DOWNEY MUNICIPAL CODE REGULATING ACCESSORY DWELLING
UNITS DEVELOPMENTS

REPORT SUMMARY
Over the past four years, the California Legislature approved and the Governor signed into law
a number of bills regulating Accessory Dwelling Units which are now codified primarily in
Government Code Sections 65852.2 and 65852.22. The proposed zoning code amendment will
repeal and replace Section 9414 (Accessory Dwelling Unit Developments) of the City's Zoning
Code to comply with aforementioned Government Code Sections. Staff is working with the City
Attorney's office to fine tune the draft ordinance and expects to complete this effort in time for
the April 19th, 2023 meeting.
RECOMMENDATION
Continue item PLN-22-00155 to regular planning commission meeting of April 19, 2023.
