PRESENT: Council Members: Claudia M. CITY COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; CONFERENCE/MEETING REPORTS Council Member Horn reported attending the Independent Cities Association Summer Seminar and the Annual National Night Out event. Mayor Pro Tern Trujillo welcomed the audience to the City Council meeting. He reported attending the Independent Cities Association Summer Seminar, the Summer Twilight Concerts in the Park event, the Breakfast with the Chamber event, the grand opening of Gelato Amore Mio, and the Annual National Night Out event. He requested staff host a financial literacy workshop and provide an update regarding the fentanyl awareness campaign. He commented regarding recruitment of the City Attorney and Economic Development Director positions. He invited the public to attend the Gangs Out of Downey backpack giveaway event. Council Member Sosa reported attending the Independent Cities Association Summer Seminar and the Annual National Night Out event. He requested staff conduct a survey of speeding/running red lights at Stewart and Gray Rd. and Rives Ave., and Downey Ave., and Brookshire Ave. Mayor Pro Tern Trujillo provided concurrence for this request. Council Member Sosa invited the public to attend the Gangs Out of Downey backpack giveaway event. City Council Minutes Regular Meeting - August 8, 2023 Mayor Frometa welcomed the audience to the City Council meeting. She acknowledged Michael Calvert and Carmen Padilla in the audience. She reported attending the Independent Cities Association Summer Seminar and the Annual National Night Out event. She commented regarding jurisdiction over Los Padrinos Juvenile Hall and thanked the Police Department and City Manager for updating the City regarding an incident. She invited the public to attend the Gangs Out of Downey backpack giveaway and Rocket Fever events. She requested additional traffic enforcement at schools during school drop-off times. She invited the public to attend the Young Men Rise Up Summer Camp event and the Girls on Fire Summer Program. She reported attending a dinner hosted by Los Angeles (L.A.) Mayor Karen Bass and commented regarding the need for a navigation center to assist homeless persons. She requested staff address the homeless situation outside of the Library. Mayor Pro Tern Trujillo provided concurrence for this request. Mayor Frometa requested additional social media presence for the "Quality Neighborhood Starts with You" campaign. Mayor Pro Tern Trujillo requested staff advertise via social media the City's phone numbers to call for service. Mayor Frometa provided concurrence for this request. Mayor Frometa requested staff address Downey App glitches. She commented regarding dumping occurring outside of assisted living facilities. Mayor Pro Tern Trujillo requested staff conduct patrols to address illegal dumping. CITY MANAGER/STAFF MEMBER COMMENTS City Manager Bradley requested concurrence for the request to host a financial literacy workshop. Council Member Sosa provided concurrence for this request. He confirmed requests for an update regarding the fentanyl awareness campaign, additional traffic enforcement during school drop-off times, addressing the homeless situation outside of the Library, addressing Downey App glitches, and patrols to address illegal dumping. He reported the Downey Theatre was named the "Best Place to See a Play or Musical" in South Los Angeles in the L.A. Times "The Best of the Southland" Awards while the Dia de Los Muertos Festival was a finalist in the "Family Friendly Attraction" category. PRESENTATIONS 1. Mayor Frometa presented a Certificate of Recognition to Grace Barrios, 2023 Congressional Art Competition Winner. 2. Mayor Frometa presented Certificates of Recognition to Enrique Zarate, Franki Zarate, and Diane L/. Sosack in honor of National Parents' Day. PUBLIC HEARINGS 1. PILOT PROGRAM ALLOWING THE EXPANSION OF EXISTING PREFERENTIAL PARKING DISTRICTS: Public Works. 1) CONDUCTED A PUBLIC HEARING CONCERNING THE CREATION OF A PILOT PROGRAM TO ALLOW THE EXPANSION OF EXISTING PREFERENTIAL PARKING DISTRICTS; 2) INTRODUCED ORDINANCE NO. 23-1608, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3199.6 WITHIN PART 12, CHAPTER 1 OF ARTICLE III OF THE DOWNEY MUNICIPAL CODE RELATING TO RESIDENTIAL PERMITTED PARKING DISTRICTS; AND, City Council Minutes Regular Meeting —August 8, 2023 2 3) ADOPTED RESOLUTION NO. 23-8184, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXPANDING EXISTING PREFERENTIAL PARKING DISTRICTS ON CORRIGAN AVENUE AND BUCKLES STREET. Mayor Frometa opened the Public Hearing at 7:14 p.m. City Clerk Duarte affirmed receipt of the Proof of Publication. It was moved by Mayor Pro Tern Trujillo, seconded by Council Member Sosa, and carried 4-0, to receive and file the publication. Deputy Director of Public Works Ed Norris presented the staff report for Item No. 1. He provided background information regarding the item, the purpose of the pilot program to create on -street parking relief, and Downey Municipal Code guidance regarding expansion of preferential parking districts. He stated the proposed Ordinance amends the Municipal Code to allow the expansion of existing preferential parking districts to include contiguous streets affected by overflow on -street parking provided that they meet certain conditions requiring findings that on -street parking relief is necessary for residential neighborhoods impacted by overflow parking from nearby uses and the existing preferential parking district has sufficient on -street parking to include additional parking demand from the single-family residential properties located on contiguous streets. He shared staff's findings that residents of the west side of the 11700 block of Bellflower Blvd. have been adversely affected due to the recent establishment of the residential preferential parking districts compounded by the lack of parking on the west side of the 11700 block of Bellflower Blvd. He stated staff confirmed the existing preferential parking districts on the 11700-11800 blocks of Corrigan Ave. and the 9010-9060 blocks of Buckles St. have sufficient on -street parking capacity to accommodate the parking demand from the single-family residents along the west side of the 11700 block of Bellflower Blvd. based on the number of preferential parking permits sold. He added upon the effective date of the proposed Resolution, which will coincide with the effective date of the proposed Ordinance and pilot program, the seven single-family residential properties on the west side of the 11700 block of Bellflower Blvd. will be entitled to the same privileges and be subject to the same requirements as all of the other properties within the preferential parking districts on Corrigan Ave. and Buckles St. Mayor Frometa thanked Mr. Norris for his presentation and requested to confirm the pilot program applies to residents of single-family residential properties and does not include residents of apartment buildings. Mr. Norris confirmed the pilot program is for seven single-family residential properties only. Council Member Sosa inquired regarding the length of the pilot program. Mr. Norris responded the pilot program has no set deadline and added the City Traffic Engineer must evaluate the effectiveness of the program within 18 months of its effective date to determine whether the pilot program should continue. Mayor Pro Tern Trujillo inquired regarding certain properties on Bellflower Blvd. Mr. Norris identified the properties as multi -family apartment buildings. Mayor Frometa, at 7:23 p.m., opened this item for public comment. Mayor Frometa asked City Clerk Duarte if there were any written comments received regarding the Public Hearing item. City Clerk Duarte confirmed no written comments were received. BC, resident, commented regarding the need for preferential parking districts, bureaucracy, and the painting of a red curb at Stamps Rd. and Telegraph Rd. Buckles St. resident, no name provided, commented regarding designation of his property as part of the Corrigan Ave. preferential parking district, and requested to open the preferential parking district further. City Council Minutes Regular Meeting - August 8, 2023 3 Vanessa Hernandez, resident, commented in opposition to Item No. 1, ongoing parking issues on Corrigan Ave., and alternate solutions for residents of Bellflower Blvd. Resident, no name provided, commented in opposition to Item No. 1, parking enforcement, and ongoing parking issues on Corrigan Ave. Kendra, Corrigan Ave. resident, commented in opposition to Item No. 1, ongoing parking issues on Corrigan Ave. and preferential parking district renewals. Corrigan Ave., resident, no name provided, commented in opposition to Item No. 1, ongoing parking issues on Corrigan Ave., and parking at the Downey Landing. Bellflower Blvd. resident, no name provided, commented in favor of Item No. 1, available on -street parking, and safe parking for residents of Bellflower Blvd. Edwin, Buckles St. resident, commented in opposition to Item No. 1, signage on Buckles St., and ongoing parking issues. Having no one else, Mayor Frometa closed the Public Hearing at 7:42 p.m. Mayor Frometa commented regarding parking enforcement, population growth, and parking relief for single-family dwelling residents of Bellflower Blvd. She commented regarding efforts to make additional parking available at the Downey Landing and concerns regarding liability. Mayor Pro Tern Trujillo requested to schedule a meeting with the owners of the Downey Landing to discuss utilizing the Downey Landing for additional parking. Mayor Frometa expressed her willingness to meet with property management for the Downey Landing. Mayor Pro Tern Trujillo commented regarding continued efforts to address the issue, additional parking spaces being added on the South side along Stewart and Gray Rd, and installation of signage. He inquired regarding Code Enforcement staff time for parking enforcement. He encouraged residents to report vehicles parked on streets for more than 72 hours. He commented in favor of providing parking relief to residents of Bellflower Blvd. Council Member Horn stated Corrigan Ave. residents were issued preferential parking permits on September 15, 2022 and Buckles St. residents were issued preferential parking permits on May 23, 2023. He expressed concerns regarding non-resident parking, litter, public nuisances, public safety, and parking for those with disabilities. He commented regarding the number of parking spots available on Buckles St. and Corrigan Ave. and ongoing parking issues. He suggested extending the preferential parking time from 6 p.m. and opening parking at the local park to relieve the parking issue. Council Member Sosa inquired regarding installed signage and parking enforcement. Mr. Norris responded the residential preferential parking program requires that 50% of residential properties purchase permits before signs may be installed and the Buckles St. preferential parking district may not have this requirement. He added the parking restrictions are in effect between 2 a.m. and 6 a.m. so the patrol units must be called to cite vehicles. Police Chief Murray confirmed parking enforcement staff is not schedule between 2 a.m. and 6 a.m. so parking enforcement would fall to regularly scheduled Police Officers responding to calls for service. She stated parking enforcement will be prioritized for particular problems and urged residents to call the Police Department to issue citations. City manager Bradley stated staff can provide priority enforcement for this area of the City. Mayor Frometa requested staff install signage regarding the preferential parking district. City Council Minutes Regular Meeting —August 8, 2023 4 City Manager Bradley inquired regarding Council direction to form a Council ad hoc committee regarding parking at the Downey Landing. Mayor Pro Tern Trujillo commented in favor of formation of a Council ad hoc committee to hold a discussion with management of the Downey Landing and address potential issues such as liability. It was moved by Mayor Pro Tern Trujillo, seconded by Mayor Frometa, and carried 3-1, with Council Member Horn voting no, to: 1) INTRODUCE ORDINANCE NO. 23-1608, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3199.6 WITHIN PART 12, CHAPTER 1 OF ARTICLE III OF THE DOWNEY MUNICIPAL CODE RELATING TO RESIDENTIAL PERMITTED PARKING DISTRICTS; AND, 2) ADOPT RESOLUTION NO. 23-8184, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXPANDING EXISTING PREFERENTIAL PARKING DISTRICTS ON CORRIGAN AVENUE AND BUCKLES STREET. Ramon Casas, resident, expressed concerns regarding vandalism and trespassing at the Downey Church of Christ, illegal vendors, and street racing. Having no one else, Mayor Frometa closed public comment. CONSENT CALENDAR Mayor Pro Tern Trujillo abstained from Item No. 13 due to owning property in the area. RECEIVED AND FILED A REPORT ON SALES TAX RESULTS FOR THE FIRST QUARTER OF CALENDAR YEAR 2023 Council Member Sosa left the City Council meeting at 8:18 p.m. ADMINISTRATIVE REPORTS 16. STATUS UPDATE ON THE IMPLEMENTATION OF A CITYWIDE FIBER OPTIC NETWORK SYSTEM: Public Works. RECEIVED AND FILED A STATUS UPDATE ON THE IMPLEMENTATION OF A CITYWIDE FIBER OPTIC NETWORK SYSTEM WITH SIFT NETWORKS DOWNEY, LLC Director of Public Works Matthew Baumgardner presented the staff report for Item No. 16. He provided background information regarding the Council's strategic goal for implementing the network, access to reliable high-speed internet, and the history of the development agreement with SiFi Networks Downey, LLC. He shared the details of the agreement for the installation of approximately 250 miles of new fiber optic cable, 42 cables, and one central terminal and added the agreement does not preclude internet service providers from expanding their own networks and every property will have access to the network, which encourages competition and keeps pricing down. He explained the fiber optic installation process through microtrenching, microduct installation, lateral installation, and backfill of the trench. He clarified the typical completion time is one day to complete an area. He stated SiFi Networks estimates another six months to complete the design process and two to three years to complete installation throughout the City, which will be divided into 10 areas. He reported the cost of the $100 million project would be funded by SiFi Networks with no cost to the property owners and SiFi Networks would pay the City's costs for review, permitting, and inspection. He added the City would coordinate with SiFi Networks to complete review of the project, provide scheduling of the City's Capital Improvement Program projects, and ensure coordination of planning of projects to prevent conflicts. Mayor Frometa thanked Director Baumgardner for his report and inquired regarding streets that have been rehabilitated under the City's Street Improvement Program. Director Baumgardner responded the microtrenching method and location of the installation ensures minimal impact to the street. Mayor Frometa inquired regarding an anticipated update in January 2024. Director Baumgardner responded the project design should be completed in January, with staff coordinating the schedule, and construction beginning in the first quarter of 2024. He stated SiFi Networks would ideally complete their work before the street is repaved. Mayor Frometa inquired regarding prioritization of the 10 sections of the City. Director Baumgardner responded this matter could be discussed during the January 2024 update and the 10 areas could follow those developed under the repaving plan. He clarified access will be unavailable until the end of the project when the system is connected to the central terminal. Mayor Frometa inquired regarding the warranty on the backfilling of the microtrench. Director Baumgardner responded the warranty was not addressed in the development agreement and he would report back to the City Council regarding the warranty.
