General Plan Conformance Downey Unified School District Disposal of Surplus Property August 2, 2023 – 2 the purpose of the disposition is found to be consistent with the City’s General Plan by the Planning Commission. The four parcels combined are approximately 3.09 acres in size or 134,868 square feet and are developed with two structures consisting of a medical office building near the corner of Davis Street and Brookshire Avenue, and a three story, 123-unit senior housing complex with associated surface parking lot along Dolan Ave. The site is currently leased to Brookshire Partners until April 2060. Subject Property In accordance with Government Code section 65402(c) the Planning Agency (the Planning Commission) must report on the disposition's conformity with the applicable General Plan within forty (40) days of receiving the notice from the District. The notice was received on June 26, 2023 and the 40th day will be August 5, 2023. If the Planning Commission disapproves of the disposition, such disapproval may be overruled by the school district. DISCUSSION The proposed sale is consistent with the General Plan of the City of Downey. The subject properties have a General Plan Land Use designation of Office and a Zoning designation of Hospital Medical-Arts, which is the corresponding zone to the Office land use designation. This Zone supports professional and medical office uses, which is what is currently developed on these properties along with a retirement center that was approved under Condition Use Permit No.133 and Variance No. 202 on March 17, 1982. The sale of the property in and of itself does not conflict with the land use designation of the General Plan or with any of the General Plan’s goals and objectives. As stated earlier, the purpose of the sale is a result of the School District determining that the property is surplus and appropriate for sale. There are no plans at this time Downey Unified School District Disposal of Surplus Property August 2, 2023 – 3 with regard to any future activities on the property. Any future change in use of the properties would be subject to the City’s General Plan and Zoning Code at the time an application is received by the City. ENVIRONMENTAL ANALYSIS Staff has assessed this request in accordance with the California Environmental Quality Act (CEQA). Staff has determined that this request is categorically exempt from CEQA, pursuant to CEQA Guideline Section No. 15312 (Class 12 – Surplus Government Property Sales). CONCLUSION Based on the analysis contained within this report, staff has concluded that the proposed sale of the subject properties is in conformance with the adopted General Plan and therefore recommends that the Planning Commission adopt the attached Resolution. Letter from the School District Downey Unified School District Disposal of Surplus Property August 2, 2023 – 4 Exhibit ‘A’ – Maps ZONING MAP Downey Unified School District Disposal of Surplus Property August 2, 2023 – 5 GENERAL PLAN MAP RESOLUTION NO. 23- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY FINDING THE DISPOSAL OF REAL PROPERTY LOCATED AT 11525 BROOKSHIRE AVENUE AND 11500 DOLAND STREET (APN: 6255-010-902, 6255-010-903, 6255-010-904, 6255-010-905) IS CONSISTENT WITH THE CITY’S ADOPTED GENERAL PLAN THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. Downey Unified School District owns the real property at 11525 Brookshire Avenue and 11500 Dolan Street identified as Assessor’s Parcel Numbers 6255-010-902, 6255-010-903, 6255-010-904, 6255-010-905 (collectively, the “Property”). The Property is composed of four (4) developed parcels consisting of a medical office building and a senior housing complex, totaling 3.09 acres in size or 134,868 square feet which is currently leased to Brookshire Partners; and, B. The sale of this property is a result of the School District determining the land is surplus property which has not been used for any school use nor does the District plan to use the property for future school use; and, C. Pursuant to the Surplus Land Act (“SLA”), Section 65402(b), no real property shall be disposed of until the location, purpose and extent of such disposition has been submitted to and reported upon by the Planning Agency as to conformity with the adopted General Plan of the local agency; and, D. Pursuant to the Surplus Land Act (“SLA”), Section 65402(c), the Planning Agency (“Planning Commission”) must report on the disposition’s conformity with the application General Plan within forty (40) days of receiving the notice from the District. The notice was received on June 26, 2023 and the 40th day will be August 5, 2023; and, E. The subject site has a General Plan land use designation of (O) Office and a Zoning designation of Hospital Medical-Arts (H-M), which is the corresponding zone and all existing uses developed on the property are legally established as by right uses and uses approved under a discretionary action; and, F. The proposed sale is consistent with the General Plan of the City of Downey. The subject properties have a General Plan Land Use designation of Office and a Zoning designation of Hospital Medical-Arts, which is the corresponding zone to the Office land use designation; and G. The Planning Commission held a regular meeting on August 2, 2023, and after fully considering all oral and written testimony, facts, and opinions offered at the aforesaid meeting adopted this resolution. SECTION 2. The Planning Commission further finds, determines and declares that the proposed project was reviewed for compliance with the California Environmental Quality Act Resolution No. 23- Downey Planning Commission General Plan Conformance Letter August 2, 2023 - Page 2 (CEQA), and is categorially exempt from CEQA, pursuant to CEQA Guideline Section No. 15312 (Class 12 – Surplus Government Property Sales). SECTION 3. Based upon the findings set forth in Sections 1 through 2 of this Resolution, the Planning Commission of the City of Downey determines that the sale of the real property owned by Downey Unified School District is in compliance with the City’s adopted General Plan. SECTION 4. The Secretary shall certify the adoption of this Resolution.
