Director of Community Dev./City Planner William Davis, Business Development Manager Mark Dryer, Police Captain Christina Vogel, Assistant to the City Manager Steven Yee, Economic Development Coordinator PRESENTATIONS: None HEARINGS Mayor Perkins opened the public hearing on LIGHTING AND LANDSCAPING DISTRICT A.D. 121 – RESOLUTION CONFIRMING 2002-03 DISTRICT ASSESSMENT. Ms. Midstokke affirmed receipt of the Proof of Publication and Affidavit of Posting of Notice. It was moved by Council Member Winningham, seconded by Council Member McCarthy and so ordered to receive and file. There was no correspondence or protests received regarding this matter. Council Minutes 6/1 1/02 -1- 0141 b' q r 1 it Mr. Alvarez explained that this assessment finances the annual operation and maintenance costs of the street lighting system and landscaping ofmedians and the public right of way. He noted the City has approximately 5,418 streetlights, the majority of which are owned by Southern California Edison and 673 streetlights owned by the City. The financing for the operational costs of the streetlights is funded through the Landscaping and Lighting Act of 1972. In addition to streetlights, this assessment also allows for the financing of landscaping and maintenance, which includes all tree trimming and maintenance of landscaping on medians and parkways. The assessment district consists of seven zones and the recommendation is to set the assessments at the same levels set last year when the assessments were raised in some of the zones to cover the increased cost of electricity. Since this cost has stabilized, there is no need to increase assessments. He referred to the tables summarizing the assessment zones, energy rates, financial summary and history of assessment collection and responded to comments from the .Council. Council Member McCarthy referred to the 189 new streetlights installed along Imperial Highway and inquired if they are included and was informed the operational costs are included. He was informed they are in Zone III, Public Roadways, and are owned and maintained by the City. Council Member Winningham asked if the City monitors electrical costs by controlling the time streetlights are on and was advised the City controls the cost for lights that are direct metered but the majority are owned by Southern California Edison, and are on a flat charge rate. It was noted rates are set by the Public Utilities Commission, with a schedule of charges for Edison owned lights and a different rate for metered lights. He surmised that the City is still paying the flat rate for streetlights that are non-operational and inquired about Edison’s maintenance procedures for lights that are burned out, noting it is to Edison’s advantage not to replace these bulbs. He was informed Edison’s stated policy is that they replace the lights as soon as they are aware of them. He questioned who is responsible to make Edison aware that lights are burned out and was informed it is Edison’s responsibility but that the City also works to bring burnt out lights to Edison’s attention. He requested the Mayor direct staff to look into Edison’s procedures of monitoring as he felt they are not doing a sufficient job. He stated if the City is paying a flat fee for lights, the lights should be operatIng. Council Member Cartozian inquired how the zones are determined and was informed there is a map on file that ties the zones together. Council Member Trejo asked how it came about that the City owns lights and was informed all the lights along Imperial Highway and the new lights in the downtown area are City owned circuits. He referred to Appendix A-1 and the number of parcels listed for 1-20 units, noting it is much larger than the number of parcels listed for 21-60 units. He was informed the 10,572 fiWre represents residences in the City that have from 1-20 units, which is the majority of units in the CitY. Mayor Perkins asked if there was anyone present who wished to speak in favor or in opposition to the 2002-03 District Assessment. There being no one to speak in favor or in opposition to the 2002-03 District Assessment, it was moved by Council Member Winningham, seconded by Council Member Cartozian and so ordered to close the public hearing. RESOLUTION NO. 6572 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE 2002-2003 FISCAL YEAR ASSESSMENT FOR LIGHTING AND LANDSCAPING DISTRICT A.D. 121 The Resolution was read by title only. It was moved by Council Member Winningham, seconded by Council Member Cartozian, and unanimously carried to waive further reading and adopt. Mayor Perkins opened the public hearing to CONSIDER THE APPLICATION OF MAIN CITY TAXI FOR A PERMIT TO CONDUCT TAXICAB SERVICE IN THE CITY OF DOWNEY. Ms. Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Winningham, seconded by Council Member Cartozian, and so ordered to receive and file. There was no correspondence received regarding this matter. Ms. Vogel explained that further review of this application disclosed the omission of some information and staff is recommending the hearing be continued until the Council Meeting of July 9th to allow the applicant time to submit this information and to give staff time to review it. Mayor Perkins asked if anyone present, who could not attend the Council Meeting of July 9th, wished to speak in favor or in opposition to the proposed application. It was moved by Council Member Winningham, seconded by Council Member Cartozian and unanimously carried to continue the public hearing to the Council Meeting of July 9th. CONSENT CALENDAR - ITEMS FOR REMOVAL Agenda Item 7, CASH CONTRACT NO. 629 – BELLFLOWER BOULEVARD IMPROVEMENT PROJECT, was removed at the request of Council Member McCarthy. (See statement by Mr. Caton below continuing this Item). Agenda Item 6, CASH CONTRACT NO. S.S. 498 – IMPERIAL HIGHWAY STREET LIGHTING, was removed at the request of Council Member Winningham. Agenda Item 9, PUBLIC HEARING FOR THE APPEAL OF CERTAIN CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO. 02-08 AND ZONE VARIANCE NO. 02-27, was removed at the request of Council Member Cartozian. She noted the Code currently prohibits owners from allowing dogs to defecate on any public property but does not prohibit that behavior in a street gutter. She advised the City does not want this matter to enter storm drains and receiving water bodies, particularly with the new heavier requirements relating to the National Pollutant Discharge Elimination System (NPDES) Permit, with cities being responsible for eliminating different types of bacteria found in receiving water bodies. She referred to Page 2 of the staff report, noting the last paragraph describes the language being added and removed. Council Member Trej o inquired where bacterial information was obtained and was informed it was provided by Mr. Green in the City’s Engineering Department. Council Member Winningham complimented the City Manager and Assistant to the City Manager for noticing this provision of the Downey Municipal Code and for correcting it. Council Member McCarthy inquired how prosecution on this issue would be carried out. Council Minutes 6/11/02 014 1 '? 8 Mr. Alvarez advised violators would be referred to the City Prosecutor in the event the act was observed and the party at fault was identified. The City Prosecutor would then proceed to prosecute. Mr. Vose noted the property owner has civil rights. The party would make a complaint with the City and the City’s Code Enforcement Division would be involved. ORDINANCE NO. It was moved by Council Member Winningham, seconded by Council Member Cartozian, and unanimously Qarried to waive further reading and introduce. RESOLUTIONS: None ADMINISTRATIVE REPORTS UNDERGROUND UTILITY DISTRICT NO. 17 EASEMENT IMPERIAL HIGHWAY (PHASE II) – GRANT A UTILITY EASEMENT TO SOUTHERN CALIFORNIA EDISON Mr. Alvarez referred to the underground utility district in place on Imperial Highway where the City is in the process of removing the overhead electrical wires, advising this district is broken down into three phases. He noted Phase I is near completion with most of the overhead electrical wires now gone and with poles coming down shortly. Phase II begins at Ardis Avenue and runs to the easterly City limit and work on this phase is beginning, with poles anticipated to be down by the end of the year. He pointed out one issue associated with undergrounding of overhead lines is that new lines have to be installed underground and the power company and other utilities require easements to take their connections up to the point of service. He noted the subject property is a well site on Imperial Highway and the City’s service cabinet that Southern California Edison must feed is at the back of this well site. The City needs to provide an easement for Edison to install buried cables, as well as an access easement for future maintenance of the cabinetry. He noted the recommendation is that the Council grant a utility easement to Southern California Edison on City property at 9151 Imperial Highway. He responded to comments from the Council. Mayor Perkins complimented Mr. Alvarez and Hector Bordas for an outstanding job in this process. He pointed out the City had a press release a week ago where the first pole was removed, noting it had originally been installed in 1959. It was moved by Council Member Cartozian, seconded by Council Member McCarthy, and unanimously carried to grant a utility easement to Southern California Edison on City property located at 9151 Imperial Highway. Council Minutes 6/11/02 -6- Q lil '; ’. I OTHER BUSINESS – Consent Calendar – Items removed by Council Approval CASH CONTRACT NO. S.S. 498 – IMPERIAL HIGHWAY STREET LIGHTING (ACCOUNT NO. 26-16498) Council Member Winningham stated this is a good project instigated by Council Members McCarthy and Perkins. He noted Edison attempted to take the funding away but the City was persistent and brought the project back on track. He complimented staff noting the project was completed a half million dollars under budget. Council Member Cartozian inquired as to how the project came in under budget and was informed it was partially due to the funds estimated, noting the City was fortunate in the final design and was also due to the fact the City selected a less costly light pole than originally anticipated. Council Member Winningham questioned how elimination of the metered poles saves the City money and was informed this information will be provided at a later time. It was moved by Council Member Wirmingham, seconded by Council Member Cartozian, and unanimously carried to accept the improvements constructed and the maintenance responsibility for the work completed under Cash Contract No. S.S. 498 – Imperial Highway Street Lighting. Prior to the vote, Council Member McCarThy stated he felt it was assertive action with Southern California Edison and other utilities to make this happen. He noted there has been some disruption and inconvenience in this process but it has benefited the City visually and has enhanced property values along Imperial Highway. APPEAL OF CERTAIN CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO. 02-08 AND ZONE VARIANCE NO. 02-27 – A CONDITIONAL USE PERMIT FOR THE EXPANSION OF AN EXISTING CAR WASH FACILITY, AND A ZONE VARIANCE RELATING TO REAR YARD SETBACKS FOR PROPERTY LOCATED AT 7423 FIRESTONE BOULEVARD (FIRESTONE CAR WASH), ZONED C-2 (GENERAI, COMMERCIAL) Council Member Cartozian requested staff supply the minutes and specifics detailing the conditions the applicant has problems meeting that were specified by the Planning Commission last week It was moved by Council Member Cartozian, seconded by Council Member McCarthy, and unanimously carried to set the public hearing for the appeal of Conditional Use Permit No. 02-08 and Zone Variance No. 02-27 for 7:30 p.m., June 25, 2002, in the Council Chamber of Downey City Hall. Council Minutes 6/11/02 -7- 0141 dti AGREEMENT WITH LEHMAN-ENGLISH AND ASSOCIATES FOR GENERAT , ADVOCACY SERVICES IN SACRAMENTO Mayor Perkins mentioned he had a lengthy conversation with the City Manager regarding this agreement, which resolved most of his questions. He noted his primary concern was that a staff member was devoting all of his time to water issues and that all correspondence was directed to a staff member instead of the City Manager. He requested all future correspondence be directed to the City Manager, with copies then distributed to staff. He mentioned his concern that a City representative in Sacramento was not invited to intervene and be a part of the Boeing project. He noted this has now been corrected and this person will take an active part to insure the Governor does hear about the City’s project on the former Boeing property. He requested the following changes to the contract: He noted the contract was for nine months and this gentleman has been representing the City since April and he would like to leave the term at nine months from the original submission date in April; and he referred to Section 26. Modification of Agreement. requesting the wording “City Manager” be removed from line two and “City Council“ inserted. He noted the remainder of the contract would remain the same. Council Member Winningham mentioned receiving a monthly update from Mr. Lehman and felt it was important this information continues to be supplied on a monthly basis. He suggested it be directed to the City Manager with copies to key department heads. It was moved by Mayor Perkins, seconded by Council Member Cartozian, and unanimously carried to authorize the City Manager to execute the Agreement with Lehman-English and Associates for general advocacy services in Sacramento, with amendments as noted. Mayor Perkins apologized for this omission. Council Member Wimringham advised the speaker the item was introduced tonight and will be brought back for adoption at the next Council Meeting where additional comments can be made. Council Minutes 6/11/02 -8- ' 0141 dl Mayor Perkins referred to the statement he read a couple of meetings ago regarding the investigation into the Gonzalo Martinez incident and noted the City is still awaiting the reports from the District Attorney and Federal Bureau of Investigation. OTHER BUSINESS - Council Members Council Member McCarthy noted a Budget Study Session was held on June 4th and commended staff and the members of the public who participated. Council Member McCarthy advised the Downey Civic Light Opera opened their production of Man of La IVIancha, which will run for the next two weekends. He noted it was a great performance and urged everyone to attend. Council Member McCarthy announced that tomorrow morning the Citizens for Downey Committee will meet at 7:00 a.m. at the Rio Hondo Country Club, with guest speaker Bruce Severs, an inspiring poet and patriot. Council Member Winningham mentioned he attended the Greek Festival last weekend. C'ouncil Member Wirmingham thanked the press for their coverage of the Transformation Values march held last weekend. He felt it did an excellent job of bringing people together in unity and supported the values that should be upheld in the community. ('-'ouncil Member Trejo mentioned summer is coming and urged everyone to utilize the recreational programs in the City. He noted the Library has excellent activities and there is an excellent golf clinic at the Rio Hondo Country Club and urged citizens to use the City’s web site to obtain information on these activities. Council Member Trejo thanked Officer Wells, Lieutenant Esteves and Neighborhood Preservation Officer Mark Galvan for meeting with him to discuss gang activity and neighborhood preservation programs in the City. Council Member Cartozian noted school \viII be out for summer vacation soon and students will have more free time. He encouraged them to utilize the recreational activities available in the City (-'ouncil Member Cartozian noted he enjoyed the excellent food at the recent Greek Festival. Council Member Cartozian advised that Friday, June 14th, is Flag Day, which symbolizes the birth of the nation’s flag. He mentioned a trip with his family to the East Coast when he was in fourth grade where they visited the home of Betsy Ross in Philadelphia on Flag Day, June 14, 1983 . Council Member Cartozian requested the meeting be adjourned in memory of Dick Swift, a member of the Downey Tennis Club. Mayor Perkins mentioned attending the Greek Festival and stated the new Greek church is a welcome addition to the newly improved downtown Downey Avenue. Council Minutes 6/11/02 -9- 01418: Mayor Perkins congratulated Mario Guerra on becoming a Deacon at St. Raymond’s Catholic Church, noting he is also a Chaplain for the Downey Police Department. Mayor Perkins mentioned he enjoyed participating in the Keep Downey Beautiful Awards given to proud homeowners who exceptionally maintain their homes and yards.
