A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING
GENERAL PLAN AMENDMENT NO. 06-77 AND ZONE CHANGE NO. 06-78 FOR
PROPERTY LOCATED AT 12850 WOODRUFF AVENUE (AIN 6283-024-010).
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby find, determine and
declare that
A On May 26, 2006, the applicant submitted applications for General Plan
Amendment No. 06-27 and Zone Change No. 06-28, a request to amend
the General Plan Land Use Designation from Neighborhood Commercial
(NC) and Medium Density Residential (MDR) to General Manufacturing
(GM) and rezoning from R-1 5,000 (Single-Family Residential) to M-1
(Light Manufacturing), for property located at 12850 Woodruff Avenue
(AIN 6283-024-010); and
B.The Planning Commission held a duly noticed public hearing on
September 6, 2006 and fully considered all oral and written testimony and
facts and opinions offered at the aforesaid public hearing. At The
conclusion of said public hearing, the PlannIng Commission adopted
Resolution No. 2460, thereby recommending that the City Council adopt a
Negative Declaration and approval of General Plan Amendment No. 06-
and77
C The City Council held a duly noticed public hearing on October 24, 2006,
at which time they fully considered all written and oral testimony. At the
conclusion of said public hearing, the City Council, by a vote of 5-0,
denied the project and directed staff to return on November 14, 2006 with
a Resolution of denial
SECTION 2. Having considered all of the oral and written evidence presented to it at
said public hearing, the City Council further finds, determines and declares that:
A.The requested amendments may negatively affect the health, safety and
general welfare of the City of Downey. The proposal would place a
manufacturing/industrial use adjacent to a school, church, and multi-
family residential complex. This would allow certain hazardous materials
and/or processes on the property that abuts these sensitive receptors,
which in turn could have a negative effect on the health, safety and
general welfare on the persons and property in the area; and
B The requested amendments are not desirable for the development of the
community and they are not in harmony with the policies and objectives of
the General Plan. Approval of the proposed amendments would be in
conflict with General Plan Policy Number 1.3.1, which states, “ Minimize or
eliminate conflicts where incompatible land uses are in proximity to each
other. ” The proposal would place a manufacturing/industrial use on a
property that is abutting parcels that contain a school, a church, and a
multi-family residential complex; and

C That the requested zone change will not be compatible nor
complementary to existing conditions and adjoining property in the
surrounding area. The proposal would place a manufacturing/industrial
use adjacent to a school, church, and multi-family residential.
SECTION 3. Based upon the findings set forth in this Resolution, the City Council of the
City of Downey hereby denies General Plan Amendment No. 06-77 and Zone Change
No. 06-78, for property located at 12850 Woodruff Avenue (AIN 6283-024-010)
SECTION 4. That the City Clerk shall certify to the passage and adoption of this
Resolution
