A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY
APPROVING PLN -11-00207 (SPECIAL EVENT) - A REQUEST FOR A SPECIAL EVENT FOR
A WEDDING CEREMONY ON THE FRONT LAWN AND RECEPTION ON THE FIRST FLOOR
OF THE BUILDING (RIVES MANSION) ON SEPTEMBER 10, 2011 FROM 3:00 PM TO 12:00
AM ON PROPERTY LOCATED AT 10933 PARAMOUNT BOULEVARD, ZONED DOWNTOWN
DOWNEY SPECIFIC PLAN (DDSP).
THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The Planning Commission of the City of Downey does hereby find,
determine and declare that:
A. An application was filed by Carmen Rivera (hereinafter "Applicant") requesting
approval of a PLN -11-00207 (Special Event) - a request for a special event for a
wedding ceremony on the front lawn and reception on the first floor of the
building (Rives Mansion) on September 10, 2011 from 3:00 pm to 12:00 am on
property located at 10933 Paramount Boulevard (hereinafter "Subject Site"),
zoned Downtown Downey Specific Plan (DDSP); and,
B. On August 24,2011 notice of the pending public hearing was published in the
Downey Patriot and on August 25, 2011 notice of the pending public hearing was
sent to all Downey property owners within 500 feet of the subject site; and,
C. The Planning Commission held a duly noticed public hearing on September 7,
2011, and fully considered all oral and written testimony and facts and opinions
offered at the aforesaid public hearing, hereby adopted this Resolution No. 11-
2728, approving PLN -11-00207 (Special Event), subject to the conditions of
approval (hereto attached as Exhibit A).
SECTION 2. The Planning Commission further finds, determines and declares the
environmental impact of the proposed development has been reviewed and has been found to
be in compliance with the California Environmental Quality Act (CEQA) and is categorically
exempt from CEQA, pursuant to Guideline Section No. 15304 (Class 4), Temporary Land Uses.
SECTION 3. Having considered all of the oral and written evidence presented to it at
said public hearings, the Planning Commission further finds, determines and declares that:
1. That the proposed activity or use will be consistent with the objectives,
policies, and general land uses and programs specified in the City's
General Plan.
PLN -11-00207 (Special Event) is consistent with Program 1.2.2.1 of the City's
Vision 2025 General Plan, Chapter 2. Livable Communities, which states that
the City shall "Promote the downtown area as a destination point for
entertainment, dining, civic and other activities". In addition, Program 8.4.3.3 and
8.4.2.4 of the City's Vision 2025, General Plan, Chapter 8, Design, respectively
state "Encourage adaptive re -use of older structures" and "Encourage cultural
uses to be more centrally located — preferably in the downtown area." Thus,
allowing for an event such as the proposed wedding within the subject site,
allows for the temporary reuse of a historic structure without significantly or
permanently impacting the structure. Additionally, this type of event will allow for
more activity in the downtown and will encourage further civic and cultural
activities within it.

2. That the proposed activity or use will be consistent with other provisions of
this article.
The proposed activity is located within the DDSP (Downtown Downey Specific
Plan) and special events such as outdoor events and festivals are permitted,
subject to Section 2.4.2 — Temporary Uses and Special Events of the Downtown
Downey Specific Plan and 9420.04 (b) of the Downey Municipal Code, which
states that "If an event is of a scale (e.g. large in area or number of persons) or
use that may result in extensive potential, even temporary, impacts to the
community, the City Planner may use his/her discretion and forward the Special
Event Permit application to the Commission for their decision". Consequently,
the City Planner forwarded this item to the Planning Commission.
3. That the proposed activity or use will not result in conditions or
circumstances contrary to the public health, safety, and general welfare.
It is staffs opinion that approving the PLN -11-00207 (Special Event) will not
result in conditions contrary to the public health, safety and general welfare given
that it is a temporary one day event. As such, conditions of approval have been
imposed to prevent such conditions and circumstances that may be contrary to
the public health, safety and welfare (see Exhibit A — Conditions, of this
Resolution).
SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this
Resolution, the Planning Commission of the City of Downey hereby approves PLN -11-00207
(Special Event), subject to conditions of approval attached hereto as Exhibit A — Conditions,
which are necessary to preserve the health, safety and general welfare of the community and
enable the Planning Commission to' make the findings set forth in the previous sections. The
conditions are fair and reasonable for the accomplishment of these purposes.
SECTION 5. The Secretary shall certify the adoption of this Resolution.

EXHIBIT A— CONDITIONS
PLN -11-00207 (SPECIAL EVENT)
PLANNING
1. This approval of PLN -11-00207 (Special Event) allows for an special event to be held on
Saturday, September 10, 2011, from 3:00 p.m. to 11:00 p.m. Approved activities include:
a. A wedding ceremony on the front lawn of the property from 4:00 pm to 5:00 pm.
b. A wedding reception from 5:00 pm to 11:00 pm. This reception shall occur within the
confines of the main structure on the premises (Rives Mansion).
2. The City Planner is authorized to make minor modifications to the approved preliminary
plans or any of the conditions if such modifications shall achieve substantially the same
results as would strict compliance with said plans and conditions.
3. Outdoor set-up of seating and flower arrangements for the wedding ceremony shall begin at
3:00 p.m. the day of the event. Break -down of the outdoor seating and flowers shall be
completed by 6:00 pm of the same day.
4. Applicant shall be responsible for the removal of litter, trash, and debris to cleanup and remove
all trash on the public streets and neighboring properties no later than 11 pm the day of the
event. The removal of trash receptacles, portable restrooms and garbage shall be completed
between 8:00 a.m. and 5:00 p.m. on Sunday, September 11, 2011.
5. Amplified sound shall occur within the Rives Mansion building and shall be directed away
from adjacent residential properties.
6. The applicant shall be responsible for providing parking for all attendees on-site. If this
cannot be achieved, the applicant shall provide to the City Planner an alternative parking
plan by no later than September 9, 2011. Such plan shall provide among other things, (1)
the number of parking spaces that cannot be accommodated on-site; and (2) the location
where additional vehicles will park. If public parking will be utilized, the appropriate permit
must be obtained and fees paid through the Downey Public Works Department by no later
than September 9, 2011.
7. Valet parking activities shall not occur in any public -right -of way. Valet attendants shall be
located on-site.
8. Issues, including but not limited to police and security, food and water supply, use of tents
and canopies, sanitation facilities, medical services, noise, signage, fire protection, public
parking lots, and traffic control, shall be satisfactorily addressed by the applicant, as required
by the City Planner or other City departments in their administration of other City regulations.
Such other regulations may require the applicant to obtain permits such as building,
electrical, health, tent, encroachment, and other permits. Required permits by outside
agencies are the sole responsibility of the applicant.
9. All required Building Department, Police Department, Public Works Department and Fire
Department permits shall be obtained prior to the start of the event.

10. Any necessary Health Department approvals required for the sale or serving of food shall be
obtained prior to the start of the event. Bartenders serving alcohol at the event shall be licensed
and bonded.
11. The sale or serving of alcoholic beverages shall comply with the requirements of the State
Department of Alcoholic Beverage Control.
12. Pursuant to Downey Municipal Code Section 9420.20, special outdoor events shall not occur
more than four (4) times in a calendar year.
13. Pursuant to Downey Municipal Code Section 9534.16, the subject property shall maintain, for
safety vision purposes, a triangular area formed by the lot lines adjoining the intersecting
streets for a distance of twenty-five (25) feet from such intersection and a line connecting the
ends of such lot lines, and within the area comprising such triangle nothing shall be erected,
placed, planted, or allowed to grow in such a manner as materially to impede vision (see
diagram below).

14. The applicant shall be responsible for notifying attendees that parking on Third Street west of
the event site is prohibited.
15. No noise shall exceed five (5) dba above the ambient noise level, as measured at the
property line, per the Downey Municipal Code.
16. Provide sufficient trash receptacles for the disposal of food and other goods.

17. The applicant must have four (4) licensed security guards on-site during the duration of the
event (September 10, 2011 from 3:00 pm to 1:00 am).
