HomeMy WebLinkAboutPC Reso 12-2750RESOLUTION NO. 12-2750 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN -11-00265, A REQUEST TO MODIFY AN EXISTING PLANNED SIGN PROGRAM (DESIGN REVIEW BOARD CASE NO. 88-33) FOR THE RANCHO BUSINESS CENTER TO ESTABLISH A MULTI -TENANT MONUMENT SIGN ON PROPERTY LOCATED AT 7700 IMPERIAL HIGHWAY, ZONED S -P 85-1 (RANCHO LOS AMIGOS). THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. On April 2, 1991, the Design Review Board approved Design Review Board Case No. 88-33, thereby approving a Planned Sign Program for the Rancho Business Center; this sign program included sign development standards and limitations for all businesses located at the center; B. An application was filed by Stephen Hoy, (hereinafter "applicant") requesting approval of PLN -11-00265 (Sign Program): a modification to an existing Planned Sign Program for the Rancho Business Center to allow a multi -tenant monument sign on the property located at 7700 Imperial Highway, zoned SP 85-1 (Rancho Los Amigos) (hereinafter "subject property") (AIN 6245-016-913); C. On December 22, 2011, notice of the public hearing was sent to all property owners -within 500' of the subject site and the notice was published in the Downey Patriot; and, D. The Planning Commission held a duly noticed public hearing on January 4, 2012 and, after fully considering all oral and written testimony and facts and opinions offered at aforesaid public hearings, adopted Resolution No. 12-2750, subject to conditions of approval (Exhibit A). SECTION 2. The Planning Commission further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to be in compliance with the California Environmental Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15311 (Class 11, Existing Facilities). SECTION 3. Having considered all of the oral and written evidence presented to it at said public hearings, the Planning Commission further finds, determines and declares that: The proposed sign is permitted within the zone and complies with all applicable provisions of this chapter, the General Plan, and any other applicable standards. The subject -site is within a specific plan area, which permits the use of signage. The proposed modification to the Planned Sign Program limits the sign appropriately and the applicant is not requesting any deviations from the provisions of the Code. The proposed modification to the Master Sign Program complies with all the applicable provisions of the Zoning Code. Resolution No. 12-2750 Downey Planning Commission 2. The sign is in proper proportion to the structure or site on which it is located. The proposed monument sign will be in proper proportion to the building facade of the center. The design of new sign will compliment the architecture of the existing businesses. 3. The sign materials, color, texture, size, shape, height, and placement are compatible with the design of the structure(s), property, and neighborhood of which it is a part. As noted in the previous finding, the proposed sign is compatible with the tenant space's facade and the site. 4. The sign's illumination is at the lowest reasonable level as determined by the City Planner, which ensures adequate identification and readability, and is directed solely at the sign or is internal to it. All of the signs are internally illuminated with fluorescent lamps and LED strands to reduce the brightness of the sign. The City Planner has reviewed both of these lighting sources and has agreed that they are set at the minimum standards needed to ensure that there is adequate readability of the sign. 5. The sign is not detrimental to the public interest, health, safety, or welfare. The proposed sign at the subject site is set at a sufficient height and setback, such that they will not create a detrimental impact to the public interest, health, safety, and/or welfare. 6. The sign -is in compliance with Section 96-24, Lighting and Design Standards. All proposed signs on site are internally illuminated with fluorescent lamps and LED strands, which is in compliance with Municipal Code Section 9624. SUCTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution, the Planning Commission of the City of Downey hereby approves PLN -11-00265 (Sign), subject to conditions of approval attached hereto as Exhibit A, which are necessary to preserve the health, safety and general welfare of the community and enable the Planning Commission to make the findings set forth in the previous sections. The conditions are fair and reasonable for the accomplishment of these purposes. SECTION 5. The Secretary shall certify the adoption of this Resolution. Robert Kiefer, Chairman City Planning Commission PLN -11-00265 — 7700 Imperial Hwy January 4, 2012 - Page 2 Resolution No. 12-2750 Downey Planning Commission I HEREBY CERTIFY that the foregoing is a true copy of a Resolution adopted br the Planning Commission of the City of Downey at a regular meeting thereof, held on the 4t day of January, 2012, by the following vote, to wit: AYES: COMMISSIONERS: Morales, Murray, Lujan, Garcia, Kiefer NOES: COMMISSIONERS: None ABSENT: COMMISSIONERS: None Theresa Donahue, Secretary City Planning Commission PLN -11-00265— 770OAmperial Hwy Januerj,A, 2012 - Page.3 Resolution No. 12-2750 Downey Planning Commission PLN -11-00265 (MASTER SIGN PROGRAM) EXHIBIT A - CONDITIONS PLANNING 1) The Downey Planning Commission grants this approval of PLN -11-00265 for the modification to Design Review Board Case No. 88-33 to replace the existing monument sign with a new multi -tenant monument sign for the Rancho Los Amigos Center located at 7700 Imperial Highway, as shown on the approved plans. 2) The City Planner is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 3) All other conditions of approval for Design Review Board No. 88-33 shall remain valid and in force. 4) All conditions of approval of PLN -11-00265 shall be complied with before this modification becomes valid. 5) Prior to the issuance of any building permit for a sign, said sign shall comply with this modification to Design Review Board No. 88-33, except for window signs and non -permit signs, which shall comply with the requirements of the Downey Municipal Code. BUILDING 6) All construction shall comply with the 2010 California Building Code and Title 24 of the California -Energy Code. 7) Prior to the commencement of sign installation, the applicant shall obtain all required permits. Additionally, the applicant shall obtain all necessary inspections and permit final prior to beginning operation of the site.
