The Wenzel’s daughter Joan was also present. Mayor Perkins presented to Elton Wa11ar, owner ofWallar’s Appliance Store, and Downey business owner since 1932, a Proclamation thanking him for his dedication and commitment to the betterment of the community and congratulating him on his retirement. Mr. Wallar’s daughter Margaret was also present. Mayor Perkins advised that Mr. Wallar will be celebrating his 94th Birthday this month and asked everyone to join him in singing “Happy Birthday to You.” Council Minutes 1/22/02 -1- 014928 Mayor Perkins brought Agenda Item X-B- 1-a, UPDATE OF “THE WAR ON LITTER,” BEGUN AS A MODEL FOR THE COMMUNITY AT DOWNEY HIGH SCHOOL BY CAROL ROWLAND OF THE KEEP DOWNEY BEAUTIFUL COMMITTEE, forward for presentation at this time. Council Member Cartozian explained this project was spearheaded by three individuals, Carol Rowland of Keep Downey Beautiful, Roger Brossmer, a City Planning Commissioner and teacher at Downey High School, and Downey High School Vice-Principal Robert Jagielski. He stated he hoped the program would become a model for the Downey Unified School District and the community. He also acknowledged Joan Frey of Keep Downey Beautiful for her input. Ms. Rowland narrated a Power Point presentation of “the War on Litter” program, which she noted was initiated seven months ago to assist with litter problems at the Downey High School campus. She pointed out it is a campaign in progress and is changing as it goes forward. She advised students have developed the attitude that litter is an acceptable behavior and the School District has declared that litter will not be tolerated. She demonstrated special anti-litter tee shirts teachers were requested to wear to caution students on the repercussions of littering and noted the ultimate goal is to have no trash left after the lunch period is over. Vice-Principal Jagielski shared results and noted the program is being developed as it goes along, with mini assemblies being held, students monitoring each other, and signs being made to remind students to pick up their trash. Mr. Brossmer advised the School District is attempting to change student behavior, which he pointed out takes consequences or rewards. He advised many students sit at the same lunch tables each day and caution tape is being used to cordon off lunch tables where trash was not picked up the previous day. He noted the program will be shared with other community schools, if it succeeds at the Downey High School campus. “The War on Litter” group presented anti-litter tee shirts to each Council Member. Council Member Trejo mentioned noticing trash at DowneyLINK stops near the Hospital, which are utilized by students, and requested bus stops be included in “the War on Litter“ program. Ms. Rowland noted she hoped the students would begin to stop littering on campus and would carry the trait throughout the community. Council Member Cartozian noted when kids see results they want to be a part of it. He commended the three individuals for spearheading the War on Litter effort and urged everyone to join them Council Minutes 1/22/02 -2- 01402:J HEARINGS Mayor Perkins opened the public hearing on APPEAL OF CONDITIONAL USE PERMIT NO. 00-08 AND APPEAL OF ZONE VARIANCE NO. 01-65 FOR PROPERTY AT 12145 WOODRUFF AVENUE, which was continued from the Council Meeting of January 8, 2002. Ms. Midstokke advised there was no correspondence received on this matter, but noted a revision to Exhibit A - Conditions to the Resolution for Conditional Use Permit No. 00-08, Pages 4 through 9, was submitted by staff prior to the Meeting. It was moved by Council Member Wirmingham, seconded by Council Member Cartozian and so ordered to receive and file. Mr. Yoshiki advised these issues are a continuation of a previous matter where the Council considered a General Plan Amendment and rezoning of property formerly used by Boeing employees as a recreational area. Tonight land use entitlements under Conditional Use Permit No. 00-08 will be considered and a Zone Variance for the religious institution proposed by the applicant/appellant. He reviewed the project, pointing out the property is on the west side of Woodruff Avenue, south of Washburn Road, and contains about 7-3/4 acres, with frontages on both Washburn Road and Woodruff Avenue. He noted the Council recently adopted a General Plan Amendment to change the land use designation from Open Space to Neighborhood Commercial and rezoned the property from industrial to CI, which will provide for the church facility. He noted the proposed project will house a 3,000-member parish and the Zone Variance will address a slight over-height condition along the west side of the property. He explained Staffs justification of the minor deviation in height requirements and reviewed amendments incorporated in the revision to Exhibit A – Conditions of CUP No. 00-08, submitted today, as follows: Condition 2 - strikes the 1-year limitation; Conditions 5 and 6 - require a protective wall/fence around the perimeters of the property; Condition 7 - provides that the parking area is adequately lit; Condition 8 - requires a trash enclosure of sufficient size be provided on site; and Conditions 10 and 1 1 - state conditions required before the Conditional Use Permit becomes valid. Council Member Trejo noted Sunday would be the busiest day at this facility and asked if traffic issues were addressed. He was informed the church will conduct three services, therefore, there will not be 3,000 people at the site at one time and traffic will be staggered. It was noted Woodruff Avenue is the main street but there is also an opening on Washburn Road, which will relieve some of the traffic volume. Council Member McCarthy asked when the additional conditions submitted on the revision to Exhibit A were added and was informed yesterday. It was noted the applicant/appellant was advised conditions had been left out and staff reviewed the revisions with them. Council Member Winningham noted traffic was not an issue in the Environmental Impact Report. Mayor Perkins stated he would appreciate receiving amendments sooner, as the Council needs adequate time to absorb changes. He reviewed the amended conditions and referred to the driveway located on Woodruff Avenue, inquiring about its size and whether there was a left-turn lane when heading north. Council Minutes 1/22/02 -3- 01403 ; 1 Mr. Yoshiki referred to Condition No. 28, stating one of the mitigation measures required all right turns . Mayor Perkins inquired how the assembly room would be controlled in terms of the number of people. Mr. Yoshiki advised the site is more than adequate to accommodate the assembly in terms of parking and traffic and noted the building is situated far enough away from the residential areas, with activities to be contained inside. If problems appear, Staff will notify the property owner and the issue will be revisited. He noted any problems can also be mitigated by Code Enforcement. Mr. Vose noted the general standards and numbers mentioned are more for the fact that if a problem develops, they provide objective standards for Staff to refer to. Mayor Perkins asked if the applicant/appellant wished to come forward and present the case. Steve Sheldon, 695 Towne Center Drive, Suite 410, Costa Mesa, 92626, advised Joel Columbo, architect for the project, is with him to answer questions. He thanked staff for deleting the requirement in Condition 2 for the one-year period and noted he has read the conditions of approval and the staff report and is in support. Mayor Perkins asked if the applicant/appellant agrees to the additional conditions and the response was affirmative. Mayor Perkins asked if anyone present wished to speak in favor or in opposition to the Appeal to Conditional Use Permit No. 00-08. There being no one to speak to either Appeal, it was moved by Council Member McCarthy, seconded by Council Member Winningham and so ordered to close the public hearing. RESOLUTION NO. 6538 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING THE APPEAL AND APPROVING A CONDITIONAL USE PERMIT TO ESTABLISH A CHURCH FACILITY ON PROPERTY AT 12145 WOODRUFF AVENUE The Resolution was read by title only. It was moved by Council Member Winningham, seconded by Council Member Trejo, and unanimously carried to waive further reading and adopt, with amendments to Exhibit “A” - Conditions, as noted. Council Member Cartozian noted he was in support of both of the Appeals. He felt the City Attorney made it clear that objective measures are in place to hold certain requirements under the uses proposed. Council Minutes 1/22/02 -4- 014031 Council Member Trejo felt it was a good project and noted there was no correspondence in objection from residents in the area. He stated his concerns with traffic have been addressed and felt the conditions noted placed proper limitations on the facility and he was in support. Council Member Winningham noted omissions to the chart under Condition 2 of “revised” Exhibit“ N' - Conditions, pointing the chart supplied with the Council packet for Exhibit “A“ of the Resolution for Conditional Use Permit No. 00-08 should be duplicated onto the “revised” Exhibit “A.” He also noted an amendment to the motion would be in order. Mr. Vose inquired if the maker and seconder of the motion were in agreement to the amendment and the response was yes. Council Member McCarthy complimented both staff and the applicant/appellant for working towards a conclusion that is in the best interest of everyone involved. He mentioned his initial concern with the loss of open space but felt documents presented address this issue properly. Mayor Perkins referred to the numbers presented in the chart under Condition 2 of Exhibit “A“ - Conditions, noting it is confusing when multiple numbers are presented for different hours, days and places. He cautioned the applicant/appellant they could jeopardize the CUP, if these numbers are increased. He stated he was in support of the project. Mr. Vose noted these numbers were proposed by the applicant/appellant and not by City staff Mr. Sheldon reiterated, for the record, that he was in agreement with inserting the correct chart under Condition 2 on “revised” Exhibit A - Conditions. He also noted the figures referred to by Mayor Perkins were intended to get the church open and ready for services and it is not anticipated 250 students will be at the church at 7:00 a.m. on Sunday morning. Council Member Winningham pointed out the daycare facility would also fall under State licensing and mandates. RESOLUTION NO. 6539 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING THE APPEAL AND APPROVING A ZONE VARIANCE RELATED TO MAXIMUM HEIGHT AND VARIABLE HEIGHT (SECTIONS 9140 AND 9122 OF THE DOWNEY MUNICIPAL CODE) FOR A NEW STRUCTURE ON PROPERTY AT 12145 WOODRUFF AVENUE The Resolution was read by title only. It was moved by Council Member Trejo, seconded by Council Member McCarthy, and unanimously carried to waive further reading and adopt. Council Minutes 1/22/02 01403: ORAT I COMMUNICATIONS Hazel Scotto, 9203 Cord Avenue, commended everyone involved in the first “Know Your City Forum“ at the Barbara J. Riley Community/Senior Center and thanked John Adams for his editorial in the Downey Eagle. She advised the Cable TV tape of the forum is available by contacting Christina Vogel, Assistant to the City Manager. She noted a change expected for the next forum, whereby students will not be on a panel, as they are in the midst of finals and many activities, and attendance will be from the general public. Mayor Perkins opened the public hearing on PROPOSED DOWNEY MUNICIPAL CODE AMENDMENT RELATING TO SIGNING; AND A PROPOSED AMENDMENT TO THE DOWNTOWN PLAN OVERLAY ZONE RELATING TO SIGNING. Ms. Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Winningham, seconded by Council Member McCarthy, and so ordered to receive and file There was no correspondence received regarding these matters. Mr. Yoshiki explained this amendment was in part initiated by the Downey Chamber of Commerce to relax some of the standards as to how businesses are allowed wall signs. He presented a Power Point program reviewing and illustrating proposed changes and noted the amendments maintain the present allowable maximum signing area but allow the business owner greater flexibility in the allocation of wall signs, while continuing to protect residential neighborhoods adjacent to or across the street from the signing. He noted the changes will involve a Downey Municipal Code amendment, which applies to the General Commercial and Industrial areas of the City; and an amendment to the Downtown Plan. He advised the Planning Commission adopted Resolutions 2173 and 2174 recommending the Council adopt the two Ordinances before it tonight. Council Member McCarthy referred to the Agenda Memo, noting it refers to allowable area as opposed to actual area, explaining if the business owner does not utilize the full frontage, he/she can still utilize the whole side area. He referred to Page 2 of the report and noted the revisions affect the commercial, office and industrial zones and asked if signing is allowable in other zones too and, if so, why those zones were not noted. Mr. Yoshiki explained the C-1 (Neighborhood Commercial), C-2 (General Commercial) and C-3 (Central Business District) zones are a group and the M- 1 (Light Manufacturing) and M-2 (General Manufacturing) zones are a group. The C-M (Commercial Manufacturing) zone also reflects changes noted. The only zone omitted was the Professional Office zone, which has more restnctrve slgnrng. Council Member McCarthy complimented the Chamber of Commerce and felt this was a good way to promote business in Downey. Mayor Perkins asked if anyone wished to speak in favor or in opposition to the proposed Downey Municipal Code Amendment. Council Minutes 1/22/02 -6- 014033 David Bowers, 10620 Dolan Avenue, stated he was in favor of allowing business people more signage to advertise their businesses and felt it was a step in the right direction. There being no one else to speak, it was moved by Council Member Cartozian, seconded by Council Member McCarthy, and so ordered to close the public hearing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING A DOWNEY MUNICIPAL CODE AMENDMENT TO ARTICLE IX, CHAPTER 1, SECTION 9148 RELATED TO SIGNING The Ordinance was read by title only. It was moved by Council Member Winningham, seconded by Council Member Cartozian, and unanimously carried to waive further reading and introduce. Council Member Trejo was in support of the changes in signage and felt they would assist businesses. He also felt the City needs to monitor any abuses of signage. Council Member Cartozian, liaison to the Downey Chamber of Commerce, mentioned he has spoken to the Chamber extensively on this topic. He recognized Jerry Andrews of the Downey Eagle in the audience. He stated he has spoken to many of the downtown merchants and members of the Chamber on this issue and felt it makes a lot of sense. He commended the Chamber and supported the code amendment. Council Member Winningham thanked former Mayor Hazel Scotto for her time and effort in arranging the “Know Your City” forums. He commended staff for an excellent job of discussing their particular department and mentioned how impressed he was by the City Manager’s historical knowledge of Downey and Governor John Downey. He also commended the press coverage of the fOIum Council Member Winningham noted the City Council and Downey Unified School Board Members were invited to a community get-together last Friday with Congresswoman Lucille Roybal-Allard, who will be the City’s new representative in the 34th Congressional District. He advised the Congresswoman praised Congressman Steven Hom for doing an excellent job for Downey. He noted she will not be our official representative until next year but has begun to listen to the needs in Downey and invited the Council to meet with her staff to share its concerns. Council Minutes 1/22/02 -9- 014036 Council Member Winningham mentioned attending the Downey Soroptimist-Kiwanis Clubs’ play, “Playing Doctor,” at the Downey Civic Theatre last weekend, which was a very enjoyable event. Council Member Winningham referred to the Council’s tour of the NASA/Boeing site where they met the star of the movie “Austin Powers III,” Mike Myers (? sp.), and Bionsay Knowles (? sp.) of the music group Destiny’s Child. Council Member Cartozian thanked Hazel Scotto for her time and effort in arranging the “Know Your City” forums and added additional historical data to that previously noted by Council Member Winningham and City Manager Caton. Council Member Cartozian mentioned touring the former NASA/Boeing site and the Austin Powers III movie set and noted he is hopeful about the future use of this property. He also advised the movie “Catch Me if You Can,” with Director Stephen Spielberg, will be filmed at the site and commended the Community/Economic Development Department for their efforts in this goal. Council Member Trejo thanked the City for allowing him to travel to the State Capitol in Sacramento on behalf of the City. He commended Desi Alvarez and Christina Vogel for discussing issues of concern to Downey and mentioned meeting with Assemblyman Marco Firebaugh and Senator Betty Karnette. He stated he felt confident local interests will be considered when budgetary items are addressed. Council Member Trejo expressed concern with trash being left at DowneyLINK drop-off and pick-up points, especially near the hospital, and requested staff review this issue to see what can be done Council Member Trejo commended Darrell George and his staff for their efforts regarding the NASA/Boeing property and for the recent tour. Council Member Trejo requested staff begin a collection of movie posters from movies filmed at the NASA/Boeing site for framing and display in the Council offices. Mayor Perkins mentioned having the opportunity to attend a play at West Middle School, “the Bone Chiller,” and complimented the drama teacher for doing an outstanding job with her drama class. Mayor Perkins announced the formation of a subcommittee to review Rio Hondo Golf Course clubhouse improvements and noted they are currently conducting interviews for architectural services associated with this endeavor.
