PLN-21-00139 (General Plan Amendment) Approval Location: Citywide Request: A request to recommend approval of an Initial Study and Negative Declaration and adoption of the 2021-2029 City of Downey Housing Element to the City Council PLANNING COMMISSION AGENDA JANUARY 19, 2022 CEQA: Pursuant to the California Environmental Quality Act (CEQA) and State CEQA Guidelines, the City, as Lead Agency, prepared an Initial Study/Negative Declaration (IS/ND) to identify and assess the significance of the physical effects on the environment due to potential future development guided by the goals and policies of the 2021-2029 Housing Element Update. Findings of the IS support the adoption of an ND and through determinations indicate that the environmental impacts of the programs for accommodating housing pursuant to the Housing Element Update, in accordance with the governing land use planning policies and zoning standards, will be less than significant and that an Environmental Impact Report (EIR) is not required Staff: City Planner Crystal Landavazo Contact: HEupdate@downeyca.org 562-904-7154 3. PLN-22-0004 (Municipal Code Amendment) Approval Location: Citywide Request: A request to recommend approval of an amendment of various sections of Article IX of the Downey Municipal Code to establish procedural and objective development standards related to urban lot splits and two-unit developments, in compliance with Senate Bill 9, to the City Council CEQA: Categorical Exemption – Under California Government Code sections 65852.21, subd. (j), and 66411.7, subd. (n), the adoption of an ordinance by a city or county implementing the provisions of Government Code sections 66411.7 and 65852.21, which is California’s SB 9 Law and which regulates urban lot splits and two-unit projects, is statutorily exempt from the requirements of the California Environmental Quality Act (“CEQA”) Staff: City Planner Crystal Landavazo Contact: clandavazo@downeyca.org 562-904-7154 VII. NON-AGENDA PUBLIC COMMENTS: This portion of the agenda provides an opportunity for the public to address the Planning Commission on items within the jurisdiction of the Planning Commission and not listed on the agenda. Pursuant to the Brown Act, no discussion or action, other than a brief response, referral to the City Planning staff or schedule for a subsequent agenda, shall be taken by the Planning Commission on any issue brought forth under this section.
