Chair Duarte called the October 6, 2021, Regular Meeting of the Planning Commission to order at 6:32 p.m., at Downey City Hall, 11111 Brookshire Avenue, Downey, CA. After the flag salute, Secretary Cavanagh called roll. COMMISSIONERS PRESENT: Miguel Duarte, District 1, Chair Arturo Montoya, District 3 Horacio Ortiz, Jr., District 5 COMMISSIONERS ABSENT: Patrick Owens, District 2, Vice Chair Carmela Uva, District 4 OTHERS PRESENT: Yvette Abich Garcia, City Attorney Crystal Landavazo, City Planner Alfonso Hernandez, Senior Planner Gissel Enriquez, Assistant Planner PLANNING COMMISSIONER ANNOUNCEMENTS; REQUEST FOR FUTURE AGENDA ITEMS; AND CONFERENCE/MEETING REPORTS: None PRESENTATIONS: The Planning Commission presented Steven Dominguez with a Certificate of Appreciation for the time and efforts he put into the Commission, and his care and consideration in representing his District and community. REPORT ON CITY COUNCIL ACTION: None PUBLIC HEARINGS: 1. PLN-21-00121 (Conditional Use Permit): Chair Duarte opened the public hearing for PLN-21-00121 and Senior Planner Alfonso Hernandez affirmed proof of publication. Assistant Planner Gissel Enriquez presented a request by the Desert Reign Church, to hold the 11th Annual Harvest Festival on Sunday, October 31, 2021 from 5:30 p.m. to 8:30 p.m. As in previous years, the festival will take place in the northwest corner of the church parking lot, located at 11610 Lakewood Boulevard and zoned C-P (Professional Office). Set-up will begin no earlier than 8:00 a.m. the day of the event, and all activities, including clean-up, will conclude by 11:00 p.m. Festival activities consist of game booths, jumpers, and live entertainment, with an estimated 500 attendees throughout the length of the event. Event staff and volunteers will help pedestrians cross nearby intersections and streets, and direct vehicles to appropriate parking areas. Staff reviewed last year’s festival, and found there were no complaints, issues or concern. This application was presented to the Development Review Committee on September 16, 2021 and issued standard conditions of approval. Applicant: Joyce Yasumura, Office Administrator for Desert Reign Church, stated that the Harvest Festival is a free community event to provide a safe environment for neighborhood kids to have fun and get candy. The Commissioners thanked Ms. Yasumura for providing a safe environment for the community to enjoy Halloween, and Commissioner Ortiz stated he looks forward to attending the event. Correspondence: None. Planning Commission October 6, 2021 Draft Minutes - 2 - Public Comment: None. Staff recommended approval of the request for a Special Event Permit (PLN-21-00121). Chair Duarte closed the public hearing. It was moved by Commissioner Montoya, seconded by Commissioner Ortiz, and passed by a 3-0-2 vote, with Vice Chair Owens and Commissioner Uva absent; to adopt Resolution 21-3153, thereby approving the request for a Special Event Permit (PLN-21-00121). NON-AGENDA PUBLIC COMMENTS: None CONSENT CALENDAR ITEMS: 3. Minutes from September 15, 2021 Due to a lack of quorum, the September 15, 2021 Minutes were continued to the October 20, 2021 Meeting. OTHER BUSINESS: Commissioners Montoya stated he read the new SB 9 legislation pertaining to residential developments and inquired as to the impact it may have on housing within Downey. Deputy City Manager Aldo Schindler briefed the Commission on the potential impact the SB 9 legislation will have on the R-1 Single Family Residential neighborhoods. City Planner Landavazo is reviewing the new legislation that goes into effect on January 1, 2022. Staff will provide an update in November or December of this year. Chair Duarte received comments from residents regarding the state of the 7/Eleven construction site on Downey Avenue and the former Denny’s on Firestone Boulevard. Deputy City Manager Schindler will send Code Enforcement to the sites.
