JUNE 8, 2004
The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:42 p.m., June 8, 2004, in the Council Chamber of the Downey City
Hall, Mayor/Chairman Kirk Cartozian presiding.

APPROVAL OF CLOSED SESSION MINUTES
It was moved by Council Member/Commissioner Perkins, seconded by Council
Member/Commissioner Trejo and carried 4/0 to approve the Closed Session Minutes of May 11,
2004 and May 25, 2004.
RECESS TO CLOSED SESSION
Mayor/Chairman Cartozian announced the Council/Commission is recessing to Closed
Session (6:43 p.m.) to discuss matters under the authority of the following sections of the
Government Code:
1. SECTION 54956.8 – Conference with real property negotiators Gerald Caton and Darrell
George, re: property commonly known as Parcels 1 and 6 of the Downey NASA site
generally bounded by Stewart & Gray Road, Imperial Highway and Lakewood Boulevard;
negotiating party: Eclipse Development; under negotiation; price and terms of payment.
2. SECTION 54957.6 – Conference with labor negotiator Lee Powell re direction for labor
negotiations with the Downey City Employees’ Association – Maintenance and
Miscellaneous groups and the Downey Public Safety Auxiliary Association.

COUNCIL MEMBER ANNOUNCEMENTS
Mayor Pro Tempore McCarthy recognized David Gafin, President of Gangs Out of Downey,
Planning Commissioner for District One and future candidate for City Council, in the audience
tonight; announced that he had attended the Spring Home Beautification Awards which is a great
community event; and mentioned attending the recent opening of the City of Paramount new Civic
Center
Council Member Perkins thanked Mayor Pro Tempore McCarthy for his kind words about
former President Ronald Reagan; also attended the Keep Downey Beautiful Spring Home
Beautincation Awards; attended the Chamber of Commerce 7th Annual Awards Luncheon; and
attended an event at Downey High School where Mayor Cartozian was installed into the Hall of
Fame
Council Member Trejo mentioned that while listening to the radio this morning, heard Dr.
Ballard, one of the discoverers of the Titanic shipwreck, say hello to his friends at Downey High
School.

Mayor Cartozian announced that he had attended the St. George Greek Church Festival; held a
subcommittee meeting with Council Member Bayer and the Police and Fire Associations
representatives; attended an event for Rita Tapalian who is running for the State Assembly in the 58th
District; attended Downey Council PTA Scholarship event; announced that there would be a Downey
USC Alumni event tomorrow night at Vasilio’s Restaurant on Firestone Boulevard at 7:30 p.m.; and
announced that he had participated in the recent NASA e-mission learning program with the Downey
schools
PRESENTATIONS
Mayor Cartozian presented a plaque to Gerard Reyes, representing Senator Betty Karnette, in
appreciation of her years of service to the City as State Senator for the 27th Senatorial District.
Mayor Cartozian presented a Certificate of Appreciation to Jonathan Martin Robles, Downey
High School Senior, in recognition of perfect school attendance from Kindergarten through 12th
grade
PUBLIC HEARINGS:
1.LIGHTING AND LANDSCAPING DISTRICT A.D. 121, FISCAL YEAR 2004-2005.
Mayor Cartozian opened the Public Hearing at 7:52 p.m. City Clerk Midstokke affirmed
receipt of Proof of Publication and Affidavit of Posting. It was moved by Council Member Perkins,
seconded by Council Member Trejo and so ordered to receive and file.
Public Works Director Alvarez presented a brief staff report explaining the seven zones of the
District. He indicated all of the zones are the same as last year except for zone three, which was
raised back to the 2003-03 level.
No one coming forward to speak, it was moved by Mayor Pro Tempore McCarthy, seconded
by Council Member Perkins and so ordered to close the Public Hearing at 7:55 p.m.
City Clerk Midstokke read the title of the Resolution. It was moved by Council Member
Trejo, seconded by Council Member Bayer and unanimously carried to waive further reading and
adopt the Resolution which confirms the 2004-2005 Fiscal Year Assessment for Lighting and
Landscaping District A.D. 121.
Prior to the vote, Mayor Pro Tempore McCarthy reminded everyone that non-working
streetlights can be reported through the City website; however, 85% of the streetlights are owned by
Southern California Edison Co. and not the City.

ORAT I COMMUNICATIONS
Craig Schwerdt, resident of Downey, thanked City staff for the presentation of information at
the recent Budget workshop and indicated that he supports a beginning balanced budget.
Jennifer Galacki, representative of Union Local # 777 which represents Downey Public Safety
Auxiliary Association and Downey City Employees Association, referred to the labor contract that
expired in October of 2003, the duties of members and that they have proposed many cost saving
measures to address the budget crisis.

RESOLUTION NO. 6773 (ADOPT)

CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE
OFFICE PERTAINING TO CANDIDATES’ STATEMENTS SUBMITTED TO THE
VOTERS AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON
TUESDAY, NOVEMBER 2, 2004.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 3186 OF THE DOWNEY MUNICIPAL CODE RELATING
TO SPEED LIMITS FOR GALLATIN ROAD.

18.LOAN DOCUMENTS FOR THE $2.5 MILLION LOAN FROM THE U.S.
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR THE NASA
PARK PROJECT.
Housing Manager Velasco presented a brief staff report explaining the three funding
sources for the development of the park at the former NASA property. He noted that this is the third
source of funding and is in the amount of $2.5 million. The application must be submitted by June
15th, then the transaction would occur on June 30th and the monies received on July 1st. The loan is
for ten years.
Mayor Pro Tempore McCarthy inquired as to what the annual interest would be and was
informed that the amount would vary from year to year with an average rate of 4.7%. The costs
would be covered by the CDBG funds.
Council Member Trej o asked if the interest rate is a fixed rate. It was explained that there are
ten different certificates, one coming due each year and they are all different, but have set rates.
Mayor Cartozian questioned if the loan could be paid back earlier than the ten years and was
informed that it could not. The City has the option to set aside the money but they cannot pay it off in
advance as there are investors that are guaranteed the payouts of the certificates each year.
City Clerk Midstokke read the title of the Resolution. It was moved by Council Member
Perkins, seconded by Council Member Trejo and unanimously carried to waive further reading and
adopt.
RESOLUTION NO. 6774 (ADOPT)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING A $2.5 MILLION LOAN FROM THE U.S. DEPARTMENT OF
HOUSING AND URBAN DEVELOPMENT, PURSUANT TO SECTION 108 OF THE
HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AS AMENDED,
AND AUTHORIZING THE MAYOR TO EXECUTE THE PROMISSORY NOTE
AND THE CONTRACT FOR LOAN GUARANTEE ASSISTANCE.

OTHER BUSINESS – Consent Calendar – Items removed by Council Approval:
12.AWARD A CONTRACT TO MARIPOSA HORTICULTURE ENTERPRISES, INC.
TO PROVIDE STREET LANDSCAPE MAINTENANCE FOR A FIVE-YEAR
PERIOD.
Tom Murray, owner Complete Landscape in Santa Fe Springs, requested Council to consider
awarding this contract to his company, stating that his company previously did work for the City and
would deliver quality service.
Public Works Director Alvarez, responding to questions from the Council, explained that it is
a new five-year contract, which will be reviewed every year and that the City is satisfied with the
current servrces.
It was moved by Council Member Trejo, seconded by Mayor Pro Tempore McCarthy and
unanimously carried to award contract to Mariposa Horticulture Enterprises, Inc. to provide
street landscape maintenance services for a five-year period
Prior to the vote, Mayor Pro Tempore McCarthy asked staff to report back on bonding
requirements for surrounding cities.
OTHER BUSINESS – Council Member Requests for Future Agenda Items
Council Member Trejo requested a cost figure of maintaining the landscaping medians on the
Lakewood Boulevard project.
Mayor Pro Tempore McCarthy repeated his request for the City’s bonding requirements
compared to other cities; announced that the three positions on legislative bills taken tonight support
maintaining local control of planning issues.
Mayor Cartozian indicated that in considering the budget for 2004-05, the changes in salary
and pay for personnel are not consistent with base salaries. He would like to see each proposed salary
change instead of several lumped together.
Council Member Trejo announced that he had attended a moving Memorial Day Ceremony at
the Downey Cemetery.

President of the United States and 33rd Governor of the State of California, to 5:30 p.m., June
15, 2004 in the Council Chamber of Downey City Hall.
