HomeMy WebLinkAboutPC Reso 10-2679RESOLUTION NO. 10-2679 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY RECOMMENDING THE CITY COUNCIL APPROVE DENSITY BONUS APPLICATION NO. 09-72 FOR THE VIEW APARTMENTS, LOCATED AT 8314 2ND STREET, ZONED DOWNTOWN SPECIFIC PLAN WHEREAS, Alfredo Izmajtovich of National Community Renaissance of California (National CORE), the Applicant, filed Density Bonus Application No. 09-72 to consider a request for a density bonus and two regulatory concessions for the View Apartments (the Project), located at 8314 2nd Street, Assessor Parcel Numbers 6254-020-902 and 6254-902-914. The Project is a six -story, multi -family development for income -restricted households and the request is for a density bonus of eleven (11) to allow the development of a 50 -unit project; and WHEREAS, the Applicant also filed Site Plan Review Application No. 09-71 (SPR No. 09-71) in conjunction with Density Bonus Application No. 09-72. SPR No. 09-71 consists of Options 1" and '2" and is a request to consider the options' designs and onsite improvements. The parking arrangements of Options "1" and "2" is the principal difference between the two; required parking for Option "1" is entirely onsite, while the parking for Option "2" is both onsite and an offsite location within 200 feet of the project site; and WHEREAS, Density Bonus Application No. 09-72 also includes a request for two concessions: 1) develop 25% of Option 1's parking spaces as compact stalls instead of 15%, which is the maximum prescribed by the Downtown Specific Plan; and 2) reduce the parking requirement for Option "2" from 1.5 space per dwelling unit to one (1) space per unit; and WHEREAS, the Planning Commission held a public hearing on October 20, 2010, to hear and consider evidence for and against the requested density bonus and concessions and make findings and recommendations; and WHEREAS, the Planning Commission reviewed the proposed density increase request in the context of General Plan goals and policies, availability of public services and utilities, neighborhood compatibility and site development, and after due investigation, and study, and after due consideration of all evidence and reports offered at said hearing; and WHEREAS, the Planning Commission finds and determines: 1. The proposed density increase is consistent with the General Plan in that it implements the plan's following goals and policies: Goal 2: Encourage a variety of housing types and adequate supply of housing to meet the existing and future needs of city residents. Policy 2.1: Provide adequate sites and zoning to encourage and facilitate a range of housing to address the regional fair share allocations. Policy 2.2: Encourage infill development and recycling of land to provide adequate residential sites. Policy 2.5: Assist private and nonprofit developers in providing affordable housing to low income residents and special needs groups. Resolution No. 10-2679 Density Bonus Application No. 09-72 Goal 3: Expand and protect housing opportunities for all economic segments and special housing needs of the community. Policy 3.1: Use public financial resources, as feasible, to support the provision of housing for lower income households and special needs groups. Goal 4: Reduce the impact of potential governmental constraints on the maintenance, improvement, and production of housing. Policy 4.3: Utilize density bonuses, fee reductions, or other regulatory incentives to minimize the effect of governmental constraints. Policy 4.4: Utilize the Redevelopment Agency as a tool to provide sites and assist in the development of affordable housing. 2. The proposed project will provide 49 income -restricted apartments. 3. The units will be income restricted for no less than 55 years with several affordability covenants recorded as liens on the property; plus, the project's funding sources require that affordability restrictions be recorded as part of their financing. 4. Community facilities are adequate to serve the proposed project. Neighborhood parks, schools, and public transit are located within walking distance of the project site. Utilities are available and adequate to serve the proposed project. 5. The application's proposed density increase and related concession request will not have an adverse impact on surrounding properties and the proposal is compatible with the uses occupying neighboring properties. 6. The proposed project provides a community room and an onsite garden, courtyard and other onsite amenities for future residents. WHEREAS, State Density Bonus Law 65915 requires that when a housing developer meets certain criteria for a density bonus, the local jurisdiction must grant regulatory concessions (unless the city makes a written finding that the concessions or incentives are not required in order to provide for affordable housing costs as defined by state law); and WHEREAS, the proposed project is requesting two regulatory concessions: 1) permit the applicant to develop 25% of Option 1's parking spaces as compact spaces instead of the required 15%; and 2) reduce the parking requirement of Option "2" from 1.5 spaces per unit to one (1) space per unit; and NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Downey recommends to the City Council an eleven (11) unit density bonus over the otherwise allowed density for a total of 50 units at 96 units per acre and two (2) concessions for the View Apartments, located at 8314 2'd Street, more specifically described as Assessor Parcel Numbers 6254-020-902 and 914. 2 Resolution No. 10-2679 Density Bonus Application No. 09-72 PASSED, APPROVED AND ADOPTED this 20`h day of October, 2010.
