HomeMy WebLinkAboutResolution No. 20-7959 - Ratifying Emergency Order No 4 Temporarily Suspending Downeylink & Dial-a-Ride FaresA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY RATIFYING EMERGENCY ORDER • . 4 BY THE CITY MANAGER ACTING AS • ' OF EMERGENCY SERVICES AUTHORIZING THE TEMPORARY SUSPENSION OF DOWNEYLINK AND DIAL -A -RIDE FARE COLLECTIOU FOT VIDERS► TYE CI-V OF DOWVEY SectionWHEREAS, pursuant to Article 11, Chapter 4, Part 4 of the Downey Municipal Code, • and Government Code Section :• 1 the City Manager• as the CouncilDirector of Emergency Services is authorized to proclaim the existence or threatened existence of a public emergency when the City is affected or likely to be affected by a public calamity and the City • session; WHEREAS, the novel coronavirus (COVID-119) is a respiratory disease that may result in serious illness or death and is easily transmissible from person to person and poses conditions of peril to the public healthand safety of •- • and WHEREAS, the Los Angeles County Department of Public Health on March 16, 2020 issued a Health Officer Order prohibiting all indoor and private gatherings and all outdoor public and private events of no more than 50 people and later updated its Health Officer Order on March 21, 2020 prohibiting all indoor and outdoor gatherings and events, and requiring all businesses to cease in -person operations and close to the public, unless the business is defined as an Essential- and WHEREAS, on March 18, 2020, the City Manager acting as the Director of Emergency Services proclaimed - existence of • Emergency - City of Downey, ratified by s on 1 1 and on • 2020, the County of • Angeles announced - - approval of the County's plan to move further into "Stage 2" of the State's "Resiliency oa .• and CountyWHEREAS, Los Angeles County announced that the number of confirmed COVID-19 cases in the of 1 1 was approximately 141 • . with 3,763 deaths and that Countythe • to see a high•- of and WHEREAS, COVID-19 therefore has and will continue to cause conditions of peril to the health, safety, • welfare of persons • property in the City of Downey; and On July 14, 2020, the Countyof •, Angeles -•i . revised Health Officer Order, "Safer at Work and in the Community for Control of COVID-19" prohibiting indoor operations of various businesses, in order to comply with the Statewide Public Health Officer Order that was issued on 1 1 and WHEREAS, the City's current DowneyLink Faresare 1' per • and per 1 Use Bus Pass as set annually by the City of Downey — Citywide User Fee Schedule; and WHEREAS, the City's current Dial -A -Ride Fare is $.50 per trip; and WHEREAS, the City intends to assist local patrons who have been financially impacted by the COVID-19 Pandemic by temporarily suspending DowneyLink and Dial -A -Ride fare collection for riders; and V TOM B I 1i j • �t �— PAGE 2 WHEREAS, this action is necessary to help alleviate the unexpected financial burden being experienced by patrons who depend on the City's Transit system to transport them to and from essential business and work; and WHEREAS, this action will also help further enhance COVID-19 mitigation measures by limiting interactions between operators and passengers during trips; and WHEREAS, the following COVID-19 protocols are place to mitigate the spread of the virus 0 Buses are deep clean and wiped down every night, * Bus Operators are provided before each shift gloves, hand sanzer, and wipes to be use during their shift on high touch areas such as rangs, seats, All bus operators and passengers are required to wear masks, All boarding's are only thru the back door of the bus, Passenger capacity was set to 15 passengers for DowneyLink to ensure social distancing, Passenger capacity was set to 7 passengers for cutaway buses for Dial -A -Ride to ensure social distancing; and 'WHEREAS, the City Manager acting as the Director of Emergency Services is authorized to promulgate orders and regulations necessary to provide for the protection of life and property; and to further promote economic recovery of the community. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 2. That Emergency Order No. 4 issued by the City Manager acting as the Director of Emergency Services and attached hereto as Exhibit A is hereby ratified pursuant to Downey Municipal Code Section 2434(a). As the Director of Emergency Services pursuant to Downey Municipal Code Section 0�,433(a) and by the powers vested in me by Downey Municipal Code Section 2434, 1 hereby -ssue the following order: 2. This Emergency Order No. 4 is effective immediately until the City Council terminates the Local Emergency.
