GaIn presiding. PRESENT: Council Members/Commissioners: David R. Gafin Mario A. Guerra Anne M. Bayer Kirk O. APPROVED CLOSED SESSION MINUTES: May 13, 2008. It was moved by Council Member/Commissioner Bayer, seconded by Mayor Pro Tem/Vice- Chairperson Guerra and unanimously carried (3/0) to approve. RECESSED TO CLOSED SESSION: Mayor/Chairperson Gafin announced the Council/Commission is recessing to Closed Session (6:32 p.m.) to discuss matters under the authority of the following section of the Government Code: 1. Government Code Section 54956.8 – Conference with real property negotiator Gilbert Livas re: property at 8102 Third Street; negotiating party: Dr. Chris Myung; under negotiations: price and terms of payment. Minutes (adj.) 05/27/08 -2- MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING MAY 27, 2008 The City Council of the City of Downey held a Regular Meeting at 7:35 p.m., May 27, 2008, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor David R. Pomrehn, Assistant to the City Manager Desi Alvarez, Deputy City Manager/Special Projects Roy Campos, Police Chief Linda Haines, Building and Housing Director Gilbert Livas, Deputy City Manager/Community Development John Michicoff, Finance Director John Perfitt, Economic Development Director Thad Phillips, Community Services Director Brian Ragland, Public Works Director Mark Sauter, Fire Chief Susan Domen, Secretary to the City Clerk Other City Staff COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND CONFERENCE/MEETING REPORTS: Council Member Trejo thanked City Manager Caton and the contractor for providing a tour of the Columbia Learning Center and the Discovery Sports Complex construction sites. Mayor Pro Tem Guerra noted he attended a scholarship committee meeting for the Downey Police Fire Association last week; announced that the Downey Fire Department will be holding a Fill the Boot fundraiser this Saturday at Downey Landing at10:00 a.m. for the Muscular Dystrophy Association; mentioned he attended the International Conference on Shopping Centers (ICSC) along with Council Member Cartozian and Economic Development Director Perfitt last week; announced that Police Chief Campos’ brother will be ordained as a priest this Saturday; noted he will be attending the California Contract Cities conference this weekend; stated that he attended the Memorial Day celebration at the Downey Cemetery; attended the Downey High School Hall of Fame induction ceremony last Friday wherein Mayor Gafin was inducted; requested that staff meet with him regarding a bimonthly email newsletter; requested an update on the consolidation of the Public Works Yards, the fence around the Police Station parking lot, the fence at Fire Station Number 1 , and the Council meetings aired on the web; noted he attended the Coordinating Council Volunteer City Council Minutes 05/27/08 -1- Banquet and complimented Council Member Bayer on putting it together; requested that a community organization calendar and links to community organizations websites be added to the City’s website; and requested that items on the Council Assignment List remain on the list until they are completed. Council Member Cartozian congratulated Mayor Gafin on his induction in the Downey High School Hall of Fame; stated he attend the Memorial Day celebration at the Downey Cemetery; attended the Armenian Church’s annual Memorial Day picnic; attended the ICSC conference; he will be attending the California Contract Cities conference this weekend; and reminded everyone about the Relay for Life and Greek Festival both taking place on June 7th and 8th. Mayor Gafin announced he attended the Public Works employee appreciation pancake breakfast last week; asked for staff to work on a press release for the traffic calming measure passed at the last meeting; noted he had spoken to Joseph Del Rio regarding having a purple heart monument constructed; recognized Mike Murray representative for the Chamber of Commerce and Planning Commissioner in the audience; and announced he would not be attending the June 10, 2008 Council meeting. PRESENTATIONS: Mayor Gafin presented a Proclamation declaring May 2008 as Motorcycle Awareness Month. PUBLIC HEARINGS: None NON-AGENDA PUBLIC COMMENT: Maria Larkin, resident of Downey, announced that she is running for City Council in District 5 and former Council Member Winningham is supporting her. Harold Tseklenis, resident of Downey, congratulated Council Member Cartozian and Mayor Pro Tem Guerra for attending the Green conference and stated that the 17th Annual United States Green Building Council was held in Downey last week. APPROVED AMENDMENT TO AGREEMENT WITH ITURASEC FOR NETWORK AND FIREWALL SECURITY MAINTENANCE SERVICES: Finance. APPROVED AN INSTRUCTIONAL CONTRACT WITH RANCHO SANTIAGO COMMUNITY COLLEGE DISTRICT: Fire. CASH CONTRACT NO. 661 - QUILL DRIVE 8-INCH SEWER MAIN EXTENSION: AWARDED CONTRACT IN THE AMOUNT OF $33,900 TO GALLEGOS GENERAL ENGINEERING: Public Works. CONCRETE REPAIRS - SETTLEMENT OF STOP NOTICE CLAIMS: APPROVED SETTLEMENT AGREEMENT WITH WESTCHESTER FIRE INSURANCE COMPANY AND AUTHORIZED PAYMENT OF $50,159.17: Public Works. 7.ADOPTED RESOLUTION NO. 08-7056, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE RIVERS AND MOUNTAINS CONSERVANCY FOR THE TREASURE ISLAND PARK RENOVATION PROJECT: Community Services. 8.ADOPTED RESOLUTION NO. 08-7057, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE APPLICATION FOR PEDESTRIAN FUNDS FOR FISCAL YEAR 2007-2008 AUTHORIZED UNDER TRANSPORTATION DEVELOPMENT ACT ARTICLE III: Public Works. It was moved by Council Member Cartozian, seconded by Council Member Trejo, and unanimously carried to approve the Consent Calendar items as recommended . ADMINISTRATIVE REPORTS: 9.CONTINUING DISCUSSION AND DIRECTION TO THE CITY ATTORNEY FOR PREPARATION OF A WRITTEN POLICY ON THE MAYOR ROTATION: City Attorney. (Continued from May 13). City Attorney Lee noted that a proposed policy was included with the staff report and is asking the Council to give direction on how they wish staff to proceed. Council Member Bayer explained that she feels any policy should be based on districts like it has been historically and would like this to come back with more than one option at a Public Hearing It was moved by Council Member Bayer to have an alternative policy brought back at a Public Hearing. Mayor Pro Tem Guerra noted his disagreement that there had been any policy and would like to see the proposed policy move forward. Council Member Cartozian stated his agreement with Council Member Guerra and that he feels there has never been a written policy approved by the Council and the proposed policy is fair. Mayor Gafin mentioned that the passing of a policy that has no teeth does not guarantee the prevention of what happened earlier in the year and that he does not agree with Item Number 1 as they cannot set policy that binds future Councils. Council Member Trejo seconded Council Member Bayer’s motion. A substitute motion was made by Council Member Cartozian, seconded by Mayor Pro Tem Guerra, to approve the policy presented by staff with the deletion of Item Number 1. For clarity, the motion and vote are listed below. City Clerk Midstokke stated the question before the Council is to make the subsidiary motion the main motion and it passed with Council Members Bayer and Trejo dissenting. City Council Minutes 05/27/08 -3- City Manager Caton explained that he had worked on the policy with the City Attorney to create a logical and fair policy and that by involving the districts, it is impossible. He noted that the unique thing about Downey is that the Mayoral rotation has never been a huge issue like it is in other cities After further discussion, Council Member Cartozian amended the main motion and reinstated Item Number 1 with the approval of Mayor Pro Tem Guerra as the second. It was moved by Council Member Cartozian, seconded by Mayor Pro Tem Guerra and carried, with Council Member Trejo dissenting, to approve the policy as presented by staff. 10.SCHEDULED DATE AND TIME FOR A STUDY SESSION TO REVIEW THE PROPOSED 2008-09 BUDGET: Administration. It was discussed and so ordered by the Mayor to hold a Budget Study Session on Tuesday, June 3'd at 6:30 p.m. OTHER BUSINESS: None. CONSENT ITEMS REMOVED: None.
