HomeMy WebLinkAboutResolution No. 07-6998 - Set Priorities for Filing Written Arguments for Proposed Measure on Term Limits- RESOLUTION NO. 076998 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, SETrING PRIORITIES FOR FILING WRITrEN ARGUMENTS FOR A PROPOSED CHARTER AMENDMENT REGARDING TERM LIMITS AND DIRECTING THE CITY ATrORNEY TO PREPARE AN IMPARTIAL ANALYSIS. WHEREAS, a Special Municipal Election is to be held in the Cityof Downey, on November 6, 2007, at Mich there will be submitted to the \oters the following question: Charter Amendment No. 13: Shall a Charter amendment, proposed by the Downey City Council, which amends Charter Section 500.1 Limitation of Terms from a two (2) term limit to a three (3) consecutive term limit and provides for additional terms after a two (2) year waiting period, be adopted? WHEREAS, the proposed complete text of the Charter Amendment submitted to the voters is as follows: Charter Amendment No. 13: Section 500.1 ofthe Downey City Charter is hereby amended by deleting the existing wording and replacing it with the following: “Section 500.1 LIMITATION OF TERM. Any person who shall have served three (3) consecutive terms as a member of the Council shall be ineligible to serve again in the office until an intervening period of two (2) years has elapsed. For the purposes hereof, any person who serves as a Council Member for two (2) years or more of an unexpired term, or two (2) years or more of an elected term, shall be considered to have served a term. It is the intent of this Charter Amendment that this Amendment shall be letroactive.” NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1 That the City Council hereby authorizes: Mayor Trejo (Council Member in Favor of / Against) Council Member Cartozian (Council Member in Favor of / Against) Council Member Guerra (Council Member in Favor of / Against) Council Member Bayer (Council Member in Favor of / Against) members of that body, to file written arguments regarding the Charter Amendment as specified above, accompanied by the printed names and signatures of the authors submitting it, in accordance with Sections 9280 – 9287 of the California Elections Code and to change the argument until and including the date ixed by the City Clerk after which no arguments for or against the City measure may be submitted to the City Clerk. The arguments shall not exceed 300 words. The arguments shall be filed with the City Clerk, signed, with the printed names and signatures of the authors submitting it, or if submitted on behalf of an organization, the name of the organization, and the printed names and signature of at least one of its principal officers who is the author of the argument. The arguments shall be accompanied by the Form of Statement To Be Filed By Authors of Argument. RESOLUTION NO. 07- 6998 PAGE TWO SECTION 2. That the City Council directs the City Clerk to transmit a copy of the proposed measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the proposed measure showing the affect of the measure on the existing law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of direct arguments. The impartial analysis shall not exceed 500 words. SECTION 3. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
