The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:35 p.m., January 11, 2005, in the Council Chamber of the Downey

It was moved by Mayor Pro Tem/Vice-Chairman Perkins, seconded by Council
Member/Commissioner Trejo and unanimously carried (4/0) to approve the Closed Session
Minutes of December 14, 2004.
RECESS TO CLOSED SESSION
Mayor/Chairman Bayer announced the Council/Commission is recessing to Closed Session
(6:36 p.m.) to discuss matters under the authority of the following sections of the Government Code:

PUBLIC COMMENT
Luis Marquez, field deputy for State Senator Alan Lowenthal and Downey resident,
introduced himself to the Council and presented former Mayor Cartozian with a Certificate of
Appreciation for his year as Mayor from former Assembly Member Lowenthal.
Mike Holland, field deputy for Assembly Member Hector De La Torre, introduced himself to
the Council and informed them of the committees to which the new Assembly Member has been
appointed.
Craig Schwerdt, resident of Downey, expressed that he has reservations about the recently
approved City Attorney/Economic Development Director contract and that this may be too many hats
for one person.

CONSENT CALENDAR – ITEMS FOR REMOVAL
Council Member Gafin indicated that he will be abstaining on Item 13, setting the date for the
Public Hearing, for appeal of Conditional Use Permit #04-59 and Zone Variance #04-60 for property
located at 12245 Woodruff Avenue, as he lives within five hundred feet of the property.

18.APPROVE CITY COUNCIL COMMITTEE ASSIGNMENTS FOR 2005: Mayor Bayer.
City Clerk Midstokke noted that there were two supplemental items submitted for this item A)
a new assignment list with two changes on it and B) a memo from Council Member Cartozian.
It was moved by Council Member Trejo, seconded by Mayor Bayer to approve the list as
presented. There was no vote on this motion as a substitute motion was subsequently made.
Council Member Cartozian read his supplemental memo indicating that previously he had
served on seven committees and had been removed from them. He would like to look at each
committee individually to determine if Mayor Bayer’s suggested appointments are the best qualified
member for the position and he is interested in retaining all of his previous assignments.
A substitute motion was made by Council Member Cartozian, seconded by Mayor Pro Tem
Perkins to take each committee assignment individually. The substitute motion is restated and the
vote is listed below
Mayor Pro Tem Perkins explained the importance to have unity amongst the Council and
while he had seconded the motion, it was to allow discussion, as he felt any Council Member with an
issue has the right to discuss the matter. He is happy with the assignments given to him and feels that
it is the Mayor’s call to make the assignments.
Council Member Trejo noted that he had no objections to the assignments as presented and
said sometimes it is good to move things around so that they all have the opportunity to learn about
the various committees.
Council Member Gafin mentioned that he feels he is more than qualified to serve on the
committees assigned.

Mayor Bayer responded that she appreciates everyone’s opinions, however, she did take into
consideration every member’s special talents and there is sometimes more than one person who may
be qualified for the job. She made her decisions based on what she felt was best for the City.
City Attorney Vose clarified that a vote needed to be taken on the substitute motion made by
Council Member Cartozian and depending on the outcome, then vote on the first motion.
Council Member Cartozian inquired that since they are recommendations, do they have to be
voted on and if the Mayor and Council are allowed to direct the City Manager and staff to serve in a
capacity on these committees. City Manager Caton responded that yes, the Council has always voted
on them in the past and that if it is in the best interest of the City for voting purposes, yes, they can be
appointed. Council Member Cartozian went on to state that the assignments don’t make any sense to
him and he wants justification for his removal from committees.

Council Member Gafin stated that he is in favor of open government and would gladly discuss
each item, however, he had no problem with voting as a slate either.
Mayor Pro Tem Perkins stated that he seconded the motion to have discussion, however, he is
very happy with his assignments and just this evening had met with the Mayor and asked to be
removed from two of his assignments.
Council Member Trejo noted that he was removed from many committees last year and never
complained about it as he felt it was better for the team and the City to let the Mayor make his
choices at that time.
A substitute motion was made by Council Member Cartozian, seconded by Mayor Pro Tem
Perkins and carried by the following vote to take each committee assignment individually.

1.California Contract Cities Association Board (CCCA)
It was moved by Mayor Pro Tem Perkins, seconded by Council Member Gafin and
unanimously carried to approve Meredith Perkins as the primary and Anne Bayer as the alternate
assigned to the California Contract Cities Association Board (CCCA).
2.Chamber of Commerce Board of Directors, City Representative
It was moved by Mayor Pro Tem Perkins, seconded by Council Member Gafin and
unanimously carried to approve David Gafin as the primary and Anne Bayer as the alternate
assigned to the Chamber of Commerce Board of Directors City Representative.
3.City-Chamber of Commerce Committee
It was moved by Council Member Cartozian, seconded by Council Member Gafin and
unanimously carried to approve Kirk Cartozian and David Gafin as the primary and remove Gerald
Caton as the alternate to the City-Chamber of Commerce Committee.
4.City-School Coordinating Committee
It was moved by Council Member Cartozian, seconded by Mayor Pro Tem Perkins to appoint
Kirk Cartozian and Anne Bayer as primaries to this committee. The second was subsequently
withdrawn.
It was moved by Mayor Bayer, seconded by Council Member Trejo and carried by the
following vote to approve Anne Bayer and Rick Trejo as primaries assigned to the City-School
Coordinating Committee.

It was moved by Mayor Pro Tem Perkins, seconded by Council Member Cartozian and

City Affairs Committee.
6.Downey Community Hospital Foundation Board of Directors
It was moved by Mayor Pro Tem Perkins, seconded by Council Member Trejo and
unanimously carried to approve Council Members with Mayor Pro Tem Perkins as the lead assigned
to the Downey Community Hospital Foundation Board of Directors.
7.Downey Police/Fire Foundation (DPFF)
It was moved by Mayor Pro Tem Perkins, seconded by Council Member Gafin and
unanimously carried to approve Anne Bayer as primary and Meredith Perkins as alternate assigned
to the Downey Police/Fire Foundation (DPFF).
8. Gangs Out of Downey (GOOD)
It was moved by Council Member Gafin, seconded by Council Member Cartozian and
unanimously carried to approve Kirk Cartozian and David Gafin as primaries assigned to Gangs
Out of Downey (GOOD).
9.Gateway City Council of Governments
It was moved by Mayor Pro Tem Perkins, seconded by Council Member Trejo and
unanimously carried to approve Anne Bayer as primary and remaining members as alternate
assigned to Gateway City Council of Governments.
10.Greater Los Angeles County Vector Control District
It was moved by Mayor Pro Tem Perkins, seconded by Council Member (Iann and
unanimously carried to approve Meredith Perkins as primary assigned to Greater Los Angeles
County Vector Control District.

It was moved by Council Member Gafin, seconded by Council Member Trejo and failed by
the following vote to approve Anne Bayer and Rick Trejo as primaries assigned to Downey Landing

Temporary Ad Hoc Subcommittees
1. Art & Cultural Commission (12-14-04)
It was moved by Mayor Pro Tem Perkins, seconded by Council Member Gann and
unanimously carried to approve Anne Bayer and Kirk Cartozian as primaries assigned to Art &
Cultural Commission Subcommittee.
CONSENT CALENDER – ITEMS REMOVED BY COUNCIL APPROVAL:
5.APPROVE CONTRACT FOR ON-CALL LEGAL SERVICES WITH OLIVER, VOSE,
SANDIFER, MURPHY & LEE: Administration.
Mayor Pro Tem Perkins inquired if using this firm would present any conflicts of interest
since Mr. Vose had been hired as an employee. City Attorney Vose responded that as of January 1,
2005, he no longer has any financial interest in the firm. The firm’s name will be changing at some
point in the near fUture to remove the name Vose.
Assistant City Manager Powell stated that the firm had been providing litigation services for
sometime and would provide continuity for the City to continue to use them on an on-call basis.
It was moved by Mayor Pro Tem Perkins, seconded by Council Member Gafin and
unanimously carried to approve the contract for on-call legal services with Oliver, Vose,
Sandifer, Murphy & Lee.
7.RECEIVE AND FILE THE COMPREHENSIVE ANNUAL FINANCIAL REPORT
FOR THE FISCAL YEAR ENDED JUNE 30, 2004: Finance.
Council Member Gafin asked the Finance Director to compare how the City did on budget
projections and actual for last fiscal year. Finance Director Michicoff stated that the projected
revenues had slightly exceeded expectations and expenditures had fallen below. In many areas the
City met or exceeded expectations.
It was moved by Council Member Gaan, seconded by Council Member Cartozian and
unanimously carried to receive and file the Comprehensive Annual Financial Report for the
Fiscal Year ended June 30, 2004.

Council Member Cartozian inquired if the Personnel Advisory Board was a necessary
commission to keep and was informed that it is in the City Charter. He then asked Mayor Bayer why
she was removing Mrs. Lumsdaine from the Planning Commission as his Planning Commissioner felt
she was doing a good job. Mayor Bayer responded that the decision had been made along with Mrs.
Lumsdaine due to her having scheduling conflicts because of other obligations and noted that Mrs.
Lumsdaine had also decided not to be on the Personnel Advisory Board.
City Clerk Midstokke read the title of the supplemental Resolution. It was moved by Council
Member Gafin, seconded by Mayor Pro Tem Perkins and unanimously carried to waiver further
reading and adopt the Resolution appointing Terry Lambros to the Planning Commission,
District Four, as amended.

OTHER BUSINESS – Council Member Announcements or Requests for Future Agenda Items:
Council Member Cartozian complimented the new agenda format and requested to have the
Council Announcements moved back to the beginning of the meeting near the Public Comment time.
Council Member Gafin mentioned that the Los Amigos Kiwanis is performing the “Odd
Couple“ this weekend at the Downey Civic Theatre as a fundraiser. He thanked Assistant City
Manager Powell for his promptness in responding to his request for a quarterly budget report.
Mayor Pro Tem Perkins noted that Consent Item #3 was the completion of the new Rio
Hondo Clubhouse which came in on time and under budget by $394,000 thanks to the efforts by
Public Works Director Alvarez. He mentioned that he had just returned from a trip to St. Louis to
visit his family and had attended a funeral for longtime business owner and resident of Downey,
Elton Waller. He suggested everyone take a few moments to give thanks for the many blessings they
have in their lives and wished everyone a Happy New Year.
Mayor Bayer announced that Carol Rowland and the Keep Downey Beautiful program
received first place in the Keep America Beautiful contest, the City will be receiving a Presidential
Circle award.
