HomeMy WebLinkAboutPC Reso 11-2713RESOLUTION NO. 11-2713 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN -10-08048 (SIGN) FOR A PLANNED SIGN PROGRAM FOR A MULTI -TENANT BUILDING LOCATED AT 10441-45 LAKEWOOD BOULEVARD, ZONED C-1 (NEIGHBORHOOD COMMERCIAL). THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. An application was filed by Mr. and Mrs. Phillipy, (hereinafter "applicant") requesting approval of a planned sign program for a multi -tenant building at 10441-45 Lakewood Boulevard, zoned C-1 (Neighborhood Commercial) (hereinafter "subject property"), AIN: 6252-002-032. B. On May 5, 2011, notice of the pending public hearing was sent to all property owners within 500' of the subject site and a notice was published in the Long Beach Press Telegram; and C. The Planning Commission held a duly noticed public hearing on May 18, 2011 and, after fully considering all oral and written testimony and facts and opinions offered at the aforesaid public hearing, adopted this resolution, approving PLN - 10 -08048 (SIGN). SECTION 2. The Planning Commission further finds, determines and declares that after preparing an Initial Study in compliance with the requirements of the California Environmental Quality Act, which found that there would be no significant environmental impacts created by the proposed Planned Sign Program, a Negative Declaration was prepared. Based on its own independent judgment that the facts stated in the initial study are true, the Planning Commission hereby finds that the approval of the Planned Sign Program will not have any potential negative environmental impacts. SECTION 3. Having considered all of the oral and written evidence presented to it at said public hearings, the Planning Commission further finds, determines and declares that: The proposed sign is permitted within the zone and complies with all applicable provisions of this chapter, the General Plan, and any other applicable standards. The subject site is within the C-1 zone, which permits the use of wall, projecting and monument signs. The proposed Planned Sign Program appropriates wall, projecting and monument sign space for each tenant, as demonstrated in the table below: Sian Description Maximum Area Allowed Proposed Area Wall Signs Tenant Space A, Primary (Lakewood Blvd.) 165 sq. ft. 52.5 sq. ft. Resolution No. 11-2713 Downey Planning Commission As such, the planned sign program complies with all the applicable provisions of the Zoning Code, including the allowance for the Planning Commission to permit deviations to the sizes and quantities of the signs. 2. The sign is in proper proportion to the structure or site on which it is located. Based on a review of the proposed signs size and location, the wall, projecting and monument signs will be in proper proportion to the building facades since the applicant has kept the sign square footage significantly under the allowed square footage. The height of the monument sign shall be reduced from the proposed ten -foot height to the Downey Municipal Code allowed eight -foot height so as to be in proportion to the one-story building. 3. The sign materials, color, texture, size, shape, height, and placement are compatible with the design of the structure(s), property, and neighborhood of which it is a part. The wall and projecting sign are compatible with the building and the site. However, the monument sign shall meet the required eight -foot maximum height requirement per Downey Municipal Code and not be approved at the proposed ten -foot height deviation; this change allows for the height of the monument sign to be in proportion to the one-story height of the building. 4. The sign's illumination is at the lowest reasonable level as determined by the City Planner, which ensures adequate identification and readability, and is directed solely at the sign or is internal to it. The wall and monument signs are internally illuminated with neon bulbs to reduce the brightness of the sign. A condition of approval is included for the use of internal LED strands to illuminate the signs. The City Planner has reviewed both of these lighting sources and has agreed that they are set at the minimum standards needed to ensure that there is adequate readability of the signs. Accordingly, staff believes that this finding can be adopted. 5. The sign is not detrimental to the public interest, health, safety, or welfare. In addition, any signs that are to face the residential properties to the east are to be non -illuminated per Section 9608 (j) of the Downey Municipal Code. Finally, although the monument signs are setback sufficiently to allow for visibility, they shall meet the required eight -foot maximum height requirement per Downey Municipal Code and not be approved at the proposed ten -foot height deviation. As such, staff feels that this finding can be adopted. 6. The sign is in compliance with Section 9624, Lighting and Design Standards. The internally illuminated signs will be in compliance with Municipal Code Section 9624. As such, staff feels that this finding can be adopted. SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution, the Planning Commission of the City of Downey hereby approves PLN -10-08048 (SIGN), subject to conditions of approval attached hereto as Exhibit A, which are necessary to preserve the health, safety and general welfare of the community and enable the Planning Commission to make the findings set forth in the previous sections. The conditions are fair and reasonable for the accomplishment of these purposes SECTION 5. The Secretary shall certify the adoption of this Resolution. Maximum Sign Area Allowed for Entire Site 424.13 sq. ft. 2) Approval of this Planned Sign Program shall not be construed to mean any waiver of applicable and appropriate zoning regulations, or any Federal, State, County, and City laws and regulations. Unless otherwise expressly specified, all other requirements of the City of Downey Municipal Code shall apply. 3) The City Planner is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 4) All tenants shall follow the colors and font styles per the Planned Sign Program (Exhibit B of this resolution). Trademarked tenants, names and/or logos may deviate from said color and font styles. 5) The applicant/property owner shall comply with all conditions of approval for PLN -10- 08048 (SIGN) before the Planned Sign Program becomes valid. 6) Prior to the issuance of any building permit for a sign, said sign shall comply with this Planned Sign Program, with exception of window signs and non -permit signs, which shall comply with the requirements of the Downey Municipal Code. 7) The following changes shall be incorporated into the Planned Sign Program: a) Monument signs — The sign height shall not exceed eight -feet (8') tall above grade, as allowed by Downey Municipal Code Section 9618.04 (4), Table 9.6.6.
