The City Council/Community Development Commission of the City of Downey held an
adjourned regular meeting at 6:33 p.m., December 10, 2002, in the Council Chamber of the Downey

Mayor/Chairman Trejo announced the Council/Commission is recessing to Closed Session

PRESENTATIONS
The presentation by Patricia Alvarez Sahagun, League of California Cities, Gateway Cities
Region, regarding the Grassroots Coordinator Program was held during Oral Communications, as
Ms. Alvarez Sahagrm was not present earlier.
Kathy Simmons, Integrated Waste Coordinator, explained the City’s Annual Toy Drive
where new and used toys are collected and donated to local organizations for Downey families in
need
Mr. Julian Dufour, presented to Ms. Simmons, a check for $1,000 towards the City’s Toy
Drive on behalf of the Von’s Foundation and Von’s Store No. 5 at Florence Avenue and
Paramount Boulevard. Ms. Simmons advised the donation would be split between two local
organizations to purchase toys for children assisted by their groups and she presented $500 to Stacy
Brabant, Director of the PTA H.E.L.P.S. Program, and 8500 to Gilda Mathews of the Penny Lane
Family Center.

Kathy Simmons, Integrated Waste Coordinator, commended the Mervyn’s department store in
the Stonewood Shopping Center as the City’s 2002 RecycIer of the Year. (No one from Mervyn’s
was present to receive the award.)
Mayor Trejo and Ms. Simmons, Integrated Waste Coordinator, presented winners of the Used
Oil Recycling Calendar Awards. Ms. Simmons noted this is the fifth year the recycling department
has conducted the Used Oil Recycling Calendar contest, which is open to fifth grade students
throughout the City. She mentioned calendars will be available for distribution around the beginning
of January and recognized Kevin and Marian Sales of KJ Services, used oil consultants, who produce
the calendars and conduct presentations at local schools to educate children on the damage used oil
causes to the environment and why it should be recycled. She acknowledged contest sponsors: All
American Home Center, Frantone’s Pizza, Import Car Service, CaIMet Services, Jiffy Lube, Downey
Acura, Penske Toyota, Downey Ford Auto Center, the Aquarium of the Pacific, Hollywood Sports
Park, Downey Symphonic Society and the Women’s Club of Downey, and reviewed prizes the
winners will receive, as well as additional prizes for the Second, First and Grand Prize winner. The
winners were: Jose Anaya, Brittany Esterbrook, Christy Gera and Brianda Ulloa, Old River School,
Evelyn Arroyo, Rio San Gabriel School, Brandi Bondoc, Rio Hondo School, Crystal Fresquez, Lewis
School, Nicole Jowett and Eddie Romero, Price School, Eric Martinez, Gallatin School, Joshua
Toscano and Raul Pimentel, Gauldin School, and David Villalobos, St. Raymond’s School. The
second place winner was David Villalobos, first place was Joshua Toscano, and the grand prize
winner, whose drawing will be on the front cover of the calendar, was Brittany Esterbrook.

RESOLUTIONS
FORMATION OF THE ORANGE LINE DEVELOPMENT AUTHORITY
Mr. Alvarez introduced Mayor Bruce Barrows of the City ofCerritos to give a slide
presentation on this topic.
Mayor Barrows advised he has approached several cities on behalf of the Southern California
Association of Governments (SCAG) and Gateway Cities Council of Governments (GCCOG),
regarding transportation issues involving the Pacino Electric right-of-way that still runs through their
cities. He noted a small portion of this right-of-way runs through the southwest corner of Downey.
He mentioned methods of transportation considered and advised the proposed system is similar to

Disneyland’s Monorail. He referred to a train currently developed in Germany that China purchased
and has tested at 280 miles per hour between the Pudong Airport and downtown Shanghai and plan to
have up and running for public use in March 2003. He advised it took less than three years for China
to go nom the discussion to implementation stage and stated the same opportunity is available here.
He mentioned SCAG has identified 275 miles of corridors on which to build a Mag-Lev (magnetic
levitation) train throughout this region with a multitude of stations beginning in downtown Los
Angeles at the Staples Center or Union Station and ending up at either the Metrolink station in
Anaheim or Santa Ana. He pointed out the speed will be below 120 miles per hour and the noise
level at that speed will be less than a new Lexus automobile going by at 45 miles per hour, as there
are no wheels and no vibration on the system. He noted seven cities have joined the Joint Powers
Authority (JPA) to date and stated the language is basically the same as that used for the 710 Freeway
Corridor JPA and once members get together it will be brought back to the Council for a vote. It was
also noted the financial aspects to operate the JPA and stipends for Board Members, etc., will also
come back for a vote. He responded to comments from the Council.
Council Member Perkins clarified that approval of the Resolution only indicates the City’s
support of the JPA and suggested the slide presentation be presented when the item is brought back
for a vote, to which the Mayor and other Council Members agreed.
Council Member McCarthy noted he is familiar with this project, has worked closely with
Mayor Barrows, and commended him for his leadership role.
RESOLUTION NO. 6621
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
SUPPORTING ENTRY INTO THE JOINT EXERCISE OF POWERS
AGREEMENT FOR THE FORMATION OF THE ORANGE LINE
DEVELOPMENT AUTHORITY TO FACILITATE FURTHER STUDY OF THE
PROPOSED ORANGE LINE
The Resolution was read by title only. It was moved by Council Member McCarthy, seconded
by Council Member Perkins and unanimously carried to waive further reading and adopt.
Prior to the vote, Council Member Cartozian inquired about the response from the other cities
along the corridor and was informed seven cities have considered it and all approved by unanimous
vote. It was noted the cities of Downey and Maywood are considering the matter tonight.
ADMINISTRATIVE REPORTS
GEOGRAPHICAL INFORMATION SYSTEM (GIS) BASED TRAFFIC SAFETY
MANAGEMENT SYSTEM
Mr. Alvarez mentioned the City applied for a grant in January 2002 from the California Office
of Traffic Safety along with 540 other applicants and was the recipient of a $53,000 grant. He
explained the purpose of the grant is to develop a traffic safety management system that would
operate as part of the City’s GIS system and would provide the digital framework to collect and
compile traffic collision data. The software will work with the City’s present system and will
facilitate timely and accurate information upon which to base engineering, enforcement, and other

traffic related safety decisions. He noted a request for proposals was issued, with one proposal
received, and staff is recommending a contract be awarded to Crossroads Software for the
development of a GIS-Based Traffic Safety Management System. He responded to comments aom
the Council.
It was moved by Council Member McCarthy, seconded by Council Member Cartozian, and
unanimously carried to authorize the Mayor to execute a Professional Services Agreement with
Crossroads Software in the amount of $53,000 for development and implementation of a GIS-
based traffic safety management system; and appropriate grant funds in the amount of 553,000.
OTHER BUSINESS - Consent Calendar - Items removed by Council Approval
CASH CONTRACT NO. C.C. 626 – HVAC (HEATING, VENTILATION AND AIR
CONDITIONING) AIR DUCT CLEANING AND SYSTEM REFURBISHING
Lennie Whittington, 8542 Manatee Street, stated the staff report does not mention whether
this work will go out to bid and was advised staffs recommendation is that the Council grant
authority to advertise for bids.
Prior to the vote, it was noted Council Member McCarthy had left the dais.
It was moved by Council Member Cartozian, seconded by Council Member Perkins, and
unanimously carried (4-0) to approve specifications and grant authority to advertise for bids on
Cash Contract No. C.C. 626 for heating, ventilation and air conditioning (HVAC) duct cleaning
and system balancing for Civic Center facilities.
AMENDMENT TO JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT
PROGRAM (JAIBG)
Council Member McCarthy returned to the dais.
Council Member Perkins mentioned this program was originally funded by a State grant of
approximately $100,000 and was a successful program but grant funding ran out. He inquired if the
Gangs Out of Downey Committee (GOOD) picked up half the funding at that time and Chief Finch
advised it was agreed during last year’s budget session that the City would seek additional grant
funding to continue this program and the GOOD Committee, the School District and the City would
also supply funding. Council Member Perkins stated his understanding that the GOOD Committee
was supplying $25,000 and the remainder would be shared between the City and School District. He
commended Stan Hanstad of the School District for securing the new $150,000 grant. Chief Finch
noted the $150,000 was in addition to a $25,000 grant the City had already received. Council
Member Perkins noted the GOOD Committee and School District are now not contributing funding
to the program but the City is still contributing $19,491 and he felt the partnership should still be
upheld with the City and School District splitting the $19,491 balance.

Chief Finch explained the grant came in after a plan was already set up. He noted initial
funding required General Fund money from the School District and the City, as well as funding from
the GOOD C'ommittee. After review, it was found matching funds were available in the Asset
Forfeiture Fund and the GOOD Committee then rescinded its offer and will hold funds for the 2003-
2004 budget year when the new grant will not be available. It was also felt the use of Asset Forfeiture
funds would release General Fund money for other uses by the School District and the City.
It was moved by Council Member Perkins, seconded by Council Member Bayer and failed by
the following vote, to split the $19,491 matching grant amount with the School District.

Prior to the vote, Council Member Cartozian requested an explanation as to why the School
Safety Program increased from $100,000 to $194,000 and Chief Finch advised the program cost is
still the same and the one-time grant was sought to incorporate other programs consistent with the
grant application. The Chief noted the State was impressed with the high school program and the
citation program and afforded parameters allowing the use of funds in different ways. He advised the
City budgeted 8155,000 for personnel costs and 539,000 for one-time equipment purchases, noting,
the funding will be utilized for truancy sweeps, one-time direct administrative costs, such as citation
printing in the citation program, one-time equipment purchases, such as uniforms that officers wear,
and administrative overhead, in addition to the high school program. He pointed out the funds will go
back to the State if they are not used.
Council Member Cartozian noted the new State grant expands the resources within the Police
Department and felt partnerships are not always purely economical. He noted most of the grant effort
was made by the School District and pointed out the GOOD Committee personnel are harbored and
mobilized by the School District. He mentioned the figure appropriated by the City is lower than
originally anticipated and felt it was still a partnership.
Council Member McCarthy was in support of staffs proposal but wanted to make it clear to
the GOOD Committee and School District that the City expects the financial level of cooperation
next year that was forthcoming in the past. He felt this grant was a rare opportunity that can be put to
good use
Mayor Trejo echoed the comments of Council Member McCarthy and felt the grant will
enable the City and the School District redirect hInds elsewhere.
Council Member Perkins referred to State budget deficiencies and requested the School
District be asked to appropriate half of the $19,491.
Council Member Bayer concurred with Council Member Perkins.
Council Member Cartozian inquired if a match was required at the local level for the grant
and was informed a match of approximately 10 percent was mandatory.

Council Member McCarthy asked if the match had to come from the City or could come from
another agency. Mr. Vose advised the School District could make a contribution to the City that
could be implemented as part of the grant but the City will be the one to make the payment directly to
the grant.

carried by the following vote to adjust the City budget for the School Safety Police Program as
shown on the staff report, with the amendment that it be made clear to the School District it is
expected to participate financially in the future and possibly in the present, if it can help the
City backfill its outlay on the grant.

ORAL COMMUNICATIONS
Patricia Alvarez Sahagun, Regional Representative for the League of California Cities
Gateway Cities Region, spoke about the League’s “grass roots network” to encourage cities to
participate more in State politics and State budget issues, and form coalitions with community
organizations and others who can help present their case to State Legislators. She noted a coalition
was also formed called the “Local Coalition,” which is made up primarily of the League and
California State Association of Counties and Special Districts. She referred to State budget cuts and
noted the “Local Coalition” advocates for the protection of local government services and is
advocating the restoration of vehicle license fees to their previous levels, which would raise $4 billion
in revenue for the State, which they feel is necessary. She hoped the Downey Council would support
this locally and in Sacramento and asked the City to lobby its State Legislators.
The following people spoke regarding the Police Pursuit that resulted in the death of
Gonzalo Martinez and related issues.

MANAGEMENT COMPENSATION PLAN – CITY CLERK
Lennie Whittington, 8542 Manatee Street, mentioned discussing this topic with the Personnel
Department, stating he was informed executive management positions are entitled to salary increases
of 0 to 10 percent at the time of performance evaluations. He inquired if the City Clerk will receive a
salary increase in addition to the $300 per month automobile allowance mentioned in the Discussion
section of the staff report.
Council Member Perkins commended the City Clerk for doing an outstanding job and noted
her performance was evaluated last month and it was decided a $300 per month automobile
allowance was in line. He referred to the prior speaker’s comment regarding information supplied by
the Personnel Department and suggested the Council might want to review whether a performance
increase of 0 to 10 percent should also be considered.
Council Member Cartozian referred to the other Department heads who receive automobile
allowances, stating this is a common practice in many cities, and noted it was found the City Clerk
was the only department head position not receiving the allowance and it was felt the City Clerk
position should be brought in line.

The Resolution was read by title only. It was moved by Council Member Perkins,
seconded by Council Member Cartozian, and unanimously carried to waive further reading
and adopt.
OTHER BUSINESS - Council Members
Council Member McCarthy thanked Ms. Alvarez Sahagun for her presentation on behalf of
the League of California Cities. He noted the League has been a good advocate for Downey and all
cities in California. He advised he will review the proposal to reinstate vehicle license fees and
referred to a list received regarding decreased funding in areas, such as Library services, local street
and road maintenance funds, and State funded mandates.
Council Member McCarthy referred to a letter from SEAACA (Southeast Area Animal
Control Authority) complimenting Pastor Glenn Kravig for counseling their employees after the death
of a fellow employee.
C'ouncil Member McCarthy complimented the Downey Chamber of Commerce for the
Holiday Lane Parade last Sunday. He mentioned the frame of the Downey rose float that was in the
parade and noted the Rose Float Association will need a lot of help before January 1st to decorate the
float and he encouraged everyone to participate.

Council Member McCarthy mentioned participating in the Downey Rose Float Association’s
“Night of a Thousand Stars” to raise money for the community. He noted the Pasadena Rose
Parade is broadcast around the world and gives the world a great perception of the city.
Council Member McCarthy wished everyone and their families a Merry Christmas and
Happy New Year.
Council Member Canozian mentioned attending the Downey Unified School District’s
celebration for the retirement of School Board Member Margo Hoffer after 23 years of service.
Council Member Cartozian introduced new Los Angeles Times staff writer Akila Johnson
who will be covering our community.
Council Member Bayer complimented students who participated in the Used Oil
Recycling Calendar contest and their parents for supporting them.

Council Member Perkins introduced District 2 Planning Commissi crier Steve Allen.
Council Member Perkins thanked everyone who attended the Council Reorganization
Meeting last week. He complimented Barbara Hruden, Secretary to the City Malager9 for putting
together the memory book commemorating his year as Mayor and also thanked Christina Vogel for an
outstanding job of organizing the event.
Council Member Perkins thanked Patricia Alvarez Sahagun of the League of California
Cities for attending the meeting and welcomed her to the City.
Council Member Perkins mentioned the retirements of Director of Community Services
Jim Jarrett and City Librarian Victoria Jenkins after many years of service to the City and stated
they will both be missed.
Council Member Perkins requested a budget study in February 2003 to consider adjustments
after the State’s budget cuts are known.
Council Member Perkins congratulated Mayor Trejo and noted it has been a pleasure
working with him this past year and stated he looked forward to the coming year.
Mayor Trejo acknowledged his friend Kevin Copeland in the audience.
Mayor Trejo thanked Director of Community Services Jim Jarrett for 30 years of
commitment to the City and also thanked City Librarian Victoria Jenkins for her service, noting
retirement parties will be held next week.
Mayor Trejo thanked his Council colleagues for their support and noted he looks forward to
next year. He also commended Ms. Vogel, Assistant to the City Manager, for her skill in completing
assignments in an organized and expeditious manner.
Mayor Trejo wished everyone a Merry Christmas and Happy New Year.

Mr. Caton echoed prior comments regarding the retirements of City Librarian Victoria
Jenkins and Director of Community Services Jim Jarrett. He noted Mr. Jarrett is the last of the
original Department heads since he was hired as City Manager and stated no Department head has
been more helpful to him and he will be missed.
