PLN-20-00124 8017 Florence8017 Florence Avenue – PLN-20-00124 May 19, 2021 – Page 2 On December 8, 2020, the applicant submitted an application for a Planned Sign Program requesting to establish sign standards to regulate the size, location, and appearance for wall signs on an existing multi-tenant commercial building. Due to missing information, staff deemed the application incomplete on January 7, 2021. After multiple revisions, on April 27, 2021 staff deemed the application complete for further processing. The notice of pending public hearing was published in the Downey Patriot and mailed to all property owners within 500’ of the subject site on May 6, 2021. DISCUSSION As previously mentioned, Downey Municipal Code Section 9610.04 states that a Planned Sign Program shall be required for any site having three (3) or more nonresidential tenants and shall be approved by the Planning Commission before any sign permit is issued. The purpose of the Planned Sign Program is to establish sign standards to enhance the overall appearance of the commercial site through cohesive signage. Existing view of property from Florence Avenue (above) Examples of illuminated channel letter wall signs 8017 Florence Avenue – PLN-20-00124 May 19, 2021 – Page 3 The applicant is proposing one (1) illuminated channel letter wall sign for each tenant space and a secondary channel letter wall sign for the tenant space located at the west corner of the commercial building. The secondary wall sign shall not exceed half the allowable square footage of the primary wall sign oriented towards Florence Avenue. The primary wall signs will be centered above each tenant space and shall have a maximum height of 20 inches and a maximum sign area of 1.5 square feet per lineal foot of tenant space frontage. The wall sign widths will vary with each tenant space lineal frontage. The maximum sign copy area shall be 75 percent of the sign area. Any logos within the allowable sign area shall not exceed 25 percent of the sign copy area. The depth of the channel letter and logo signs shall not exceed 3 inches. Upon review of the application materials, staff supports the request for a Planned Sign Program to establish sign standards to regulate the size, location, and appearance of wall signs for a multi-tenant commercial building. DEVELOPMENT REVIEW COMMITTEE The project did not require a review from the Development Review Committee (DRC). However, all proposed wall signs submitted at a later date will require all applicable departmental reviews to ensure sign program and code compliance. ENVIRONMENTAL ANALYSIS The proposed project has been reviewed for compliance with the California Environmental Quality Act (CEQA). Upon completion of this review, it has been determined that this request is categorically exempt from CEQA, pursuant to Guideline Section No. 15311 (Class 11, Accessory Structures). Categorical Exemptions are projects, which have been determined not to have a significant effect on the environment and have been exempted from the requirements of CEQA. Class 11 consists of projects that involve replacement of minor structures accessory to (appurtenant to) existing commercial including on-premise signs. FINDINGS Pursuant to the requirements of DMC Section 9610.06 (Planned Sign Program), staff recommends that the Planning Commission make the following findings to approve the overall request: 1. The proposed sign is permitted within the zone and it complies with all applicable provisions of this chapter, the General Plan, and any other applicable standards. The subject commercial site is located within the C-2 (General Commercial) zone, which permits a variety of signage, specifically, awning signs, exempt signs, freestanding signs, hanging signs, marquee signs, monuments signs, projecting signs, temporary signs and wall signs. The proposed Planned Sign Program will regulate the appearance of signs and limits the number of wall signs for each tenant space. The total allowable wall sign area for each tenant space will be 1.5 square feet of sign area per lineal foot of tenant space frontage, with a maximum sign copy area of 75 percent of sign area. The width of each sign shall not exceed 75 percent of the tenant leasehold frontage. Logos shall not exceed 25 percent of sign copy area. All proposed wall sign square footage will comply with the maximum allowable sign area permitted by the Downey Municipal Code. Approval of this Planned Sign Program will comply with Policy 8.3.1. of the City’s 8017 Florence Avenue – PLN-20-00124 May 19, 2021 – Page 4 General Plan, which calls for the enhancement of the views of property from public streets to exhibit a positive image, in this case, enhanced signage. The proposed Planned Sign Program will also comply with all other applicable provisions included in Chapter 6 (Signs) of the Downey Municipal Code. 2. The sign is in proper proportion to the structure or site on which it is located. The Planned Sign Program will ensure that all proposed illuminated, channel letter wall signs will be properly spaced and be in proportion with the building’s façade, specifically the tenant space frontage. The sizes of the wall signs will vary based on the lineal foot frontage for each tenant space as mentioned above. The tenant space located at the west corner of the commercial building will have the option of installing a secondary wall sign not exceeding half the allowable area of the primary wall sign fronting Florence Avenue. In order to prevent signage from exceeding these wall areas, the maximum letter height of all wall signs and logos shall be a 20 inches. In addition, all proposed wall signs shall be positioned between an existing three foot tall wall area located immediately below the existing 6 inch fascia at the top of the building but above the existing roof awning. Based on these sign standards, staff believes that the new wall signs will complement the commercial building with consistency in size and relatively with the nature of business and/or service. 3. The sign materials, color, texture, shape, height, and placement are compatible with the design of the structure(s), property, and neighborhood of which is a part. As mentioned, the Planned Sign Program includes proposed illuminated channel letter wall signs that will be mounted onto the building’s façade. Staff believes the illuminated channel letter wall signs will be more compatible with the building’s current architectural style. The existing signage consists of dated box signs whereas the Planned Sign Program will require channel letters with font styles Oranda Bold or Futura Heavy Bold and a choice of two color options, red and/or green for the sign face. This will create a more uniform appearance to the building and site. The Planned Sign Program will allow flexibility for logo signs by allowing their nationally recognized trademark image and colors. The neighborhood is commercially developed, and both the height and placement of the proposed wall signs will not negatively impact surrounding businesses. 4. The sign’s illumination is at the lowest reasonable level as determined by the City Planner, which ensures adequate identification and readability, and is directed solely at the sign or is internal to it. All new wall signs shall include LED internal illumination in order to reduce the brightness of the signs. The Planned Sign Program has been conditioned to ensure that the LEDs and power supplies will be enclosed behind the channel letters attached to the wall and the lighting shall be 100 feet from any residentially zoned property. 5. The sign is not detrimental to the public interest, health, safety, or welfare. The proposed illuminated wall signs will be mounted at a sufficient height and location and will not affect pedestrian/vehicle access. The individual letters will be affix safely to the existing stucco façade. All new wall signs will be subject to review and approval by city departments ensuring conformance with the Building Code and local and state electrical 8017 Florence Avenue – PLN-20-00124 May 19, 2021 – Page 5 standards. Staff believes that the new signs will not create a detrimental impact to the public interest, health, safety, and or welfare. 6. The sign complies with Section 9624, Lighting and Design Standards. As mentioned in Finding No. 4, all proposed signs on the building will be internally illuminated using LED light units. In addition, the proposed project has been conditioned to ensure that all lighting will be LED and distanced from residential properties. The signs are not expected to conflict with the Downey Municipal Code because it is subject to conditions that will require this compliance. CORRESPONDENCE As of the date that this report was printed, staff has not received any correspondence regarding this matter. CONCLUSION Based on the analysis contained in this report, staff recommends that the Planning Commission adopt the resolution approving the Planned Sign Program (PLN-20-00124), subject to the conditions of approval as stated in the Planning Commission Resolution. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. An application was filed by Harry Daglas (hereinafter referred to as the “the applicant”) on December 8, 2020 requesting approval of a Planned Sign Program (PLN-20-00124) to establish standards for a multi-tenant commercial building for the size, location, and appearance of new wall signs; and, B. On January 7, 2021, staff deemed the application incomplete due to missing information. Upon multiple revisions to the plans, staff deemed the application complete on April 27, 2021; and C. On May 6, 2021, notice of the pending public hearing was sent to all Downey property owners within 500 feet of the subject site and the notice was published in the Downey Patriot; and, D. The Planning Commission held a duly noticed public hearing on May 19, 2021 and after fully considering all oral and written testimony, facts, and opinions offered at the aforesaid public hearing adopted this resolution. SECTION 2. The Planning Commission further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to be in compliance with the California Environmental Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15311 (Class 11), Accessory Structures because the project consists of on-premise signs. SECTION 3. Having considered all of the oral and written evidence presented to it at said public hearing regarding the Planned Sign Program, the Planning Commission further finds, determines and declares that: A. The proposed wall signs are permitted within the zone and it complies with all applicable provisions of Chapter 6, the General Plan, and any other applicable standards. The conditions are fair and reasonable for the accomplishment of these purposes. SECTION 5. The Secretary shall certify the adoption of this Resolution. Unless otherwise expressly specified, all other requirements of the City of Downey Municipal Code shall apply. 3) The City Planner is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 4) The Planning Commission reserves the right to revoke or modify this approval if the proposed use becomes a public nuisance, finds the permit was obtained by fraud, the approved use is not being exercised, the approved use is operated in violation of the terms and conditions contained herein, or the approved use ceased or was suspended for one year or more. 5) The Owner/Applicant agrees, as a condition of approval of this resolution, to indemnify, defend and hold harmless, at Applicant's expense, City and City's agents, officers and employees from and against any claim, action or proceeding commenced within the time period provided in Government Code Section 66499.37 to attack, review, set aside, void or annul the approval of this resolution, to challenge the determination made by City under the California Environmental Quality Act or to challenge the reasonableness, legality or validity of any condition attached hereto. City shall promptly notify Applicant of any such claim, action or proceeding to which City receives notice, and City will cooperate fully with Applicant in the defense thereof. Applicant shall reimburse the City for any court costs and attorney's fees that the City may be required to pay as a result of any such claim, action or proceeding. City may, in its sole discretion, participate in the defense of any such claim, action or proceeding, but such participation shall not relieve Applicant of the obligations of this condition. 6) An affidavit of Acceptance of Conditions, as provided by the City of Downey, shall be signed, notarized, and returned to the Planning Division within fifteen (15) days of approval. This approval will be considered invalid until this condition has been fulfilled. 7) Primary wall signs shall only be mounted on the store front façades facing Florence Ave and one unit facing west. A secondary wall sign for the west corner tenant space facing the drive entrance/parking lot as indicated on the approved Planned Sign Program. 8) All wall signs shall be illuminated with LED light. Illuminated wall signs shall be a minimum of 100 feet from any adjacent residential zone. The applicant shall also obtain required building inspections for all signs. 12) The property owner shall notify all tenants that all individual tenant signs shall be brought into compliance with the Planned Sign Program at such time that the tenant’s lease is renewed or when any changes are proposed to the sign, whichever occurs first. In any case, the property owner shall bring all signage into compliance within one (1) year of this Planned Sign Program approval. It is the intent that any new signage within Building 8017 -8027 Florence Avenue is not specifically addressed by this sign program shall require once sign program is approved. B.GENERAL LANDLO RD TENANT REQUIREMENTS 1.In order to gain consistent design and conformance, it is recommended to have tenants replace sign within the 1 year of program approval. The Tenant shall submit to Landlord for written approval, three (3) sets of detailed, scaled drawings, in full color. These drawings shall include scaled drawings of the building elevation to which the sign are to be attached with the sign placed on the building, leasehold location and width, and proposed sign specifications including exact sign dimensions, area, materials, and colors. A section detail must also be included in the submitted drawings clearly illustrating sign construction and types offasteners. Proposed drawings must clearly illustrate compliance of the proposed sign with this sign program, the City of Downey Municipal Code, and the requirements of any other governmental agency. 2.All signs shall be reviewed by the Landlord for conformance with this criteria, overall design quality, and compatibility with the intended aesthetic character of Building 8017 -8027 Florence Avenue. Approval or disapproval of sign submittals shall remain the sole right of the Landlord and City. 3.Tenant must obtain written approval from the Landlord (and any other relevant agencies) of all proposed signs prior to submitting sign drawings to the City of Downey for the purpose of obtaining a sign permit. 4.Tenant's sign contractor shall be licensed and insured, and be responsible for the fulfillment of all the requirements and specifications, completing the installation in a good and work-man like manner, cleanup, patching and painting all surfaces damaged by them. Tenant shall ensure their signs have all required inspections. 5.Prior to the install and manufacture of any sign, the Tenant shall obtain a sign permit from the City of Downey and provide Landlord with a copy of such sign permit. 6 Signs built and/or installed without permits and approval by Landlord, governmental agencies having jurisdiction over Building 8017 -8027 Florence Avenue. (or others having rights of approval of such signs), or contrary to corrections made by Landlord or such governmental agencies, shall be altered to conform to such standards at Tenant's sole cost and expense. If Tenant's sign has not been brought into conformance within fifteen (15) days after written notice from Landlord, Landlord shall have the right to correct said sign at the sole cost and expense of Tenant. 7.The Tenant shall pay for all signs, related materials, permits and installation fees (including final inspection costs). 8.Tenant signs should be installed prior to opening date but after city issues a city business license for new tenant. 9.Damaged portions of any sign(s) shall be repaired or replaced within three (3) business days. In the event Tenant shall be unable to effect such repair or replacement within said period for any reason (other than financial inability) beyond Tenant's control, Tenant shall notify Landlord and provide to Landlord a plan of action to be taken to ensure that such repair or replacement shall be continuously pursued with due diligence until completed. 10.A Tenant who vacates their space is responsible to remove any wall sign in its entirety, clean, patch and paint to match existing color, leaving the fascia in like-new condition. The Landlord will remove and dispose of any sign remaining after tenant vacates within fourteen (14) days of a tenant's departure, considering the sign abandoned and withholding the cost of the removal from the Tenant's deposit. GENERAL SPECIFICATIONS Sign sizes shall not exceed the general sizes outlined. Landlord has the final discretion when reviewing the proposed signage and reserves the right to not allow signage, even if it meets the criteria herein. Signs shall be fabricated per the specifications shown. All signs and their installation shall comply with all local building and electrical codes. All electrical signs will be fabricated according to U.L. specifications. Sign company to be fully licensed with the State and shall have full workman's compensation and general liability insurance. All penetrations of exterior fascia are to be sealed watertight (color and finish to match existing building exterior). No roof penetrations shall be made without Landlord's prior written consent. Tenant, at Tenant's expense, shall immediately repair any damage caused by Tenant's sign contractor which has occurred to the premises during the course of installation of Tenant's sign(s). All conduits, transformers, junction boxes and openings in building surfaces shall be concealed. Any necessary exposed hardware must specifically be approved by Landlord and City regulatory departments prior to installation and must be finished in a manner consistent with quality fabrication practices. Signs shall be placed in locations as shown, with Landlord approval. D.PROHIBITED SIGNS 1.Permanent advertising devices such as attraction boards, posters, balloons, pennants, banners, and flags. Temporary signage requires advanced express written Landlord approval prior to installation and any required City approval. 2.Flashing, animated, audible, revolving or other signs that create the illusion of animation are not permitted. 3.Signs Constituting a Traffic Hazard. No person shall install or maintain, or cause to be installed or maintained, any sign which simulates or imitates in size, color, lettering or design any traffic sign or signal, or which makes use of the words "STOP", "LOOK", "DANGER" or any other words, phrases, symbols or characters in such a manner as to interfere with, mislead, or confuse traffic. 4.Signs in Proximity to Utility Lines. SIGN PROGRAM PRIMARY WALL SIGNS The following requirements apply to all Tenant signs: 1.All primary storefront signs shall be illuminated channel letters signs except for logo I sub copy signs as approved by the Landlord. Logo signs included in channel letter signs may constitute no more than 25% of the sign area. Letter dimensions of greater proportions may be considered if, in the Landlord's opinion, the sign design is of exceptional merit and architectural quality. 10.All storefront signage and lighting both interior and exterior is required to be on a separate circuit and controlled by a time clock. Wall signs and lighting are required to be on during operational hours and off during non-operation hours. This includes exterior building storefront signage.
