FEBRUARY 8, 2005
The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:32 p.m., February 8, 2005, in the Council Chamber of the Downey
City Hall, 11111 Brookshire Avenue, Downey, California, Mayor/Chairman Anne M. Bayer
presiding.

APPROVAL OF CLOSED SESSION MINUTES
It was moved by Mayor Pro Tem/Vice-Chairman Perkins, seconded by Council
Member/Commissioner Trejo and unanimously carried to approve the Closed Session Minutes of
January 25, 2005.
RECESS TO CLOSED SESSION
Mayor/Chairman Bayer announced the Council/Commission is recessing to Closed Session
(6:33 p.m.) to discuss matters under the authority of the following sections of the Government Code:
1.SECTION 54957 – Public Employee Appointment – Position: Development Services
Director.
2.SECTION 54957.6 – Conference with labor negotiator Gerald Caton re: direction for
labor negotiations with Downey Executive and Middle Management.

The meeting reconvened in Open Session at 7:35 p.m. with all Council
Members/Commissioners present.

City Attorney Vose announced that pursuant to City Charter Section 604, the City Manager
requested approval for the appointment of Linda Haines as Development Services Director and the
appointment was confirmed by motion made by Mayor/Chairman Bayer, seconded by Council
Member/Commissioner Gafin and unanimously carried.
The meeting recessed at 7:36 p.m.

The meeting reconvened for Oral Communications at 7:43 p.m. with all Council
Members/Commissioners present (see Oral Communications under Regular City Council Meeting)
and recessed at 7:50 p.m.

The City Council of the City of Downey held a Regular Meeting at 7:39 p.m., February 8,
2005, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey,
California, Mayor Anne M. Bayer presiding.

PRESENTATIONS :
Mayor Bayer and former Mr. Downey Andrew Webb presented City pins to Mr. Downey
Josh Minero, second runner up Justin Lauer and Little Mr. Downey Mark Anthony Garcia.
NON-AGENDA PUBLIC COMMENT:
Lee Ann Sears, resident of Downey and member of the Emergency Preparedness Committee
and graduate of the Citizens Emergency Response Team (C.E.R. T.), spoke regarding a police
incident last Sunday that resulted in residents of an apartment building being evacuated. The
Downey Community Center was opened as emergency shelter and the people were very comfortable
with food and television provided. Ms. Sears commended all City departments involved and
indicated that this gave the affected citizens an opportunity to learn about C.E.R. T. and meet their
neighbors.

PUBLIC COMMENT –cont.
Gustavo Hernandez, resident of Downey, submitted a petition signed by eight residents of
Patton Road, Cleta Street and Manatee Street complaining about the hospital employees parking in
front of their properties and the associated problems. They indicated the two (2) hour parking
restriction does not work and requested permit parking for the residences.

12.ADOPTED ORDINANCE NO. 05-1170, AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF DOWNEY AMENDING SECTION 3186 OF THE DOWNEY
MUNICIPAL CODE RELATING TO SPEED LIMITS ON LAKEWOOD
BOULEVARD: Public Works.

13.CITY FACILITY NAMING POLICY ADDITIONAL CRITERIA: Administration.
City Manager Caton presented a staff report noting the matter went before the City Council on
May 11, 2004, detailing the City’s present policy for naming facilities. The City has since then
conducted additional research of how other cities handle the naming of facilities. He related that
Mayor Bayer requested that the following criteria be considered by Council for inclusion in the
City’s current policy: The person who the facility is to be named after be deceased for at least five
year and that the group or persons requesting the name change submit an application to the
Recreation & Community Services Commission, who in turn would make a recommendation to the
City Council.
Council Member Cartozian clarified with City Manager Caton that City facilities includes
streets as well.
Maria Larkin, Downey resident, stated she is opposed to honoring someone whose family has
to wait for them to be deceased for five years. She supports the previously established City criteria.
Council Member Cartozian stated he feels it is important that the person to be honored be deceased for
five years feeling it takes away much of the emotion that can cloud the decision making process. He said he
would like to continue to work with staff and feels they are moving in a good direction.
Mayor Pro Tem Perkins said during his time on the Council the following people who are still
living with the exception of one person had street/City facilities named in their honor: Former
Congressman Steve Horn, former Council Members Barbara Riley (noting the facility was named in
her honor shortly after her death), Gary McCaughan and Diane Boggs. He supports the current
policy

Council Member Trejo said he cannot support the five years deceased criteria added to the
policy.
It was moved by Council Member Cartozian and seconded by Mayor Bayer to continue to
review the policy and work with staff and bring back to Council. No vote was taken on this motion
as a subsequent successful substitute motion was made.
Council Member Gafin said dealing with emotional situations is part of the difficult decisions
the Council has to make at times and he is not in support of the five years deceased criteria.
Council Member Cartozian suggested if the Council did not want the five year deceased
restriction, that the second part of the recommendation be: 1) the person to be honored not be
involved in the process and 2) any supporters of a person to be considered would submit letters to
the Council or City Manager and not lobby the City Council.
City Manager Caton suggested since the majority of the Council did not want the five year
deceased restriction, the second part of the proposal be brought back to Council which includes an
application process to be reviewed by the Recreation & Community Services Commission with a
recommendation to City Council.
It was moved by Mayor Pro Tem Perkins and seconded by Council Member Trejo for a
substitute motion to receive and file and leave the current policy in place.
Prior to voting on the substitute motion, the following discussions ensued:
City Attorney Vose clarified for Council a motion could not be made to not bring this item
back to Council, but rather receive and file the staff report and to leave the current policy “as is.”
Terry Lambros, Downey resident, said she had previously made a recommendation to the
Council that a committee be formed for the purpose of recommending persons to honor by naming
City facilities after them. She is opposed to the five years deceased restriction.
Lennie Whittington, Downey resident, feels if a person is deserving of having a City facility
named after them, they should be living.
Council Member Gafin stated he did not want the death restriction, but favored the application
process going through the Recreation & Community Services Commission
It was moved by Mayor Pro Tem Perkins, seconded by Council Member Trejo, and carried by
the following vote to make the substitute motion the main motion.

OF THE CITY OF DOWNEY APPOINTING BOARD OF DIRECTORS FOR THE
COLUMBIA MEMORIAL SPACE SCIENCE LEARNING CENTER FOUNDATION:
Administration.
Council Member Cartozian inquired if the Council subcommittee, consisting of himself and
Council Member Trejo, could have a role in the foundation. City Manager Caton responded this is a
non-profit foundation to help raise funds for the building of the museum. The Council subcommittee
will continue to work with Community Services Director Kehoe on the design of the park and actual
center
Council Member Trejo said he was glad to see this matter coming to Council and that the City
had control of the project. He offered to serve in any capacity on this project.
It was moved by Council Member Cartozian, seconded by Mayor Pro Tem Perkins and
unanimously carried to adopt the Resolution.
RESOLUTION NO. 05-6829
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPOINTING BOARD OF DIRECTORS FOR THE COLUMBIA MEMORIAL
SPACE SCIENCE LEARNING CENTER FOUNDATION.
OTHER BUSINESS – Council Member Announcements or Requests for Future Agenda Items :
Council Member Cartozian reported that the subcommittee on Public Art met again and
continues to make progress receiving information from many other cities and reviewing the positives
as well as the pitfalls of the programs; and congratulated Development Services Director Haines on
her new position overseeing the Planning, Building and Housing Divisions.
Council Member Gafin requested the status on his request for a report on the feasibility of
artificial grass on the medians; requested the status on his request on the City Manager evaluation
process; announced that the Downey Rose Float Association will be having an installation of officers
banquet at the Rio Hondo County Club this Friday night; and congratulated Director Haines on her
new posItIon.

OTHER BUSINESS – cont.
Council Member Trejo commended Public Works Director Alvarez for the resurfacing work
being done on Gallatin Road; and thanked Police Chief Finch for the update on the police incident
that occurred on Sunday.
Mayor Pro Tem Perkins inquired whether the petition regarding parking on residential streets
near the hospital will be forwarded to the Parking Commission; announced that he had participated in
the recent Catholic Schools Week; announced that he had attended the recent grand opening of the
new Albertsons market; thanked Police Chief Finch for the handling of the police incident last
Sunday; and thanked Lee Ann Sears for coming forward tonight and reporting about the evacuation
of residents and the emergency shelter.
Mayor Bayer thanked Lee Ann Sears and Janet Molinaro for their television interviews
regarding the police incident last Sunday and thanked Police Chief Finch for the handling of the
incident; congratulated fellow Soroptimist Linda Haines on her new position as Development
Services Director; and noted that the various City departments and resources did a tremendous job in
working together last Sunday during the police incident.
STAFF MEMBER COMMENTS:
City Manager Caton congratulated Development Services Director Haines on her new
position; and noted the unfortunate police event that occurred last Sunday and commended the
various City departments for working together so well.
City Attorney Vose announced that the next City Council meeting will be preceded by an
update on the NASA development project at 6:30 p.m..
