Director of Community Dev./City Planner Susan Domen, Executive Secretary PRESENTATIONS Stephanie Miladin of the L. A. Vector Control District made a Power Point presentation on the West Nile Virus prevention and control program and responded to questions from City Council. She explained that the virus was first detected in the United States in 1999 and infects humans, horses, birds and mosquitoes. In 2003 to date there have been over 367 cases and 9 deaths. The majority of people and animals that are infected with the virus have a mild illness or no symptoms but the virus can cause the life threatening condition of encephalitis. She reviewed prevention measures and noted there is no human vaccine available at this time. HEARINGS 1.CONFIRMING WITH MTA’S CONGESTION MANAGEMENT PROGRAM: ADOPTING A SELF-CERTIFICATION RESOLUTION AND THE CITY’S 2003 LOCAL IMPLEMENTATION REPORT. City Council Minutes 08/12/03 -1- ; ., . Q.1,4:548 Mayor Trejo opened the Public Hearing at 7:54 p.m. City Clerk Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Perkins, seconded by Council Member McCarthy and unanimously carried (4/0) to receive and file. There was no correspondence received on this item. A staff report was given by Ron Yoshiki, Assistant Director of Community Development/City Planner who explained that this Public Hearing on the Self-Certification with regards to the City’s compliance with the Congestion Management Program has been an annual event for the last ten years, which has came as a result of State Proposition 1 11. This demonstrates that the City is following programs as required by the Metropolitan Transportation Authority which help ensure that the City is maintaining adequate traffic control measures to minimize traffic congestion in the City. This assures the continued flow of Downey’s allocation of Proposition 1 11 gas tax monies. This year’s debit total, or congestion mitigation goal, is 1,233 and has occurred as a result of some development activity. With the new debit total, the City’s credit total will decrease from 36,490 to 35,256. However, the City is submitting a request for 916 credits for the buildings that were demolished this year and will receive additional 3,284 points for the transportation improvements that were implemented. In the end, the City will have a credit balance of 38,540, which is 2,050 more than last year. Assistant Community Development Director/City Planner Yoshiki noted that there is a minor correction on the form submitted, Part 1, New Development Activity, Non-Retail Development Activity, it indicates 57,178 square feet of Office (less than 50,000 sq.R.) and it should be categorized as Industrial instead of Office. Council Member McCarthy questioned on page 2 of the staff report, Item 1 mentions that the level of service calculations must be done for Lakewood/Firestone and Lakewood/Telegraph, but does not mention the level of service. Assistant Community Development Director/City Planner Yoshiki responded that Traffic Engineering provides this information and he believes the level of services went from F (the lowest) to either D or E. There being no speakers, it was moved by Council Member Perkins, seconded by Council Member McCarthy, and so ordered to close the Public Hearing at 8:02 P.M. RESOLUTION NO. 6687 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL IMPLEMENTATION REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089. ADMINISTRATIVE REPORTS 17.CREATION OF A NEW NEIGHBORHOOD PRESERVATION AREA AND PLACE A SECOND AREA ON MAINTENANCE STATUS. A staff report was presented by Neighborhood Preservation Coordinator Mark Galvan who presented a Power Point program and indicated that this is a request from the Police Department to modify the Neighborhood Preservation areas. He reviewed the six existing areas in the City. It is being asked that the area ofAdco/Neo be placed on a maintenance status and a new area near Paramount/Gardendale be added. City Council Minutes 08/12/03 -4- 0 14 ISS [ Coordinator Galvan then reviewed the specifics of the new proposed area bounded by Adoree on the north, Gardendale on the south, Paramount Boulevard on the west and Downey Avenue on the east; with the Gardendale frontage extending east to Brookshire. The zoning of the area is R-2, with predominantly single family residential use with homes built in the 1930s to 1950s. 25% of the dwellings appear to be deteriorating, dilapidated or in need of repair with many illegal garage conversions and unpermitted construction noted. The program components include: grant and loan programs; code enforcement sweeps; walk- abouts; parole and warrant sweeps; commercial code enforcement and organized clean-up activities. Property owners and managers will be contacted and educated regarding programs for which they can apply for property improvements, including a deferred loan program. The City of Paramount will also be contacted to work with those problems on the south side of Gardendale to address issues such as graffiti, abandoned items and litter. Responding to questions from Council Member Perkins, Coordinator Galvan indicated that the area has approximately 68% owner occupied dwelling units, although the area is R-2. Assistant Community Development Director/City Planner Yoshiki confirmed that due to a new State law, if there is adequate square footage of the lot, owners may apply for a second unit administratively. Council Member Perkins referred to the public improvements recently made on Gardendale including new sidewalks and trees. He noted the retail center built in the 1980s has an excellent occupancy rate, although there appears to be a sign issue which should be addressed through an educational effort. Council Member Perkins inquired regarding a fence program. Coordinator Galvan responded that there was one about two years ago funded in the amount of approximately $20,000. Council Member Perkins requested that the program be reviewed at a possible lower cost including contacting the City of Paramount about their program. Council Member McCarthy states that he appreciates the look of this area and thinks it can help. He inquired regarding the area immediately west of Paramount Boulevard, north of Gardendale, which was not on the map and indicated there is an alley where homes actually face west on that alleyway. He requested that the area be reviewed in the future. He feels the picket fence program is worthwhile and requested that Coordinator Galvan work with Housing Manager Ed Velasco. He thinks residents should be allowed a longer pay off time on the fence loan. Lennie Whittington, resident of Downey, inquired regarding the fences and in response it was noted that they were plastic and still in good condition. Dan Nelson, resident of Downey, requested that consideration be given to the colors of house paint that are allowed. City Manager Caton responded that there are no current restrictions. Mr. Nelson also inquired regarding how many families are allowed to live in a single family home. Council Member McCarthy responded that some other cities have imposed house paint colors and thinks it is worth considering. He requested that staff review some of the ordinances of other cities related to the colors of homes. He also asked Police Chief Finch about the number of families in homes and Chief Finch responded that a number of complaints have been received and the City has worked closely with L. A. County Health Department although none have resulted in prosecution. City Council Minutes 08/12/03 -5- ul{ ? 5 : Maria Larkin, resident of Downey, indicated that as a realtor, she receives many calls from people upset that homes are being sold and then three of four families move in. She indicated that this can not be controlled unless it is a health issue, or an illegal conversion of a garage. It was moved by Council Member Perkins, seconded by Council Member McCarthy and unanimously carried (4/0) to approve the creation of a new Neighborhood Preservation area (Adoree/Gardendale) and place a second area (Adco/Neo) on maintenance status. Mayor Trejo thanked Coordinator Galvan for taking him on a recent tour of the areas and feels this is a very good program that gets the community involved and proactively reduces crime. OTHER BUSINESS – Consent Calendar – Items removed by Council Approval: 8.AGREEMENT WITH KABBARA ENGINEERING FOR PREPARATION OF PLANS, SPECIFICATIONS, AND ENGINEER’S ESTIMATE FOR GALLATIN ROAD AND WOODRUFF AVENUE SIDEWALK SYSTEM FOR AN AMOUNT NOT TO EXCEED $39,990: Approve. Mayor Trejo explained that he had pulled this item for clarification that this is the sidewalk that serves Gallatin Elementary School, including both sides of Gallatin Road between Lakewood Boulevard and Paramount Boulevard. Public Works Director Desi Alvarez confirmed that is was. Mayor Trejo indicated that he supports this project as there is a great need due to the schoolchildren using this street. It was moved by Mayor Trej o, seconded by Council Member Perkins, and unanimously carried (4/0) to authorize the Mayor to execute a Professional Services Agreement with Kabbara Engineering for preparation of plans, specifications, and engineer’s estimate for Gallatin Road and Woodruff Avenue Sidewalk System for an amount not to exceed $30,990. ORAL COMMUNICATIONS Verner Waite, M.D., resident of Cypress, former member of Downey Community Hospital Board of Directors, submitted a letter dated August 12, 2003 and read it into the record, including that he had been sued by the hospital Parent Board and Caremore for speaking out, which lawsuits have been recently dropped. He also referred to the documents attached to the letter. Lennie Whittington, resident of Downey, gave compliments to various City employees. Suzanne (no last name given), resident of Downey, spoke regarding code enforcement notice of violations for unpermitted concrete next to her driveway that has been there for many years prior to her purchase of the home in 1995. Mayor Trejo indicated he would speak to her after the meeting. Mohammed (no last name given), owns a commercial property at 9555 Firestone Blvd. where he is trying to build an apartment building. He has pending code enforcement violations and requested assistance from the Council to speed up the process for approval of the project. Mayor Trejo indicated he would meet with him after the meeting. City Council Minutes 08/12/03 -6- QI 46 j J Steve Gross, resident of Downey, referred to the public forum held regarding the relocation of the L. A. County Public Health Lab to Downey and asked if there would be a second hearing. City Manager Caton indicated that no further meetings have been scheduled. Mayor Trejo indicated he would be glad to meet with him on this issue. Zaida Ramos, resident of Downey, also spoke regarding the public forum held regarding the L. A. County Public Health Lab and requested a further meeting. She referred to questions submitted by a Charles Gerlach which have not been answered. City Manager Caton suggested that she contact her L. A. County Supervisor. OTHER BUSINESS – Consent Calendar – Items removed by Council Approval – con’t. : 11.A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY IN SUPPORT OF THE RE-INSTATEMENT OF MTA BUSLINE ROUTE 460: Adopt. Council Member McCarthy stated that he had pulled this item as he was not prepared to adopt a Resolution at this time even though there had been concerns expressed regarding the line. He feels issues such as this should go through the local sector governance program that has been established by the Metropolitan Transit Authority. He suggested that no action be taken or that action be postponed until more information is available. Michael Sieckert, Planning Manager for Gateway Cities Sector of MTA, requested that the Council delay any action on the Resolution until they have had an opportunity to have further dialogue on this issue. Council Member Perkins questioned when they had heard about the issue as it had been in the newspapers as a result of citizens coming to the Council meeting regarding changes in Route 460. Mr. Sieckert responded that they only found out about it yesterday afternoon. Mr. Sieckert explained that Route 460 had been discontinued for several reasons, one of them being due to declining ridership and a problem with the ontime performance service of the route along the 1-5 Freeway. The route was changed to operate along the transitway on the 110 Freeway to reduce the amount of travel time from the Norwalk area into downtown Los Angeles. Philip Capo, has been working with the Gateway transit users and City residents to restore Route 460 and requested approval of the proposed Resolution. He indicated that the route had about 20 passengers per hour. He disagrees with the conclusions of the MTA and requested reinstatement of the route which he indicated has been in operating for almost fifty years. Council Member McCarthy requested that action be postponed until the next meeting so that MTA can bring forward more information including a graphic of the routes. He also requested that the Community Services Director review an expansion of DowneyLINK service so that it interacts with this route. It was moved by Council Member McCarthy, seconded by Council Member Perkins and unanimously carried (4/0) to postpone this matter until the next meeting and ask MTA to bring additional information forward for review. City Council Minutes 08/12/03 -7- ,D} 4D ii ', 13.A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF PARCEL MAP NO. 26698 (9816 TWEEDY LANE), APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTING A SUBDIVISION FAITHFUL PERFORMANCE BOND AS SURETY: Adopt Council Member Bayer requested continuance of Items Nos. 13, 14 and 15 until the next meeting as she needs some more information before she is prepared to make an informed vote. It was moved by Council Member Bayer, seconded by Council Member Perkins and unanimously carried (4/0) to continue these items until the next meeting. Council Member McCarthy questioned Public Works Director Alvarez as to what effect continuing these items for two weeks would have on these developments. Director Alvarez responded that there would be no material effect. OTHER BUSINESS - Council Members Comments Council Member Bayer thanked Public Works Director Alvarez and staff for the meeting held on August 9 regarding the Lakewood Boulevard Improvement Project. She also thanked the citizens who attended. Council Member Perkins announced that last Thursday, in Sacramento, he attended an interesting meeting with the movie studio developers; the Rio Hondo Clubhouse construction is on schedule; and reminded everyone that the Chamber of Commerce Golf Tournament will be held on August 22 at Rio Hondo Golf Course. City Council Minutes 08/12/03 -8- . ’ Ol ££i5 ii Council Member McCarthy announced that the Municipal Code will soon be available over the Internet which he feels will be an expanded opportunity for the public to access this information; he also attended the Lakewood Boulevard Improvement Project presentation on Saturday and agrees that the presentation was excellent; mentioned that the issue of the color of painting homes is a delicate issue and needs to be reviewed very carefully; and hopes we will have cooler weather soon Mayor Trejo announced that on Saturday he had the honor of presenting a Proclamation for Relay for Life which is a fundraiser for the American Cancer Society; commended Public Works Director Alvarez and his staff for the improvements on Third Street. Council Member McCarthy announced that information on the Lakewood Boulevard Improvement Project is also available on the Internet.
