties all of the entitlements for the project together, including the
loss of open space, and provides mitigations for the loss of open space with a payment of $300,000 to
replace and improve open space in the City in the future. He advised the City Planning Director is
available to answer any questions.
There was no correspondence received regarding these matters.
Mayor Perkins asked if the applicant/appellant wished to come forward and address the
Council.
Steve Sheldon, 695 Town Center Drive, Suite 410, Costa Mesa, 92626, Attorney representing
the applicant/appellant, Iglesia de Cristo Ministerios Llamada Final, stated the applicant/appellant
reviewed the Development Agreement and is in agreement with it. He noted they are also in
agreement with the staff report and request Council’s support of the measures.
There being no one else to speak in favor or in opposition to the seven items mentioned, it was
moved by Council Member Winningham, seconded by Council Member McCarthy, and so ordered to
close the public hearing, except for the Appeals of Conditional Use Permit No. 00-08 and Zone
Variance No. 01-65, which were continued to January 22, 2002, (see later action).

RESOLUTION NO. 6532
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT FOR
GENERAL PLAN AMENDMENT NO. 00-06, ZONE CHANGE NO. 00-07. AND
DEVELOPMENT AGREEMENT NO. 01-104
The Resolution was read by title only. It was moved by Council Member Winningham,
seconded by Council Member Trejo, and unanimously carried to waive further reading and
adopt.
Council Member Winningham noted his concern regarding the mitigation of open space
can be dealt with through the Development Agreement. He referred to one of the mitigation
measures, on-site storage for recyclable materials, stating this is typically not done in a lot of
commercial facilities and inquired if it was for the life of the project.
Dwayne Mears of the Planning Center responded that this mitigation measure would be
included in the operation of the facility.
RESOLUTION NO. 6533
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
GRANTING THE APPEAL AND APPROVING AN AMENDMENT TO THE
CITY’S GENERAL PLAN CHANGING THE LAND USE DIAGRAM ON
PROPERTY LOCATED AT 12145 WOODRUFF AVENUE FROM OPEN
SPACE TO NEIGHBORHOOD COMMERCIAL) (General Plan Amendment
No. 00-06)
The Resolution was read by title only. It was moved by Council Member Winningham,
seconded by Council Member Cartozian, and unanimously carried to waive further reading and
adopt.
Council Member McCarthy advised that approximately 7-1/2 acres of open space will be
removed from the General Plan and hoped the City would continue to look for opportunities to
add additional open space.

Council Member Winningham pointed out this open space was never open to the public
and was only available to employees of Rockwell International and Boeing. He noted the
addition of new park space at the Boeing site will offset this lost acreage.

The Ordinance was read by title only. It was moved by Council Member Winningham,
seconded by Council Member Trejo, and unanimously carried to waive further reading and
introduce.
Council Member Winningham felt this was the correct move to make regarding the
zoning of this property.
Mayor Perkins noted staff has requested the appeal of Conditional Use Permit No. 00-08
be continued to the Council Meeting of January 22, 2002.
It was moved by Council Member McCarthy, seconded by Council Member
Wirmingham, and unanimously carried to continue the Appeal of Conditional Use Permit No.
00-08, to 7:30 p.m., January 22, 2002, in the Council Chamber of the Downey City Hall.
Mayor Perkins noted staff has also requested the appeal of Zone Variance No. 01-65 be
continued to the Council Meeting of January 22, 2002.
It was moved by Council Member Winningham, seconded by Council Trejo, and
unanimously carried to continue the Appeal of Zone Variance No. 01-65, to 7:30 p.m.,
January 22, 2002, in the Council Chamber of the Downey City Hall.
Mayor Perkins noted Zone Change No. 01-64, the request to rezone property at 12145
Woodruff Avenue from Ml (Light Manufacturing) and PB (Parking Buffer) to OS-RA (Open
Space – Recreational Area), is requested to be withdrawn as it is no longer applicable.
It was moved by Council Member Winningham, seconded by Council Member
McCarthy, and unanimously carried to withdraw Zone Change No. 01-64 for property at
12145 Woodruff Avenue.
Mayor Perkins opened the public hearing on PROPOSED DOWNEY MUNICIPAL
CODE AMENDMENT RELATED TO DELETING CERTAIN SUB-ZONES AND USES
OF THE OS (OPEN SPACE) ZONE, which was continued from the Council Meeting of
November 27, 2001.
There was no correspondence received regarding this matter.

Mr. Vose advised this is a continuance from November 27th and is a cleanup item
relating to definitions under the open-space zone within the Downey Municipal Code. Staff
recommends approval of the introduction of this Ordinance to clean up language, as it relates to
this zone.
Mayor Perkins asked if anyone present wished to speak regarding the proposed Downey
Municipal Code Amendment.
There being no one to speak, it was moved by Council Member Winningham, seconded
by Council Member McCarthy, and so ordered to close the hearing.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 9108 (OS – OPEN SPACE ZONE) OF THE DOWNEY
MUNICIPAL CODE DELETING CERTAIN SUB-ZONES AND USES OF THE
OS ZONE
The Ordinance was read by title only. It was moved by Council Member Cartozian,
seconded by Council Member Winningham, and unanimously carried to waive further reading
and introduce.
Council Member Wirmingham explained the proposed Municipal Code Amendment
deletes some usage from the open space zone and insures the City retains open space in the
community, with the goal of one acre of open space per 1,000 acres. He noted the acreage at the
Boeing site will improve open space in south Downey and stated the Code Amendment will
assure open space zoning will remain open space zoning.
Council Member McCarthy advised the term open space essentially means parks,
recreation areas and playgrounds. He supported this amendment, noting it clearly defines the
definition of open space in terms of what is and what is not open space and conforms with what
is and is not included in the definition of open space in surrounding communities and makes the
City more consistent in this area.
Council Member Trejo supported this item, noting the City is in dire need of more
recreational facilities and felt this Code Amendment would assist the City in achieving this goal.

CITY COUNCIL REDISTRICTING
Mr. Powell explained the City Charter requires the review of Council District boundaries
every ten years after the National Census is completed to keep the populations in each Council
District equal to comply with the principal of “one man, one vote.“ He advised the Council formed a
Redistricting Subcommittee composed of Council Members, McCarthy, Trejo and Cartozian to
review information. The Subcommittee is proposing the following plan for Council consideration
and, if approved, it will be introduced in the form of an Ordinance to be brought back for adoption at
another meeting. He noted this information will also be forwarded to the County of Los Angeles,
with the revised boundaries in line for the next City Election in November 2002. He narrated a
Power Point program of proposed changes, pointing out the area in District 1 that will be relocated to
District 4 to increase the population of District 4, as it was found to be underrepresented compared to
the other three Districts. District I was found to be the most heavily represented area in terms of
population. He explained the criteria reviewed by the Committee and noted other alternatives were
considered but it was felt the proposed change complied with all criteria and was the best option.
Council Member McCarthy commended Mr. Powell and Mr. Jardn for their efforts in putting
this information together and he supported the results.
Council Member Trejo commended those involved in reviewing this information and
supported the decision.
Council Member Winningham felt this was the most practical of the three options.
Council Member Cartozian stated this was a good learning process and felt staff did a great
job of making it easy for the Subcommittee to make a decision.

ADMINISTRATIVE REPORTS
BUDGET REDUCTIONS
Mr. Powell explained this item is related to current economic conditions affecting the City
Budget and advised Staff recommends the Council reduce the City Budget by $500,000 according to
the list supplied with the staff report. He noted revenues are declining, in particular sales tax revenue
and transient occupancy tax revenues, and ar.e below current budget projections. He pointed out this
is occurring throughout the State, as well as in the State Government itself, and many jurisdictions are
reducing their budgets in response. He noted reductions are in the area of non-personnel costs, such
as equipment, supplies, and contracts, and are in the General Fund, which is more prone to react to
the economy. He stated the Transit and Golf Course Funds are also impacted but there is no need for
action at this time. He noted these funds may experience some impact when the new City Budget for
2002-2003 is prepared.
Council Member Winningham asked Mr. Jarrett how the energy savings in the Library and
Theatre would be achieved and was informed the reduction has been going on since last Summer. He
also noted lighting changes at the Theatre will produce a reduction in cost.
Council Member McCarthy stated the Community Services Department is often affected in
times of Budget reductions, as many of its programs are not as critical as Police and Fire Services.
He noted expenditures must be reduced when income is down.
Council Member Cartozian noted he is pleased with the reductions proposed by each
department .
Council Member Trejo supported the Department Heads for reducing their budgets without
cuts in personnel.
Mayor Perkins commended staff for taking proactive measures to reduce the budget at this
time and was happy Police and Fire services will remain the same.
Lennie Whittington, 8542 Manatee Street, mentioned in previous economic downtums, staff
cut down on travel expenditures and asked if this was considered or is being cut back in any way.
Mr. Caton advised staff travel never came back to its previous level and was not cut
additionally to achieve the $500,000 reduction. He noted it would be considered if further reductions
are necessary.
It was moved by Council Member McCarthy, seconded by Council Member Cartozian, and
unanimously carried to reduce the City Budget by $500,000 per the list included with the staff
report.

CITY COUNCIL COMMITTEE ASSIGNMENTS 2002
Mayor Perkins explained each year the new Mayor reviews the committees Council Members
must serve on, which is usually approved by the Council during the new Mayor’s first or second
meeting. He stated he discussed the committee assignments with each Council Member and assigned
a primary and alternate representative for eaQh of the committees listed.
Council Member McCarthy commended the Mayor for an outstanding job of assigning the
commrttees.
Mayor Perkins noted there is one new committee, the Rio Hondo Golf Club Facility
Modernization Subcommittee, which will consist of Council Member Winningham and himself, with
Council Member Trejo as the Alternate.
It was moved by Council Member Winningham, seconded by Council Member Trejo and so
ordered to approve the City Council Committee Assignments for 2002.
Mayor Perkins acknowledged newly elected Downey Unified School Board Member
William Gutierrez and Downey Chamber of Commerce President, John Tilley; in the audience.
Mayor Perkins mentioned the election coming up in March on Fireworks and noted two of
the non-profit organizations operating fireworks booths have still not turned in their financial report
and requested staff look into this. He felt those that do not report are not in good standing and should
not be allowed to sell fireworks.
Council Member Winningham inquired as to which two organizations and was informed there
are actually three: West Downey Little League, Downey Pop-Warner, and Warren High School
Football.
Mayor Perkins mentioned having the opportunity to work with the Downey Rose Float
Association preparing the float for the parade this year. He noted the float again won the Founder’s
Trophy and commended the Rose Float Association and the volunteers who worked on the float.
Mayor Perkins read part of the letter received from Officer Javier Sanchez, who is serving
the country in the armed services at this time, which stated the City’s card was the most special one
received by his family and wished everyone a special holiday season.
Mayor Perkins mentioned the three goals he pointed out at the Mayoral Transition
Meeting on December 5, 2001: Educational Programs; the City’s 45th Anniversary; and Economic
Development. He advised he will donate two months of his compensation as Mayor towards the
Educational Programs to be set aside in an account to recognize those within the City who extend
themselves into education in order to better serve the citizens.

Mayor Perkins announced a press conference to be held this Friday in the Council Chambers
with County Supervisor Don Knabe and people from Washington, D.C., regarding the cancellation of
the mandatory flood insurance requirement for Downey and surrounding area residents.
Council Member Cartozian recognized former Mayor Hazel Scotto in the audience.
Council Member Canozian wished everyone a happy, safe and sane New Year
Council Member Trejo commended the Downey Rose Float Association for this year’s float,
which won the Founder’s Trophy at the Pasadena Tournament of Roses Parade. He noted he and his
family viewed the float the day before the parade.
Council Member Trejo commended Physical Education Coach Latham of Warren High
School for his innovative ways to get kids to exercise.
Council Member Winningham mentioned the raising of the dome on the new Greek
Orthodox Church on Downey Avenue and complimented the architect for this beautifUI additional
to downtown Downey Avenue.
Council Member Winningham mentioned a Resolution approved recently allowing employees
on reserve status to be compensated if called to military action. He advised that Officer Javier
Sanchez was called to action and mentioned receiving a very nice holiday letter from him and his
family commending the City of Downey as the best place to live and work.
Council Member Winningham referred to correspondence received for Public Works from
Mr. Freeman and noted he would forward it to Mr. Alvarez.
Council Member Winningham mentioned being advised of a problem during street
sweeping days with some corner lots where the garages are only ten feet off the public right-of-way
where people cannot park in their own driveway without obstructing the sidewalk, which causes a
safety issue and citations are issued. He noted this is a condition of these properties built in the 50’s
and 60’s and requested staff review this matter and to consider a permit allowing these residents to
park on the street during street sweeping day.
Council Member McCarthy commented on items approved in the Consent Calendar:
Creation of new landscaped medians along Paramount Boulevard; and improvements to Downtown
Downey continuing the landscaping theme along Third Street from City Hall to Downey Avenue and
also from Downey Avenue, south of Firestone Boulevard to the railroad tracks, incorporating the new
transit center with the same theme.
Council Member McCarthy mentioned a concept previously discussed regarding the creation
of more open space and a pedestrian area outside City Hall and suggested having a pedestrian mall
from the Civic Center along Third Street to Paramount Boulevard. He felt this is something to
consider as this area is improved.
Council Member McCarthy complimented Captain Mark Dryer of the Police Department
who will begin training with the Federal Bureau of Investigation (FBD National Academy and will be
the only officer, other than Chief Finch, to have undergone this training.

Council Member McCarthy mentioned sales tax has gone up to 8-1/4 percent again and noted
the City does not benefit directly by it and still receives only one percent back.
OTHER BUSINESS - Staff Members
Mr. Caton advised on December 20, 2001, Los Angeles County and the Army Corps of
Engineers declared the LACDA flood control project complete and the City now has 100 years of
flood protection. He explained the County submitted this information to FEMA (Federal Emergency
Management Association) on December 21, 2001, and noted this Friday at 9:00 a.m. there will be a
media briefing in the Council Chamber where FEMA will approve the project, as of that date. He
noted it took over 10 years to finalize but Friday will be a great day.
Mr. Caton mentioned the League of Women Voters “Know Your City Forum,”
cosponsored by the City, will be held this Saturday at the Community/Senior Center at Apollo Park,
noting he will be one of the speakers.
ORAL COMMUNICATIONS
Hazel Scotto, 9203 Cord Avenue, commended Christina Vogel for her assistance with the two
“Know Your City” forums sponsored by the League of Women Voters and co-sponsored by the
City and encouraged everyone to attend. She also thanked Mayor Perkins for assisting with Cable TV
coverage and noted there will also be coverage by Cerritos College.
Regina Barlow, formerly of 8061 Florence Avenue, complained about the way the Police
Department handled her stolen vehicle, and submitted a handwritten request for the release of the
vehicle and for reimbursement of any and all impound fees and related charges.
Mayor Perkins referred Ms. Barlow to Chief Finch and to the City Clerk’s Office, if she
wished to file a claim form.
