The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:34 p.m., April 26, 2005, in the Council Chamber of the Downey

APPROVAL OF CLOSED SESSION MINUTES
It was moved by Council Member/Commissioner Trejo, seconded by Mayor Pro
Tem/Vice-Chairman Perkins and unanimously (4/0) carried to approve the Closed Session Minutes
of April 12, 2005.
RECESS TO CLOSED SESSION
Mayor/Chairman Bayer announced the Council/Commission is recessing to Closed Session
(6:35 p.m.) to discuss matters under the authority of the following sections of the Government Code:
1.SECTION 54957 – Public Employee Appointment/Contract. Position: Chief of
Police
2.SECTION 54957.6 – Conference with labor negotiator Lee Powell re: direction for
labor negotiations with Downey Police Officers’ Association.

The City Council of the City of Downey held a Regular Meeting at 7:34 p.m., April 26, 2005,
in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California,

Mayor Bayer presented the Mayor’s Award of Service to the City to Sandy Gall,
Administrative Clerk, Finance Department.
Mayor Bayer presented a Proclamation declaring April 25th – May 1 st as West Nile Virus and
Mosquito & Vector Control Awareness Week to Minoo Madon, Scientific Technical Services
Director of Greater Los Angeles County Vector Control District.
Mayor Bayer presented a Proclamation declaring May 1 st – 8th as annual Holocaust Days of
Remembrance.
Mayor Bayer presented a Proclamation declaring the month of May as Motorcycle Awareness
Month to John McDonald.

Mayor Bayer presented a Certificate of Re-appointment to the City Hospital Commission to
Dwight Simpson, for Council District Four.
PUBLIC HEARING:
1.DOWNEY MUNICIPAL CODE AMENDMENT RE: BUILDING BULK AND MASS
OF DETACHED SINGLE FAMILY DWELLINGS.
A. INTRODUCE ORDINANCE NO. , AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL
CODE, ARTICLE IX, CHAPTER 1, SECTIONS 9110 AND 9112, TO ADD
STANDARDS RELATING TO THE BUILDING BULK AND MASS OF DETACHED
SINGLE FAMILY DWELLINGS IN THE R-1 (SINGLE FAMILY RESIDENTIAL)
AND R-2 (TWO FAMILY RESIDENTIAL) ZONES (CODE AMENDMENT No. 05- 01):

Mayor Bayer opened the Public Hearing at 7:50 p.m. City Clerk Midstokke affirmed
receipt of the Proof of Publication. It was moved by Mayor Pro Tem Perkins, seconded by Council
Member Gafin and so ordered to receive and file.
Asst. Director of Community Dev./City Planner Yoshiki presented a Power Point presentation
explaining that the current Code allows for a home to be built with four foot side yard setbacks,
which results in a distance of eight feet between homes. A home may be built with up to 50% (fifty
percent) of lot coverage with the second story covering 100 percent of the first story. The current
trend of building second stories on homes is giving the appearance of over building. He explained
that staff had examined other surrounding cities and has come up with the solution of allowing only
two-thirds coverage for a second story. This would create two scenarios for the second story; the first
being a four foot setback on one side of the home and a ten foot setback on the other side of the
home; or, the second scenario would allow for eight feet setback on either side of the home. He also
stated that while this solution does not eliminate the building of larger homes, it does address some of
the concerns that were raised by the Council and the Planning Commission while maintaining the
property owners rights to improve their homes. He concluded that any homes that were built under
the current conditions would be out of compliance but would not have to come into compliance
unless a situation arose where they remodeled their home by 90% (ninety percent) or more.

There being no further speakers, it was moved by Mayor Pro Tem Perkins, seconded by
Council Member Trejo and unanimously carried (4/0) to continue the Public Hearing and to send
the item back to the Planning Commission for further review.
Prior to the vote Council Member Gafin suggested a better format ofpublicizing the issue be
found prior to the item coming back to Council so that a better representation of the community
would be present.
NON-AGENDA PUBLIC COMMENT:No one came forward to speak.

DOWNEY MUNICIPAL CODE RELATING TO SPEED LIMITS FOR
FLORENCE AVENUE: Public Works
Director of Public Works Alvarez presented a staff report explaining that periodically the City
must conduct traffic speed surveys throughout the City to determine if the current posted speed is the
correct speed for that area. This allows for the use of radar enforcement of violations. Florence
Avenue was the street being evaluated and at this time it is being recommended to leave the current
posted speed of 40 mph in effect.

It was moved by Mayor Pro Tem Perkins, seconded by Council Member Trejo and
unanimously carried (4/0) to introduce the Ordinance.
OTHER BUSINESS – Council Member Announcements or Requests for Future Agenda Items:
Council Member Trejo commended Public Works Director Alvarez for the ongoing public
improvements at Firestone & Lakewood Boulevards; noted that there was a lot going on in the City in
both commercial and residential construction; and said he rode his bike to work recently which
allowed him to get a different perspective of the City.
Council Member Gafin announced that he had recently attended the Library Volunteer
Awards event along with Mayor Bayer and Mayor Pro Tem Perkins and noted that Downey is special
because of all its volunteers; and announced the upcoming Chamber of Commerce Annual Street
Faire on Saturday May 7th.
Mayor Pro Tem Perkins announced that he had recently attended the Gangs Out of Downey
(GOOD) Annual luncheon; the Rotary Club 80th anniversary celebration; and Amistad 2005 Gala
fund raiser for Rancho Los Amigos National Rehabilitation Center; announced that Congress
Member Lucille Roybal-Allard had recently held the 12th Annual 34th Congressional District Student
Art Competition and noted that David Chao, a 12th grader from Downey High School received
honorable mention.
Mayor Bayer announced that she had recently attended a tour of the City with the Keep
Downey Beautiful group judging homes and had seen the entire City in about two hours; and
announced that May 5th at noon at the City flagpole will be the National Day of Prayer services.
STAFF MEMBER COMMENTS :
City Manager Caton requested that the meeting also be adjourned in memory of former
Assistant to the City Manager Scot Yotsuya who recently passed away.
ADJOURNMENT: 9: 10 p.m.
The meeting adjourned in memory of Steve Jensen, retired City of Downey Building
Inspector and Downey resident; and Scot Yotsuya, former Assistant to the City Manager to
6:30 p.m., May 10, 2005, in the Council Chamber of Downey City Hall.
