PRESENT:Council Members/Commissioners: Kirk O. Cartozian Keith McCarthy Anne M. Bayer Meredith H. Perkins Rick Trejo Mayor/Chairman Mayor Pro Tempore/Vice-Chairman ALSO PRESENT:Gerald M. Caton, City Manager Charles S. Vose, City Attorney Kathleen L. Midstokke, City Clerk/Secretary Lee Powell, Assistant City Manager RECESS TO CLOSED SESSION Mayor/Chairman Cartozian announced the Council/Commission is recessing to Closed Session (6:35 p.m.) to discuss matters under the authority of the following sections of the Government Code: 1. SECTION 54957 – Public Employee Performance Evaluation/54957.6 – Salary Negotiations (Charles Vose, negotiator) – City Manager. 2. SECTION 54957 – Public Employee Performance Evaluation/Appointment/Employment (Lee Powell, negotiator) – City Attorney. RECONVENED The meeting reconvened in open session at 7:35 p.m. with all Council Members/- Commissioners present. There were no Closed Session actions to report. The meeting recessed at 7:35 p.m. City Council/Community Dev. Comm. Mayor/Chairman Cartozian announced the Council/Commission is recessing back to Closed Session (8:19 p.m.) to continue discussing items previously listed. MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING OCTOBER 26, 2004 The City Council of the City of Downey held a Regular Meeting at 7:38 p.m., October 26, 2004, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor Kirk Cartozian presiding. PRESENT:Council Members: Kirk O. Cartozian Keith McCarthy Anne M. Bayer Meredith H. Perkins Rick Trejo Mayor Mayor Pro Tempore ALSO PRESENT:Gerald M. Caton, City Manager Charles S. Vose, City Attorney Kathleen L. Midstokke, City Clerk Lee Powell, Assistant City Manager James Makshanoff, Assistant to the City Manager Desi Alvarez, Director of Public Works John Finch, Chief of Police Bonnie Kehoe, Director of Community Services John Michicoff, Director of Finance Mark Sauter, Fire Chief Linda Haines, Building Official Mark Sellheim, Principal Planner Ed Velasco, Housing Manager Ron Yoshiki, Asst. Director of Community Dev./City Planner Susan Domen, Executive Secretary COUNCIL MEMBER ANNOUNCEMENTS : Mayor Pro Tempore McCarthy congratulated Joshua Beal, Downey resident, on receiving the award of Eagle Scout; and stated that the City Manager had received a letter from the City of Garden Grove commending Chief Finch for his participation in their leadership development workshop. Council Member Perkins announced that he had attended the Downey/Warren football game on Saturday night; the Candidates Forum sponsored by Citizens for Downey; golf tournaments for the Living Help Center and the Police/Fire Departments; and the “Lights On After School“ bus tour of three local after school program sites. He stated he was very impressed with the after school programs the City provides. Mayor Cartozian mentioned that he had attended the school site visits also and was equally impressed with the job that staff does at these sites. He noted that next Tuesday is Election Day and recognized candidates Mark Vasquez, Dave Gafin and Jose Trujillo, City Council District 1; Keith McCarthy, Water Board; Desi Alvarez, West Basin Water District; and School Board Member Tod Corrin in the audience. City Council Minutes 10/26/04 -1- ui 4 b / 3 PRESENTATIONS : Mayor Cartozian presented the Mayor’s Academic Excellence Award to Michelle Sanchez, Senior at Warren High School. Mayor Cartozian presented a proclamation declaring the week of October 24-31 as “Breast Cancer Awareness Week“; and November as “End Domestic Violence Month” to Linda Haines, President of Downey Soroptimist. Mayor Cartozian presented a proclamation declaring October 28, 2004 as “National Immigrants Day”. HEARING 1.UTILITY EASEMENTS FOR EDISON SUBSTATION AT 12341 BELLFLOWER BOULEVARD: A.GRANTING UTILITY EASEMENTS TO SOUTHERN CALIFORNIA EDISON ON CITY PROPERTY AT 12341 BELLFLOWER BOULEVARD. B.RESOLUTION CERTIFYING AN ADDENDUM TO THE FINAL ENVIRONMENTAL IMPACT REPORT RE: THE GRANTING OF EASEMENTS FOR THE KAISER ELECTRICAL SUBSTATION PROJECT. Building Official Haines presented a staff report stating that Southern California Edison is requesting an easement for City property located along Bellf:lower Boulevard westbound on to the piece of property addressed as 12341 Bellflower Boulevard. The easement will provide access for an underground 66kV sub-transmission cable to power a new 66kV substation. The easement for the sub-transmission cable will consist of a strip of land 12 feet wide by 720 feet, while the easement for the substation will be 70 feet by 80 feet. Kaiser Permanente is funding the project. City Attorney Vose clarified that part of the motion be subject to the acceptance of the legal description by the Building Official; approval as to form of the grant of easement and the joint use agreement by the City Attorney; and subject to the delegation of authority to execute by the City Manager after such acceptance and approval has been granted by the Building Official and the City Attorney City Manager Caton explained that Kaiser Hospital will have to provide insurance for the use of this property. Richard Pridham , resident of Downey, inquired if this would be an above or below grade level substation and if by granting this land for Kaiser’s exclusive use, would it be setting a precedence for future requests. City Manager Caton responded that the easement is with Southern California Edison and not Kaiser Permanente and it is hoped that others will have need of the use of the substation in the future. It is an above ground facility that will have an eight foot chain link fence around the perimeter of the substation. City Council Minutes 10/26/04 -2- til 4 b / 4 City Clerk Midstokke read the title. It was moved by Council Member Perkins, seconded by Mayor Pro Tempore McCarthy and unanimously carried to grant the utility easements to Southern California Edison on property at 12341 Bellflower Boulevard and to waive further reading and adopt the Resolution with the additions noted by the City Attorney. RESOLUTION NO. 6811 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CERTIFYING THAT THE ADDENDUM INVOLVING THE GRANTING OF EASEMENTS FOR THE KAISER ELECTRICAL SUBSTATION TO THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE DOWNEY LANDING SPECIFIC PLAN IS ADEQUATE AND WAS PREPARED IN ACCORDANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT CONSENT CALENDAR – ITEMS FOR REMOVAL None CONSENT CALENDAR It was moved by Council Member Perkins, seconded by Mayor Pro Tempore McCarthy and unanimously carried to approve the Consent Calendar items as recommended: 2.COUNCIL MINUTES: ADJOURNED REGULAR MEETING, OCTOBER 12, 2004: Approve. 3. 4. 5. City Council Minutes 10/26/04 -3- u 14 b / 3 City Manager Caton presented a staff report indicating that the City Attorney has prepared an Ordinance for the Council’s approval that would incorporate the suggested additions to the Rules of Conduct that the Council directed at the last meeting. City Clerk Midstokke read the title. It was moved by Mayor Pro Tempore McCarthy, seconded by Mayor Cartozian and unanimously carried to waiver further reading and introduce the Ordinance. ORDINANCE (INTRODUCE) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE RELATING TO RULES OF CONDUCT FOR CITY COUNCIL MEETINGS AND ENFORCEMENT THEREOF. ORAI, COMMUNICATIONS – No one came forward to speak.
