Vose, City Attorney/Economic Development Director Lee Powell, Assistant City Manager Joyce E. Doyle, Acting Secretary Scott K. Pomrehn, Assistant to the City Manager Desi Alvarez, Public Works Director Roy Campos, Police Chief Linda Haines, Development Services Director Thad Phillips, Community Services Director Mark Sauter. Fire Chief Mike Larnard, Acting Building Official Maurina Lee, Finance Manager Collette Fowler, Assistant Supervisor Ed Velasco, Housing Manager Susan Domen, Secretary to the City Clerk COUNCIL MEMBER ANNOUNCEMENTS: Council Member Bayer announced the Citizens for Downey meeting tomorrow morning featuring Pastor Glenn Koonz as the speaker; invited everyone to Kids Day at Furman Park and to the Police Department’s Open House on Saturday. Council Member Cartozian noted that he had attended the Kids Day Hall of Fame ceremonies; attended the La Casita graduation ceremony; recognized his Commissioners Roger Brossmer and Guy Sterner in the audience; and thanked Development Services Director Haines for an earlier meeting on Green Building Technology incentives. Council Member Guerra noted his attendance at the La Casita graduation ceremony as well; mentioned that Supervisor Knabe had a follow up meeting in Washington with Congresswoman Roybal-Allard regarding funding for solar technology for the learning center; stated that he and Council Member Bayer attended the National Day of Prayer Ceremony last Thursday outside City Hall; mentioned he went to Sacramento two weeks ago and spoke on Assembly Bill 640 which will be heard at the appropriations committee next week; thanked Community Services Director Phillips and staff for doing a great job on the Kids Day Hall of Fame event. City Council Minutes 05/08/07 -1- Mayor Pro Tem Gafin also thanked Community Services Director Phillips and staff for doing an excellent job on the Kids Day Hall of Fame event; congratulated the Chamber of Commerce on a successful Street Faire; announced the Coordinating Council awards dinner is Thursday evening; and recognized his appointee to the Cable TV Advisory Board, Luis Marquez, in the audience. Mayor Trejo thanked Community Services staff for the well organized Kids Day Hall of Fame event; and recognized School Board Member Mark Morris in the audience. PRESENTATIONS: Mayor Trejo presented a Proclamation declaring May as Older Americans Month. Mayor Trejo presented a Proclamation declaring May 20 – 26 as National Public Works Week Mayor Trejo presented a Proclamation declaring May 6 – 12 as National Building & Safety Week PUBLIC HEARING: 1.ACTION PLAN FOR CDBG: Development Services. A. APPROVED THE 2007-08 ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND HOME INVESTMENT PARTNERSHIP GRANT PROGRAMS. Mayor Trejo opened the Public Hearing at 8:07 p.m. Chief Deputy City Clerk Doyle affirmed receipt of the Proof of Publication. It was moved by Council Member Cartozian, seconded by Mayor Pro Tem Gafin and so ordered to receive and file. Housing Manager Velasco presented a Power Point presentation explaining the process that the City adheres to for the receipt of funds. He explained the application that is submitted to U.S. Department of Housing (HUD) and the proposed use of the funds totaling $4,158,100. Staff is recommending the following breakdown of the distribution of the funds: Community Housing Development Organization (CHDO) projects 22%, Home Improvements 38%, HUD Loans 12%, General Administration 9%, Code Enforcement 6%, Public Services 6%, Economic Development 5% and Public Improvements 2%. Council Member Guerra inquired how the determination is made as to what groups receive funds and how much and it was explained that while many groups apply they must prove how many residents in the community they serve, how it serves the community, and is the need covered in the 5 year plan. He then mentioned a letter from Senator Boxer regarding funding for the program and asked how it would affect the City. Housing Manager Velasco noted that substantial cuts are being proposed by the current administration and Congress is trying to maintain as is, however, there will be a 1% cut this year. Council Member Bayer asked the name of the homeless shelter receiving funding and was told it is the Rio Hondo Temporary Home in Norwalk. Council Member Cartozian stated that it is a challenge every year to see what the funding will be and asked if the HUD payments are a carry over. He was informed that the loan payments are a fixed amount. He concluded that he would like to see more of the funds directed towards capitol improvement projects such as the new park. City Council Minutes 05/08/07 -2- Mayor Trejo noted he was pleased to see funds allocated towards Code Enforcement and asked what programs are funded to help alleviate the homeless needs and was told the Salvation Army, the Rio Hondo Temporary Home in Norwalk, and several programs that provide dental and health services in the community at the Barbara J. Riley Community Center. There being no further speakers, it was moved by Council Member Guerra, seconded by Council Member Bayer and unanimously carried to close the Public Hearing the time being 8:25 p.m It was moved by Council Member Cartozian, seconded by Mayor Pro Tem Gafin and unanimously carried to approve the 2007-2008 Action Plan, and authorize the City Manager to submit the Action Plan and Grantee Certifications to HUD. NON-AGENDA PUBLIC COMMENT: Bob Goldstein, resident of Downey, stated that the current proposed wording of the Term Limits measure regarding a Council Member being allowed to sit out two years is not equitable for all Council Districts and should be changed to four years. Mary Freeland, resident of Downey, stated she is an opponent of Term Limits and many residents are utilizing the online agenda to stay informed. She stated that having the staff reports available is a great tool, however, a brief explanation of how to access them should be put on there as well Dwayne Bradford, Cerritos College Student, inquired about the safety and disaster recovery plans and procedures the City has in effect and was informed by City Manager Caton that he should meet later with the Fire Chief for the answers on these questions. Michael Hutchinson, resident of Downey, inquired about the loan agreements, approved with the Community Development Commission at the previous meeting and the interest calculation process Lennie Whittington, resident of Downey, questioned why the contract for the security services at the Downtown Parking Structure had been removed from the agenda several months ago and had never been brought back. CONSENT CALENDAR - ITEMS FOR REMOVAL: 8 ADOPT RESOLUTION NO. , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SUPPORTING SENATE BILL 974 (LOWENTHAL), LEGISLATION THAT WOULD ESTABLISH A CARGO FEE AT THE PORTS IN ORDER TO FUND PORT CONGESTION RELIEF TRUST FUND AND PORT MITIGATION RELIEF FUND: Administration. This item was removed at the request of Council Member Cartozian and is listed under other business below. ADMINISTRATIVE REPORTS: 9.SET DATE AND TIME FOR STUDY SESSION TO REVIEW PROPOSED FISCAL YEAR 2007-08 BUDGET: Administration. City Manager Caton stated that Council needed to set a date for the study session, explaining that the budget must be adopted by the last meeting in June pursuant to the City Charter. Council Member Guerra suggested May 29th at 6:30 p.m. It was moved by Council Member Cartozian, seconded by Mayor Pro Tem Gafin and so ordered to set May 29th at 6:30 p.m., in the Council Chambers as the date for the Budget Study Session. OTHER BUSINESS: CONSENT CALENDER – ITEMS REMOVED BY COUNCIL APPROVAL: 8.ADOPTED RESOLUTION NO. 07-6988, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SUPPORTING SENATE BILL 974 (LOWENTHAL), LEGISLATION THAT WOULD ESTABLISH A CARGO FEE AT THE PORTS IN ORDER TO FUND PORT CONGESTION RELIEF TRUST FUND AND PORT MITIGATION RELIEF FUND: Administration. Council Member Cartozian stated he was happy to see we are supporting Senate Bill 974 and invited Field Representative Marquez from Senator Lowenthal’s office to speak. Luis Marquez, Field Representative for Senator Lowenthal, stated that several surrounding Cities have supported this Bill as well as the Gateway Cities and other business groups. He noted that it provides a steady stream of funding to maintain infrastructure improvements and mitigation for public health and air quality issues. It was moved by Council Member Guerra, seconded by Council Member Cartozian and unanimously carried to adopt the Resolution. City Council Minutes 05/08/07 -4- COUNCIL MEMBER REQUESTS FOR FUTURE AGENDA ITEMS: A. CONFERENCE AND MEETING REPORTS. Council Member Bayer noted she had attended a Council of Governments (COG) meeting and announced she will be attending Kids Day. STAFF MEMBER COMMENTS: City Manager Caton announced that the ASPIRE after school program has opened in six additional schools this year; thanked Public Works Director Alvarez for his efforts on the Metropolitan Transit Authority call for projects noting he submitted 8 projects and 4 were approved with a value of $5 million dollars; responded to earlier speaker's comments regarding the Parking Structure security agreement, stating that in his review of the information it was not cost effective to continue the service for the low amount of improvement.
