HomeMy WebLinkAboutPC Reso 20-3120RESOLUTION NO. 20-3120 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY FINDING THE DISPOSAL OF REAL PROPERTY LOCATED AT THE NORTHWEST CORNER OF CONGRESSMAN STEVE HORN WAY & BELLFLOWER BOULEVARD IS CONSISTENT WITH THE CITY'S ADOPTED GENERAL PLAN THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. The City of Downey owns 19.69 acres of vacant land between the Promenade at Downey shopping center and Bellflower Boulevard; and, B. The City of Downey was approached with a proposal to purchase 8.67 acres of this vacant land located at the northwest corner of the Congressman Steve Horn Way and Bellflower Boulevard intersection; and, D. The City of Downey desires to enter into a Sale Agreement and Escrow Instructions to dispose of the surplus property; and, C. Prior to the City selling the land, California Government Code Section 65402(a) requires the Planning Commission adopt a finding that the disposal of said property is consistent with the General Plan; and, SECTION 2. The Planning Commission further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to comply with the California Environmental Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15312 (Class 12, Surplus Government Property Sales). SECTION 3. The Planning Commission further finds, determines and declares that the sale of the vacant land located at the northwest corner of the Congressman Steve Horn Way and Bellflower Boulevard intersection is consistent with the City of Downey's adopted General Plan (Vision 2025). The subject site has a General Plan Land Use Designation of Mixed Use which encourages development of a variety of uses within close proximity to each other. The General Plan Land Use Element further specifies that it is appropriate for the 168 -acre area encompassed by the Downey Landing Specific Plan, including the Tierra Luna Marketplace area where the surplus property is located, is intended to promote a variety of uses throughout the Specific Plan area. Through the disposition of the property, the site will be available for development as permitted and encouraged by the Tierra Lune Marketplace designation. Additionally, the sale of the subject site would be consistent with Goal 9.3 of the Economic Development Element of the General Plan, which states the City should "Ensure the continued fiscal balance of the community." The disposition of an excess property will generate revenue for the City and relieve the City from liabilities and burdens that accompany property management. Additionally, the sale will be consistent with Program 9.1.1.4 " Promote sites available for development" and Program 9.1.1.5 "Continue the revitalization of commercial and industrial corridors" because the site will be available for development as permitted and encouraged by the Tierra Luna Marketplace land use designation within the Downey Landing Specific Plan. For this reason, the sale of the 8.67 acres of vacant land located at the northwest Resolution No. 20-3120 Downey Planning Commission corner of the Congressman Steve Horn Way and Bellflower Boulevard intersection is consistent with the General Plan. SECTION 4. The Secretary shall certify the adoption of this Resolution.
