REGULAR MEETING
MAY 23, 2006
The City Council of the City of Downey held a Regular Meeting at 7:36 p.m., May 23, 2006,
in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California,

Mayor Perkins presented the Mayor’s Soaring Eagle Award to Fire Engineer/Inspector
Fernando de la Torre.
Mayor Perkins presented a Proclamation re: National Public Works Week, May 21-27
accepted by David Chavez, Water System Lead Operator and “2005 Public Works Employee of the
Year
PUBLIC HEARINGS:
1.APPEAL OF DENIAL OF ZONE VARIANCE NO. 05-147, REQUEST TO CONVERT AN
UNPERMITTED STRUCTURE INTO A GUEST HOUSE AT 7753 HONDO STREET,
MIGUEL MARQUEZ, APPELLANT: Development Services.
Mayor Perkins opened the Public Hearing at 7:55 p.m. City Clerk Midstokke affirmed
receipt of the Proof of Publication. It was moved by Council Member Gafin, seconded by Mayor Pro
Tem Trejo and so ordered to receive and file.
Mayor Perkins stated that staff is requesting that the hearing be opened and continued until
the June 13, 2006 meeting.

There being no one coming forward to speak it was moved by Mayor Pro Tem Trejo,
seconded by Council Member Gafin and unanimously carried (3/0), to continue the Public Hearing
to June 13, 2006 at 7:30 p.m.
2.ESTABLISHMENT OF UNDERGROUND UTILITY DISTRICT ALONG THE LENGTH OF
LAKEWOOD BOULEVARD FROM FIFTH STREET TO GALLATIN ROAD (DISTRICT
NO. 21): Public Works.
A. ADOPTED RESOLUTION NO. 06-6917, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY ESTABLISHING AN UNDERGROUND UTILITY DISTRICT
ALONG THE LENGTH OF LAKEWOOD BOULEVARD FROM FIFTH STREET TO
APPROXIMATELY 500 FEET NORTH OF GALLATIN ROAD AND CAUSING ALL
SPECIFIED UTILITIES THEREIN TO BE RELOCATED UNDERGROUND (DIST. NO. 21).
This Public Hearing was held before Item 1; however, is listed in order for clarity.
Mayor Perkins opened the Public Hearing at 7:50 p.m. City Clerk Midstokke affirmed
receipt of the Proof of Publication. It was moved by Mayor Pro Tem Trejo, seconded by Counci
Member Gafin and so ordered to receive and file.
Public Works Director Alvarez presented a staff report explaining the process in which the
City must go through in order to underground utilities. He stated that this project is estimated at $5
million which is funded entirely by the effected utility companies. He has negotiated the funding with
the utility companies through 201 1/12.
There being no one coming forward to speak, it was moved by Council Member Gafin,
seconded by Mayor Pro Tem Trejo and so ordered to close the Public Hearing at 7:52 p.m.
Mayor Perkins clarified that no funds would be coming from the general fund.
It was moved by Mayor Pro Tem Trejo, seconded by Council Member Gafin and
unanimously carried (3/0), to adopt the Resolution.
NON-AGENDA PUBLIC COMMENT: No one came forward to speak.
OTHER BUSINESS – Council Member Announcements or Requests for Future Agenda Items:
A. CONFERENCE AND MEETING REPORTS
Mayor Pro Tem Trejo reported that he attended a California Contract Cities Assn. conference
in Indian Wells last week and among the items presented were ethics, Los Angeles County Health
Services and jail systems. Mayor Perkins reported that he also attended this conference.
Mayor Pro Tem Trejo requested that the Downtown Subcommittee schedule a meeting soon
Council Member Gafin congratulated the Community Services Department for another great
Kids Day celebration; commended the Police and Fire Departments for their recent demonstration to
high school seniors regarding graduation night and the dangers of drinking and driving; and
announced the upcoming annual Memorial Day ceremony on Monday, May 29th at 1 1 :00 a.m. at the
Downey Cemetery.

Mayor Perkins congratulated Council Member Gafin and his wife Brenda on the celebration
of their 18th wedding anniversary; reported that he had attended the ceremony for Older American
Month where Dorothy Wilson of Downey was recognized; attended ceremony today honoring
students at Downey High School who completed the Regional Occupational Program; recognized
his son Jeff and friend Irene in the audience tonight; noted that he had requested reports at the last
meeting on the Downey Studios and the Space Science Learning Center/NASA Park, pointing out
that he has heard that the Downey Studios may be for sale and he has concern about the future
uses and zoning; and that he wants the new park on fast track.
STAFF MEMBER COMMENTS:
City Manager Caton reported that the NASA Park project is expected to come back at the
second meeting in June requesting approval of the plans, specifications and advertising for bids.

6.APPROVE CONTRACT WITH THE SOUTHEAST AREA ANIMAL CONTROL AUTHORITY
(SEAACA) IN THE AMOUNT OF $40,600 TO PROVIDE ANIMAL LICENSE CANVASSING:
Finance. This item was pulled at the request of Mayor Pro Tem Trejo and is listed under
Other Business below.
8.APPROVE SETTLEMENT AGREEMENT WITH VERIZON FOR UNDERGROUNDING
FACILITIES ALONG LAKEWOOD BOULEVARD FROM IMPERIAL HIGHWAY TO FIFTH
STREET (DIST. NO. 18): Public Works. This item was pulled at the request of Mayor
Perkins and is listed under Other Business below.
9.APPROVE CONTRACT RENEWAL WITH STEPHEN WRIGHT FOR BUILDING
INSPECTION MANAGEMENT SERVICES FOR THE DOWNEY LAND DEVELOPMENT:

B. AWARDED CONTRACT IN THE AMOUNT OF $394,771 TO GMC ENGINEERING, INC.

7.APPROVED AGREEMENT WITH VAVRINEK, TRINE, DAY & CO. IN THE AMOUNT OF
$15,500 FOR SPECIAL FINANCIAL SERVICES RELATING TO THE DOWNEY LANDING
PROJECT: Administration.
10.APPROVED AGREEMENT RENEWAL WITH EDINGTON, PEEL & ASSOCIATES, INC. IN
THE AMOUNT OF $50,000 FOR CONSULTANT SERVICES: Administration.
11.APPROVED AGREEMENT RENEWAL WITH E. DEL SMITH AND COMPANY, INC. IN
THE AMOUNT OF $35,000 FOR CONSULTANT SERVICES: Administration.
12.ADOPT RESOLUTION NO. 06-6919, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPOINTING SPECIFIC REPRESENTATIVES TO THE
INDEPENDENT CITIES RISK MANAGEMENT AUTHORITY (ICRMA): Finance.
ADMINISTRATIVE REPORTS :
13.SET DATE FOR STUDY SESSION TO REVIEW PROPOSED FISCAL YEAR 2006-07
BUDGET: Administration.
Mayor Perkins took a consensus of the Council and it was decided to set June 12th at 6:30
p.m. in the Council Chambers as the date for the Budget study session.
OTHER BUSINESS:
CONSENT CALENDER – ITEMS REMOVED BY COUNCIL APPROVAL:

Mayor Pro Tem Trejo asked if there was a fine for having an unlicensed dog and was
informed that there is no fine; however, when someone is caught they are required to license the
dog
It was moved by Mayor Pro Tem Trejo, seconded by Council Member Gafin and
unanimously carried (3/0), to approve the contract.
8.APPROVED SEl-rLEMENT AGREEMENT WITH VERIZON FOR UNDERGROUNDING
FACILITIES ALONG LAKEWOOD BOULEVARD FROM IMPERIAL HIGHWAY TO FIFTH
STREET (DIST. NO. 18): Public Works.
Mayor Perkins noted his concerns that Verizon had asked the City to share in the cost of the
project and hopes that they won't do it again on the project approved earlier tonight.
It was move by Mayor Perkins, seconded by Mayor Pro Tem Trejo and unanimously carried
(3/0), to approve the settlement agreement.
9.APPROVED CONTRACT RENEWAL WITH STEPHEN WRIGHT FOR BUILDING
INSPECTION MANAGEMENT SERVICES FOR THE DOWNEY LAND DEVELOPMENT:
Development Services.
Mayor Perkins questioned the amount of hours versus the value of the contract not adding
up correctly.

Director Haines stated that the referral to 20 hours per week would be removed from the staff
report as the contract states it is for an amount not to exceed $60,000.
It was moved by Mayor Perkins, seconded by Council Member Gafin and unanimously
carried (3/0), to approve the contract.
ADJOURNMENT: 8:16 p.m.
The meeting adjourned to 6:30 p.m. June 12, 2006, for the purpose of a Budget study
sessIon.
