It was moved by Council Member/Commissioner Winningham, seconded by Council
Member/Commissioner Cmtozian, and so ordered approve the Closed Session Minutes of
August 27, 2002.

Mayor/Chairman Perkins announced the Council/Commission is recessing to Closed Session

The City Council of the City of Downey held a regular meeting at 7:50 p.m., September 10,
2002, in the Council Chamber of the Downey City Hall, Mayor Meredith H. Perkins presiding.

PRESENTATIONS
Mayor Perkins read a Proclamation declaring September 11, 2002, as Patriot Day, in
honor of those who lost their lives on September 1 1, 2001, at the World Trade Center towers in New
York, the Pentagon in Virginia, and in fields in southwestern Pennsylvania, and to all the men and
women in uniform who have lost their lives fighting terrorism around the world.
Mayor Perkins noted a Certificate of Appreciation for Louis Apodaca for his service on the
Recreation and Community Services Commission and Golf Course Authority for District 1. (Mr.
Apodaca was not present.)
Mayor Perkins mentioned that representatives of various elected officials serving Downey are
present tonight to honor a group in the City called the Transformation Values Movement and called
upon Pastor Frank Campos to accept the presentations.
Pastor Frank Campos introduced Pastors Glenn Koons, Steven Jordan, and George Cade from
the Christian Businessmen’s Committee.

Council Member Winningham presented to the Christian Businessmen’s Committee and
members of the Downey clergy a Proclamation declaring the week of September 16 through 22,
2002, Transformation Values Week. He noted this is the second anniversary of Transformation
Values Week wherein the business community, churches, political leaders, and residents work
harmoniously to promote traditional American family values.
Talya Strauss, representing Assemblywoman Sally Havice, presented a Proclamation/-
Certificate of RecogniTion to the Christian Businessmen’s Committee and clergy of the City of
Downey.
Council Member Cartozian, representing Assemblyman Tom Calderon, presented a
Proclamation to the Christian Businessmen’s Committee.
Rudy Montalvo, Field Representative for Assemblyman Marco Firebaugh, presented a
Certificate of Recognition to the Christian Businessmen’s Committee of Downey.
Barbara Baiz, Deputy for Los Angeles County Supervisor Don Knabe, presented to the
Christian Businessmen’s Committee a Proclamation in recognition of Transformation Values Week.
She also commended young Ms. Campos for her rendition of the National Anthem, referred to the
events of September 1 1, 2001, and stated the importance of family has led to a renewed shift in
values. She referred to a post September 1 1 survey where 77 percent of those polled stated spending
time with family has become their number one priority.
Connie Sziebl, Deputy for Congressman Steven Horn, presented a Certificate of Recognition
to the Christian Businessmen’s Committee.
Mayor Pro Tem Trej o, representing Senator Betty Karnette, presented to the Christian
Businessmen’s Committee, a Certificate of Recognition.
Pastor Frank Campos of Living Hope Church, Downey, thanked the Council for their support
of this movement, his wife Katie and children Michael and Candice, and the Transformation Value
Committee members who made this effort to restore the value that made this nation great to begin
with possible.
Pastor Glenn Koons of Living Hope Church, Downey, noted the Council is willing to work
with the churches and business people in town in a united way. He stated the pastors pray for the
City’s officials and hope the community looks to the churches as partners. He urged everyone to
attend the commemoration service tomorrow night at 7:00 p.m. at the Downey Civic Theatre.
Council Member McCarthy, on behalf of the City and the Southeast Los Angeles County
Workforce Investment Board (SELACO WIB), presented a Certificate of Appreciation to Dan Fox
for his service as Downey’s Private Sector Representative on the Southeast Los Angeles County
Workforce Investment Board (SELACO WIB) from July 1, 2000, to June 30, 2002, and thanked
him for his outstanding commitment. He noted Downey works with six other cities to create job
opportunities for people who cannot always find work. He noted Johnny Croshaw will be replacing
Mr. Fox as the City’s representative on this Board.

Mr. Fox thanked the Council for their commitment to helping people throughout the Southeast
area find jobs and thanked the Council for the opportunity to serve the City on the SELACO WIB.
HEARINGS
Mayor Perkins opened the public hearing on CONDITIONAL USE PERMIT NO. 02-08
AND ZONE VARIANCE NO. 02-27 FOR PROPERTY LOCATED AT 7423 FIRESTONE
BOULEVARD (FIRESTONE CAR WASH) – A CONDITIONAL USE PERMIT FOR THE
EXPANSION OF AN EXISTING CAR WASH FACILITY, AND A ZONE VARIANCE
RELATING TO REAR YARD SETBACKS ON PROPERTY ZONED C-2 (GENERAL
COMMERCIAL, which was continued from the Council Meeting of August 27, 2002.
There was no correspondence received regarding this matter.
Mr. Yoshiki advised this hearing was continued from the last Council Meeting at which time
the Council directed staff to bring back guidelines for the use of canopy type structures at car wash
and car detailing facilities. He revisited slides from the previous meeting, which depicted the
temporary canopies at the subject site and noted the Planning Commission had approved the
applicant/appellant’s request for a CUP and ZV, with the condition that Canopy No. 1 along Firestone
Bouldvard be relocated and the applicant/appellant appealed the condition placed on Canopy No. 1.
He advised the applicant agreed to a continuance of the matter to afford staff time to formulate
criteria for placing canopies in this area, while optimizing and promoting the visual streetscape. He
reviewed criteria listed in the staff report for canopies within fifty feet of the public right-of-way,
noting canopies outside the 50-foot public right-of-way may reflect a simpler design. He stated the
idea was not to formulate a specific design but to outline design perimeters. He referred to staffs
concerns regarding the types of materials used for canopies but noted manufactures usually specify a
time period when materials should be replaced and this time frame will be noted on the initial permit.
He responded to comments from the Council.
Council Member McCarthy inquired if there was anything on record regarding sound emitted
from car washes and the response was no but all businesses are required to comply with the City’s
Noise Ordinance.
Mr. Yoshiki pointed out a correction on the Resolution for Conditional Use Permit No. 02-08
in Section 2., A., stating the last sentence should read “In addition with the conditions requiring the
proposed detail canopy to comply with the City’s design criteria, any possible impacts would be
further reduced.”
Mayor Perkins asked if the applicant/appellant, or his representative, wished to come forward
and make any comments at this time.
Susan Kim, 10001 Anington Avenue, Downey, inquired if the proposed Ordinance is adopted
tonight, would it be applied consistently to all car washes and will her family’s issue be concluded.
Mayor Perkins advised the criteria noted applies to all car washes equally and, if approved, the
CUP and ZV before the Council will conclude her family’s appeal process.

Mayor Perkins asked if anyone wished to speak in favor of or in opposition to Conditional
Use Permit No. 02-08 or Zone Variance No. 02-27.
There being no one to speak, it was moved by Council Member Cartozian, seconded’by
Council Member Winningham, and unanimously carried to close the public hearing.
RESOLUTION NO. 6597

APPROVING THE APPEAL AND APPROVING CONDITIONAL USE
PERMIT NO. 02-08 FOR THE EXPANSION OF AN EXISTING CAR WASH
FACILITY FOR PROPERTY LOCATED AT 7423 FIRESTONE
BOULEVARD, ZONED C-2 (GENERAL COMMERCIAL)
The Resolution was read by title only. It was moved by Council Member
McCarthy, seconded by Council Member Winningham, and unanimously carried to waive
further reading.
It was moved by Council Member Cartozian, seconded by Council Member Trejo,
and carried by the following vote, with the language changes previously noted in Section
2., Part A., last sentence, to adopt.

The Council assured the Kim family, owners of Firestone Car Wash, the criteria
presented by staff will be applied consistently to all car wash and car detailing facilities in
the City
Prior to the vote, Council Member McCarthy inquired if a permanent canopy would
require a pitched roof and was informed it may and staff will work with each applicant to
obtain a design that sustains the design window for their particular property. He also
inquired if the Resolution could be adopted with existing car wash facilities grandfathered
in and new criteria applied only to new applicants and was advised the addition of canopies
is an expansion of the activity and requires the initiation of the CUP process on a case by
case basis.

AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DOWNEY, CALIFORNIA, TO CREATE A MORATORIUM ON THE
ACCEPTANCE, PROCESSING OR THE APPROVAL OF
DEVELOPMENT, BUILDING OR USE PERMITS, LICENSES, AND TAX
CERTIFICATES FOR USED CAR SALES RETAIL DISPLAY AND USED
CAR SALES OFFICES WITHIN THE CITY OF DOWNEY WITHOUT
OBTAINING A CONDITIONAL USE PERMIT
Mr. Yoshiki explained staff was directed by the City Council to bring back detailed
information regarding the land use involving used car lots and the consideration of a
moratorium on this type of business. He pointed out the staff report identifies 22 used car
dealers within the City, many of which are located along Firestone Boulevard. He also
noted there have been numerous inquiries to establish used car brokerage type offices,
which are then expended to used car businesses and pointed out a number of integral
commercial sites in the City are being absorbed by this land use. He noted staff reviewed
the Downey Municipal Code as it relates to this land use in respect to set back issues,

display areas, customer parking, and the overall appearance of these facilities, and
determined that presently there are not adequate standards in the Code addressing this type
of land use. Staff is suggesting an urgency ordinance to place a moratorium on this land
use for a period of 45 days, during which time this use cannot be established without a
conditional use permit. He explained this time period could be expanded two times
through the public hearing process per Government Code Section 65858. He responded to
comments from the Council.
Mayor Perkins referred to the last paragraph on Page 1 of the Agenda Memo, stating
he felt is should read “create a moratorium to prohibit used car lots” and not “create a
moratorium to prohibit used car sales,” to which staff agreed.
Council Member Cartozian referred to the extension process and questioned if staff
felt 45 days was enough time for them to generate appropriate standards. He was informed
staff may require additional time and the Government Code provides for two extensions,
one for 10 months and 15 days and then one for an additional 1 year.
Council Member McCarthy commended the report by staff and felt the proposal is a
good idea. He inquired if the downtown overlay zone allows used car sales and noted, if it
does, he felt it should not. He was informed it does not.
Mayor Perkins noted some of the used car lots do not have parking and felt there
should be some offsite parking for these facilities.
The Ordinance was read by title only. It was moved by Council Member Winningham,
seconded by Council Member McCarthy, and unanimously carried to waive further reading and
adopt.
Prior to the vote, Council Member Cartozian commented for the record that this Ordinance
does not disallow used car sales but will create specific standards for used car sales, which the City
does not presently have, and which are a necessity, with the burgeoning supply and disproportionate
number of used car lots versus new car lots.

AMENDMENT TO AGREEMENT WITH CLAYTON GROUP SERVICES
SUPPLEMENTAL HEALTH RISK ASSESSMENT FOR THE PROPOSED PARK AT
THE NASA SITE
Council Member Cartozian referred to the health risk assessment and noted the proposed
future use of this site for a school, even though the school District has not made any formal request to
date. He noted he presumed the environmental standards for a school are probably higher than for a
park

Mr. Jarrett advised the environmental assessment required for a School District is dealt with
separately, as the School District must go through Education Code Section 17210-17224, which is a
very extensive process and takes from 2-1/2 to 3 years to complete. The School District must
undertake the process, as the City cannot act on its behalf. He noted the City wishes to move forward
with the environmental assessment for the park usage, which can be accomplished within a relatively
short period of time and has advised the School District it will share its report with them when it is
received and they can make an evaluation as to whether they wish to move forward with the
additional assessment required for a school.
Council Member Trej o supported this program and felt it will benefit many children and
adults in the area and will alleviate some of the use of school facilities for youth athletic programs.
It was moved by Council Member Winningham, seconded by Council Member Cartozian, and
unanimously carried to approve an amendment to the agreement with Clayton Group Services
dated February 12, 2002, to perform a supplemental health risk assessment for the proposed
park at the NASA site for a fee not to exceed $30,000; and appropriate $30,000 from the
General Fund.
Council Member McCarthy commended the approval of this report for a park at the former
NASA site and felt it is a good benefit for the community.
SAFE ROUTES TO SCHOOL (SR2S) – DE PALMA STREET (S.S. 534, ACCOUNT
NO. 26-16543)
Council Member Cartozian noted this is something that has been needed for a long time. He
noted he was a substitute teacher at Warren High School and knows how dangerous it is to exit from
De Palma Street onto Downey Avenue. He felt the installation of a traffic signal, which is part of this
grant, will be greatly appreciated and complimented Engineering for successfully promoting another
school route improvement program.
Council Member Trejo was in favor of this project and complimented the Public Works
Department. He also urged a review of elementary school sites for future Safe Route to School
grants
Council Member McCarthy referred to a previous Safe Routes to School project, the
crosswalk installed on Brookshire Avenue just north of Imperial Highway, and inquired if there has
been any follow-up in terms of activity, crossings, safety, etc.
Mr. Alvarez advised that nothing has come to his attention as far as complaints and Chief
Finch noted he too has not received any complaints but would make an inquiry and get back to the
Council

RESOLUTION NO. 6600
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING PROGRAM SUPPLEMENT NO. M016 TO THE CITY OF
DOWNEY-STATE MASTER AGREEMENT NO. 07-5334, FOR THE
CONSTRUCTION OF A TRAFFIC SIGNAL, FLASHING BEACONS, AND
SIDEWALK, IN THE VICINITY OF WARREN HIGH SCHOOL
It was moved by Council Member McCarthy, seconded by Council Member
Cartozian, and unanimously carried to waive further reading and adopt.
It was moved by Council Member McCarthy, seconded by Council Member
Winningham, and unanimously carried to authorize the Mayor to execute a Professional
Services Agreement with FPL and Associates, Inc. in the amount of 816,500 for
preliminary engineering (design) work.
OTHER BUSINESS - Council Members
Council Member McCarthy mentioned attending the opening day of Downey Razorbacks’
football last Saturday with the Mayor and noted the Police and Fire Chiefs were also in attendance.
Council Member McCarthy announced he would be honoring September 11th tomorrow
with the rest of the City and the rest of the Country, to recognize the courage and sacrifice of our
crtlzens
Council Member Wirmingham complimented the Downtown Subcommittee for an excellent
job on the Downtown banner selection.
Council Member Winningham announced he had front row tickets for the September 11th
memorial tribute at the Downey Civic Theatre tomorrow night.
Mayor Pro Tem Trej o mentioned he has noticed a proliferation of abandoned shopping carts
and requested a meeting be arranged with the contractor, himself and Lee Powell.
Council Member Winningham also stated he has seen a proliferation of shopping carts on
Suva Street and has called but noted carts are not picked up within the 48-hour time frame after his
call and require a second call.
Council Member Cartozian recognized District 4 Candidates for the November 5th General
Municipal Election in attendance: Anne Marie Bayer, Maria Larkin and Craig Schwerdt.
Council Member Cartozian recognized a visitor in the audience, Linda Khatchatorian.
Council Member Cartozian acl,mowledged the events of last September 11th as being one of
the four major events in American history that have shaped the Country and noted everyone’s prayers
are with the United States tomorrow.
