REGULAR MEETING
MARCH 25, 2008
The City Council of the City of Downey held a Regular Meeting at 7:37 p.m., March 25, 2008,
in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California,
Mayor David R. Gafin presiding.

COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND
CONFERENCE/MEETING REPORTS:
Council Member Trejo thanked Mayor Gafin for allowing him to sit on the Sanitation District’s
Board of Commissioners stating that he has learned a lot; he noted that the Sanitation District puts
on workshops and has opportunities for students interested in becoming engineers and he will be
approaching the School Board to further the opportunity for Downey students.
Mayor Pro Tem Guerra announced that he toured the City with the visiting group from our
Ensenada Sister City; mentioned the fundraiser the Fire Department participated in, St. Baldricks,
which raised over $30,000 for childhood cancer research; he attended a meeting between the City
and Los Angeles County regarding the Rancho Los Arnigos property development; he attended the
funeral services for Paul Yokota and feels the City lost a great citizen; he attended a neighborhood
watch meeting and commended Public Information Officer Ceniceros and the Police Department for
doing a great job; announced a neighborhood watch meeting this Thursday evening; requested that
a presentation by Mr. Dagget regarding handicap parking in the Downtown area be put on the next
agenda; requested the City have an information booth at the Farmer’s Market staffed by volunteers;
and requested that the proposed budget includes continued funding for the Police in the schools.

Mayor Gafin mentioned that on May 15th he attended the Keep Downey Beautiful clean-up,
the Arbor Day tree planting at the Barbara Riley Center, the Miss Downey/Miss Teen Downey
Pageant; and the Easter Eggstravaganza at the parks last Saturday. He announced the ARC Walk
on April 5th at Stonewood Center; and recognized Planning Commissioner Mike Murray in the
audience
PRESENTATIONS:
Mayor Gafin presented a Proclamation declaring April 5, 2008 as Arc Walk for Independence
Day.
Mayor Gafin presented a Certificate of Appointment to Maria Larkin to the Parking Place
Commission for Council District Four.
Mayor Gafin presented City Pins to Miss Downey Sarah Lopez, Miss Teen Downey Carli
Ciatti and their Courts.
Mayor Gafin presented a Proclamation regarding the Sister City of Ensenada’s official visit to
Downey March 25, 2008.
PUBLIC HEARINGS: None.
NON-AGENDA PUBLIC COMMENT:
Jim Roberts, resident of Downey, asked for clarification on who would be running the
Farmers’ Market and how the profits would be distributed; and he noted he would like to see the
community getting to know the Police Officers so that all can work together.
Lennie Whittington, resident of Downey, stated that he was upset regarding an email that
was distributed in regards to his lawsuit against the City and that the case is not over.
Jerry Aweto (sp?), resident of Downey, asked for civility to be used at Council meetings and
in our communities.
CONSENT CALENDAR:
It was moved by Council Member Bayer, seconded by Council Member Trejo1 and
unanimously carried to approve the Consent Calendar items as recommended:
1.APPROVED CITY COUNCIL MINUTES: Regular and Adjourned Meetings March 11, 2008:
City Clerk.
2.APPROVED WARRANTS ISSUED: Warrant Nos. 230043 – 230433; Wire Nos. 357
30001637 – 30001645; in the total amount of $3,470,863.05: Finance.
3.APPROVED RENEWAL OF LICENSE AGREEMENTS WITH SOUTHERN CALIFORNIA
EDISON COMPANY FOR THE CONTINUED USE OF THEIR RIGHT-OF-WAY FOR PARK
PURPOSES AT WILDERNESS AND CRAWFORD PARKS: Community Seraices

4.CASH CONTRACT NO. 632-1D: LAKEWOOD BOULEVARD IMPROVEMENT PROJECT
PHASE ID: APPROVED CONTRACT WITH SULLY-MILLER CONTRACTING COMPANY
IN THE AMOUNT OF $414,408 AND AUTHORIZED THE DRAWDOWN OF $646,570 1N
ACCORDANCE WITH THE PUBLIC WORKS AGREEMENT BETWEEN THE CITY AND
COMMISSION, DATED APRIL 10, 2007: Public Works.
5.ADOPTED RESOLUTION NO. 08-7049, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING THE SUBM11-rAL OF FUNDING APPLICATION FOR
THE “PARAMOUNT BOULEVARD TRAFFIC SIGNAL UPGRADES AND FIBEROPTIC
COMMUNICATIONS PROJECT” UNDER THE PROPOSITION IB LOCAL TRAFFIC
LIGHT SYNCHRONIZATION PROGRAM (TLSP): Public Works.
6.ADOPTED RESOLUTION NO. 08-7050. A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF TRACT NO. 69348
(9110 – 9126 FLORENCE AVENUE) BY APPROVING AN AGREEMENT WITH THE
SUBDIVIDER AND ACCEPTING A SUBDIVISION IMPROVEMENT PERFORMANCE
BOND AS SURETY: Public Works.
7.ADOPTED ORDINANCE NO 08-1228, AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING CODE AMENDMENT NO. 07-170. THEREBY MOVING
THE SUBDIVISION REQUIREMENTS WITHIN THE MUNICIPAL CODE FROM CHAPTER
2 OF ARTICLE IX TO CHAPTER 9 OF ARTICLE IX: Community Development.
8.ADOPTED ORDINANCE NO. 08-1229. AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING AN AMENDMENT TO THE CITY’S COMPREHENSIVE
ZONING MAP, CHANGING THE ZONING CLASSIFICATION OF PROPERTY AT 9520
TELEGRAPH ROAD FROM R-1 5,000 (SINGLE FAMILY RESIDENTIAL) TO R-3 (MEDIUM
DENSITY MULTIPLE-FAMILY RESIDENTIAL) AND ADOPTING A NEGATIVE
DECLARATION (ZONE CHANGE NO. 07-183): Community Development.

The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:31 p.m., ApHI 8, 2008, in the Council Chamber of the Downey City
Hall, 11111 Brookshire Avenue, Downey, California, Mayor/Chairperson David R. Gafin presiding.

PUBLIC COMMENT ON ADJOURNED MEETING AGENDA ITEMS:None
Anthony Mendez, real estate broker, submitted a letterto the Council and spoke regarding an
alleged contractual relationship with Raul Porto regarding Closed Session Item Number One.
APPROVED CLOSED SESSION MINUTES: March 11, 2008.
It was moved by Council Member/Commissioner Bayer, seconded by Mayor/Chairperson
Gafin and unanimously carried (3/0) to approve.
RECESSED TO CLOSED SESSION:
Mayor/Chairperson Gafin announced the Council/Commission is recessing to Closed
Session (6:38 p.m.) to discuss matters under the authority of the following sections of the
Government Code:
1. Government Code Section 54956.8 – Conference with real property negotiator Gilbert Livas
re: property at 9066 Firestone Boulevard; negotiating party: Raul Porto; under negotiations:
price and terms of payment. There was a correction to the address in this item Wth the
correct address being 8255 Firestone Boulevard.

2. Government Code Section 54956.8 – Conference with real property negotiator Gerald Caton
re: property at northeast comer of Blodgett Avenue and Cheyenne Street; negotiating party:
State of California, Department of Transportation; under negotiations: price and terms of
payment.
3. Government Code Section 54957.6 – Conference with labor negotiator Lee Powell re:
direction for labor negotiations with Downey Police Officers Association.
4. Government Code Section 54956.9(c) – Conference with legal counsel – Anticipated litigation
– Initiation of litigation – one case.
5. Government Code Section 54956.8 – Conference with real property negotiator Desi Alvarez
re: property located at 88188832 Imperial Highway, negotiating party David Gonsalves;
under negotiations: price and terms of payment. (For clarity the vote to add this item is listed
under the City Council meeting where it occurred).
RECONVENED:
The meeting reconvened in Open Session at 7:33 p.m. Qth all Council
Members/Commissioners present. There were no Closed Session actions to report. Mayor Gafin
announced they would be returning to Closed Session at the end of the City Council meeting.

immediately recessed to Closed Session
The meeting reconvened in Open Session at 9:24 p.m. Qth all Council
Members/Commissioners present. There were no Closed Session actions to report.
