APPROVAL OF CLOSED SESSION MINUTES It was moved by Council Member/Commissioner GaIn, seconded by Council Member/Commissioner Bayer, and unanimously carried (4/0) to approve the Closed Session Minutes of September 26, 2006. FOR PROPERTY LOCATED AT 12850 WOODRUFF AVENUE, TO AMEND THE GENERAL PLAN LAND USE DESIGNATION FROM NEIGHBORHOOD COMMERCIAL AND MEDIUM DENSITY RESIDENTIAL TO GENERAL MANUFACTURING; AND REZONING FROM Rl- 5,000 TO M-1 (APPLICANT: MOHAMAD POURNAMDAM, 4 PRAIRIE INC.): Development Services City Council Minutes 10/24/06 -1- Mayor Perkins opened the Public Hearing at 7:45 p.m. City Clerk Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Gafin, seconded by Council Member Cartozian and so ordered to receive and file. City Clerk Midstokke stated that 20 pieces of correspondence had been received on this item since the distribution of the packets, all being objections to the rezoning. It was moved by Mayor Pro Tem Trejo, seconded by Council Member Cartozian and so ordered to receive and file the correspondence. Council Member Gafin announced that he had previously met with the applicant and representatives from the Calvary Chapel Church and listened to their concerns. City Planner Godlewski explained that this piece of property is a remnant of the 1-105 Freeway construction and is 70 feet wide by 1 ,200 feet long. The odd size of the lot makes the development of the property difficult. He stated that the current R-1, 5,000 zoning existed prior to the freeway project. He continued that the applicant has requested this change to be able to put a self-storage facility on the site. City Planner Godlewski noted that the Planning Commission had concerns about amending the General Plan to allow manufacturing designation on this property because it would allow for many undesirable uses for this property and there would be no guarantee that the applicant would put in a self-storage facility after the rezoning was in effect. Michael Goodson, representative for the owner, stated that they agree with staff’s recommendation to rezone this property to M-1 would afford his client the ability to develop the property. He stated that the City’s Ordinances, Conditional Use Permit process and the site plan and design review process would ensure adequate uses on this property. He also noted that his client is willing to enter into an agreement with the church limiting the available uses of the property in the future. He noted the General Plan is a living document that is adjusted whenever a piece of property is found to be incompatible with an area or development. It was moved by Council Member Gafin, seconded by Mayor Pro Tem Trejo and so ordered to close the Public Hearing, the time being 8:46 p.m. Council Member Gafin noted although he is sensitive to the issues of size and shape of the lot, he does not believe in spot zoning or opening up a piece of property so close to a church and neighborhood to manufacturing uses. He sated that he was elected to represent the citizens and they have made it very clear what they want on this issue. Mayor Pro Tem Trejo concurred with Council Member Gafin’s comments and asked if the church had inquired about purchasing the property. City Council Minutes 10/24/06 -2- Council Member Bayer stated that she had the confidence in her appointee, Craig Schwerdt, to the General Plan Amendment Committee and her Planning Commissioner, Terry Lambros, and was confident in their decisions on this property. Council Member Cartozian explained that there should be a compatible use found for the property, but sometimes it just doesn’t happen and that the City isn’t always looking to make revenue, they have to weigh the public health and safety issues first. It was moved by Council Member Gafin, seconded by Council Member Cartozian and unanimously carried to request staff to bring back a Resolution denying General Plan Amendment No. 06-77 and Zone Change No. 06-78 for property located at 12850 Woodruff Avenue. NON-AGENDA PUBLIC COMMENT: Margarita Rogers, resident of Downey Island area, thanked their mailman Mr. Rios for calling 911 when he smelled smoke coming from a house on his mail route and also thanked the Fire Department for their services on this call. OTHER BUSINESS – Council Member Announcements or Requests for Future Agenda Items: CONFERENCE AND MEETING REPORTS. Mayor Perkins reported that he recently attended a California Contract Cities Association conference in San Diego which included presentations on border security. Council Member Cartozian announced that the Mayor’s Prayer Breakfast will be held on November 9th and congratulated Mayor Perkins on eight years of service to the City; announced that he attended the Walk the Talk against Child Abuse event, the grand opening of the Bally’s Fitness Center and a lecture on Ranch House style architecture given by Alan Hess. Council Member Bayer wished Happy Birthday to Lee Ann Sears, her appointee to the Emergency Preparedness Committee; recognized Fay Campbell, her appointee to the Water Facilities Corporation in the audience tonight; and announced that she attended a Southeast Area Animal Control (SEAACA) meeting last Thursday. Mayor Pro Tem Trejo announced that he attended the 1 ;t Annual Cheese Steak Bowl held at Philly’s Best between Downey and Warren High Schools football players; requested staff to conduct a parking use study regarding the three medical office buildings and Downey Regional Medical Center being in close proximity and at full capacity. Council Member Gafin recognized Robert Savala, member of Downey Chamber of Commerce Board of Directors in the audience tonight; announced that on October 31 =t the Pumpkin Patch will be at Apollo Park, on November 1 ;t the Coordinating Council will have State Senator Alan Lowenthal as guest speaker at noon at Barbara Riley Center, and November 4th will be the fishing derby at Wilderness Park. Mayor Perkins announced that the Downey-Warren football game will be this Friday; and recognized his friend Irene and son Jeff in the audience tonight. Mayor Perkins clarified that by the end of the clean-up process, this project will have cost approximately $1.5 million and will be completed in 12 to 18 months. City Manager Caton noted that due to the fact this will be used for a road, the Gas Tax Funds can be used to help pay for the costs. City Attorney/Economic Development Director Vose noted that after the clean-up of the property is completed, it will become a very marketable piece of property. It was moved by Mayor Perkins, seconded by Council Member Cartozian and unanimously carried to approve staff recommendation. 14.ADOPTED RESOLUTION NO. 06-6949. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING A CLASS SPECIFICATION AND ESTABLISHING A SALARY RANGE FOR TRAINING COORDINATOR: Police. Council Member Gafin inquired if the new position would be in charge of revitalizing the Neighborhood Watch program and was told they would be in charge of training programs and community groups. It was moved by Council Member Gafin, seconded by Mayor Pro Tem Trejo and unanimously carried to adopt the Resolution. Prior to the vote, Mayor Pro Tem Trejo noted that his neighborhood and others would like to start a Neighborhood Watch program. City Council Minutes 10/24/06 -5- City Manager Caton stated that he would have staff bring back a report on how to revitalize this program throughout Downey. Council Member Cartozian noted that the interest from the citizens had dropped off, and it would take the residents continuing the programs for it to be successful again.
