NOVEMBER 22, 2005
The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:38 p.m., Nowmber 22, 2005, in the Council Chamber of the Downey
City Hall, 11111 Brookshire Avenue, Downey, California, Mayor/Chairman Anne M. Bayer presiding.

NON-AGENDA PUBLIC COMMENT: No one came forward to speak.
APPROVAL OF CLOSED SESSION MINUTES
It was moved by Mayor Pro Tem/Vice-Chairman Perkins, seconded by Council
Member/Commissioner Trejo and unanimously carried to approve the Closed Session Minutes of
November 8, 2005.
RECESS TO CLOSED SESSION
Mayor/Chairman Bayer announced the Council/Commission is ncessing to Closed
Session (6:69 p.m.) to discuss matters under the authority of the following sections of the
Government Code:

Government Code Section 54956.9(b) – Conference with legal counsel – anticipated
litigation. Significant exposure to litigation – one potential case.
Government Code Section 54956.8 – Conference with real property negotiator Charles Vose
re: 8350 Firestone Boulevard; negotiating party: 3627 Tweedy, LLC; under negotiations: price
and terms of payment.
3.Government Code Section 54957.6 – Conference with labor negotiator Lee Powell re:
direction for labor negotiations with Downey Public Safety Auxiliary and Downey Police
Management Association.

NOVEMBER 22, 2005
The City Council of the City of Downey held a Regular Meeting at 7:34 p.m., November 22,
2005, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey,
California, Mayor Anne M. Bayer presiding.

PRESENTATIONS:
Mayor Bayer presented the Mayor's Award for Service to the City to Jason Riddle,
Equipment Maintenance Supervisor, Public Works Department.
Richard Lehman, Sacramento Lobbyist, gave an update on lobbying activities for the City.
PUBLIC HEARINGS: None
NON-AGENDA PUBLIC COMMENT:
Russell Rankin, resident of Downey, expressed concern regarding the residential
construction taking place in Downey without licensed contractors and indicated he is working with
various authorities on this issue.
Maria Larkin, resident of Downey, thanked the Council for their support of the upcoming
Holiday Lane Parade.
Harold Tseklenis, resident of Downey, thanked the Public Arts subcommittee consisting of
Mayor Bayer and Council Member Cartozian and the entire Council for their support of the Arts in
Public Places Program.

CONSENT CALENDAR – ITEMS FOR REMOVAL:
7.ACCEPTANCE OF $204,000 FEDERAL FIRE ACT GRANT FUNDS AND
APPROPRIATION OF $120,000 OF CITY FUNDS FOR FIRE DEPARTMENT RADIO
EQUIPMENT IMPROVEMENTS: Fire. This item was pulled by Staff and will be brought
back at the December 13, 2005 meeting.

It was moved by Council Member Cartozian, seconded by Council Member Gafin and
unanimously carried to approve the remaining Consent Calendar items as recommended:

A. ADOPTED ORDINANCE NO. 05-1182, AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE. ARTICLE VIII.
BUILDING REGULATIONS, BY ADDING A NEW CHAPTER 10 ENTITLED “ART IN
PUBLIC PLACES”.
B. ADOPTED RESOLUTION NO. 05-6882, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY ADOPTING AN “ART IN PUBLIC PLACES” POLICY MANUAL.
10.ADOPTED RESOLUTION NO. 05-6883, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPOINTING BRENT GABLE TO THE EMERGENCY
PREPAREDNESS COMMITTEE FOR COUNCIL DISTRICT ONE: Administration.

11.ADOPTED RESOLUTION NO. 05-6884, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY ESTABLISHING AN ALL-WAY “STOP” AT THE INTERSECTION OF
DOWNEY AVENUE AND SIXTH STREET: Public Works.
ADMINISTRATIVE REPORTS: None
OTHER BUSINESS – Council Member Announcements or Requests for Future Agenda Items:
Council Member Gafin recognized in attendance Darrell Dixon, a representative of the
Downey Chamber of Commerce Board of Directors; gave a brief status report as the City’s
representative to Southern California Association of Governments (SCAG) indicating that they are
doing a study regarding imposing a surcharge for containers at Long Beach/Los Angeles harbors
that would help pay for traffic shifting and air pollution abatement; wished Mayor Pro Tem Perkins a
belated Happy Birthday; announced that he had attended a recent Library Advisory Board meeting;
and that he had listened to the audio tapes of the second workshop meeting regarding Residential
Code Revisions which had an attendance of approximately two-hundred (200) citizens.
Council Member Cartozian congratulated Mayor Bayer on her completion of the year as
Mayor; announced that the Residential Code Revisions should be drafted by the end of the year and
requested the press to provide coverage regarding the January 5, 2006 Planning Commission Public
Hearing; noted that today is the forty-third (43'd) anniversary of President John F. Kennedy’s
passing; and indicated support for mixed use with higher density in downtown Downey.
Council Member Trejo announced a “Christmas on the Island” event to be held on December
10, 2005 at 5:00 p.m. which includes caroling on Del Rio Road and an appearance of Santa Claus;
requested a meeting of the Downtown subcommittee; requested a meeting with the Police Chief
regarding shopping carts and graffiti; indicated that he is working with Eddie Tafoya of
Congresswoman Lucille Roybal-Allard’s office regarding workshops for Downey citizens on
Medicare benefits; and thanked the Fire Chief for the ride in the new ladder fire truck this evening.
Mayor Pro Tem Perkins indicated that he hopes Council Member Gafin will remain the City's
representative to SCAG; congratulated Mayor Bayer on doing a fine job during her year as Mayor
and highlighted some of the accomplishments during this time; and stated that he also enjoyed the
ride on the new fire truck.
Mayor Bayer thanked her sisters in Soroptimist for the beautiful flower arrangement provided
tonight for her last meeting as Mayor; thanked her Commissioners and friends for their support and
indicated it has been a pleasure serving this last year as Mayor.
STAFF COMMENTS:
City Manager Caton congratulated Mayor Bayer on doing an outstanding job this year noting
many accomplishments.

The meeting adjourned to 6:00 p.m., December 6, 2005 (Mayoral transition ceremony), in
the Council Chamber of Downey City Hall.
