JULY 8, 2008
The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:30 p.m., July 8, 2008, in the Council Chamber of the Downey City
Hall, 11111 Brookshire Avenue, Downey, California, Mayor/Chairperson David R. Gafin presiding.

APPROVED CLOSED SESSION MINUTES: June 24, 2008.
It was moved by Mayor Pro Tem/Vice-Chairman Guerra, seconded by Council
Member/Commissioner Bayer and carried (4/0) to approve.
RECESSED TO CLOSED SESSION:
Mayor/Chairperson Gafin announced the Council/CommIssion is ncessing to Closed
Session (6:31 p.m.) to discuss matters under the authority of the following sections of the
Government Code:
1. Government Code Section 54956.8 – Conference with real property negotiator Gilbert Livas
re: property at 7447 Firestone Boulevard.; negotiating party: Jim Louder; under negotiations:
price and terms of payment.
2. Government Code Section 54956.9(b) – Conference with legal counsel – anticipated
litigation. Significant exposure to litigation – three potential cases.
3. Government Code Section 54957.6 – Conference with labor negotiator Lee Powell re:
direction for labor negotiations with Downey Police Officers Association.

RECONVENED:
The meeting reconvened in Open Session at 7:32 p.m. ath all Council
Members/Commissioners present. There were no Closed Session actions to report.
The meeting recessed to Closed Session at 7:59 p.m. and reconvened to Open Session at
8:58 p.m. will all Council Members/Commissioners present. There were no Closed Session actions
to report

The City Council of the City of Downey held a Regular Meeting at 7:34 p.m., July 8, 2008, in
the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor
David R. Gafin presiding.

COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND
CONFERENCE/MEETING REPORTS:
Council Member Trejo requested an update on the Hospital Commission’s last meeting; and
stated that the illegal fireworks seemed to be more under control this year which made the Fourth of
July more pleasant.
Council Member Bayer recognized Commissioner Lee Ann Sears in the audience; and
announced that Citizens for Downey will be Wednesday morning at 7:30 a.m. and Concerts in the
Park at 7 p.m. on Wednesday evening.
Council Member Cartozian recognized intended candidates for District 5, Gary DeRemer and
Luis Marquez in the audience; he announced he will be attending the Independent Cities Association
(ICA) conference this week; he announced that the Orangeline Maglev meeting will be tomorrow
night in Glendale; and he attended the Johnie’s Broiler site clean-up on Monday.

Mayor Pro Tem Guerra complimented Community Services staff and the Camp Wilderness
program; he requested staff to address concerns regarding health inspections, parking, cooked
foods and impact to Downtown area businesses for the Farmer’s Market; stated he attended
neighborhood watch meetings last week and complimented Juddy Ceniceros and the Police
Department for the work they are doing; he complimented the Police and Fire departments for their
service to the community on the Fourth of July; announced that Southern California Edison will be
installing smart meters throughout the City that will regulate energy in peak times; and read a letter
from a citizen praising the senior paint and fix-up program.
Mayor Gafin announced he will be attending the ICA conference; recognized George
Zoumberakis from the Chamber of Commerce in the audience; and congratulated Council Member
Anne Bayer on her election as President for the Gateway Cities Council of Governments (COG).
PRESENTATIONS:
Mayor Gafin presented a Proclamation declaring July as Parks and Recreation Month
PUBLIC HEARINGS: None.

3.APPROPRIATED $42,821 1N STATE 911 FUNDS FOR UPGRADES TO THE POLICE
DEPARTMENT COMMUNICATIONS CENTER: Police.

6.APPROVED AGREEMENT WITH GATEWAY CITIES COUNCIL OF GOVERNMENTS RE:
ADMINISTRATION AND COST SHARING OF COORDINATED MONITORING PLAN FOR
THE LOS ANGELES RIVER AND TRIBUTARIES METALS TMDL: Administration.

7.APPROVED EXTENSION OF STREET SWEEPING CONTRACT WITH NATIONWIDE
ENVIRONMENTAL SERVICES FOR A FIVE YEAR PERIOD AT AN ANNUAL COST OF
$338,571 : Public Works.
8.ACCEPTED AND APPROPRIATED $191,386 FROM 2006 STATE HOMELAND
SECURITY GRANT FOR PURCHASE OF SELF-CONTAINED BREATHING APPARATUS:

9.ADOPTED RESOLUTION NO. 08-7068, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING THE SUBMil-rAL OF A GRANT APPLICATION FOR
FEDERAL SAFE ROUTES TO SCHOOL PROGRAM (CYCLE TWO) FOR THE
WOODRUFF AVENUE AT VIA AMORITA PEDESTRIAN TRAFFIC SIGNAL: Public

ADMINISTRATIVE REPORTS:
10.RESOLUTION FOR RESOLVING A TIE VOTE AT THE GENERAL MUNICIPAL ELECTION
ON NOVEMBER 4, 2008: City Clerk.
A. ADOPTED RESOLUTION NO. 08-7069, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY PROVIDING FOR THE CONDUCT OF A SPECIAL RUNOFF
ELECTION FOR ELECTIVE OFFICES IN THE EVENT OF A TIE VOTE AT THE GENERAL
MUNICIPAL ELECTION OF NOVEMBER 4, 2008.
City Clerk Midstokke presented a staff report stating that the adoption of this Resolution will
allow for a Special Runoff Election if there were a tie in the General Election. If the Resolution is not
adopted, then the tie would be settled by a draw of lots.
It was moved by Council Member Cartozian, seconded by Mayor Pro Tem Guerra and
unanimously carried to adopt.
OTHER BUSINESS: None.
STAFF COMMENTS:
Deputy City Manager Alvarez gave a report on the Farmers Market as requested by Mayor
Pro Tem Guerra. He noted that it has been heartily accepted by the community. The hot food
vendors are inspected by the Health Department which they do twice a year. They started with
seven hot food vendors and are down to five where the fresh produce vendors are at 13 and there is
a request for more. He stated the local businesses have first priority if they would like to put a booth
in. Eclipse Coffee Shop has expressed that the market has increased their business on Saturday
mornings. The operators are pleased with the operation.

ADJOURNMENT:
The meeting adjourned at 8:58 p.m. to 6:30 p.m. July 22, 2008 in memory of Maria
Gutierrez, Downey resident and mail carrier with the U.S. Postal Service and Donald Doyle,
longtime Downey resident and father of Chief Deputy City Clerk Joyce Doyle.
