APPROVAL OF CLOSED SESSION MINUTES It was moved by Council Member/Commissioner Guerra, seconded by Mayor Pro Tem/Vice- Chairperson Gafin, and unanimously carried to approve the Closed Session Minutes of February 27 2007I RECESSED TO CLOSED SESSION Mayor/Chairperson Trejo announced the Council/Commission is recessing to Closed Session (6:32 p.m.) to discuss matters under the authority of the following sections of the Government Code: 1. Government Code Section 54956.9(b) – Conference with legal counsel – anticipated litigation. Significant exposure to litigation – one potential case. 2. PRESENT:Council Members: Rick Trejo David R. Gafin Kirk O. Cartozian Anne M. Bayer Mario A. Guerra Mayor Mayor Pro Tem ALSO PRESENT:Gerald Caton, City Manager Charles S. Vose, City Attorney/Economic Development Director Lee Powell, Assistant City Manager Kathleen L. Midstokke, City Clerk Scott Pomrehn, Assistant to the City Manager Desi Alvarez, Public Works Director Roy Campos, Police Chief John Michicoff, FInance Director Thad Phillips, Community Services Director Mark Sauter, Fire Chief John Godlewski, City Planner Susan Domen, Secretary to the City Clerk COUNCIL MEMBER ANNOUNCEMENTS: Council Member Cartozian announced he will be attending the Arc Walk on Saturday morning; mentioned he had attended a Ports of Long Beach Rivers of Trade Commission meeting where they toured the Port of Long Beach. Council Member Guerra announced that he had toured the Arc facilities today; promoted the St. Baldricks fundraiser that will be held at Fire Station No. 1 this Saturday to help raise funds for children with cancer; mentioned he had attended a meeting with Supervisor Knabe, Council Member Cartozian and City Manager Caton last Friday; he noted he will be going to Washington D.C. in a couple of weeks to meet with lobbyists; and stated that he had attended the Gangs Out of Downey meeting and how great it is to see cooperation between all of the groups. Mayor Pro Tem Gafin mentioned he had started his Town Hall meetings and is receiving good input, the next one will be Thursday, March 15th at Gauldin Elementary and the last one will be Wednesday, March 14th at Ward Elementary. City Council Minutes 03/1 3/07 -1- PRESENTATIONS: Mayor Trejo presented a Proclamation to Arc of Southeast L. A. County declaring March 24 as Walk for Independence. Mayor Trejo presented a Certificate of Appreciation to Downey resident Jim Altrnann for giving CPR to a woman at an AYSO event at Griffith Middle School. Mayor Trejo along with representatives of the California Highway Patrol and Automobile Club of Southern California presented the CHP 10851 Award re: stolen vehicles to Downey Police Officers Ed Haro, Jason Klevos, Christopher Kurtz and Vincent Rosario; and Police Corporals Justin Prentice and Nathan Weinrich. NON-AGENDA PUBLIC COMMENT: Ceasar Zaldivar-Motts, resident of Downey, introduced himself as the Director of Southeast Community Development Corporation, a non-profit group that promotes economic development, and provided an information sheet for the Council Members. ADMINISTRATIVE REPORTS: 10.CASH CONTRACT NO. S.S. 585 – IMPERIAL HIGHWAY TRAFFIC SAFETY IMPROVEMENTS: AWARDED CONTRACT TO PALP, INC., DBA EXCEL PAVING COMPANY IN THE AMOUNT OF $2,466,160.50; AND APPROPRIATED $1.5 MILLION FROM PROP C FUNDS AND $1.1 MILLION FROM GAS TAX FUNDS: Public Works (Continued from February 27, 2007) Public Works Director Alvarez explained that the project has been planned for the last 18 months with plans and specifIcations approved last November. The bid opening was held in January and the low bidder was Excel Paving. The project will increase traffic safety and capacity as the growth on Imperial Highway is expected to be over 60,000 vehicles per day. He stated that the residents had been notified and he has only received two letters from residents on LaReina and they were in support of the project. Council Member Guerra stated he had walked to 31 houses on La Reina Avenue and has received 4 phone calls, 3 emails, and would like the public to speak first. The following residents spoke in opposition to the opening of La Reina Avenue onto Imperial Highway: Ricardo Rod riquez Hector Gomez Cynthia Tomayo (sp?) Mario Seva (sp?) Dennis Mlarrnalajo (sp?) Aaron McLeva (sp?) Jerry Lozano Council Member Guerra asked if the project can be approved pending discussion of moving the traffic signal. Director Alvarez explained that the traffic signal is currently located 150 feet to the left of where it will be moved and that a new driveway is going to be installed in the school so that the traffic congestion along Imperial Highway during school drop-off and pick-up hours will be alleviated. He went on to explain that the breaking out of the median at La Reina Avenue can be held over for further discussion with the residents, however, the traffic studies conducted do not project an increase in traffic on this street as it is not a through street. He concluded that due to time constraints, Council could approved the contract except for the removal of the median at La Reina Avenue. Staff will schedule a meeting with the residents in the neighborhood and the modification can be made at a later date. It was moved by Council Member Guerra, seconded by Council Member Cartozian and unanimously carried to approve the contract with the amendment. Prior to the vote, Mayor Pro Tem Gafin asked if the median is not opened somewhere, isn’t it impossible to turn left onto Imperial Highway from the neighborhood. it was indicated that they would have to go around to Brock Avenue. Council Member Cartozian noted it would be good to have a meeting with the residents. City Council Minutes 03/13/07 -3- City Clerk Midstokke was requested to repeat the motion. 11.APPROVED CONTRACT WITH EDAW, INC. IN THE AMOUNT OF $158,700 FOR CONSULTING SERVICES FOR CODE AMENDMENT NO. 06-120, A COMPREHENSIVE UPDATE TO ARTICLE IX (ZONING CODE) OF THE DOWNEY MUNICIPAL CODE: Development Services. City Planner Godlewski presented a staff report explaining that by approving this contract, the Zoning Code will be updated in it’s entirety. The last update was in 1977 and there have been 86 amendments since that time. He stated that 40 Requests for Proposals were sent out and the top ones were interviewed. It was moved by Gafin, seconded by Council Member Bayer and unanimously carried to approve the contract. OTHER BUSINESS: COUNCIL MEMBER REQUESTS FOR FUTURE AGENDA ITEMS: A. CONFERENCE AND MEETING REPORTS. Council Member Guerra requested staff to come back with information for a proposed Charter Amendment for the November election re: term limits; requested staff to look into imposing a two hour parking limit at Stewart and Gray Road and Paramount Boulevard (east side), to discourage vehicles for sale parking there; requested staff to review campaign sign reform, specifically the requirement for the written verification of permission for signs in commercial areas. Council Member Cartozian requested staff to study parking impacts and street sweeping issues on the residential streets at Florence Avenue east of Brookshire Avenue due to the commercial business and to talk with the neighbors. Council Member Bayer thanked Lee Ann Sears for being in attendance and reminded everyone that Citizen’s for Downey is Wednesday morning at 7:15 a.m. and Mayor Trejo will be the guest speaker. Council Member Cartozian reminded everyone that the City Manager will be giving the State of the City address on Friday at the Chamber of Commerce Luncheon.
