A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CANCELING
THE SPECIAL MUNICIPAL ELECTION WHICH WAS TO BE HELD ON TUESDAY,
NOVEMBER 6. 2007. AND AMENDING AND CALLING THE SPECIAL MUNICIPAL
ELECTION ON TUESDAY, FEBRUARY 5, 2008, FOR THE SUBMISSION TO THE
QUALIFIED ELECTORS OF THE CITY OF A CERTAIN MEASURE RELATING TO
TERM LIMITS.
WHEREAS, a Special Municipal Election on Tuesday, November 6, 2007, has been
called by Resolution No. 074996, adopted on June 26, 2007, and
WHEREAS, said Special Election was to be consolidated with the School and District
Elections for the Downey Unified School District to be held on the same date; and
WHEREAS, the School and District Elections for the Downey Unified School District has
been canceled by operation of law due to the fact that there are no challenges to incumbent
seats for the Board of the Downey Unified School District; and
WHEREAS, the City Council desires to cancel the Special Election called for Tuesday,
November 6, 2007 due to the status of the School and District Elections and to reset the date of the
Special Municipal Election to a new date.

NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF DOWNEY. DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council, pursuant to its right and authority, does order
Resolution No. 074996 to be amended to change the date calling br a Special Municipal
Election to consider the following question:
Charter Amendment No. 13: Shall a Charter Amendment, proposed by the
Downey City Council, which amends Charter Section 500.1 Limitation of
Terms from a two (2) term limit to a three (3) consecutive term limit and
provides for additional terms after a two (2) year waiting period, be adopted?
SECTION 2. That the proposed complete text of the Charter Amendment submitted
to the voters is as follows:
Charter Amendment No. 13: Section 500.1 of the Downey City Charter is hereby
amended by deleting the existing wording and replacing it with the following: “Section 500.1
LIMITATION OF TERM. Any person who shall have served three (3) consecutive terms as a
member of the Council shall be ineligible to serve again in the office until an intervening period
of two (2) years has elapsed. For the purposes hereof, any person who serves as a Council
Member for two (2) years or more of an unexpired term, or two (2) years or more of an elected
term, shall be considered to have served a term. It is the intent of this Charter Amendment that
this Amendment shall be retroactive.”

SECTION 3. That the City Council, pursuant to its right and authority, does order the
Special Municipal Election for Tuesday, November 6, 2007, to be cancelled, and to amend and
call for the Special Municipal Election on Tuesday, February 5, 2008.

SECTION 4. That arguments already submitted for or against the proposed Charter
Amendment in accordance with Resolution No. 074998 are accepted or may be changed and
resubmitted no later than August 28, 2007.
SECTION 5. That rebuttal arguments already submitted in accordance with
Resolution No. 074999 are accepted or may be changed and resubmitted no later than
September 7, 2007.
SECTION 6. That the City Council will reimburse the County of Los Angeles for any
expenses incurred to the date of the cancellation of the Special Municipal Election called on
November 6, 2007
SECTION 7. That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions.
