The City Council/Community Development Commission of the City of Downey held an
adjourned regular meeting at 6:32 p.m., April 9, 2002, in the Council Chamber of the Downey City

APPROVAL OF CLOSED SESSION MINUTES – MARCH 26, 2002
It was moved by Council Member/Commissioner Cartozian, seconded by Council Member/-
Commissioner Trejo, and unanimously carried (4-0) to approve the Closed Session Minutes of
March 26, 2002.
CLOSED SESSION
Mayor/Chairman Perkins announced the Council/Commission is recessing to Closed Session
(6 :33 p.m.) to discuss matters under the authority of the following Sections of the Government Code:
A. SECTION 54956.9 - Subdivision (b) – Conference with legal counsel – anticipated
litigation – exposure to litigation (two potential cases).
B. SECTION 54956.9 – Subdivision (a) – Conference with legal counsel – existing litigation:
Community Development Commission of the City of Downey vs. Downey Hospitality

the Gonzalo Martinez incident & advised the City is still
awaiting results from the outside agencies investigating the
matter; and also addressed the request for tables, chairs and
sound equipment for the march scheduled 4/20/02 in honor of
Mr. Martinez and noted it has been the City’s policy not to

PRESENTATIONS
Mayor Perkins noted the Appointment of Mike Monaco to the Cable TV Citizens
Advisory Committee, District 5. (Mr. Monaco was not present to receive his Certificate of
Appointment.)
Mayor Pro Tem Trejo presented to Stella Fleetwood of the Exchange Club Family Support
Center, a Proclamation declaring the month of April 2002, National Child Abuse Prevention
Month.
Ms. Georgia Andrews, Executive Director of the Family Support Center, thanked the Council
and City for their support of the Center and for helping to publicize the tragedy of child abuse. She
submitted blue ribbon buttons promoting the prevention of child abuse for the Council and staff to
wear

Mayor Perkins presented to ChiefSauter, a Proclamation declaring the month of April
2002, Emergency Preparedness Month. He announced the Fire Department is holding an
Emergency Preparedness Faire on April 20th at the All American Home Center and Home Depot
businesses on Firestone Boulevard.
Chief Sauter thanked the community and Council for their efforts in emergency preparedness
and urged everyone to attend the Faire on April 20th.
Mayor Perkins presented to Library Aides, James Dawson, Susan Jimenez, and Ana Mendez,
a Proclamation declaring the week of April 14-20, 2002, National Library Week.
Mayor Perkins presented to Eric Oldar, State Forester with the California Department of
Forestry and Fire Protection, and Heather Reynolds, representing State Senator Betty Kamette’s
office, a Proclamation declaring every day during the month of April as Arbor Day. He also
noted Downey has been recognized as a “Tree City USA” by the National Arbor Day Foundation.
Mr. Oldar recognized the City for doing a fine job in making a commitment to urban trees and
noted the City’s “Tree City USA” banner is proudly flying over City Hall. He pointed out only 20
percent of California cities qualified for this award and presented a grant recognition voucher to the
City in the amount of $49,985 to assist in its tree planting efforts.
Ms. Reynolds of State Senator Betty Karnette’s office signed the grant recognition voucher
and it was presented to the Mayor.
HEARINGS
Mayor Perkins opened the Public Hearing on the KAISER PERMANENTE
APPLICATION TO CALIFORNIA STATEWIDE COMMUNITIES DEVELOPMENT
AUTHORITY FOR TAX EXEMPT FINANCING.
Ms. Midstokke affirmed receipt of the Proof of Publication. It was moved by Council
Member Winningham, seconded by Council Member McCarthy, and so ordered to receive and file.
There was no correspondence received regarding this matter.
Mr. George explained this hearing is to receive public comment and to adopt a Resolution
regarding the application submitted by Kaiser Permanente to the California Statewide Communities
Development Authority for certain tax exempt financing. He noted the application was submitted in
the amount of $525,000,000 in revenue bonds to be used for the financing and acquisition of a
number of Kaiser medical facilities throughout the area. He advised Kaiser proposed to use
$24,000,000 of the funds at its 12254 Bellflower Boulevard address in Downey, immediately across
from the NASA site. He pointed out the City, along with 225 other cities, entered into a Joint Powers
Agreement, which led to the creation of the Statewide Communities Development Authority and
noted in order to issue bonds, Kaiser cannot proceed unless the governing body, the Council, accepts
and approves the project and its financing. A public hearing is required and a Resolution approving
the package must be adopted. He noted the Communities Development Authority will be issuer of
the bonds and the City will bear no financial responsibility as a result of the application.

Mayor Perkins asked if there was anyone present who wished to speak in favor or in
opposition to the Kaiser Permanente application for tax exempt financing.
There being no one to speak, it was moved by Council Member Winningham, seconded by
Council Member McCarthy, and so ordered to close the public hearing.
RESOLUTION NO. 6556
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE ISSUANCE OF REVENUE BONDS BY THE
CALIFORNIA STATEWIDE COMMUNITIES DEVELOPMENT
AUTHORITY TO BENEFIT KAISER PERMANENTE
The Resolution was read by title only. It was moved by Council Member McCarthy,
seconded by Council Member Winningham, and unanimously carried to waive further reading
and adopt.
Council Member McCarthy requested clarification about the facility, noting the
application states it is Kaiser’s property and is a pharmacy/warehouse.
Mr. George advised the facility is Kaiser’s regional administrative office building on
Bellflower Boulevard.
Mayor Perkins opened the public hearing on PROPOSED SHARED USE PARKING
AGREEMENT BETWEEN PROPERTIES LOCATED AT 8206, 8222 AND 8224
FIRESTONE BOULEVARD.

REQUEST FOR MARCH AND STREET CLOSURES FOR SATURDAY, APRIL 20,
2002
Mr. Powell advised staff received a request from the “Friends of Gonzalo (Martinez)
Committee” in the form of a letter to hold a march in the City on Saturday, April 20th, closing
Woodruff Avenue (between Florence Avenue and Firestone Boulevard), Firestone Boulevard
(between Woodruff Avenue and Downey Avenue), Downey Avenue (between Firestone Boulevard
and Third Street) and Third Street (between Downey Avenue and the Civic Center). The Committee
also requested police support to insure vehicles do not drive on the closed streets and that a power
source be provided by the City, in the Civic Center area, for sound equipment. He noted this request
is highly unique, stating the closure of streets during the midday on Saturday would create significant
traffic problems on the unclosed portions of the closed streets and along the streets that intersect with
these streets. It was pointed out the closures would impact a regional maII, three shopping centers,
and numerous stores and businesses and would be a major burden on the driving public. He noted
safety is a concern due to the heavy traffic flow in this area, which is approximately 163,960 vehicles
per day. Additionally, 12 to 24 Police Officers would have to be stationed at 23 intersections along
the route to close streets and maintain a safe environment at a cost of $2,200 to $6,600. He advised
that other groups have requested street closures in the past but were told they had to stay off the
streets and must obey all traffic and pedestrian laws. He advised staff recommends the Council
approves the march sponsored by the “Friends of Gonzalo Committee” but does not authorize the
closure of any City streets.
Council Member Winningham inquired if Firestone Boulevard had been closed before and
was informed Firestone Boulevard was once closed in 1959 for a parade, which did not work out
well, and has not been closed since. He recalled as a past Chairman of the Optimist Club’s 5 and 10K
nms that they were denied the use of the streets in the Stonewood Mall area and felt it would set a
precedent to shut down a major boulevard.
Ms. Midstokke noted correspondence received from 15 businesses today in opposition to the
streets being closed for the “Friends ofGonzalo Committee” march.
Miguel Mochess, 8533 Via Amorita, requested the staff report be restated, noting most
members of the “Friends ofGonzalo Committee“ just arrived and did not hear it.
Mr. Powell reiterated the staff report.
Augustin Cevada, Brown Beret, Atzlan, referred to prior City Council Minutes pointing out
speakers regarding the Gonzalo Martinez incident were listed by name, while speakers on other issues
had their comments listed. He stated he felt the City was being foolish to mention the cost for
security for the march while still allowing the officers involved in the incident to remain on the streets
and suggested the Council rethink the City Manager’s proposal. He noted the reason for the march
and stated people have this right under the First Amendment. He noted the Friends of Gonzalo
Committee is in contact with the ACLU (American Civil Liberties Union) and will go to court if the
march is denied. He also referred to other cities that have allowed this type of event.

Norma Martinez, mother of Gonzalo Martinez, stated she received a letter advising that one of
the officers involved in her son’s incident was to receive an award and voiced her displeasure.
Mayor Perkins requested speakers address their comments to the march, noting the
opportunity to speak on items not on the agenda will be given during Oral Communications.
Ms. Martinez requested the City allow the march in memory of her son.
Jennifer Cummins, General Manager of Stonewood Shopping Center, 2755 Mesa Verde
Drive, Costa Mesa, representing the interests of the merchants at the Center, expressed sympathy to
the family and friends ofGonzalo Martinez. She stated it was her understanding that a peaceful rally
to commemorate the life of Mr. Martinez and to raise awareness of the incident was planned and
acknowledged and supported the right to freedom of speech. She requested a compromise on the
street closures, suggesting either an alternate route be taken or that only the sidewalks be utilized.
She pointed out Stonewood Center has 160 merchants and advised the closure of the streets
mentioned, on the busiest day of the week, during the busiest time of the day, would greatly impact
these retailers.
Council Member McCarthy felt self expression is important but can be maintained without
closing streets. He noted there is no precedent for this and felt the sidewalks will be an effective
means to utilize for this event.
Council Member Winningham advised he has participated in the ARC (Association for
Retarded Citizens) Walk for many years and in the Optimist Club’s 5K and 10K nms and noted street
closures were not allowed for these events. He stated he encouraged, acknowledged, and respected
the march as long as pedestrian and traffic laws are complied with.
Council Member Trejo did not feel it would be fair to the other groups who requested street
closures and were denied. He mentioned his concerns for safety and economic impacts.
Council Member Cartozian mentioned he valued the freedom of speech and noted he took part
in marches and protests while a student at the University of California at Berkley. He supported the
recommendation to allow a march but not to grant the closure of streets.
Mayor Perkins encouraged march participants to conduct their march in an orderly manner,
noting another march is planned in the City on the same date that will abide by the same rules.
It was moved by Council Member Winningham, seconded by Council Member Trejo, and
unanimously carried to approve a march sponsored by the Friend’s of Gonzalo Committee, but
not authorize the closure of any City streets.

The following people spoke regarding the recent Downey Police Department vehicle pursuit
involving Gonzalo Fabian Martinez, which resulted in the death of Mr. Martinez, and noted their
disappointment in Council’s decision not to allow the closure of City streets for a planned march on

the courts at the Independence Park Tennis Center and requested a status report on when courts will
be redone.

Jean Sagusay (sp. ?), City of South Gate, stated it was her understanding the march was
granted but not the street closures and requested clarification. She was informed the Council did vote
to allow the march but not the street closures.
Mayor Perkins explained that during oral communications no action can be taken on issues
not on the Agenda. He noted comments will be made during closing remarks.
Jeremy Maddocks (sp. ?), Downey resident, referred to a recent incident with the Downey
Police Department, stating his rights were violated, he was provoked, his wife was provoked, he was
harassed, and the officers broke confidentiality.
Brian Simons (sp. ?), Downey resident and student, compared Downey with surrounding
cities and recognized the City is holding itself to higher standards to keep gangs, violence, and drugs
out and to keep sanity and safety here.
Glory Denyberry, Downey citizen, defended everyone’s right to free speech. She mentioned
her husband spoke to the Council on an issue a few weeks ago, did not take a side, but spoke up for
the law. She noted the day after he spoke, an anonymous man called and uttered derogatory remarks
to him and threatened to sue their church.
Glenn Kravig, Pico Rivera, representing the Downey Ministerial Association, mentioned a
request years ago to close streets for a prayer meeting, which was denied. He pointed out the heavy
traffic on the proposed streets will see the marchers but would not if the streets were closed.

Council Member Winningham inquired about the September 11th day of prayer and
remembrance held at City Hall and inquired if the City provided tables or chairs.
Mr. Kravig responded they provided their own chairs and public address (PA) system.
Mayor Perkins recessed the meeting at 9:13 p.m. and reconvened at 9:20 p.m. with all
Council Members present.
ADMINISTRATIVE REPORTS (Cont.)
POLICE DEPARTMENT COMPUTER SYSTEM UPGRADE
Chief Finch narrated a Power Point presentation requesting the Council appropriate funds for
a new Computer-Aided Dispatch/Records Management System (CAD/RMS) for the Downey Police
Department. He noted the current computer aided dispatch and records management system was
installed in 1988. A committee was created to review options available to replace the system, which
was outdated. He reviewed the different requirements needed at this point, such as a PC based
Windows environment; field reporting system; mapping capabilities to link with the City’s GIS
system; and an automatic call entry from 911. The committee, created from the three police
department divisions, narrowed the field and the system by New World Systems was ultimately
selected. He reviewed New World Systems’ experience, noting they have over 500 installations
representing more than 1,200 public safety agencies, have all the support systems needed, and have
been in business and employee owned for over 20 years. He advised the projected total cost is
$854,036, which will be funded with $163,000 from the Equipment Replacement Fund and $690,000
from Asset Forfeiture Funds. He mentioned a change in the report, pointing out this is not a lease
purchase but is a straight purchase. He noted Lieutenant Charlie Baptista, a member of the review
committee, Network Administrator, Craig Parker, and representatives from New World Systems are
present to answer questIons.
Council Member Cartozian referred to the appropriation of $690,712 from the Asset
Forfeiture Fund and $163,324 from the Equipment Replacement Fund and questioned why the
financial impact stated on Page 2 of the staff report lists a balance of $147,620 in the Equipment
Replacement Fund.
Chief Finch advised the $147,620 reflects what was on last year’s report and the current
Equipment Replacement Fund, which includes funds put in this year, equals $163,324.
Council Member Winningham asked if this system sends the colored mug shots and was
informed it does have that ability. He referred to the 911 system and the need to write down 911 calls
when they came in over the radio where this system automatically displays it on the screen.
Council Member McCarthy asked if upgrades to the system are built into the cost and was
informed this would be part of the annual maintenance fee. He inquired as to how many end users the
system will serve and was advised there are 78 computers on desks in the Police Department and 50
mobile units. He mentioned 911 calls he has made from his cell phone that have gone to the Highway
Patrol where he was put on hold.

Lieutenant Baptista advised that Phase II wireless is being thrust upon us and stated he will
attend a meeting tomorrow in Glendale regarding this aspect of the wireless system. He noted the
City will be requesting to receive the actual cell phone calls generated inside the City.
Council Member Trejo asked if the data is capable of being stored for a long period of time
and was advised that data storage is only limited by the size of the hard drives. He asked if there have
been any problems with trouble shooting where the system has broken down. He was informed that
they periodically go down but there are spares. He asked if a password is used and the response was
yes
Mayor Perkins asked what the timeframe is to install this equipment and was advised that they
are looking to implement the system by July 1st. He referred to the situation on September 11, 2001,
in New York where they lost almost all communications and asked if these units would still work if a
disaster, such as an earthquake took place. He was informed it would depend if the site stayed up.
He suggested looking into a backup system somewhere along the line.
It was moved by Council Member McCarthy, seconded by Council Member Winningham, and
unanimously carried to appropriate $690,712 from the Asset Forfeiture Fund and $163,324 from
the Equipment Replacement Fund for a new Police Department Computer-Aided
Dispatch/Records Management System (CAD/RMS), and authorize staff to prepare an
agreement for execution by City Manager with New World Systems to provide a Aegis Suite of
Public Safety Software to the Downey Police Department.

Council Member Cartozian advised he had been looking at a “draft” agenda and the actual
item he had wanted to pull was VI-E-4, which has already been approved. He noted he will discuss
Item VI-E-4 with staff.
Mayor Perkins advised he would like to continue this item to the next Council Meeting to give
the Council an opportunity to discuss it with the City Manager before approval.
It was moved by Mayor Perkins, seconded by Council Member Cartozian, and unanimously
carried to continue this item to the Council Meeting of April 23, 2002.
Prior to the vote, Council Member McCarthy inquired if there was any urgency on this matter
that required a vote tonight and the response was no.
DECLARING THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD

Council Member Canozian referred to the County records for Measure L and stated he had not
realized there were 56 precincts in the City on election day.
Ms. Midstokke advised there were at least 53, stating it was her opinion this was too many.

MARCH 5, 2002, DECLARING THE RESULT AND SUCH OTHER
MATTERS AS PROVIDED BY LAW
The Resolution was read by title only. It was moved by Council Member Cartozian, seconded
by Council Member McCarthy, and unanimously carried to waive further reading and adopt.
Prior to the vote, Council Member Winningham noted there are three churches selling
fireworks and asked Chief Sauter if one of them was the Downey Foursquare Church. He pointed out
this church is located at 13376 Downey Avenue in the City of Paramount and was utilized as a
polling place for Downey residents during the March election. He felt only Downey businesses
should be allowed permits to sell fireworks. He also clarified that a yes vote on this item only
declares that the vote is accurate and is not a support of the decision.
Chief Sauter advised he would check into whether this location is a City fireworks stand.
Council Member McCarthy commended the Registrar of Voters for having its name on the
certificate. He mentioned a previous notice about the nature of the election being a semi-open
election that had no authority or identity marked and questioned how one would confirm the
information was correct. He suggested staff contact the Registrar of Voters office if information is
received in the future that is not properly labeled.
OTHER BUSINESS - Council Members
Council Member McCarthy referred to the Arbor Day presentation and mentioned it was
nice to see new trees being planted on the north side ofGardendale Street.
Council Member McCarthy noted he had the chance to attend the Downey Symphony last
Saturday, conducted by Thomas Osborne, which was a tremendous performance. He felt the
Symphony is a great resource for the community.
Council Member Winningham expressed disappointment there was no local newspaper last
Friday and looked forward to receiving one in the weeks to come.
Council Member Winningham suggested the Friends of Gonzalo Committee contact local
churches and the Downey YMCA to request the use of tables, chairs, and loudspeakers.
Council Member Trejo inquired whether City employees receive disaster or emergency
training and was informed there are annual Citywide drills, with an evacuation fire drill held
annually at City Hall.

Council Member Trej o also inquired if cardiopulmonary resuscitation (CPR) training is
available to employees and residents and was informed the City provides CPR training on a regular
basis at various locations, which are publicized. He encouraged everyone to be trained.
Mayor Perkins advised that City resident, Lois Buchanan, was honored by Senator Betty
Kamette recently and read a letter from Senator Karnette. He noted Mrs. Buchanan was selected as
the 2002 Outstanding Woman of the Year for the City of Downey and is well deserving of this
recognrtron.
Mayor Perkins referred to the earlier speakers regarding the tennis facilities at Independence
Park and pointed out they did meet with the Director of Community Services. He noted
improvements at Independence Park are moving along and should be completed before the end of the
year
Mr. Jarrett advised the improvements at Independence Park will include tennis court
resurfacing and re-lighting, which will be submitted to the Council for approval soon. He also
referred to issues with the tennis pro contract and noted it is currently on a month-to-month basis and
will be re-bid when improvements are complete.
Mayor Perkins mentioned the earlier requests regarding information about the Gonzalo
Martinez incident and advised the City is still awaiting results from outside agencies, the Coroner,
District Attorney, and Federal Bureau of Investigation, and stated a decision cannot be reached until
this information is received. He addressed the request for tables, chairs, and sound equipment for the
march scheduled for April 20th in honor of Mr. Martinez, noting it has been the City’s policy not
to furnish these items. He reiterated the Council’s action that the march was approved but closure of
the streets was not.
