Apollo Space Capsule-Relocation Services Adjournment Approved MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING OCTOBER 10, 2006 The City Council of the City of Downey held a Regular Meeting at 7:33 p.m., October 10, 2006, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor Meredith H. Perkins presiding. PRESENT:Council Members: Meredith H. Perkins Rick Trejo David R. Gafin Kirk O. Cartozian Anne M. Public Works Director Roy Campos, Police Chief Linda Haines, Development Services Director John Michicoff, Finance Director Thad Phillips, Community Services Director Mark Sauter, Fire Chief Ed Velasco, Housing Manager Susan Domen, Secretary to the City Clerk PRESENTATIONS: Mayor Perkins presented a Proclamation declaring October 15-21, 2006 as Character Counts Week, to Wendy Doty, Downey Unified School District Superintendent. Mayor Perkins presented a Proclamation declaring the month of October as Fire Prevention Month, to Fire Chief Sauter and Captain Holcombe. Mayor Perkins presented a Certificate of Appreciation to Eddie Tafoya, Field Deputy for Congresswoman Lucille Roybal-Allard for representation of the City of Downey. PUBLIC HEARINGS: 1.APPROVED AN AMENDMENT TO THE CITY-COUNTY AGREEMENT, WHICH RAISES HAZARDOUS MATERIALS PENALTY FEES, FOR ADMINISTRATION OF THE UNIFIED HAZARDOUS WASTE AND MATERIALS MANAGEMENT REGULATORY PROGRAM: Fire A. ADOPTED RESOLUTION NO. 06-6946, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING AMENDMENT NO. 1 TO THE CITY-COUNTY AGREEMENT FOR HAZARDOUS MATERIALS PENALTY FEES. City Council Minutes 10/1 0/06 -1- Mayor Perkins opened the Public Hearing at 7:45 p.m. City Clerk Midstokke affirmed receipt of the Proof of Publication. It was moved by Council Member Cartozian, seconded by Council Member Gafin and so ordered to receive and file. Fire Chief Sauter presented a staff report noting that the City had received a request from the County for a modification in the Hazardous Materials Penalty Fee schedule to be included in the City Fee schedule as required by the agreement. Staff is seeking an increase in the penalties from a 25% to 40% fee for businesses paying late or not reporting. He continued that the increase is due to the increased cost of enforcement. In response to Council questions, Fire Chief Sauter explained that the County collects all fees and reimburses the City except in the case of re-inspection of sites, the City then can bill directly. This is a general agreement that all local departments have with the County in regards to Haz-Mat enforcement services. It was moved by Council Member Gafin, seconded by Council Member Cartozian and so ordered to close the Public Hearing, the time being 7:50 p.m. There being no further discussion, it was moved by Council Member Gafin, seconded by Mayor Pro Tem Trejo and unanimously carried to adopt the Resolution. NON-AGENDA PUBLIC COMMENT: Robert Rubio, resident of Downey, announced the Rio Hondo Boys and Girls Club annual installation and awards banquet to be held on October 18th at the Crown Plaza located at the Commerce Club. Rainbow Yeung, Senior Public Affairs Specialist for the Air Quality Management District (AQMD), spoke regarding various clean air programs and services. Sandra and Foster Falcon, residents of Downey, spoke regarding problems at an adult residential care facility near their home. John Lacy, resident of Downey, acknowledged the efforts and services of Eddie Tafoya, field representative for Congress Member Lucille Roybal-Allard. Richard Pridham, resident of Downey, acknowledged that some of the construction related issues on Lakewood Boulevard have been addressed, but there are still some items outstanding. OTHER BUSINESS – Council Member Announcements or Requests for Future Agenda Items: Council Member Cartozian announced the Public Works Department annual car show and Christmas Toy Drive on November 18th at World of D6cor; recognized former Downey High School students Nathan Mahoney and Suzette Vega in the audience tonight; and announced a Candidates' Forum tomorrow at the Rio Hondo Event Center sponsored by Citizens for Downey. Council Member Bayer acknowledged the attendance of Lee Ann Sears, appointee for the Emergency Preparedness Committee for District Four; announced the Fire and Police Golf Tournament will be held on October 16th at the Rio Hondo Golf Course; and the Walk the Talk event raising awareness of child abuse to be held on October 21 st starting at the First Baptist Church. City Council Minutes 10/1 0/06 -2- Council Member Gafin announced the Macy’s Parade on October 18th at 2:00 p.m.; the Community Emergency Response Team (CERT) fundraiser at Frantones restaurant on October 19th; the Chamber of Commerce mixer at the new medical office building of Downey Regional Medical Center on October 19th at 5:30 p.m.; and that Bally’s Fitness is having a grand opening on October 21 ;t from 11 :00 a.m. to 4:00 p.m. Mayor Perkins recognized Robert Rubio and Mario Guerra, City Council Candidates for District Two in the audience tonight, as well as his son Jeff; and Mr. Guerro and his sons from Boy Scout Troop 371 also in the audience; and announced that he had attended the following events: Mayor’s Prayer Breakfast in Anaheim, Bellflower Prayer Breakfast, banquet for Character Counts program at the schools; and a California Cities Association conference, which he will give details on at the next meeting. CONSENT CALENDAR – ITEMS FOR REMOVAL: 4.APOLLO SPACE CAPSULE – RELOCATION SERVICES: APPROPRIATE $11,085 FROM THE GENERAL FUND FOR THE RELOCATION OF AN APOLLO SPACE CAPSULE TO THE DOWNEY STUDIOS: Administration. This item was removed at the request of Council Member Cartozian and is listed under Other Business below. CONSENT CALENDAR: It was moved by Mayor Pro-Tem Trejo, seconded by Council Member Bayer, and unanimously carried to approve the remaining Consent Calendar items as recommended: 2.APPROVED CITY COUNCIL MINUTES: Adjourned and Regular Meetings September 26, 2006: City Clerk. 3.APPROVED WARRANTS ISSUED: Nos. 216909 – 217276; Wire Nos. 297-298 and 30001303-30001310; in the total amount of $3,465,910.66: Finance. 5.SET PUBLIC HEARING FOR OCTOBER 24. 2006 FOR GENERAL PLAN AMENDMENT NO. 06-77 AND ZONE CHANGE NO. 06-78, FOR PROPERTY LOCATED AT 12850 WOODRUFF AVENUE, TO AMEND THE GENERAL PLAN LAND USE DESIGNATION FROM NEIGHBORHOOD COMMERCIAL AND MEDIUM DENSITY RESIDENTIAL TO GENERAL MANUFACTURING; AND REZONING FROM Rl-5000 TO M-1 : Development Services 6.ADOPTED RESOLUTION NO. 06-6947, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY MODIFYING THE FINE SCHEDULE PREVIOUSLY ADOPTED BY RESOLUTION NO. 5716, 1N REGARDS TO PARKING PENALTIES AND OTHER RELATED CHARGES FOR PARKING VIOLATIONS WITHIN THE CITY: Police. 7.ADOPTED RESOLUTION NO. 06-6948, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING NEW PAY RANGES FOR CERTAIN PART-TIME CLASSIFICATIONS: Administration. 8.SPEED LIMIT FOR PARAMOUNT BOULEVARD: Public Works. A. INTRODUCED AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3186 OF THE DOWNEY MUNICIPAL CODE RELATING TO SPEED LIMITS FOR PARAMOUNT BOULEVARD. City Council Minutes 10/1 0/06 -3- ADMINISTRATIVE REPORTS: 9.CASH CONTRACT NO. CC 650 – DOWNEY PARK; APPROVED PLANS AND SPECIFICATIONS AND GRANT AUTHORITY TO ADVERTISE FOR BIDS: Public Works. Public Works Director Alvarez explained that the plans and specifications for the park were prepared by Nuvis and include 140 parking spaces, 250 trees, 4 athletic fields, a restroom facility, lighting and a reclaimed water irrigation system. Alternate bid items will be sports field lighting, playground structures, concession stand and dugouts for the baseball fields. He is hoping to go out to bid in December with construction to begin in January 2007. Council Member Cartozian asked if the street elevation issues with Kaiser will be resolved by the end of the year and was informed that they should be resolved in the next couple of weeks; however, if that is not done an addendum will be issued to the bidders. Mayor Perkins inquired as to what the estimated completion date for the project is and was told approximately nine months. Harold Tseklenis, resident of Downey, asked if solar powered safety and perimeter lighting were considered on this project as was brought up last June. Director Alvarez stated that he was unsure if the architect considered it. Mayor Perkins noted that this project was looked at a few months back due to it being $4 million dollars over budget and several items were looked at to cut. At this time the sports field lighting was determined to remain in the project due to the $300,000 that had been designated for this project. He continued that it needs to be in the project and not as an alternative, as previously directed City Manager Caton responded that it would be added. It was moved by Council Member Bayer, seconded by Council Member Gafin and unanimously carried to approve the staff recommendation. 10.CASH CONTRACT NO. CC 655 - COLUMBIA MEMORIAL SPACE SCIENCE LEARNING CENTER: APPROVED PLANS AND SPECIFICATIONS AND GRANT AUTHORITY TO ADVERTISE FOR BIDS: Public Works. Public Works Director Alvarez explained that the architect Arquitectonica had designed an 18,000 square foot building to house the discovery and resource center along with meeting rooms, an administration area and a retail shop. There are also plans for a future facility to house the mock- up of the space shuttle. He continued that they are expecting to go out to bid in December with construction to start in January 2007 with an estimated completion date of one year. Mayor Perkins clarified that the $1 million dollar grant received from NASA can be used for the building of the learning center. Harold Tseklenis, resident of Downey, stated he is encouraged that the City is using energy efficient systems in the building to protect the environment and save the City money. He inquired if the solar energy systems had been looked into. Lennie Whittington, resident of Downey, noted that the Art Museum had been looking into a grant for a solar energy system for their new building for the last two years. City Council Minutes 10/10/06 d- Mayor Perkins noted that when they had visited Washington there was concern over the security and climate control of the building and whether this had been addressed. It was moved by Council Member Bayer, seconded by Council Member Gafin and unanimously carried to approve the staff recommendation. Prior to the vote, Mayor Pro Tem Trejo asked for clarification on who is in charge of the project now and was informed that Public Works is in charge of the construction phase and Assistant to the City Manager Pomrehn is in charge of the museum. He then asked if the space suits had been looked into and was told yes. City Attorney Vose noted that the architects had looked at using solar energy and had determined that due to the design of the building it would not be cost efficient as the whole building would have to be redesigned due to the amount of window usage. OTHER BUSINESS: CONSENT CALENDER – ITEMS REMOVED BY COUNCIL APPROVAL: 4.APOLLO SPACE CAPSULE – RELOCATION SERVICES: APPROPRIATED $11,085 FROM THE GENERAL FUND FOR THE RELOCATION OF AN APOLLO SPACE CAPSULE TO THE DOWNEY STUDIOS: Administration. Council Member Cartozian asked if the $1 1,085 would include the refurbishing of the capsule and the response was this amount did not include refurbishing. It was moved by Council Member Cartozian, seconded by Mayor Pro Tem Trejo and unanimously carried to appropriate the funds. Prior to the vote, Mayor Perkins noted that the capsule in Lancaster is in terrible condition and is concerned that there will not be enough in the grant monies to build the building, move the capsule and refurbish both capsules.
