HomeMy WebLinkAboutResolution No. 06-6893 - Find Nasa property Parcel#3 - environmentally safe for a City ParkRESOLUTION NO. 06-6893 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THAT THE LAND GENERALLY KNOWN AS NASA PROPERTY PARCEL NUMBER 3 IS ENVIRONMENTALLY SAFE AND MAY BE USED AS A CITY PARK. WHEREAS, the City purchased certain property known as Parcel 3 from United States of America on April 19, 1998 in accordance with a Quitclaim Deed (“Deed”) issued by the National Aeronautics and Space Administration, and WHEREAS, the Deed specifies in section 4 that the property shall be used solely for commercial purposes, and WHEREAS, the Deed allows the property to be used for other uses provided that the City performs environmental remediation activities as specified by appropriate regulatory bodies, and WHEREAS, the City has completed the appropriate environmental remediation and the City has received a letter from the California Environmental Protection Agency (CAL,EPA) allowing the City to proceed with the construction of a park on the property, and WHEREAS, on file in the office of the City Clerk, there are the following documents: • Phase II Subsurface Soil Investigation Report, dated September 1, 2004 by Leymaster Environmental • Contract Documents and Specification for Remediation Work, dated September 27, 2004 • Remedial Action Plan for Arsenic Contaminated Soil, dated December 1, 2004 by PIC Environmental • Remedial Action Plan Approval letter, dated December 10, 2004 from Los Angeles Regional Quality Control Board (CAL EPA) • Arsenic Remediation Report, dated April 13, 2004 by Leymaster Environmental Consulting • No Further Requirements Letter, dated October 11, 2005 from the Los Angeles Regional Water Control Board (CAL EPA). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City finds that, accordance with the Deed, all requirements for soil remediation work to construct a park have been completed, and that the City has received the necessary approvals from the appropriate regulatory bodies.
