EXTENDING EMERGENCY ORDER NO. 2 REQUIRING NON -CONTACT
TEMPERATURE SCREENING AND FACE COVERINGS IN CITY FACILITIES
WHEREAS, according to the World Health Organization (WHO), COVID-19 has spread
globally to 216 countries, infecting more than 16.5 million persons and killing more than 655,112
individuals worldwide, and has been characterized as a pandemic; and,
WHEREAS, on March 4, 2020, the Governor of the State of California declared a State
of Emergency in response to the COVID-19 pandemic; and,
WHEREAS, on March 4, 2020, the Health Officer of Los Angeles County determined
that there is an imminent and proximate threat to the public health from the introduction of
COVID-19 in Los Angeles County, and declared a Local Health Emergency, and the Los
Angeles County Board of Supervisors concurrently proclaimed the existence of a local
emergency for the County of Los Angeles; and,
WHEREAS, on March 15, 2020, the Governor announced via press conference that he
was: (1) calling for home isolation for adults over the age of sixty-five and individuals with
chronic conditions; (2) directing the closure of bars, brewpubs, wineries, and nightclubs; and (3)
calling for restaurants to limit occupancy to half their current allowance and practice social
distancing; and,
WHEREAS, on March 13, 2020, the President of the United States declared a National
Emergency due to the continuing spread and the effects of COVID-19; and on March 16, 2020,
announced guidelines advising people to avoid gatherings of ten (10) or more persons for a
period of fifteen (15) days; and
WHEREAS, on March 16, 2020 (and expanded on March 21, 2020), Los Angeles
County Department of Public Health instituted the "Safer at Home" order to control the spread of
COVID-19, which among other things, temporarily prohibits all events and public gatherings of
any size , and the closure of non -essential businesses and areas;
WHEREAS, on March 18, 2020, the City Manager, acting as the Director of Emergency
Services for the City of Downey, proclaimed the existence of a Local Emergency due to the
spread and potential further spread of COVID-19, which the City Council for the City of Downey
ratified at its regular meeting on March 24, 2020; and
WHEREAS, in April 2020, the Governor and the State Public Health Officer articulated a
4 Stage framework ("California Pandemic Resilience Roadmap") to reintroduce business
sectors and activities in a phased manner to protect the public health and safety and lower
COVID-19 transmissions and outbreaks in the community; and
WHEREAS, on May 13, 2020, the County of Los Angeles announced its "Reopening
Safer at Work and in the Community Revised Order" moving the County of Los Angeles through
"Stage 2" of "California's Pandemic Resilience Roadmap"; and
WHEREAS, on May 29, 2020 the County of Los Angeles announced the State's
approval of the County's plan to move business sectors and activities further into "Stage 2" of
California's "Pandemic Resilience Roadmap";
WHEREAS, during the reopening of business sectors and activities, the number of
infections and deaths in Los Angeles County due to the COVID-19 pandemic sharply increased

causing Governor Newsom on July 13, 2020 to order 30 counties in the State, including Los
Angeles County, to close indoor activities at fitness centers, places of worship, offices for non-
critical sectors, personal care services, such as hair salons and barbershops, and indoor malls;

rooms, movie theaters, family entertainment centers, museums, zoos and card rooms, and
ordered all bars shuttered across the state; and,
WHEREAS, Los Angeles County Department of Public Health continues to order that
County residents remain in their residences as much as practicable; ; to limit close contact with
others outside their household in both indoor and outdoor spaces; and to prohibit gatherings of
people who are not part of single household or living unit; to continue to practice Social
(Physical) Distancing, at all times while out in public; and to wear a cloth face covering over both
the nose and mouth when in or likely to be in contact with others, to lower the risks of person -to -
person contact for themselves and others; and,
WHEREAS, on June 4, 2020, the City Manager acting as the Emergency Services
Director issued Emergency Order No. 2, attached hereto as Exhibit A, requiring non -contact
temperature screening and face coverings when entering any city facility; and,
WHEREAS, on June 9, 2020, Emergency Order No. 2 was ratified by resolution of the
City Council; and,
WHEREAS, in order to continue to comply with State and County orders, to lower the
risk of spread of COVID-19, and to allow city businesses to continue to operate safely for city
employees and members of the public, the City Council extends Emergency Order No. 2 as set
forth in this Resolution.
SECTION 1. Emergency Order No. 2 requiring non -contact temperature checks and
the use of face coverings attached hereto as Exhibit A is extended until the City Council
terminates the Local Emergency. This order may be terminated sooner or extended further by
order of the Director of Emergency Services or the City Council.

WHEREAS, by order of the City Manager acting as the Emergency Services Director,
Downey City Hall and other city facilities were opened to the public effective June 1, 2020 with
social distancing protocols in place',

4. Members of the public entering City of Downey facilities shall wear a face covering at all
times while inside city facilities. This order shall remain in place as long as the Los
Angeles County Public Health Order reqng face coverings is in effect.
5. Individuals not permitted to enter a City facility will be provided written information on
how to receive City services, contact City Council Members or attend city meetings by
phone, email, or on-line (Attachment A).
S. This Order shall be subject to amendment, extension or repeal at any time, and shall not
be deemed to confer any contractual obligations, property rights, or assume any City
liability.
7. If any provision of this Order or.its application any person or circumstance is held to be
invalid, then the remainder of the Order, including the application of such part or
provision to other persons or circumstances, shall not be affected and shall continue in
full force and effect. To this end, the provisions of this Order are severable.
