HomeMy WebLinkAboutPC Reso 10-2686RESOLUTION NO. 10-2686 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN -10-08125 (SITE PLAN REVIEW), REGARDING THE ARCHITECTURAL DESIGN, EXTERIOR BUILDING MATERIALS, COLORS, AND LANDSCAPING FOR A RESTAURANT/ - RETAIL DEVELOPMENT AT 8236-8280 FIRESTONE BOULEVARD, ZONED C-3/DP (CENTRAL BUSINESS DISTRICT/DOWNTOWN PLAN OVERLAY ZONE THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. On October 7, 2010, Geovanny Mendoza (hereinafter "Applicant") filed a Land Use Permit Application to request approval of PLN Case No. 10-08125 (Site Plan Review) for the architecture, exterior building materials, exterior colors and landscaping for a new restaurant/retail center at 8236-8274 Firestone Boulevard. (hereinafter "subject property"). B. The subject property is zoned C -3/D -P (Central Business District/Downtown Plan Overlay). C. The General Plan designation of the subject property is M -u (Mixed Use) D. On October 8, 2010, notice of the pending public hearing was sent to all property owners within 500' of the subject site and the notice was published in the Downey Patriot on October 8, 2010. E. On October 9, 2010, the Planning Commission opened the public hearing on PLN Case No. 10-08125 (Site Plan Review) and voted to continue the public hearing to a date certain, November 3, 2010. F. PLN -10-08125 proposes to develop the "Downey Gateway" with four (4) distinct buildings, clustered along the Firestone Boulevard and Downey Avenue frontages of the site and separated by courtyard paths. G. The design of each building conveys a contemporary architectural design thorough the utilization of modular shapes, varying building heights and flat roofs H. All four buildings will utilize stacked bond bricks, cement plaster finishes, and clear anodized aluminum storefronts with clear non -reflective glass. PLN -10-08125 also proposes to incorporate design elements such as umbrellas, fabric awnings, solid -metal awnings, metal trellis arcades, signs, string lights, greenscreens, sculptural light bollards, and an exterior time piece to embellish the courtyard areas and the buildings. J. The Planning Commission held a duly noticed public hearing on November 3, 2010, and, after fully considering all oral and written testimony, facts, and opinions offered at the aforesaid public hearing, adopted Resolution No. 10-2686, approving PLN 10-08125. SECTION 2. Having considered all of the oral and written evidence presented to it at said public hearing, the Planning Commission further finds, determines and declares that: A. That the site Man is consistent with the goals and policies embodied in the General Plan and other applicable plans and policies adopted by the Council. Those goals and policies of the Downey General Plan (Vision 2025) are addressed as follows: Goal 2.5 of the Circulation Element is, "Address the impacts from the lack of parking," while Policy 2.5.1 seeks to provide for adequate parking to meet parking demands. The proposed site plan meets the minimum quantity of off-street parking spaces required for the restaurants and retail uses proposed on the subject property. Goal 8.1 of the Design Element is "Promote quality design for new, expanded and remodeled construction" and Policy 8.1.1 seeks to promote architectural design of the highest quality. The applicant proposes to construct an attractive commercial development that will convey a contemporary theme that recent construction projects in the vicinity express. Goal 9.1 of the General Plan is "Attract and retain businesses" and Program 9.1.1.5 seeks to continue the revitalization of commercial and industrial corridors. The proposed building will attract new businesses and continue the revitalization efforts of Firestone Boulevard and the Downtown area. B. That the proposed development is in accordance with the purposes and obeectives of this article and the zone in which the site is located. PLN -10-08125 (Site Plan Review) proposes a 26,232 square foot, high-end food court/retail center in the Downtown Area. The subject property is zoned C -3/D -P (Central Business District/Downtown Plan Overlay Zone. The concept for the Downtown Plan (Downtown Plan No. 00-77) is to create a distinct area within Downey's historic central business district, which will provide interesting and entertaining elements for the area and attract people to shop, dine and attend entertainment events. PLN -10-08125 is in accordance with the purposes and objectives of Downtown Plan No. 00-77for the following reasons: the proposed 43,000 square foot building is designed for retail uses and restaurant uses; the building design will compliment the Porto's Bakery building to the north and the Transit Center to the south; the high-end concept of the Downey Gateway center will result in an attractive location and encourage patronage to this site and to the Downtown Area, and the success of this project should result in an impetus for neighboring property owners to revitalize their property. C. That the uroposed development's site plan and its design features, includin architecture and landscaping, will integrate harmoniously and enhance the character and design of the site the immediate neighborhood, and the surrounding areas of the Cit The proposed buildings proposes a contemporary architectural design that incorporates stacked bond bricks, cement plaster finishes, clear anodized aluminum storefronts with clear non -reflective glass, Composite Lumber Siding, and several other accent materials. Mission style concrete tile roofing, smooth -texture plaster finishes in six colors, stone veneer, wood trim, foam accent trim along the top of the parapet, and wrought -iron railings. The plan proposes an elaborate landscaping theme that will compliment PLN -10-08125 Site Plan Review) 8236-8280 Firestone Blvd. November 3, 2010- Page 3 Resolution No. 10-2686 Downey Planning Commission and enhance the building. Overall, the building proposes an attractive and vibrant addition to the downtown area. D. That the site plan and location of the buildings parking areas, signs, landscaping, luminaries, and other site features indicate that proper consideration has been given to both the functional aspects of the site development, such as automobile and pedestrian circulation -and the visual effects of the development from the view of the public streets. Downey Gateway is located at the southwest corner of Firestone Boulevard and Downey Avenue. The property consists of four distinct buildings separated by courtyards. This configuration should enhance the view of the buildings from a distance allowing for better appreciation of the building design and for easier recognition of the site by motorists. The courtyards provide direct pedestrian access to the inner areas of Downey Gateway from Firestone Boulevard and Downey Avenue. The courtyards are also designed to maximize visual interest for motorists passing by while creating vistas to observe activities occurring outside the project. The proposed site plan encourages reciprocal access with the property to the west to make on-site circulation more efficient, to limit vehicular access on Downey Avenue, and improve circulation on Firestone Boulevard and Downey Avenue. The buildings convey an attractive architectural design and the project incorporates plant materials that will compliment the surrounding area. E. That the proposed development will improve the communitV appearance b preventing extremes of dissimilarity or monotony in new construction or in alterations of facilities. The proposed buildings reflect a contemporary architectural design that incorporates common materials and features found on many newer buildings in the vicinity. F. That the site plan and design considerations shall tend to upgrade propertV in the immediate neighborhood and surrounding areas with an accom an in betterment of conditions affecting the public health, safety, comfort, and welfare. PLN -10-08125 proposes to upgrade the subject property by constructing four buildings for restaurant and retail use, with new landscaping and parking facilities. This proposal will improve property values in the vicinity, improve the streetscape of Firestone Boulevard, and result in a contemporary structure that complies with current Building Code and Fire Code regulations for structural integrity and fire safety. The building design will compliment the soon to be completed Porto's Bakery building to the north and the Transit Center building that exists to the south. The addition of Downey Gateway will continue the revitalization of Firestone Boulevard and for Downtown Downey. The Downey Gateway center will result in an attractive location and should become an impetus for neighboring property owners to revitalize their property. G. That the proposed development's site plan and its design features will include graffiti -resistant features and materials in accordance with the re uirements of Section 4960 of Chapter 10 of Article IV of this Code. The Conditions of Approval for PLN -10-08125 will include a condition stating that the design features will incorporate graffiti resistant materials. The Planning Commission further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to comply with the California Environmental Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15302 (Class 2, Replacement or Reconstruction) SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution, the Planning Commission of the City of Downey hereby approves PLN -10-08125 (Site Plan Review), subject to conditions of approval attached hereto as Exhibit A, which are necessary to preserve the health, safety and general welfare of the community and enable the Planning Commission to make the findings set forth in the previous sections. The conditions are fair and reasonable for the accomplishment of these purposes.. Deviations or exceptions from said site plan, other than those authorized by this resolution or those that do not impact other conditions, shall not be permitted without the approval of the Downey Planning Commission. 2) The Downey Planning Commission shall retain jurisdiction to amend or add conditions with public notice to assure compatibility with the purpose and intent of the Comprehensive Zoning Ordinance and to protect the public health, safety and general welfare. 3) The Applicant shall comply with all conditions of PLN -10-08125 before this application becomes valid. 4) The City Planner is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 5) All developments in excess of $500,000 valuation that involve the construction or reconstruction of light industrial, commercial or residential buildings (over 4 units) shall be subject to the Public Arts Program. The Applicant shall either install public art on their property or pay a cash payment equal to the public arts fee in accordance with the City of Downey Manual for Arts in Public Places. 6) The Applicant shall incorporate anti -graffiti elements into the building design, such as non -porous coatings on exterior wall surfaces, plant materials, and anti -graffiti film on windows, subject to the approval of the City Planner. 7) The Applicant shall incorporate a copy of this Exhibit A, Conditions of Approval PLN -10- 08125, into the approved set of building plans. 8) Approval of this PLN -10-08102 (Conditional Use Permit) shall not be construed to mean any waiver of applicable and appropriate zoning regulations, or any Federal, State, County, and City laws and regulations. Unless otherwise expressly specified, all other requirements of the City of Downey Municipal Code shall apply. 9) Wrought -iron railings shall be powder -coated. 10) All roof -mounted mechanical equipment shall be screened from view. The working drawings shall include a cross-section detail to illustrate that the height of the building parapet is sufficient to screen all roof -mounted equipment from view. 11) Planting areas shall be maintained permanently, which includes proper watering, pruning, mowing of lawns, weed abatement, removal of litter, fertilizing-, and replacement of plants and other materials when necessary. PLN -10-08125 Site Plan Review) 8236-8280 Firestone Blvd. November 3, 2010- Page 6 Resolution No. 10-2686 Downey Planning Commission 12) The Applicant shall incorporate the same wood treatment used on the east elevation of Building 1, on the north elevation of Building 1. 13) The Applicant shall incorporate stamped concrete at the vehicular entrance to the site at Nance Avenue. 14) The Applicant shall use his best faith efforts to enter into a reciprocal ingress/egress access agreement with the owners of the property to the west. Said agreement shall include access provisions for Nance Avenue and La Reina Avenue. 15) All roof -mounted mechanical equipment shall be screened from view. 16) Trash enclosures shall incorporate solid metal gates with self-closing latching mechanisms. 17) The Applicant shall agree to abide by all provisions of Development Agreement No. 09- 94. 18) The Applicant shall obtain approval from the City of Downey Public Works Department to utilize Downey Avenue for on -street service loading. 19) The Applicant shall obtain approval of a Planned Sign Program for the Downey Gateway Project, PLN 10-08125. 20) The Applicant shall satisfy all Conditions of Approval contained in Planning Commission Resolution No. 09-2578 regarding Tentative Parcel Map 09-70964. 21) The Applicant is required to provide an opening in the street median on Downey Avenue to allow vehicles to turn left (west) from Downey Avenue to Nance Avenue. BUILDING DIVISION 22) Separate sewer shall be constructed to each building to the standards of the City Engineering and Building and Safety Divisions or a sewer covenant shall be required with the Los Angeles County recorder, and a copy filed with the City Planning Division. 23) All new utilities shall be installed underground or at the rear lot lines to the standards of the City Engineering Division and Building and Safety Division. 24) Prior to beginning any construction, the applicant shall obtain all necessary plan approvals and permits. 25) Upon future construction, the applicant/ owner shall meet all accessibility requirements at the time of development. ENGINEERING DIVISION 26) The owner/applicant shall use his best faith efforts to provide that vehicular and pedestrian right of ingress and egress to adjacent properties be recorded with the Los Angeles County Recorder, and a copy with the Engineering and Planning Divisions. PLN -10-08125 Site Plan Review) 8236-8280 Firestone Blvd. November 3, 2010- Page 7 Resolution No. 10-2686 Downey Planning Commission FIRE DEPARTMENT 27) An automatic fire sprinkler and fire alarm system shall protect the entire project. 28) Additional fire hydrants may be required to be installed 29) A fire hydrant shall be located no more than fifty feet (50') from the Fire Department sprinkler connection. 30) A Knox Box shall be obtained from the Fire Department. 31) Fire Department access lanes, twenty feet (20') wide may be required. 32) Upon final map, the owner/applicant hereby consents to the annexation of the property into the Downey City Lighting Maintenance District in accordance with Division 15 of the Streets and Highways Code, and to incorporation or annexation into a new or existing Benefit Assessment or Municipal Improvement District in accordance with Division 10 and Division 12 of the Streets and Highways Code and/or Division 2 of the Government Code of the State of California. 33) Prior to building occupancy, the owner/applicant shall execute an agreement for the future installation of permanent ornamental street lighting on along Nance Avenue property frontage. The agreement shall be recorded with the County of Los Angeles and kept on file by the City Engineering Division. 34) The owner/applicant shall install all new utilities underground. 35) Upon any future construction, the facility design shall provide for refuse/recycle enclosure specifications (show location and size). 36) Upon any future construction and demolition, the owner/applicant shall be required to complete a construction & demolition (C&D) waste management plan per Article V, Chapter 8 of the Downey Municipal Code. 37) Prior to issuance of any building permits (upon future construction), the owner/applicant shall submit an engineered grading plan and/or hydraulic calculations and site drainage plan for the site (prepared and sealed by a registered civil engineer in the State of California) for approval by the Engineering Division and Building and Safety Division. The lot(s) shall not have less than one (I%) percent gradient on any asphalt or non -paved surface, or less than one quarter (1/4%) percent gradient on any concrete surface. Provide the following information on plans: (i) Topographic site information, including elevations, dimensions/location of existing/proposed public improvements adjacent to project (i.e. street, sidewalk, parkway and driveway widths, catch basins, pedestrian ramps); (ii) The width and location of all existing and proposed easements, existing and proposed underground utility connections); the location, depth and dimensions of potable water, reclaimed water and sanitary sewer lines, if any, including containment provisions; and the type of existing use, including the gross square footage of the building, and its disposition. PLN -10-08125 Site Plan Review) 8236-8280 Firestone Blvd. November 3, 2010- Page 8 Resolution No. 10-2686 Downey Planning Commission 38) The owner/applicant shall construct/install curb, gutter, sidewalk, disabled ramps, Portland cement concrete driveway approaches, street trees (24 -inch box with 2 -inch diameter trunk), and pavement along property frontage to the standards of the Department of Public Works. Broken, uneven, or sub -standard curb, gutter, sidewalk, driveway, disabled ramps and pavement, shall be replaced to the satisfaction of the Public Works Department. Contact the Public Works Inspection Office at (562) 904-7110 to have these areas identified just prior to initiating a grading plan. The owner/applicant shall obtain all necessary plan approvals and permits and shall provide that the standards of improvements, construction materials, and methods of construction shall be in conformance with the Standard Plans and Specification for Public Works Construction and as modified by the City of Downey's Standard Plans and Specifications. 39) Upon future construction development, plans submitted for plan check shall show all driveway approaches to be as wide as the driveway or parking aisle they serve. All unused driveways shall be removed and reconstructed with full -height curb, gutter and sidewalk. Also, the owner/applicant shall install pavement, which consists of a minimum section of 4" thick aggregate base, and a minimum 2-1/2" thick asphalt concrete pavement. 40) The owner/applicant shall demonstrate on grading plans compliance with the National Pollutant Discharge Elimination System (NPDES) requirements of the Federal Clean Water Act; the General Construction Activities Stormwater Permit (GCASP) of the State Water Resources Control Board; the Standard Urban Stormwater Mitigation Plan (SUSMP); and Ordinance 1142 of the Downey Municipal Code (DMC). Furthermore, the owner/applicant shall provide a design that conveys all onsite drainage over a vegetative Swale a minimum distance of 20 feet and retain the first 0.75 inches of drainage onsite using either surface detention basins or below grade facilities with flow in excess of the first 0.75 inches allowed to overflow by underground drains to an existing Los Angeles County Public Works storm drain so as to comply with the requirements of the Standard Urban Stormwater Mitigation Plan (SUSMP) and Municipal Separate Storm Water System; and is required to Certify and append Public Works standard "Attachment A" to all construction and grading plans as required by the LACoDPW Stormwater Quality Management Plan (SQMP). 41) Upon grading plan submittal. The owner/applicant shall provide that the design and improvements of sewers shall be to the standards of the City Engineering Division. Septic systems are not acceptable. 42) Upon any future construction, the owner/applicant shall provide that all construction graffiti created as part of this project in the public right of way and on-site to be removed. 43) The owner/applicant shall provide that no easements of any type be granted over any portion of the subdivision to any agency, utility or organization (private or public), except to the City of Downey prior to recordation of the parcel map. The owner/applicant shall -grant easements in the name of the City shall include: i) Vehicular easements ii) Walkway easements iii) Utility easements 44) Prior to building occupancy, the owner/applicant shall submit a recorded_mylar copy of the final map, a digital AutoCAD format file (AutoCAD 2006 or later) and scanned, uncompressed TIFF images of Final Map on a CD-ROM media. PLN -10-08125 Site Plan Review) 8236-8280 Firestone Blvd. November 3, 2010- Page 9 Resolution No. 10-2686 Downey Planning Commission UTILITIES DIVISION 45) Upon future commercial development, the owner/applicant shall provide on plans submitted for plan check the standards of improvements, construction materials, and methods of construction shall be in conformance with the Standard Plans and Specification for Public Works Construction and as modified by the City of Downey's Standard Plans and Specifications. 46) Upon future commercial development, the owner/applicant shall submit a separate utility plan to the Public Works Department which shall note the following: A) Furnish and install a new (min. 1 -inch) dedicated potable water service line, meter, and meter box for each tenant unit (if applicable); B) Furnish and install backflow device(s) in accordance with the Department of Public Works and the State and County Department of Health Services requirements. 47) Upon future commercial development, the owner/applicant shall confirm availability of adequate fire flow and pressure in accordance with the Department of Public Works and Downey Fire Department requirements. 48) Should there be inadequate fire flow and pressure to the site, the owner/applicant shall furnish and install the public potable water improvements, including extension and/or replacement of existing mains and associated facilities. 49) Upon future commercial development, the owner/applicant shall furnish and install fire hydrant(s) and dedicated fire protection lateral(s) including backflow devices, fire department connections and other appurtenances as required by the Department of Public Works and the Downey Fire Department. Such improvements may include removal and/or replacement of existing fire hydrants, laterals, backflow devices, and associated facilities with new facilities to current Downey standards and materials. Backflow devices, fire department connections, and associated appurtenances are to be located on private property and shall be readily accessible for emergency and inspection purposes. 50) Prior to final map approval, the owner/applicant shall provide and record utility easement(s) for access to, and inspection and maintenance of, public water lines, meters and appurtenances, and backflow devices. 51) Upon future construction, the owner/applicant shall identify the point(s) of connection for the sanitary sewer lateral(s) and confirm that sufficient capacity exists in the publicly owned facilities in conformance with the requirements of the Department of Public Works and the County Sanitation Districts of Los Angeles County (CSDLAC): The owner/applicant shall furnish and install the public sanitary sewer improvements, including extension and/or replacement of existing mains and associated facilities, necessary to provide adequate capacity for the site as approved by the Department of Public Works and CSDLAC. The owner/applicant is responsible for coordinating with, and payment(s) to the City and CSDLAC for all sanitary sewer connection and capacity charges. 52) Prior to issuance of a building certificate of occupancy, the owner/applicant shall provide improvement plan mylars, record drawing mylars, and record drawing digital (AutoCAD — latest edition) files in accordance with the requirements of the Department of Public Works that have been signed by a civil engineer licensed in the State of California. Final approval PLN -10-08125 site Plan Review) 8236-8280 Firestone Blvd. November 3, 2010- Page 10 Resolution No. 10-2686 Downey Planning Commission of new utilities shall be dependent upon submittal and approval of record drawing mylars and scanned uncompressed TIFF images of record drawings on a CD-ROM Media per City's GIS requirement. 53) Upon future construction, utility plans shall be submitted to and approved by the Department of Public Works prior to the issuance of the drainage plan permit. H:IPLAN N I NG\RESOS\PC\2010\10-2686. doc PLN -10-08125 Site Plan Review) 8236-8280 Firestone Blvd. November 3, 2010- Page 11 Resolution No. 10-2686 Downey Planning Commission Attachment A Storm Water Pollution Control Requirements for Construction Activities Minimum Water Quality Protection Requirements for All Development Construction Projects/Certification Statement The following is intended as an attachment for construction and grading plans and represent the minimum standards of good housekeeping which must be implemented on all construction sites regardless of size. ❑ Eroded sediments and other pollutants must be retained on site and may not be transported from the site via sheetflow, swales, area drains, natural drainage courses or wind. ❑ Stockpiles of earth and other construction related materials must be protected from being transported from the site by the forces of wind or water. ❑ Fuels, oils, solvents and other toxic materials must be stored in accordance with their listing and are not to contaminate the soil and surface waters. All approved storage containers are to be protected from the weather. Spills must be cleaned up immediately and disposed of in a proper manner. Spills may not be washed into the drainage system. ❑ Non -storm water runoff from equipment and vehicle washing and any other activity shall be contained at the project site. ❑ Excess or waste concrete may not be washed into the public way or any other drainage system. Provisions shall be made to retain concrete wastes on site until they can be disposed of as solid waste. ❑ Trash and construction related solid wastes must be deposited into a covered receptacle to prevent contamination of rainwater and dispersal by wind. ❑ Sediments and other materials may not be tracked from the site by vehicle traffic. The construction entrance roadways must be stabilized so as to inhibit sediments from being deposited into the public way.
