A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING
RELOCATION RULES AND REGULATIONS CONFORMING TO THE CALIFORNIA
RELOCATION ASSISTANCE LAW (CALIFORNIA GOVERNMENT CODE S 7260 ET
SEQ.) AND THE FEDERAL UNIFORM RELOCATION ASSISTANCE AND REAL
PROPERTY ACQUISITION POLICIES ACT (42 U.S.C. 460 ET SEQ.)
WHEREAS, displacement as a result of programs or projects undertaken by the City is
caused by certain activities, including rehabilitation, demolition, code enforcement and
acquisition;
WHEREAS, construction of proposed projects and programs designed for the benefit of
the public as a whole could cause the displacement of occupants of properties in proposed
project areas in the City;
WHEREAS, displaces should not suffer disproportionate injuries as a result of programs
and projects designed for the benefit of the public as a whole, and the City desires to minimize
the hardship of displacement on affected persons or businesses;
WHEREAS, relocation assistance policies provide for fair, uniform, and equitable
treatment of all persons and businesses affected by City activities that result in displacement;
WHEREAS, the City anticipates using federal, state and/or local funds to implernent
proposed projects or programs for the benefit of the public as a whole;
(WHEREAS, the proposed use of these funds triggers the need to provide relocation
assistance and benefits in accordance with the statutes and regulations established by the
California Relocation Assistance Law (California Government Code 97260 et seq.), the
Relocation Assistance and Real Property Acquisition Guidelines adopted by the Department of
Housing and Community Development (Title 25, California Code of Regulations 96000 et seq.),
the Federal Uniform Relocation Assistance and Real Property Acquisition Policies Act (42
U.S.C. 460 et seq.), and Title 49 of the Code of Federal Regulations, Part 24;
WHEREAS, under the California Relocation Assistance Law (California Government
Code 97267.8), public entities shall adopt rules and regulations to implement payments and to
administer relocation assistance to carry out the policies of the California Relocation Assistance
Law and California relocation guidelines;
WHEREAS, the Rules and Regulations for Implementation of the California Relocation
Assistance Law and Real Property Acquisition Guidelines (“Rules and Regulations") is attached
to this Resolution as Exhibit A;
WHEREAS, the Rules and Regulations are designed to carry out the policies of the
California and federal relocation laws and guidelines;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
HEREBY RESOLVE AS FOLLOWS:

SECTION 1. The City Council hereby adopts the Rules and Regulations for
Implementation of the California Relocation Assistance Law and Real Property Acquisition
Guidelines.
SECTION 2. This Resolution shall take effect immediately upon the date of its adoption
and thereafter this Resolution shall be in full force and effect.
SECTION 3. The Mayor shall sign this Resolution and the City Clerk shall attest and
certify to the passage and adoption thereof.
