A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING THE
APPEAL AND DENYING TENTATIVE PARCEL MAP No. 0646335, A REQUEST TO
SUBDIVIDE THE 27,505 SQUARE FOOT PARCEL AT 8220 SUVA STREET INTO
TWO (2) LOTS, ZONED SINGLE- FAMILY RESIDENTIAL (Rl-7,500) (ASSESSOR
PARCEL NUMBER 6361- 008- 001 )
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby find, determine and
declare that:
A A written request was filed by Jesus and Lorena Magana (the “Appellants”)
with respect to the property at 8220 Suva Street, appealing the action of the
Planning Commission of July 19, 2006 regarding Tentative Parcel Map No.
06-66335, whereby the Commission denied the tentative map, a request to
subdivide the 27,505 square foot property at 8220 Suva Street into two (2)
lots
B On August 8, 2006, the City Council set the appeal hearing for August 22,
2006 at 7:30 p.m. in the Council Chamberof Downey City Hall, 11111
Brookshire Avenue, Downey, California, and a notice of the date, time, place
and purpose of the aforesaid hearing was duly given. That hearing was duly
held at the aforementioned time and place and purpose of the aforesaid
hearing was duly given. Studies and investigation made by the City Council
and in its behalf reveal the following facts:
1. Denial of Tentative Parcel Map No. 0666335 is made pursuant to Section
66474 of the Subdivision Map Act. The Map Act specifies that the City
Council shall deny a parcel map if any seven findings of fact support
denial. The following facts support the denial:
(a) in accordance with Section 66474 (c) of the Subdivision Map Act, the
site is not physically suitable for the type of development. A private street,
Suva Street, provides vehicle access to the proposed subdivision, i.e., a
non-exclusive easement for vehicular ingress and egress, and it is
incapable due to its insufficient size to accommodate the additional traffic
that the tentative map's subsequent improvements, two single-family
dwellings, are expected to generate. Moreover, the private street lacks
sufficient area to accommodate the improvements’ forecasted parking
demand; and this deficiency and the resultant effects, vehicles double -
and triple-parking in the street in front of the project site and neighboring
properties, will interfere with the ability of pedestrians and vehicles
belonging to neighboring property owners to safely ingress and egress
their properties and the street. In addition, the street’s deficiency and the
anticipated results will interfere with emergency vehicles attempting to
access the project site and adjoining properties.

SECTION 2. Having considered all of the oral and written evidence presented at the
public hearing and based upon the findings and facts set forth in Section 1 of this Resolution,
the City Council hereby denies the appeal and hereby denies Tentative Parcel Map No. 06-
66335
SECTION 3. The City Council further finds and determines that Tentative Parcel Map
No. 06-66335 was filed and reviewed in accordance with Section 9200 of the Downey Municipal
Code
SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
