LOCATION: 10853 HASTY AVENUE ZONING: R-1-6,000 (SINGLE-FAMILY RESIDENTIAL) GENERAL PLAN DESIGNATION: LOW DENSITY RESIDENTIAL (LDR) REPORT SUMMARY The applicant is requesting a Variance to deviate from the Downey Municipal Code (DMC) in order to allow a reduction in the required setback due to a substandard lot configuration. The requested five (5) foot rear setback reduction is to facilitate the construction of a master bedroom (227 sq. ft) and an attached open patio cover (360 sq. ft). The property is currently developed with a 1,579 square foot single-story, single-family dwelling and a 415 square-foot, detached two-car garage. Based on the analysis contained in this report, staff concludes that required Variance findings can be made due to the unique shape and dimensions of the property and recommends that the Planning Commission adopt the following resolution: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY TO APPROVE VARIANCE PLN-23-00131, A REQUEST FOR A DEVIATION FROM DOWNEY MUNICIPAL CODE RESIDENTIAL DEVELOPMENT STANDARDS TO ALLOW A REAR YARD SETBACK OF 15 FEET, A REDUCTION IN FIVE (5) FEET FROM THE REQUIRED 20 FEET, ON A PROPERTY LOCATED AT 10853 HASTY AVENUE REQUEST On September 1, 2023, the applicant filed an application for a Variance as required by DMC Section 9534 which allows the Planning Commission to grant modification to the rear setback on lots with restricted depth, pursuant to DMC Section 9826. PC AGENDA PAGE 1 10853 Hasty Avenue – PLN-23-00131 October 18, 2023 – Page 2 BACKGROUND The subject site is a 6,460 square foot irregularly quadrilateral shaped lot, meaning no side on this property has the same length. The subject site and adjacent lots are zoned R-1-6,000 (Single-Family Residential) and has a General Plan Land Use Designation of Low Density Residential. The subject property is located north of Firestone Boulevard and east of Woodruff Avenue. The property is currently developed with a 1,579 square foot single-family residence and a detached two-car garage. The development standards for the zone requires a minimum lot size of 6,000 square feet, a minimum lot width of 50 feet, and a lot depth that conforms to the average depth of adjacent lots. The home was built in 1952, has had one previous owner before the applicant (Luevanos family), and the lot remains in its original configuration. Figure 1: Front view of subject property from Hasty Avenue DISCUSSION A Variance is defined in the Municipal Code as “a permit which grants a property owner relief from development standards contained in this article when strict compliance with this article would result in undue hardship on the owner due to special circumstances or conditions applicable to a property, including size, shape, topography, location, or surroundings.” As stated in the above definition, the property itself must experience unique physical circumstances not found among standard lots within the City. The applicant is seeking a Variance from DMC Section 9312.08 (a) to reduce the rear yard setback to 15 feet rather than the 20 feet required for an R-1 zoned property. The DMC sets a rear yard setback requirement of 20 feet. This setback area is required to be unoccupied and unobstructed from the ground upward. The proposed addition would encroach five (5)-feet into the required rear yard setback and portions of the proposed patio cover would comply with the required 20-foot setback. As part of this request, staff reviewed the application submittal and conducted an assessment of the subject property and surrounding area to determine if a special circumstance exists. Staff concluded that the subject property holds irregular lot dimensions and a unique shape compared to other lots within the corresponding R-1 zoning district. The property is uniquely shaped in that the front (east) property line measures 74.88 feet in PC AGENDA PAGE 2 10853 Hasty Avenue – PLN-23-00131 October 18, 2023 – Page 3 width, and the rear (west) property line measures 62 feet in width. In addition, the lot depth measures 89.45 on one side and 99.69 on the other side, creating an average depth of 94.57 feet. In standard lots found throughout the City, dwelling footprint areas are built parallel to each property line to maximize the allowed buildable area. In the R-1-6,000, standard shaped lots typically measure 50 feet wide by 120 foot in depth, creating a rectangular lot shape. In the applicant’s circumstance, the home is built with varying setbacks. As an example, the side setback as measured closest to the front yard measures 7’3” but the setback tapers down to 6’1” toward the rear yard setback. In addition, the home is sited along the north side of the property to allow driveway access along the south side to the rear detached garage. These site layout characteristics creates a unique and limited buildable area which is constrained by the required front, side, and rear yard setbacks. Figure 1: Site Plan Surrounding Properties An average lot typically includes equal length side property lines and parallel front and rear property lines, which form rectangular building envelopes. For example, in the R-1-6,000, standard shaped lots typically measure 50 feet wide by 120 foot in depth, creating a rectangular BUILDABLE AREA REDUCED 15’ SETBACK PC AGENDA PAGE 3 10853 Hasty Avenue – PLN-23-00131 October 18, 2023 – Page 4 lot shape. Staff surveyed the properties along Hasty Avenue on the same street side and determined that the average lot depth to the north of the site is 150 feet. Similarly, lots south of the site have an average depth of 101.50 feet. Although the south properties are similar in depth to the subject site, the subject property is situated along a curvature on Hasty Avenue, creating two irregularly shaped lots, one being the subject site. The lot depth difference between the site and the sites to the south is approximately seven (7) feet. The second irregularly shaped lot, adjacent to the subject property, has an average lot depth of 74.25 feet and the building envelope has a rear setback of 10 feet. Although there are not many properties irregularly shaped lots along Hasty Avenue, the property adjacent to the subject site has set a precedent for a reduced rear yard setback. Figure 2: Neighborhood Analysis The existing floor plan includes a kitchen and laundry room along the south section of the house, a living, dining, den, and bedroom at the center of the house, and two bedrooms along the north side of the house. The proposed addition would be located to the rear, along the north side of the home, extending a master bedroom. The 227 square foot master bedroom addition also includes a master bathroom and walk-in closet. As proposed, the addition maintains the width of the existing bedroom and the roofline of the addition matches and continues the existing roof design. The proposed 360 square foot open patio is attached to the rear of the home and has a traditional flat roof typically used for open patio covers. Per the DMC, open patio covers are not livable areas and can be proposed with flat roofs. All other requirements for this property meet the R-1-6,000 Development Standards. PC AGENDA PAGE 4 10853 Hasty Avenue – PLN-23-00131 October 18, 2023 – Page 5 Figure 3: Floor Plan The required findings can be made in a positive manner in that the unique lot shape and dimensions, create a limitation that prevents this owner from achieving the same opportunity available to neighboring properties. As described in the analysis above, there are unique circumstances that prevent compliance with the rear yard setback standard and cause a hardship to the subject site that does not exist for typical properties in the same zone surrounding area. DEVELOPMENT REVIEW COMMITTEE The project was reviewed by the Development Review Committee (DRC) which is composed of Building & Safety Division, Fire Department, Public Works Department, and the Planning Division. Standard comments were provided by all Departments and are incorporated into Exhibit B. PC AGENDA PAGE 5 10853 Hasty Avenue – PLN-23-00131 October 18, 2023 – Page 6 PUBLIC NOTICE On October 5, 2023, a notice of the public hearing was mailed to all property owners within 500- feet of the subject property and noticed in the Downey Patriot for the October 18, 2023 Planning Commission meeting. The public notice provided meets the requirements of the DMC Section 9804.06(c). ENVIRONMENTAL ANALYSIS The request was reviewed for compliance with the California Environmental Quality Act (CEQA). This request was determined to be categorically exempt from CEQA, pursuant to Guideline Section No. 15305 (Class 5, Minor Alterations in Land Use Limitations), which includes setback variances not resulting in the creation of any new parcel. PUBLIC COMMENTS As of the date of the publishing of this report, staff has not received any correspondence regarding this application. CORRESPONDENCE As of the date that this report was printed, staff has not received any correspondence regarding this application. CONCLUSION Based on the analysis contained within this report, staff is concluding that all findings required for approval can be made in a positive manner (Exhibit B – Findings). As such, staff is recommending that the Planning Commission approve the application (PLN-23-00131), thereby approving a variance to reduce the required rear yard setback of 20 feet to 15 feet. The Planning Commission of the City of Downey does hereby find, determine, and declare that: A. On September 1, 2023, the application was filed by Guadalupe and Javier Luevanos (hereinafter referred to as the “applicant”) to request a Variance (PLN- 23-00131) to deviate from the Downey Municipal Code and grant a reduced rear setback. B. On September 21, 2023, the application was deemed complete for further processing. C. On October 5, 2023, a notice of the public hearing was sent to all property owners within 500-feet of the subject site and the notice was published in Downey Patriot. D. The Planning Commission held a duly noticed public hearing on October 18, 2023, and after fully considering all oral and written testimony, facts, and opinions offered at the aforesaid public hearing, adopted this resolution. SECTION 2. The Planning Commission further finds, determines, and declares that the proposed project was reviewed for compliance with the California Environmental Quality Act (CEQA), and is categorially exempt from CEQA, pursuant to CEQA Guidelines Section 15305 (Class 5, Minor Alterations in Land Use Limitations). Class 5 exemptions include setback variances not resulting in the creation of any new parcel. As such, a Notice of Exemption will be filed for this project. SECTION 3. Having considered all of the oral and written evidence presented to it at said public hearing regarding the Variance, the Planning Commission further finds, determines, and declares that: A. Exceptional or extraordinary conditions or circumstances exist which are peculiar to the land, structure, or building involved and which are not generally applicable to other lands, structures, or buildings in the same vicinity and zone. The subject site is unique in shape, which creates a smaller building envelope as compared to the majority of the surrounding properties which have an average building envelope of 7-feet in depth greater than the subject site. Thus, the subject site can be considered to have exceptional or extraordinary conditions that would result in an undue hardship because the property would be restricted from developing the way surrounding property can. The site is best described as an irregularly PC AGENDA PAGE 9 Resolution No. 23-4016 Downey Planning Commission 10853 Hasty Avenue – PLN-23-00131 October 18, 2023 – Page 2 quadrilateral shaped lot compared to the common rectangular shape of most of the adjacent lots. B. The literal interpretation of the provisions of Article IX of the DMC would deprive the applicant of rights under the terms of Article IX of the DMC commonly enjoyed by other properties in the same vicinity and zone in which the property is located. The project consists of a 227 square foot bedroom addition and a 360 square foot attached patio addition with a 15-foot rear setback. The proposed construction is not allowed without a Variance because it does not conform to a 20-foot rear yard setback set forth within the DMC. The unique shaped lot does not have the building envelope to create the proposed addition without encroaching into the rear yard setback. This restriction is not applicable to other lots in the same vicinity as the other lots have deeper building envelopes, parallel front and rear property lines, and equidistant side property lines, and therefore are not restricted on buildable area or prevented from utilizing their property. The dimensions and irregular lot shape create a hardship for the site to accommodate new construction. An equal scope of work may not be achieved elsewhere on the property due to the shape of the site. The subject site has a building envelope that is seven (7) feet less in depth than those of surrounding properties. Therefore, the literal interpretation and application of Article IX of the DMC deprives the applicant of rights commonly enjoyed by other properties in the same vicinity and zone in which the property is located. C. The exceptional or extraordinary conditions or circumstances do not result from the actions of the applicant. The applicant’s request for a reduced rear yard setback of 15-feet is a modification that may be granted by the Commission per section 9534.20 of the DMC for lots having unique circumstances. The unique circumstances are a result of the shape of the lot and street alignment, and not a result from actions of the applicant. Granting of a Variance will allow the applicant to gain some of the rights automatically given to properties with standard shapes and lot dimensions. The subject site’s irregular depth does not confer any special privilege that is denied by Chapter 8 of Article IX of the DMC to other lands in this same zone. Additionally, the subject site will be required to comply with all other development standards like lot coverage, building height, and other setbacks D. Granting the variance requested will not confer on the applicant any special privilege that is denied by Chapter 8 of Article IX of the DMC to other lands, structures, or buildings in the same vicinity and zone in which the property is located. The applicant’s request for a reduced rear yard setback of 15 feet is a modification that may be granted by the Commission per section 9534.20 of the DMC for lots having unique circumstances. Granting of a Variance will allow the applicant to gain some of the rights automatically given to properties with standard shapes and lot dimensions. The subject site’s irregular depth does not confer any special privilege that is denied by Chapter 8 of Article IX of the DMC to other lands in this same zone. Additionally, the subject site will be required to comply with all other development standards like lot coverage, building height, and other setbacks. E. The granting of such variance will be in harmony and not adversely affect the General Plan of the City. The General Plan Land Use designation for the subject site is Low Density Residential and is in compliance with Policy 1.4.2, which PC AGENDA PAGE 10 Resolution No. 23-4016 Downey Planning Commission 10853 Hasty Avenue – PLN-23-00131 October 18, 2023 – Page 3 states “Promote residential construction that complements existing neighborhoods.” Staff has worked with the applicant to ensure that the architectural style and quality of the proposed addition will be compatible with the architecture of the existing home and the surrounding neighborhood. In addition, the proposed scope of work is in harmony with, and does not adversely affect the following Goals, Policies, and Programs of the General Plan: Goal 8.1 – Promote quality design for new, expanded, and remodeled construction. Policy 8.1.1 – Promote architectural design of the highest quality Program 8.1.1.2 – Assist homeowners and builders by providing design guidelines to illustrate good design. These goals are most typically achieved by allowing new construction that is consistent, compatible, and similar in character to the surrounding neighborhood. F. The reasons set forth in the application justify the granting of the variance, and the variance is the minimum variance that will make possible the reasonable use of the land, building, or structure. The property is uniquely shaped, with a wide frontage, angled side property lines, a narrow rear property line, and building envelope that measures at least seven (7)-feet less than the average building envelope found in the neighborhood. Most of the properties within this neighborhood have a buildable depth of 102 feet, while the subject site currently has a 94-foot building envelope depth. The proposed rear yard setback of 15 feet will make up the difference of buildable areas as compared to the applicant’s surrounding neighbors. With the approved addition, the property will maintain proportion to the size of the lot by complying with lot coverage, building height, and other setback development standards for this land use designation. Without the approval, the applicant would not be able to achieve the same scope of work. SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution, the Planning Commission of the City of Downey hereby approves the requested Variance (PLN- 23-00131), subject to conditions of approval attached hereto as Attachment ‘A’, which are necessary to preserve the health, safety and general welfare of the community and enable the Planning Commission to make the findings set forth in the previous sections. The conditions are fair and reasonable for the accomplishment of these purposes. The approval of this Variance (PLN-23-00131) allows for the reduction of a required rear setback from 20 feet to 15 feet to allow an addition of 227 square feet and an attached 360 square foot open patio of as shown on the plans dated October 18, 2024. 2. This Variance (PLN-23-00131) shall not be construed to mean any waiver of applicable and appropriate zoning regulations, or any Federal, State, County, and City laws regulations. Unless otherwise expressly specified, all other requirements of the City of Downey Municipal Code shall apply. 3. The addition shall be in complete compliance with all other development standards within the City of Downey Municipal Code that pertain to the subject site. 4. The applicant and the property owner shall sign and return an affidavit of Acceptance of Conditions, as provided by the City of Downey. 5. The Planning Commission reserves the right to revoke or modify this approval if the proposed use becomes a public nuisance, finds the permit was obtained by fraud, the approved use is not being exercised, the approved use is operated in violation of the terms and conditions contained herein, or the approved use ceased or was suspended for one year or more. 6. The Owner/Applicant agrees, as a condition of approval of this resolution, to indemnify, defend and hold harmless, at Applicant's expense, City and City's agents, officers and employees from and against any claim, action or proceeding commenced within the time period provided in Government Code Section 66499.37 to attack, review, set aside, void or annul the approval of this resolution, to challenge the determination made by City under the California Environmental Quality Act, or to challenge the reasonableness, legality or validity of any condition attached hereto. City shall promptly notify Applicant of any such claim, action or proceeding to which City receives notice, and City will cooperate fully with Applicant in the defense thereof. Applicant shall reimburse the City for any court costs and attorney's fees that the City may be required to pay as a result of any such claim, action or proceeding. City may, in its sole discretion, participate in the defense of any such claim, action or proceeding, but such participation shall not relieve Applicant of the obligations of this condition. 7. The Director of Community Development is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 8. All exterior lights on the property shall be directed, positioned, and/or shielded such that they do not illuminate surrounding properties. 9. The approved architectural elements shall be as noted in the approved plans to be compatible with the existing structure at the subject site. BUILDING & SAFETY DIVISION 10. All construction shall comply with the most recent adopted City and State building codes: • 2022 California Building Code • 2022 California Residential Code • 2022 California Electrical Code • 2022 California Mechanical Code • 2022 California Plumbing Code • 2022 California Fire Code • 2022 California Green Code 11. The Title Sheet of the plans shall include: • Occupancy Group • Occupant Load • Description of use • Type of Construction • Height of Building • Floor area of building(s) and/or occupancy group(s) 12. School impact fees shall be paid prior to permit issuance. 13. Dimensioned building setbacks and property lines, street centerlines and between buildings or other structures shall be designed on plot plan. 14. All property lines and easements must be shown on plot plan. A statement that such lines and easements are shown is required. 15. The project design will conform with energy conservation measures articulated in Title 24 of the California Code of Regulations and address measures to reduce energy consumption such as flow restrictors for toilets, low consumptions light fixtures, and insulation and shall use to the extent feasible draught landscaping. FIRE DEPARTMENT 16. The following comments pertain to a fire review of a limited design plan submittal. The comments contained herein shall not be construed as complete or encompassing all fire- life safety code requirements set forth in local, State, and/or National local codes. 17. Premises shall be appropriately addressed. An approved address identification shall be provided that is legible and placed in a position that is visible from the street/road. Sizing shall be approved and at a minimum meet requirement of CA Fire Code [CA Fire Code §505.1] 18.
