Pursuant to Downey Municipal Code (DMC) Section 9420.04(c), special events involving over five hundred (500) people shall require Planning Commission approval. Based on the analysis contained in this report, Staff is recommending that the Planning Commission adopt the following titled resolution: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN-23-00029 (SPECIAL EVENT PERMIT), THEREBY ALLOWING THE OPERATION OF AN ANNUAL FUNDRAISING CARNIVAL FOR THREE (3) CONSECUTIVE DAYS FROM APRIL 28 THROUGH APRIL 30, 2023, IN CONJUNCTION WITH THE OUR LADY OF PERPETUAL HELP SCHOOL, ON PROPERTY LOCATED AT 10441 DOWNEY AVENUE, ZONED R-3 (MULTIPLE FAMIL Y RESIDENTIAL) BACKGROUND Our Lady of Perpetual Help School has operated its carnival annually since 1998 as a fundraiser for the school. The subject site is a 4.17 acre, rectangular-shaped, lot that is located on the west side of Downey Avenue, north of Cherokee Drive. The subject site is zoned R-3 PC AGENDA PAGE 1 10441 Downey Avenue – PLN-23-00029 April 19, 2023 – Page 2 (Multi-Family Residential) and is currently improved with a school. Single -family and multiple- family residential land uses surround the school property. On March 8, 2023, Michael Bolliger submitted a Special Event Permit (PLN-23-00029) application on behalf of OLPH School, requesting the Planning Commission’s approval to conduct a three-day fundraising carnival on the school grounds. On April 6, 2023, staff mailed notice of the requested Special Event Permit to all property owners within 100 feet of the subject site. DISCUSSION The applicant has indicated that they expect approximately 500 – 1,000 attendees of the carnival throughout each day of the event. The applicant requests approval of the same carnival activities conducted in prior years, which include mechanical rides, jumpers, kid rides, food sales, a beer garden, live entertainment and games. The proposed carnival hours will be as follows: •Friday, April 28, 2023, 5:00 p.m. to 10:30 p.m. •Saturday, April 29, 2023, 12:00 p.m. to 11:00 p.m. •Sunday, April 30, 2023, 12:00 p.m. to 8:30 p.m. The rides and jumpers will be located on the west side of the designated event parking lot, as well as along La Reina Avenue. There will be three (3) entrances to the carnival area. Two (2) entrances being along La Reina Avenue and one (1) being from Downey Avenue. The applicant also proposes a stage for live entertainment. The hours of live entertainment will differ on each day. Performances will begin between 6:00 p.m. to 10:00 p.m. on Friday, 1:00 p.m. to 10:30 p.m. on Saturday, and 2:00 p.m. to 8:00 p.m. on Sunday. The stage will be located next to the playground equipment facing north where the game and food booths are located. The stage location is approximately 150 feet from the nearest residential properties to the west. Similar to previous year’s events, the applicant is proposing the sale of food and alcohol. The applicant will be required to obtain temporary permits from the California Department of Alcoholic Beverage Control (ABC) for the sale of alcoholic beverages within the beer garden /bar area. The beer garden and bar lounge are completely gated and wristbands are distributed to attendees that are 21 years of age or older as they enter the gated area. Alcohol will only be sold and consumed within these designated areas. The applicant is proposing to sell beer and wine on Friday and all other alcohol on Saturday and Sunday. Trash receptacles will be placed throughout the site. Additionally, to ensure litter generated by the carnival does not impact surrounding residences, school and parish members will walk around the premises to p ick up trash every two hours. All sound and lighting equipment will be directed away from local residences and generators will be placed away from property lines. The applicant will be using two (2) Downey Police officers for carnival security as well as retired law enforcement and 50-60 volunteers. With regards to parking, 55 parking spaces will remain available on the northern portion of the school and 34 parking spaces will be available on the south portion of the school. In addition, the church has another parking lot located at the northwest corner of New Street and 6 th Street which will provide 61 spaces, and an additional 46 spaces across from the site at the rear of St. Marks Episcopal Church giving them a total of 196 parking spaces for patrons. PC AGENDA PAGE 2 10441 Downey Avenue – PLN-23-00029 April 19, 2023 – Page 3 West view of subject site along Downey Avenue DEVELOPMENT REVIEW COMMITTEE The project was reviewed by the Development Review Committee (DRC) and standard comments were provided similar to previous years. Staff included conditions in order to address the department’s comments. Police Department has conditioned that if noise becomes an issue after 10:00 p.m. on any day of the carnival operation, Police Department will require the event to cease and will not be allowed to continue to operate to 11:00 p.m. ENVIRONMENTAL ANALYSIS Staff has reviewed the proposed use for compliance with the California Environmental Quality Act (CEQA). Upon completion of this review, it has been determined that this request is not Subject to CEQA because the activity is not a project as defined in Section 15378. FINDINGS Pursuant to the requirements of the Downey Municipal Code, Staff recommends that the Planning Commission make the following findings to approve the overall request: A.That the proposed activity or use will be consistent with the objectives, policies, and general land uses and programs specified in the City’s General Plan. The overall request is a temporary fundraising event consistent with all applicable objectives, policies, and programs specified in the City’s General Plan. In addition, the temporary event’s fundraising efforts help achieve various long -term goals. Specifically, the following policies are promoted by the S pecial Event Permit: Program 7.4.1.4 – Support efforts to raise funds for local school districts and other groups involved with providing educational facilities for residents. Program 1.1.5.3 – Promote recreation and entertainment uses that serve needs of the public. The proposed carnival is a fundraising event for Our Lady of Perpetual Help School, the event is open to the public, and includes games and rides for attendees to enjoy. The proposed special event is consistent with the City’s General Plan Programs listed above. The proposed activity will take place April 28th to April 30th, 2023 between specific hours. B.That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area. That the proposed activity or use is consistent with other provisions of this art icle. OLPH School is located within R-3 (Multiple-Family Residential) zones, which allows for the establishment of public and private schools. Operation of a carnival will not alter the existing use of the site or create a need to deviate from any section of the Downey Municipal Code. Section 9420.20 of the Downey Municipal Code permits special outdoor events in residential zones, subject to the general requirements stated in Special Event’s Code Section. The proposed event satisfies those requirements . C.That the proposed activity or use will not result in conditions or circumstances contrary to the public health, safety, and general welfare. The temporary event will occur on school grounds of the school property. The applicant will provide 196 parking spaces located onsite and offsite. The applicant will provide onsite restroom facilities for the event to accommodate visitors. Also, conditions of approval are incorporated to address any concerns related to the permitted hours of the event, parking, noise, security, trash receptacle requirements, restroom, and site clean-up. Approving the special event, subject to conditions of approval, will not result in conditions contrary to the public health, safety and general welfare. CORRESPONDENCE As of the date that this report was printed, staff has not received any correspondence regarding this matter. CONCLUSION Based on the analysis contained in this report, staff recommends that the Planning Commissio n adopt the resolution approving the Special Event Permit (PLN-23-00029), subject to the conditions of approval as stated in the Planning Commission Resolution. City shall promptly notify Applicant of any such claim, action or proceeding to which City receives notice, and City will cooperate fully with Applicant in the defense thereof. Applicant shall reimburse the City for any court costs and attorney's fees that the City may be required to pay as a result of any such claim, action or proceeding. City may, in its sole discretion, participate in the defense of any such claim, action or proceeding, but such participation shall not relieve Applicant of the obligations of this condition. 4.The City Planner is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 5.Prior to April 24, 2023 at 12:00 p.m., the applicant and the property owner shall sign an affidavit of Acceptance of Conditions, as provided by the City of Downey. 6.The approved activities for the special event shall consist of mechanical rides, jumpers, a beer garden, kid rides, food sales, live entertainment and games. 7.The owner/applicant shall provide trash receptacles on the subject site, includ ing parking lots. During the event, perish member(s) shall walk around the premises during all carnival hours to remove trash on the subject site (including parking lots) and the adjacent streets. 8.Set up of the carnival shall occur no s ooner than Wednesday, April 26, 2023. Clean-up and removal of the carnival, including all apparatus, shall be complete by 10:00 p.m. on Monday, May 1, 2023. Permitted hours for set-up and clean-up operations are from 7:00 a.m. until 10:00 p.m. 9.The generator is proposed to be located in the between the north open area and the rides on the sports field; however, in no instance shall the generator be located less than of 25 PC AGENDA PAGE 10 Resolution No. 23- Downey Planning Commission PLN-23-00029 – 10441 Downey Avenue April 19, 2023 - Page 4 feet from any property line. Additionally, the generator shall not exceed a noise level of 65 dBA, as measured from the nearest property line. 10.Temporary lighting shall not illuminate off-site. 11.Any necessary Health Department approvals required for the sale of food at the carnival shall be obtained on or before Monday, April 24, 2023. 12.The alcohol area shall be contained within a “beer garden” area where patrons may consume alcohol. The applicant shall obtain a permit from the Department of Alcohol Beverage Control for the sale of alcoholic beverages on or before Monday, April 24, 2022. 13.Live entertainment shall only occur during hours listed below and shall cease immediately to reduce noise impacts to surrounding residents. •Friday, April 28, 2022, from 6:00 p.m. to 10:00 p.m. •Saturday, April 29, 2022, from 2:00 p.m. to 10:30 p.m. •Sunday, April 30, 2022, from 2:00 p.m. to 8:00 p.m. 14.All speakers for amplified sound shall be placed to minimize impacts on the nearby residences adjacent of the subject site. 15.Hand held signs shall not be utilized on public or private property to advertise the event. The construction documents shall include a site plan indicating the location of the temporary structure and information delineating the means of egress and the occupant load. The temporary structure shall be located in accordance with the requirements of California Building Code Table 602 based on the fire-resistance rating of the exterior walls proposed type of construction (10 feet minimum from property line based on Type VB). 19.Temporary structures or facility shall meet the requirements of Chapter 11B of the California Building Code. Site plan shall include a site accessibility plan identifying exterior routes of travel and detailing running slope, cross slope, width, pedestrian ramp, curb ramps, handrails, signage and truncated domes. Path of travel shall be provided from the public right of way and accessible parking to building or facility. The design professional shall ensure that the site accessibility plan is compliance with the latest Federal and State regulations. FIRE DEPARTMENT 23.Obtain a special event permit from City of Downey Fire Department. Permit shall be obtained through the Fire Prevention Bureau no later than seven (7) business days prior to event – special event permit application shall be submitted no later than Friday, April 21, 2023. 24.Event set-up including all rides, booths, generator, tents, fire protection, electrical, etc. shall be complete, in place, and ready for inspection by 3:00 pm on Friday, April 28th, 2023. [Note: If inspection is conducted after hours (or on the weekend) an additional inspection fee (4-hour minimum) will be applied as per city fee schedule]. 25.Fire apparatus access (e.g. fire lane) shall be maintained accessible at all times. Areas where deep frying cooking operations are occurring shall be provided with a K-class fire extinguisher. All extinguishers shall be in good repair, serviced, and with CA SFM-tag affixed indicating required annual service complete. 34.Maintain occupant load in all structures, buildings, tents, canopies as per California Fire Code. Occupant load signs, where required, shall be conspicuously posted [CA Fire Code § 3104.14; §1004.3] 35.All electrical cords shall be UL-listed and rated for heavy-duty, outdoor use and protected from physical damaged by cable bridges or other approved methods [CA Fire Code § 605.5]. 36.All amusement rides shall be permitted with State of California DIR-DOSH. All amusement rides shall comply with the requirements of CCR Title 8 – General Safety Orders and CA Labor Code. 37.Each amusement ride shall display the required State registration (identification & rating plate). At time of special event application, submit list of rides with their corresponding current annual permit to operate. 38.Provide updated plot plan showing location of the Ferris Wheel (if applicable) and generator. 39.Crowd managers (clearly identified as such via uniform, vests, shirts, etc.) shall be provided with duties to maintain egress, assist in evacuation, and maintain fire lanes and site access. Crowd managers shall be required for an event involving the gathering of more than 1,000 persons. Please provide information as to anticipated crowd size. Crowd managers shall be established at ratio of one crowd manager for every 250 persons and their duties to include: conduct inspections to identif y fire hazards, verify permit compliance, direct and assist event attendees in evacuation during an emergency, assist emergency response personnel where requested [CA Fire Code §403.12.3; 403.12.3.1; 403.12.3.3]. 40.If the event shall require a crowd manager(s), then an IAP (Incident Action Plan) or Emergency Action Plan (EAP) shall be required for emergency planning purposes. 41.Event shall not obstruct or impede egress from any other building or occupancy. POLICE DEPARTMENT 42.The owner/applicant must provide licensed security guards on-site during all carnival hours, including two (2) Downey Police Department Officers and a minimum of four (4) security guards. West view of commercial tenant space On February 15, 2023, the applicant applied for a Conditional Use Permit requesting to allow the establishment of a veterinary hospital. Subsequently, after submittal of revised plans and additional information, staff deemed the ap plication complete for further processing on April 6, 2023. The notice of pending public hearing was published in the Downey Patriot and mailed to all property owners within 500’ of the subject site on April 6, 2023. DISCUSSION The subject property is improved with a 24,811 square foot multi-tenant commercial building with a total of 16 tenant spaces occupied by uses ranging from medical office, restaurant, and retail. Uses surrounding the commercial site include commercial uses to the north, west, and south with residential to the east. The subject site is also improved with a total of 127 shared parking spaces including five (5) ADA parking stalls. Since the tenant space previously contained a medical use, additional parking is not required for the pro posed veterinary use. Both uses require the same amount of parking space (1 space per 200 square feet of floor area). If the request is approved, the veterinary hospital will operate Monday through Friday from 8:00 a.m. to 6:00 p.m. The applicant is not proposing to operate on weekends, however, any changes to the hours of operation will require approval from the City Planner. Although the site is adjacent to residentially developed parcels, no impacts are anticipated related to noise levels since the building is separated by parking spaces and a drive aisle at the rear (east) of the building. In order to prevent potential noise impact to the abutting commercial tenant to the north, the Applicant is proposing to install sound Batt insulation along the shared interior wall. Staff has included a condition to certify that the insulation is installed prior to the operation of the PC AGENDA PAGE 2 veterinary hospital. Additionally, animals will not be kept overnight and any potential odor is controlled by daily cleaning of the space. Lastly, upon review of the application materials, staff supports the request for a Conditional Use Permit to allow the establishment and operation of a veterinary hospital within the existing multi - tenant commercial building. DEVELOPMENT REVIEW COMMITTEE The project was reviewed by the Development Review Committee (DRC) and standard comments were provided. Staff included conditions in order to address the department’s comments. Other departments had no other concerns and standard conditions were provided. ENVIRONMENTAL ANALYSIS Staff has reviewed the proposed use for compliance with the California Environmental Quality Act (CEQA). Upon completion of this review, it has been determined that this request is categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing Facilities). Categorical Exemptions are projects, which have been determined not to have a significant effect on the environment and have been exemp ted from the requirements of CEQA. Class 1 consists of projects that involve interior alterations to an existing structure. The proposed veterinary hospital, only involves an interior improvement to an existing commercial building. FINDINGS Pursuant to the requirements of DMC Section 9824.06 (Conditional Use Permit), staff recommends that the Planning Commission make the following findings to approve the overall request: 1.That the requested Conditional Use Permit will not adversely affect the intent and purpose of Article IX or the City’s General Plan or the public convenience or general welfare of persons residing or working in the neighborhood thereof. The requested Conditional Use Permit for the establishment of a veterinary hospital will not adversely affect the purpose and intent of the Downey Municipal Code . The subject property is located within the C-2 zone, which is intended to provide for and encourage the orderly development of commercial uses, with a wide variety of goods and services for the residents of the entire City, with provisions designed to ensure that such commerce will be efficient, functionally related, and compatible with adjac ent noncommercial development. The requested Conditional Use Permit will allow the operation veterinary hospital use but will not adversely affect the purpose and intent of the Zoning Code or the City’s General Plan or the public convenience or general welfare of persons residing or working in the neighborhood in that this site has already been approved and improved for commercial development to serve the surrounding neighborhood. The new use will serve the community by providing animal medical services for all pet and animals owners in the area. PC AGENDA PAGE 3 2.That the requested use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. The requested Conditional Use Permit will not adversely affect the adjoining land uses since the proposed use conforms to its C-2 zone development standards. The proposed veterinary hospital will consist of an interior renovation of the existing commercial tenant space. The applicant is not proposing to expand the existing building, maintaining the tenant and building footprint. The interior improvements include so undproofing walls and appropriate placement of any animal cages away from walls abutting the adjacent tenant space. The new use will complement the surrounding commercial uses and overall will serve the public with a use that the Zoning Code deems appropriate for uses within the C-2 zone. In addition, conditions have been included to ensure that the new use will not affect adjoining land uses of the area. 3.That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area. The subject site is approximately 85,390 square feet in size. The existing tenant space is 2,296 square feet in size and is situated at the south end of the multi-tenant commercial building. A total of 127 parking spaces are provide for onsite parking. Based on the parking calculations, the commercial site is currently meeting the minimum required parking spaces when analyzing all existing uses of the subject site. The request to operate a veterinary hospital will not require additional parking spaces considering that the new use is the same parking ratio is equivalent to the previous medical use . Therefore, it will not be an adverse impact to the area. 4.That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways in the area. The traffic generated by the proposed use is not expected to significantly increase with the approval of the CUP, as the previous use was also a medical office use utilizing the same square footage. In addition, Lakewood Boulevard is classified as a major arterial that can support high volume of vehicles. The new veterinary hospital is not expected to generate significantly more traffic or impose an undue burden upon the streets and highways in the area because the proposed use is similar in parking ratio and primarily operates by appointment basis. CORRESPONDENCE As of the date that this report was printed, staff has not received any correspondence regarding this matter. CONCLUSION Based on the analysis contained in this report, staff recommends that the Planning Commissio n adopt the resolution approving the Conditional Use Permit (PLN-23-00020), subject to the conditions of approval as stated in the Planning Commission Resolution. City shall promptly notify Applicant of any such claim, action or proceeding to which City receives notice, and City will cooperate fully with Applicant in the defense thereof. Applicant shall reimburse the City for any court costs and attorney's fees that the City may be required to pay as a result of any such claim, action or proceeding. City may, in its sole discretion, participate in the defense of any such claim, action or proceeding, but such participation shall not relieve Applicant of the obligations of this condition. 7) The permitted hours of operation of the business are as follows: a. Monday – Friday, 8:00 a.m. to 6:00 p.m. The City Planner is authorized to make modifications to the approved hours of operation. 8) The business shall comply with the City of Downey’s noise ordinance, but in any case, no greater than 65 dBA as measured at the property line. Upon receiving complaints regarding noise levels, the Director of Community Development may order the preparation of a noise study. The City will hire a consultant to prepare a noise study, and said noise study shall be paid by the business owner. All mitigation measures identified in the noise study shall be implemented and become part of this Conditional Use Permit and shall have the force of conditions of approval. PC AGENDA PAGE 11 9) The facility shall be improved with sound abatement measures to ensure compliance with the noise ordinance. Proper insulation shall also be installed along any shared walls abutting commercial tenant spaces. 10) Daily cleaning operations shall be implemented in order to prevent pet odors. 11) All animal waste shall be appropriately bagged and disposed of in odor preventing receptacles. 12) Deceased animals shall be picked up on a weekly basis, 2-3 times per week by a certified animal body disposal company. 13) All signs shall comply with the requirements set forth in the Downey Municipal Code and shall require separate permits. 14) Signs must be posted within the tenant space notifying patrons to remain courteous and pick up any animal waste. 15) A copy of this Resolution shall be maintained on the premises at all times. A copy of the Conditions of Approval and any Police Permit shall be prominently posted on the premises at all times. The applicant shall make available said copies upon r equest by any Police Officer or other City official charged with the enforcement of the City’s laws, ordinances, or regulations. 16) Overnight stays of animals shall not be permitted. Prior to the commencement of any construction, the applicant shall obtain all required City permits. POLICE 18) The business owner shall consent to and provide access to all areas of the subject premises without charge during normal business hours to any Police Department or City Official for purposes of verifying compliance with any of the Conditions of Approval of this approval, as well as with any Police Permit. 19) The owner/applicant shall not permit any loitering on the property. 20) A copy of this conditional use permit and any Police permit shall be prominently posted on the premises at all times. The applicant shall make available said copies upon request by any Police Officer or other City official charged with the enforcement of the City’s laws, ordinances, or regulations. The project is subject to a Conditional Use Permit because antennas are proposed at a location on the building rooftop which would defeat the concealment elements of the originally approved facility. The application was deemed complete for processing on February 27, 2023 and the action deadline is April 28, 2023. The Planning Commission had originally approved the wireless facility in 2000, through conditional use permit (PLN-00-5718) for Sprint. Then in 2002, a co-location wireless communication facility was approved for AT&T under Design Review Board (DRB) 02-26. Both approvals allowed the installation of the wireless facilities and their associated antennas on the roof of the existing building screened from view; including antennas enclosed in a functional clock tower for Sprint. Since the design review board approval in 2002, there has been no modification to the site’s wireless communication facilities. The following image shows the existing conditions of the site, including the functional clock tower with existing antennas. Existing Site Conditions On April 6, 2023, a public notice was published in the Downey Patriot announcing that a public hearing on the modification of the existing wireless facility is scheduled to occur on Wednesday April 19, 2023, and the notice was also mailed to all property owners within 500-feet of the subject site. SITE DESCRIPTION Located at the northwest corner of Old River School Road and Stewart & Gray Road, the site is improved with an existing 14,682 square foot, single-story, 18’-5” tall, multi-tenant commercial building. The building consists of a flat roof with a parapet. The site is zoned C-1 (Neighborhood Commercial) with a General Plan Land Use Designation of NC (Neighborhood Commercial). 7375 Stewart & Gray Road – PLN-22-00092 April 19, 2023 - Page 3 DISCUSSION A Conditional Use Permit is required because the proposed antenna location does not comply with concealment elements from the originally approved Conditional Use Permit (per Section 9426, Wireless Communication Facilities of the Downey Municipal Code). The existing wireless facility is comprised of one roof mounted enclosure on the northwest corner of the building and is described as Sector “A”, Sector “B” and Sector “C” on the submitted set of plans (Exhibit C). The existing facility operates with six antennas and twenty-one remote radio units (RRUS) that service all sectors. The applicant is proposing to relocate Sector “A” and Sector “B” to a new enclosure of ± 630 square feet, proposed on the southeast corner of the building and will hold a total of eight antennas and six RRUS. The existing and expanded enclosure of ± 288 square feet will consist of four antennas and six RRUS along with an upgraded battery cabinet and power plant serving both enclosures. In summary, the overall number of antennas would be a total of twelve, and twelve RRUS distributed between two enclosures. Below is a detailed list of the project: • Expand an existing rooftop enclosure from ± 214 sq. ft lease area to ± 288 sq. ft lease area; • Remove twenty-one (21) remote radio units (RRUS) and replace with six (6) upgraded RRUS; • Relocating four (4) existing antennas to a new enclosure, two (2) existing antennas and two (2) new antennas within existing expanded enclosure; • Construct one new rooftop enclosure of 630 sq. ft of lease area; • Six (6) new remote radio units (RRUS) and four (4) new antennas; • Remove one (1) equipment cabinet and one (1) power plant, and replace with upgraded battery cabinet and power plant. Aerial view of the site Based on the Development Regulations in Section 9426.04, the new wireless communication facility complies with the height restrictions, concealment methods, and will be visually compatible with the existing building and its surroundings. Network Coverage Pursuant to the Downey Municipal Code, a Wireless Communication Facility is “an antenna structure and any appurtenant facilities or equipment located within City limits that provide commercial wireless service”. Wireless Communication Facilities owned by individual wireless carriers, e.g. Verizon Wireless, AT&T, Sprint, etc., are necessary to provide cellular service to its customers. As cellular technology advances the demand for bandwidth increases, existing wireless facilities experience dips in service and speed due to a high user amount and demand. New AT&T Enclosure 7375 Stewart & Gray Road – PLN-22-00092 April 19, 2023 - Page 5 Therefore, when there is a lack of bandwidth capacity in an area these carriers will, among various options, potentially choose to modify existing facilities. Due to the advancement in cellular technology, the need for more communications facilities has increased. Specifically, in this instance, AT&T has identified a need for additional coverage and a lack of capacity in this area, as can be seen by the propagation map below. As can be seen, the service provided by the center cell site is less potent than others located throughout the city prompting a gap in coverage. The construction of the proposed wireless communications facility is necessary to bridge the need for additional coverage. Below is the new coverage area with the proposed modification. The concealment consists of two enclosures surrounding the antennas and RRUS and all other associated materials. The existing and new enclosure have the same overall height of 5’-7” tall above the parapet of the 18’-5” tall existing building. The four foot (4’) tall antennas fit completely within the enclosures and are installed at a height lower than the top of the enclosures. The existing facility to be expanded will have its screening panels replaced and painted to match the existing building. The newly constructed enclosure will match or mimic the texture of the façade. The east side will mimic the existing split face block wall directly underneath it and the south side will match the existing stucco. The replicated texture will be painted to match the building and achieve the intent of concealment. DEVELOPMENT REVIEW COMMITTEE The City’s Development Review Committee reviewed the requested application. No division or department articulated any concerns regarding the project. Standard comments were provided, and can be reviewed in the attached resolution. ENVIRONMENTAL ANALYSIS Staff has reviewed the proposed wireless communication facility for compliance with the California Environmental Quality Act (CEQA). Upon completion of this review, it has been determined that this request is categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1 – Existing Facilities) and Section No. 15303 (Class 3 – New Construction or Conversion of Small Structures. Categorical Exemptions are projects, which have been determined not to have a significant effect on the environment and have been exempted from the requirements of the California Environmental Quality Act. Class 1, exemptions consist of minor alteration of an existing telecommunication facility involving negligible or no expansion of use, whereas Class 3 exemptions consist of installation of small new equipment and facilities in small structures. Staff believes that the proposed wireless facilities meets all of the requirements needed to qualify for a Class 1 & Class 3 exemptions. FINDINGS Pursuant to Municipal Code Section 9824.06, there are four (4) findings that must be adopted prior to the Planning Commission approving the Conditional Use Permit. A discussion of the findings follows: 1. The requested Conditional Use Permit will not adversely affect the purpose and intent of the Zoning Code or the City’s General Plan or the public convenience or general welfare of persons residing or working in the neighborhood thereof. A purpose of the Zoning Code is to regulate the use of land in order to promote the public’s health, safety, and the general welfare. The Conditional Use Permit allows wireless communication facilities subject to specific standards listed in Subsection 9426.04(b) of the Downey Municipal Code. As the project conforms to the development standards applicable to wireless communication facilities, it is determined that the Conditional Use Permit will therefore not adversely affect the purpose and intent of the Zoning Code. 7375 Stewart & Gray Road – PLN-22-00092 April 19, 2023 - Page 7 General Plan Policy 2.7.1 states: “Provide adequate utility and communications infrastructure”. Furthermore, General Plan Program 2.7.1.2 states: “Promote the expansion of communication networks to meet the needs of city residents, business and other land uses”. This project will expand and improve the communication network and fulfill the aforementioned program. Therefore, the Conditional Use Permit will not adversely affect the City’s General Plan. The Zoning Code and the General Plan function to promote the public convenience and general welfare of persons residing or working throughout the City. As the Conditional Use Permit is consistent with the Zoning Code and the General Plan, it is therefore determined that it will not adversely affect the public convenience or the general welfare of persons residing or working in the surrounding neighborhood. 2. The requested use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. The uses and structures on the site as well as those on nearby sites will remain the same, and uninterrupted by the proposed wireless facility. Staff does not anticipate adverse impacts as a result of the proposal specifically because the wireless site will be roof mounted within existing and new enclosures and is consistent with the required development regulations in Section 9426. In addition, building mounted wireless facilities are common within commercial corridors and the proposal is designed to be compatible with other structures on site. The wireless facility will not negatively affect the current or future use of the building. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area. The site is approximately 41,194 square feet and improved with an existing 14,682 square foot building. Installation of the antennas and various related equipment will occur on the roof of the existing building within existing and new enclosures. The modified wireless facility will not interfere with the potential future expansion of the existing commercial building as long as the building complies with the applicable development standards. Therefore, the size and shape of the site is adequate to allow the proposed use without being detrimental to the area. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways in the area. The proposed wireless communication facility will generate limited visits to the site for maintenance purposes only. The facility operates automatically without the presence of a working crew. The limited visits will not impose an undue burden upon the streets and highways in the area as the capacity of the surrounding streets and highways can accommodate the trips generated by the maintenance of the facility. Prior to the issuance of building permits, the applicant shall demonstrate to the satisfaction of the City Planner, that the finished materials will comply with this requirement. 9) Any graffiti applied to the site shall be removed within 48 hours. 10) All utilities servicing the facility shall be installed underground. 11) The project must satisfy all necessary standards, requirements, licenses and registrations from the Federal Communications Commission (FCC) and any other applicable regulatory bodies prior to initiating the operation of the Wireless Telecommunication Facility. 12) The applicant shall file, receive, and maintain all necessary licenses and registrations from the Federal Communications Commission (FCC) and any other applicable regulatory bodies prior to initiating the operation of the wireless telecommunication facility. The applicant shall supply the Community Development Director with the documentation of these licenses and registrations. 13) Within 30 days following the activation of the Wireless Telecommunications Facility, the applicant shall provide a radio frequency emissions compliance report to the Community Development Director certifying that the unit has been inspected and tested in compliance with FCC standards. 14) Every 5 years following the date of the building permit final, the applicant shall, at their own expense, prepare and submit to the Community Development Director an independently prepared updated radio frequency emissions compliance report and certification in compliance with all applicable FCC standards. 15) If any radio frequency emissions compliance report and certification, required by the Downey Municipal Code or these Conditions of Approval, demonstrates that the cumulative levels of radio frequency emissions exceed or may exceed FCC standards, the Community Development Director may require the applicant to modify the location or design of the facility and/or implement other mitigation measures to ensure compliance with FCC standards. The Director may require additional independent technical evaluation of the facility, at the applicant’s expense, to ensure compliance with FCC standards. 16) In the case of discontinuation, within 30 days after discontinuation of use, the facility’s operator shall notify the Community Development Director in writing that use of the facility has been discontinued. W ithin 180 days after discontinuation of use, the facility must be completely removed. Additionally, the applicant shall obtain all necessary inspections and permit final prior to occupancy of the units. FIRE 19) The following comments pertain to a limited fire review of a design review plan submittal. The comments contained herein shall not be construed as complete or encompassing all fire-life safety code requirements set forth in local, State, and/or National local codes. 20) The establishment shall comply with all current code requirements for the occupancy use and type. 21) Both ground level and roof top equipment enclosures shall be properly identified with operator information, emergency phone numbers, location address, etc. Required hazardous identification and warning signage shall be provided. Should the 16 VRLA batteries contain corrosive electrolyte equal to or in excess of 55-gallons, the business shall be required to establish, implement, and submit a Hazardous Materials Business Plan (HMBP) to Statewide Environmental Reporting System (CERS) [HSC 25507; 25508]. 22) Roof access shall be maintained. Any antenna, or other obstruction on the roof of any commercial establishment, shall not obstruct or render egress or access hazardous in the event of fire other emergency [CA Fire Code §504.4]. New antenna locations with FRP screens shall not obstruct fire department roof access.
