HomeMy WebLinkAboutResolution No. 23-8187 - Approving the City's Sewer System Management Plan (SSMP)RESOLUTION NO. 23-8187 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE CITY'S SEWER SYSTEM MANAGEMENT PLAN (SSMP) WHEREAS, on May 2, 2006, the State Water Resources Control Board (SWRCB) Order No. 2006-003 (Sanitary Sewer Order) Statewide General Waste Discharge Requirements (WDR) for Sanitary Sewer Systems was adopted and implemented; and WHEREAS, the purpose of the Sanitary Sewer Order was to develop a regulatory mechanism to provide a consistent statewide approach for reducing sanitary sewer overflows (SSOs); and WHEREAS, the Sanitary Sewer Order required public agencies that own or operate sanitary sewer systems comprised of more than one mile of pipes or sewer lines which convey wastewater to a publicly owned treatment facility to apply for coverage under the Sanitary Sewer Order, develop and implement SSMPs, and report all SSOs to the SWRCB's online SSO database; and WHEREAS, the City of Downey's (City's) sewer collection system is comprised of approximately 200 miles of sewer mains; and WHEREAS, the City filed a Notice of Intent (NOI) for coverage under the Sanitary Sewer Order with the SWRCB and certified that its SSMP and constituent subparts/elements were in compliance with the Sanitary Sewer Order within the timelines established for each; and WHEREAS, on December 6, 2022, the SWRCB adopted Order No. 2022-0103-DWQ Statewide Waste Discharge Requirements General Order for Sanitary Sewer Systems (General Order); and WHEREAS, the General Order serves as the new statewide waste discharge requirements regulating sanitary sewer systems; and WHEREAS, prior to June 5, 2023, the City was asked by the SWRCB to certify continuation of regulatory coverage for the City's sanitary sewer system from the Sanitary Sewer Order to the General Order which was subsequently completed; and WHEREAS, on June 5, 2023 the General Order became effective and the original Sanitary Sewer Order was rescinded; and WHEREAS, the new General Order requires development of an SSMP to provide a plan to properly manage, operate, and maintain all parts of the City's sanitary sewer system and to help reduce and prevent emergency spills, as well as mitigate any sewage spills that do occur; and WHEREAS, the SSMP has been prepared in compliance with the General Order and will be periodically updated in accordance with the requirements of such order; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The above recitals are all true and correct. SECTION 2. The City Council of the City of Downey does hereby approve the attached RESOLUTION NO. 23-8187 PAGE 2 SECTION 3. The Director of Public Works, or his designee, is hereby authorized to certify via the SWRCB's online database that the SSMP is complete and in compliance with the General Order and to certify any ongoing compliance reports as required by the General Order, on behalf of the City of Downey. �•Efli I I R I 'Fil NOR � � � � 1 11 11• 1 W - * 0 August, 2023.
