HomeMy WebLinkAboutResolution No. 08-7090 - Designate LA County Public Health agent under Solid Waste Act; amends #5536RESOLUTION NO. 08-7090 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, APPROVING THE REDESIGNATION OF THE LOS ANGELES COUNTY DEPARTMENT OF PUBLIC HEALTH AS THE LOCAL ENFORCEMENT AGENCY PURSUANT TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT ACT, AND AMENDING RESOLUTION NO. 5536. WHEREAS, the County of Los Angeles and its incorporated cities are required by Section 43203 of the Public Resources Code to designate an enforcement agency to carry out the provisions of the California Integrated Waste Management Act of 1989 (AB 939); and WHEREAS, the Los Angeles County Department of Health Services possesses the required capabilities in environmental health and solid waste management to implement the California Integrated Waste Management Act of 1989 and the regulations and ordinances that have been and will be adopted pursuant thereto; and WHEREAS, the Los Angeles County Department of Health Services was certified by the California Integrated Waste Management Board as Los Angeles County’s Local Enforcement Agency and is currently authorized and designated to enforce all laws and regulations relating to solid waste disposal, handling and transport in the City of Downey; and WHEREAS, in July 2006, the Los Angeles County Department of Health Services reorganized and formed the Department of Public Health. Within the Department of Public Health is the Los Angeles County Department of Environmental Health, Solid Waste Management Program, Local Enforcement Agency; and [ WHEREAS, the Los Angeles County Department of Public Health continues to possess the required technical expertise, staff resources, budget resources, and training to carry out the enforcement program mandated by AB 939; and WHEREAS, the City Council of the City of Downey recognizes and supports the need for enforcement of regulations and therefore desires to continue Local Enforcement Agency enforcement activities. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: The City Council of the City of Downey hereby designates and approves the Los Angeles County Department of Public Health to act as the Local Enforcement Agency for the City of Downey pursuant to subsection (a) of Section 43203 of the Public Resources Code. //// RESOLUTION NO. 08-7090 PAGE TWO APPROVED AND ADOPTED this 25th day of November, 2008. gmrb+mFm ATTEST: -M%a KATHLEEN L.
