MINUTES OF THE
CITY COUNCIL OF THE CITY OF DOWNEY
SPECIAL MEETING
OCTOBER 5, 2005
The City Council of the City of Downey held a Special Meeting at 8:02 a.m., October 5, 2005,
in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California,
Mayor Anne M. Bayer presiding.

Mayor Bayer announced the Council is (8:02 a.m.) to discuss
matters under the authority of the following sections of the Government Code:
1. Government Code Section 54956.8(b) – Conference with real property negotiator Charles
Vose re: 12000 Lakewood Boulevard; negotiating party: Downey Landing LLC; under
negotiations: price and terms of payment.
2. Government Code Section 54957.6 – Conference with labor negotiator Lee Powell re:
direction for labor negotiations with Police Officers’ Assn.; Police Management Assn.; Public
Safety Auxiliary; City Employees Association – Maintenance Unit.

The meeting in Open Session at 8:48 a.m. with Mayor Pro Tem Perkins absent.
Mayor Pro Tem Perkins took the dais at 8:49 a.m. There were no Closed Session actions to report.
1. REQUEST BY STAPLES AND DOWNEY LANDING (ECLIPSE DEVELOPMENT GROUP)
TO ALLOW FOR SHOPPING CENTER STORE OPENINGS PRIOR TO COMPLETION OF
STEWART AND GRAY ROAD STREET IMPROVEMENTS – 12000 LAKEWOOD
BOULEVARD:

City Attorney/Economic Development Director Vose stated that the City had received a letter
from Staples and several telephone calls from the seven (7) retail establishments listed regarding
their planned openings based upon the Council’s decision at the September 27, 2005 meeting to not
allow any further openings until the Stewart and Gray Road improvements are completed. They are
requesting that the Council reconsider that decision.
Council Member Perkins inquired if there were any representatives from the listed retail
establishments present and was informed that Monica Douglas from Old Navy and Rona Griego
from Elephant Bar were present.
It was moved by Council Member Trejo, seconded by Mayor Bayer to approve the
recommendation to allow the store openings listed in the staff report. Mayor Bayer requested an
amendment to direct the City Attorney to return with an all inclusive agreement with Eclipse
Development Group for the October 25, 2005 meeting. Council Member Trejo agreed to the
amendment.
Council Member Perkins asked the two (2) representatives from the retail establishments
why they weren’t present at the City Council meeting last week to make their requests and was
informed that they were not aware of there being any issues with their openings until after the
meeting.
Council Member Trejo called for the question to which Mayor Pro Tem Perkins and Council
Member Gafin responded that the item should be allowed to be discussed thoroughly and suggested
postponing the matter until there were less time constraints.
Council Member Trejo withdrew his call for the question and his previous motion.
It was moved by Council Member Trejo, seconded by Mayor Bayer and carried by the
to approve the opening of Staples this coming weekend and postpone a
following vote
decision on the other six (6) stores until the October 11, 2005, a regular City Council meeting.
