JULY 27, 2021 1
The City Council of the City of Downey held a Regular City Council Meeting on July 27, 2021, at
6:31 p.m., in the Council Chambers of the Downey City Hall, 11111 Brookshire Avenue, Downey,
California, Mayor Frometa presiding.

The Invocation was delivered by Pastor Charlie Rivera, New Season LA/Downey. The Pledge of
Allegiance was led by Mayor Pro Tem Pacheco.
CONFERENCE/MEETINGCITY COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS;
REPORTS
Council Member Trujillo welcomed members of the public to the meeting. He thanked the City
for providing Camp Downey a summer youth program. He reported attending a meeting with City
Manager Livas and Chief Milligan to discuss Public Safety in Downey. He provided an update regarding
the reduction in the FBI Index Crimes with the exception to forcible rape. He was informed most of the
forcible rape cases reported the assailant is known to the victim. He commented regarding Public
Safety continuing to be his priority. He wished Chief Milligan a speedy recovery. He announced his
decision to retire from the District Attorney's Office after 24 years of service as a Deputy District
Attorney. He acknowledged his husband in the audience. He thanked Mayor Frometa for agreeing to
postpone a discussion regarding District Attorney Gascon. He requested staff report how District
Attorney Gascon's directives have impacted the City of Downey. He commented regarding Senator
Gonzalez's Broadband initiative to provide resources to build Broadband infrastructure. He also
requested staff research and identify funding to provide Broadband internet access to southeast
Downey. He thanked staff for identifying resources to bring $30 million dollars in Bond Funds to repave
residential streets. He also thanked staff for the progress to improve the conditions of the playing fields
at Rio San Gabriel Park. He reported meeting with Downey's Homeless Coordination team regarding
Downey's plan to prevent and combat homelessness and discussed how the City can meet its
objectives to reduce the homeless population and provide services. He reported meeting with the
Downey Veterans Council to discuss instilling an alliance between the Downey homeless coordination
team and the Downey Veterans Council to identify homeless Veterans and provide them services. He

Mayor Frometa recessed the City Council meeting at 7:57 p.m. Mayor Frometa reconvened the
City Council meeting at 8.06 p.m. with all Council Members present.

19. DISCUSSED REALLOCATION OF HAVANA NIGHTS FUNDING FOR ARTS & CULTURE:
Council Member Alvarez.
Council Member Alvarez requested this item to discuss reallocating the Havana Nights surplus
of funds from FY 2019/20. She stated the surplus of funds was a result of the cancellation of the
Havana Nights event due to the pandemic. She added that the Theatre Subcommittee has not
rescheduled Havana Nights and she recommends the surplus funds be reallocated to host a Hispanic
Heritage event in September. She clarified that it was never her intention to cancel Havana Nights and
this has brought forth many misconceptions. She requested staff draft a Resolution in support of
Cubans. She proposed an event for the upcoming Fiscal Year (FY) that will unite the community and
provide inclusivity.
Council Member Trujillo asked for a point of clarification. He stated it was his understanding
that the Parks & Recreation Department is responsible for scheduling the Havana Nights event.
Mayor Frometa stated Havana Nights was included and approved in the current FY's Budget
under the Parks and Recreation Department. She added the event is scheduled for this FY year. With
regards to the International Food Festival those events were cancelled in the best interest of the
public's health and COVID restrictions on public gatherings. She added the International Food Festival
event unites all cultures and celebrates all nationalities. She mentioned Havana Nights has out grown
the roof top and proposed expanding the event beyond the roof top in order to accommodate the
attendees.
Council Member Ashton requested staff confirm when Havana Nights is scheduled for. City
Manager Livas stated for clarification the City's budget for FY 2020-21 included many events that the
City cancelled due to COVID. He stated the Budget for FY 2021-22 includes Havana Nights and the
event is typically scheduled for October.

Interim Director of Parks and Recreation Chacon confirmed Havana Nights is scheduled
October 7, 2021.
Council Member Trujillo inquired what date el Dia de los Muertos Art Festival is scheduled.
Interim Director of Parks and Recreation Chacon confirmed el Dia de los Muertos is scheduled for
Saturday, October 30, 2021.
Council Member Trujillo stated he is relieved that Council Member Alvarez confirmed her intent
was never to cancel Havana Nights. He stated the event has been well attended and successful and,
Havana Nights offers a great opportunity to celebrate the Cuban culture. He stated the Cuban
community has a strong presence in Downey even though it is only 2% of the City's population.
Mayor Frometa asked City Clerk Duarte if there was any written correspondence received
regarding Item No. 19. Mayor Frometa asked if there was anyone present who would like to comment
regarding Item No. 19.
Brian Sanguily, resident, submitted written comments in opposition of cancelling Havana
Nights. He also commented in opposition to the Pride Picnic, Pride Month and flying the Pride Flag at
all City facilities.

opposition of communism.
Armando Herman, non-resident, commented in opposition of cancelling Havana Nights. He
commented regarding the First Amendment to the U.S. Constitution.

regarding the living conditions in Cuba. She thanked the Mayor Frometa, Mayor Pro Tern Pacheco,

the Cuban community.
Lee Squire, resident, commented regarding the importance of celebrating the Cuban heritage
and in opposition of communism in Cuba.
Lourdes Cotaya, resident, thanked the Police and Fire Departments for their hard work. She
commented in opposition of cancelling Havana Nights, and commented regarding the importance of
continuing cultural traditions and celebrating the Cuban heritage through community events.

Michael Cueto, resident, thanked Mayor Frometa for her support to expand Havana Nights
beyond the rooftop. He commented in opposition of cancelling Havana Nights. He commented
regarding freedom of speech and in support for the Cuban people.

Jean Tallero, resident, thanked Council Member Trujillo for his support of inclusivity. He
appreciated Council Member Alvarez for clarifying her position regarding Havana Nights and the
reallocation of funds. He commented regarding the Cuban community's strength, unity and their ability
to rally together to support Cubans.
Joey Martinez, resident, commented regarding the $85,000 expense to host Havana Nights,
He requested the City Council support funding all community events.

Mayor Frometa requested City Manager Livas clarify the expenses associated with hosting
Havana Nights.
City Manager Livas stated the $85,000 mentioned by the speaker is inclusive of three separate
events. He stated the annual budget allocated to Havana Nights is $31,000.
Mayor Frometa stated the City Council is supportive of an inclusive community and will
continue to promote diversity and inclusion through events as the International Food Festival and el Dia
de los Muertos. She stated how unfortunate it was to have to cancel the events last year due to the
pandemic.
Mayor Pro Tem Pacheco recognized the Cuban and non -Cuban residents in the audience. She
thanked the residents for attending the meeting, and for expressing their concerns and support for
Havana Nights and the Cuban community. She commented regarding the importance of the City
Council to hear their constituent's point of view.
It was moved by Council Member Ashton, seconded by Mayor Frometa and carried 5-0, to
receive and file the report.

Don Perez, resident, thanked Mayor Frometa for hosting the online Mayor's Townhall Meeting.
He commended Director Consunji for his prompt and respectful response to questions submitted during
Mayor Frometa's Townhall Meeting. He commented in support of repaving Parrot Ave. south of Imperial
Hwy. in Area 10.
Rodolfo Cortes Barragan, non-resident, commented regarding ADA compliant sidewalks and
curb access ramps, sustainable local communities, adding bike lanes to improve the quality of life and
eco -friendly street lights.
Joey Martinez, resident, commented regarding ADA compliant sidewalks and curb access
ramps; and, proper gutter drainage.

Council Member Ashton asked if the residential street pavement project will include addressing
the City's list of ADA projects. Director Consunji responded the City Council is updated on a yearly
basis of the status of ADA improvement projects. Mr. Consunji stated staff includes ADA compliance in
all City projects and over the past five to six years the City has spent close to $500,000 yearly on ADA
improvements. This Fiscal Year the City has included approximately $2 million dollars from the Capital
Improvement Projects Budget on ADA improvements. Mr. Consunji stated the City will expend
approximately 10 to 15% of the $45 million dollars for ADA improvements.
It was moved by Mayor Frometa, seconded by Mayor Pro Tem Pacheco and carried 5-0, to
adopt Ordinance No. 21-1465, an Ordinance of the City Council of the City of Downey approving the
Issuance and Sale of Bonds by the Downey Public Financing Authority to finance Measure M and
Measure R Transportation projects.
It was moved by Mayor Frometa, seconded by Mayor Pro Tem Pacheco and carried 5-0, to
authorize the City Manager, the Assistant City Manager, and/or the Finance Director to execute the
following documents, and any other related documents, necessary, provided the aggregate principal
amount does not exceed $33 million: Pledge Agreement (Measure M) between the City and the

City Manager Livas presented the staff report for Item No. 14. He provided staff's
recommendation for the City Council to designate a Voting Delegate and Alternate for the League of
California Cities Annual Conference.

Council Member Ashton nominated Mayor Pro Tem Pacheco as the Voting Delegate being she
is the City's Representative for the League of California Cities.
Mayor Frometa asked City Clerk Duarte if there was any written correspondence received
regarding Item No. 14. City Clerk Duarte confirmed no written correspondence was received for this
item. Mayor Frometa asked if there was anyone present who would like to comment regarding Item No.
14.

Human Resources Director James McQueen presented the staff report for Item No. 15. Director
McQueen provided a brief overview of the resolution adopting the classification specification and
establishing compensation for the new position of Deputy City Manager/Community Development. The
action is to supplement Council's action adopting the FY 2021-22 Budget that includes sufficient funds
to reclassify the existing temporary position of Director of Community Development to Deputy City
Manager/Community Development. In accordance with Senate Bill (SB) 1436 local agencies are
required '.• -•• changes in regards to compensation and benefits that •' to executive posons.
Under this law local agencies are required to provide a summary of the recommendations before voting
in the open session portion of the meeting. The reclassification for a permanent position of Deputy City
Manager/Community Development is based on current operational needs related to the City's response
to the COVID-19 pandemic, the Director of Community Development has been receiving Out -of -Rank
pay premium for the additional duties related to the City's response. As part of the City's succession
planning efforts the reclassification of this position will allow the incumbent to become involved in
Citywide administrative functions supporting the City Manager. The new proposed position will be
•- • all Community Development operations as wen as providing highly responsible and
complex administrative support to the City Manager. The proposed pay rate for this position is

$14,840.29 to $18,105.25 per month which is approximately 3% above the existing position of Director
of Community Development salary. The total increase cost to implement the position is approximately
$9,192.69 for FY 2021-22.
Mayor Frometa requested staff confirm the pay increase for the position of Deputy City
Manager/Community Development is based on the recently adopted budget. Director McQueen
confirmed the proposed pay increase and the proposed reclassification are included in Council
approved FY 2021-22 Budget.
Mayor Frometa requested staff elaborate regarding the importance of succession planning and
its impact on the City. City Manager Livas stated one goal of successful management is to have a
Succession Plan. The ultimate goal is to prepare the organization in the event there is a need to fill a
management position. A successful Succession Plan provides internal staff growth opportunities and
preparation to become involved in higher level Citywide administrative duties. He stated succession
planning is essential for the Fire and Police Departments and the City has implemented succession
planning throughout the organization.
Mayor Pro Tem Pacheco inquired as to when the 3% pay increase became effective. Director
McQueen stated Director Schindler has been receiving temporary Out -of -Rank premium pay of 3% for
additional duties related to the City's response to the pandemic since April, 2020.
City Manager Livas provided another example of staff receiving temporary Out -of -Rank
premium pay for additional duties. The Recreation Manager is currently serving as the Interim Director
of Parks and Recreation until the position can be filled. He stated the cost to temporarily fill the position
with internal staff is approximately $9,000 versus the $117,000 it would cost to fill the Director's position
and provides a savings of roughly $100,000. He added part of Director Schindler's additional duties is
to oversee the Department of Parks and Recreation.
Council Member Alvarez requested clarification as to why staff is proposing to make the Deputy
City Manager/Community Development position permanent. She understood the position was
temporary and created as a response to the pandemic. City Manager Livas confirmed tonight staff
recommends reclassifying the temporary position to permanent and afford the organization the ability
for succession planning and stability. He provided a brief history of the Deputy City
Manager/Community Development position by stating the position has been vacant for 13 years and at
one time the City had three Deputy City Managers.
Council Member Ashton asked regarding the difference between the Assistant City Manager
and Deputy City Manager/Community Development positions. City Manager Livas stated Assistant City
Manager Oskoui, due to his facilities background, is charged with the Measure S Projects and labor
negotiations between the City and bargaining units. The Deputy City Manager occupies the position
between the City Manager and Assistant City Manager to be charged with land use transactions,
homeless taskforce, affordable housing and attending the various City Council Committees and
Subcommittees, and the Council of Governments Steering Committee's policy issues. In addition he will
continue to oversee the Parks and Recreation Department to assist Interim Director Chacon. City
Manager Livas stated with a permanent Deputy City Manager/Community Development position it will
allow the City Manager to concentrate on regional issues and committees.
Mayor Frometa asked City Clerk Duarte if there was any written correspondence received
regarding Item No. 15. City Clerk Duarte confirmed no written correspondence was received for item.

City Manager Livas confirmed the City of Downey has not had any such issues. He stated
Ethics is his top priority and good governance is essential to the organization. He added all employees
2re required to adhere to the International City/County Management Association's Code of Ethics. He

c-candals that have permeated the Southeast Corridor which he attributesto the City Council's—

City Attorney Abich Garcia presented the staff report for Item No. 16. She provided a brief
summary of the City Council's direction to staff to include language into the Moratorium Ordinance
requiring commercial tenants pay a minimum of 25% of rent due during the Moratorium period; tenants
to make payments to the landlord of unpaid rent during the repayment period; prohibit retaliation of
commercial tenants who exercise their rights under the Urgency Ordinance; and extend the eviction
Moratorium to September 30, 2021 to align with Governor Newsom's new Executive Order. She stated
in order to extend the Urgency Ordinance a 4/5 th vote of the City Council is required.
Mayor Frometa asked if municipalities are required to extend the Moratorium. City Attorney
Abich Garcia confirmed the extenslun is optional and municipalities are not required to extend the

ordinance. She stated Governor Newsom's Executive Order merely provides the authority to
municipalities to extend the ordinance through September 30, 2021.
Mayor Pro Tem Pacheco asked when the partial rent payments would be expected to begin.
City Attorney Abich Garcia confirmed the 25% partial payments of rent will be effective commencing
August 1, 2021; and, if the extension is approved through September 30, 2021 the repayment period
for past owed rents would become effective October 1, 2021.
Council Member Alvarez inquired if the ordinance would return to Council to extend the
Moratorium past September 30, 2021. City Attorney Abich Garcia stated the Urgency Ordinance would
only return before the City Council should Governor Newsom extend his Executive Order. She stated
extending the ordinance without an Executive Order would expose the City to litigation.
Council Member Ashton stated he has noticed many businesses have reopened and has not
seen many businesses remain closed due to COVID-19. He added the intention of a Moratorium was to
provide businesses the opportunity to remain open without financial hardship due to the reduction of
patrons during the pandemic. He thanked City Attorney Abich Garcia for providing clarifying language
requiring tenants make payments during the repayment period effective October 1, 2021 versus waiting
until the end of the repayment period to make one large balloon payment for the back owed rent to the
landlord and addressing that the end of the repayment period; including language regarding making
partial rent payments during the Moratorium period; and, the protection from retaliation. He added he is
not clear whether extending the Moratorium would still be required.
Mayor Frometa asked City Clerk Duarte if there was any written correspondence received
regarding Item No. 16. City Clerk Duarte confirmed no written correspondence was received. Mayor
Frometa asked if there was anyone present who would like to comment regarding Item No. 16.

businesses, rental assistance for commercial and residential tenants, and mortgage forgiveness for
property owners.
William Davidson, commented in opposition of Item No. 16. He requested the City Council
consider the negative financial impact the proposed ordinance would impose on property owners and
suggested a revision of the Urgency Ordinance to include a payment plan.

Council Member Alvarez asked how many businesses have benefited from the Federal COVID
Business Program and the length of time to process an application. Deputy City Manager/Community
Development Schindler stated the COVID-19 Small Business Assistance Program has benefited seven

related from COVID-19 as stated in Paragraph 3; and, City Attorney Abich Garcia will remove the
language making partial payment of rent language; (2) Section 2 (111) Notice and Partial Payment of
Rent to the Landlord language will be stricken completely; (3) Section 4 (A) For each month the tenant
has late or partially payment of rent impacted due to COVID-19 the tenant shall have a maximum of 16
months to repay the rent in arrears to the landlord during the repayment period and the landlord will not
charge or collect a late fee due to a COVID-19 financial impact; Subsection (B) will remain the same
except that anytime during the repayment period the tenant terminates the tenancy or the lease or
rental agreement terminates for cause or on its own terms the repayment period terminates and the
repayment of rent in arrears will be due and payable immediately to the landlord; Subsection (C) will
remain except the reference, and will make partial payments of rent as required under Paragraph B will
be struck; Section 5 the Temporary Moratorium will remain effective until September 30, 2021 will be
stricken.
It was moved by Council Member Ashton, seconded by Mayor Frometa, and carried 4-0-1, with
Council Member Trujillo abstaining to adopt Urgency Ordinance No. 21-1466, an Uncodified Urgency
Ordinance of the City Council of the City of Downey pursuant to California Government Code Section
8634 and Downey City Charter Sections 511 and 514 extending the temporary Moratorium on evictions
of commercial tenants for nonpayment of rent resulting from loss of income due to the COVID-19
pandemic and rent repayment period and making other substantive changes thereof; and setting forth
the facts constituting such urgency.
